of the Adoption by the Sanger, Texas Industrial Development Corporation of a
Resolution Authorizing the Issuance of the Sanger, Texas Industrial Development
Corporation Industrial Development Revenue Bonds, Series 2012B (Texas Pellets
Project), Approving and Authorizing an Indenture of Trust, a Loan Agreement, a
Limited Offering Memorandum, a Tax Certificate and Agreement, a Bond Purchase
Agreement, Authorize the Execution of Documents and Instruments Necessary or
Convenient to Carry out the Issuance of the Bonds and Other Matters in Connection
Therewith.
8. Conduct a Public Hearing on the Proposed Budget for FY 2012/2013.
9. Conduct the First Public Hearing on a Proposal to Increase Total Tax Revenues From
Properties on the Tax Roil in the Preceding Year by 8.76% (Total Tax Rate Remains
Unchanged at 0.633049 per $100 of Assessed Value).

1. Call Meeting to Order, Invocation, Pledge of Allegiance.
Mayor Muir called the meeting to order at 11:05 a.m. Councilman Martin led the
Invocation followed by Councilman Bilyeu leading the Pledge of Allegiance.

to act as Tax Assessor and Collector.
d) Approve Resolution #R08-13-12 -Amending the Investment Policy

Councilman Patton made a motion to approve. Seconded by Councilman Bilyeu.
Motion carried unanimously.

REGULAR AGENDA
5. Discuss Tax Rate; Take Record Vote on Tax Rate and Schedule Two Public Hearings
on Tax Rate and Approve Resolution #ROS-14-12 -Establishing Date, Time and Place
for Public Hearings on Budget and Tax Rate.
City Manager advised keeping the same tax rate of 0.633049, which will generate
approximately $160,000 of extra revenue.
Councilman Bilyeu made a motion to approve proposing the adoption of a total
ad valorem tax rate of 0.633049 per $100.00 assessed valuation Seconded by
Councilman Martin. Motion carried unanimously.

Councilman Bilyeu
Councilman Patton
Voted Against:
None
Councilman Bilyeu made a motion to approve Resolution #R08-14-12. Seconded
by Councilman Patton.
The Public Hearing on the proposed budget and first public hearing on the tax rate
will be August 20, 2012 at 7:00 p.m. The second Public Hearing on the tax rate will
held on September 4, 2012 at 7:00 p.m.
6. Discuss, Consider and Possibly Act on Approving the Minor Final Plat of Lots 1-2,
Block A, of the Lynch Addition, Being 12.12 Acres in the Reuben Bebee Survey,
Abstract #29, in the City of Sanger's Extra -Territorial Jurisdiction, Denton County,
Texas,
City Manager advised that this will be divided into an 8 acre and a 4 acre lot on
Mesquite Hill.
Councilman Bilyeu made a motion to approve. Seconded by Councilman Martin.
Motion carried unanimously.
7. Discuss, Consider and Possibly Act on Authorizing Staff to Advertise for Request for
Qualifications (RFQ) for General Engineering Services.
This would allow a pool of outside engineers to pick from. This is for qualifications
only, not rates.
Councilman Martin made a motion to approve. Seconded by Councilman Patton.
Motion carried unanimously.

Local Option Liquor Election

Background for Local Option Liquor Elections
The State of Texas lays out the steps required for a municipality to call for an election allowing
or prohibiting the sale of alcoholic beverages within the territorial boundaries. Any issue
relating to local elections is processed through the City Secretary's office, including alcohol
issues. Previously, any alcohol issue to be placed on a ballot was handled by the County. In
order for the City of Sanger to bring a local option liquor election to the voters, the citizens had
to comply with several steps:
application to file a petition must be completed. An application from 10 citizens
(registered voters) must be submitted to the City Secretary for a petition.

option liquor election.
3. Once the application and proof of application have been submitted to the City Secretary's
office, a formal petition form was given to the citizens.
4. According to State law, the number of names required for a petition to be considered is 35%
of the registered voters who voted in the last gubernatorial election. 365 signatures of
registered voters in Sanger was required on the petition to successfully petition for this issue
to be included on the next election which will be held November 6, 2012.
5. The petition was returned with the required number. The list of valid signers is presented to
the Council for review and to order the issue on the ballot.
6. The last day to order a local option liquor election is the 71 st day before election day or
August 20, 2012.

On July 9, 2012, I was presented with applications for a petition for the proposition stated above. The
applications contained proof of publication in the Denton Record Chronicle and 10 valid signatures as
required in order to begin the petition process to place on the November ballot. Per the Denton County
Elections Administrator, the required number of signatures needed is 365. The group called "The Better
Business for Denton County" Committee circulated the petitions in the City and turned in their
completed petition pages on July 19, 2012. I verified that we received the required number of valid
signatures for this proposition to be placed on the November 6, 2012 ballot.

TO BE POSTED AND PUBLISHED; AUTHORIZE THE MAYOR TO SIGN THE
NOTICE AND ORDER AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City of Sanger, Texas ("City") is a home rule City acting under its
charter; and
WHEREAS, the City has received a petition in conformance with the requirements of
Chapter 501 of the Texas Election Code (the "Code") requesting that the City call a local option
election regarding one issue; and
WHEREAS, the Council hereby determines that there is a sufficient number of
signatures verified by the City Secretary from the petitions to require an election; and
WHEREAS, Chapter 501 of the Code requires that this election be called regarding the
following issue: To legalize: "the legal sale of all alcoholic beverages for off -premise
consumption only"; and
WHEREAS, the City will enter into an Agreement for Election Services with Denton
County; and
WHEREAS, the City Secretary has verified that there are sufficient signatures on the
submitted petitions to require an election.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL, THAT:
Section 1. Special Election Called: A special election shall be held in the City of
Sanger, Texas, on November 6, 2012, at which voters will vote or "against" the following
proposition:

OFF -PREMISE CONSUMPTION ONLY
Section 2. Polling Place: The polling place for the special election for all
precincts shall be determined at a later date by the Denton County Elections Administrator. The
election shall be held on November 6, 2012, between the hours of 7:00 a.m. and 7:00 p.m.
Section 3. Joint Election Agreement: Prior to the special election, the City
will enter into a joint election agreement for election services with Denton County.
Section 4. Early Voting by Personal Appearance: Early voting by personal
appearance will be located at the following location beginning October 22, 20121 and shall
continue daily, until November 2, 2012:

November 1st and 2nd are hereby designated as the two week days during the Early Voting
period, which the location for Early Voting shall be open for at least twelve (12) hours.
Section 5. Early Voting by Mail: Frank Phillips, the Denton County Election
Administrator is hereby designated as the Early Voting Clerk for the special election.
Applications for Early Voting by mail shall be delivered to Franlc Phillips, Election
Administrator at the following address: P.O. Box 1720, Denton, Texas 76202.
Section 6. Early Voting by Ballot Board: Early voting, both by personal appearance
and by mail, shall be canvassed by the Early Voting Board established by Denton County
under the terms of the Agreement.
Section 7. Appointment of Election Judge and Alternate Election Judge:
The Denton County election contract shall designate the election judges for the election.
Section S. Method of Voting: Direct Record Electronic (DRE) voting machines shall
be used in this election for early voting by personal appearance and election day voting.
Section 9. Publication and Notice of Election: The City Secretary is hereby
authorized and directed to publish and/or post, in the time and manner prescribed by law, all
notices required to be published and/or posted in connection with the conduct of this election.
The election, including providing notice of the election shall be conducted in accordance with
the Texas Election Code and other applicable law, and all residents qualified and registered
voters of the City shall be eligible to vote at the election.
Section 10. Necessary Actions: The Mayor and City Secretary of the City, in
consultation with the City Attorney, are hereby authorized and directed to take any and all
actions necessary to comply with the .provisions of the Code in carrying out and conducting
the election, whether or not expressly authorized herein.
Section 11. Should any part, section, subsection, paragraph, sentence, clause or phrase
contained in this ordinance be adjudged or held to be unconstitutional, illegal or invalid, the
same shall not affect the validity of this ordinance as a whole or any part or provision thereof
other than the part thereof decided to be unconstitutional, illegal or invalid all respects said
remaining portion shall be and remain in full force and effect.
This ordinance will take effect immediately from and after its passage, and the publication of the
caption, as the law and Charter in such cases provide.

Industrial Development Board on August 13, 2012. Using us as a conduit allows Texas Pellets to sell

Bolivar water is in the process of selling their building on Third Street. The survey of the property
showed that their building is actually over the property line two feet on the east side (part of the lot the
fire department sits on). They have approached us about selling a two foot strip to rectify the situation.
They have had the property appraised at $1050. We also have $300 in attorney's fees associated with
the sale. I recommend we sell the property to them for $1350.00 However, the council can set the
value at any amount over the Appraised Value.

SECTION 1. That the City Council of the City of Sanger hereby finds and determines that
a narrow strip of land owned by the City, being 0.010 acre of land and being more particularly
described and depicted in Exhibit "A" attached hereto and made a part hereof for ail purposes, the
same as if fully copied herein, in the City of Sanger, Denton County, Texas, because of its small
area cannot be used independently and is not needed or necessary for public purposes.
SECTION 2. The City has obtained an appraisal of the fair market value of the strip of
land described herein. Upon receipt of a cash consideration of $1,350.00, the City Manager is
authorizeA to execute and deliver to Bolivar Water Supply Corporation, the abutting owner to said
strip, a special warranty deed to the land described in Exhibit "A", such deed to be recorded in the
real property records of Denton County, Texas, as the conveyance deed of the City of Sanger. The
approved form of such special warranty deed is attached hereto as Exhibit "B" and made a part
hereof for all purposes, the same as if fully copied herein.
SECTION 3. This ordinance shall take effect immediately from and after its passage, as
the law and Charter in such cases provide.

HIGHLIGHTS:
Two special programs and the end of summer Reading Club Party caused a spike in
program attendance for July. The meeting room was full for the Ringling Clowns, but not quite
so full for the Ugly Duckling by Storytime Theater.
ADMINISTRATION:
This year 125 kids age 12 and under read at least 10 books. In 2011 there were 113, so
we had an 11 % increase in participation. Participation by adults and teens dropped from 75 to
50. The adult and teen program is just for fun, and not heavily promoted.
Laura Klenke was elected chair of the Reports Committee for the North Texas Library
Consortium, The Reports Module is the worst aspect of the Evergreen software, and the Reports
Committee will be constructing templates for the most needed reports.

COLLECTION:
The annual inventory continued.
PROGRAMS:
Three adult programs were held: two Knitting and Crochet workshops and the book club.
A Wii gaming weekend attracted teens to play Guitar Hero on Friday night, and
ManoKart and Super Mario Smash Brothers on Saturday.
The Storytime theme was "Get a Clue, .at the Library". Kids designed T-shirts at the
program "Get a Clue about Sanger History". Other weekly themes were "Mystery Hounds and
Cat Burglars", "Chills and Thrills", "Naturally Mysterious" and "Codes and Ciphers". The last
program prepared the kids for the treasure hunt at the Pirate Party. Some clues for the treasure
hunt were in letter and number substitution codes, and some were riddles. Also at the Pirate
Party, every child got to dress up, throw cannon balls (made of newspaper), find diamonds and
make a pirate ship out of a fruit slice gumdrop with a fruit roll -up sail.

Subject: City Council Resignation
Good morning.
I have finally confirmed that my schedule changes will indeed cause me to have difficulty attending city council meetings
for several months. Therefore I am going to have to resign from the city council. I regret that I must take this action,
however, I do not want to put the city in a position where a member of the council cannot be present for all meetings.
It has been wonderful serving with you and the council over the last couple of years and will definitely want to serve in
some capacity, perhaps on a board or commission. As soon as I know for sure what my availability will be I will let you
know and hopefully be able to serve where there is a need. I have been offered a position with a wonderful company and
just didn't feel that I could turn it down, unfortunately it will be very demanding on my time initially.
I won't be able to be there for the meeting on the 20th, however please pass along to the council my regrets.
Mike, if it works for you I can bring my computer in on Wednesday this week.
Please advise me on any other action I may need to take.
