Call Meeting to Order. Mayor Muir called the meeting to order. 2. Discussion on Water and Wastewater Impact Fees. City Manager discussed impact fees and had a handout comparing the costs of Sanger to what the City of Little Elm charges. He also discussed what other cities are charging. 3. Discussion on Future Capital Projects and Priorities. City Manager discussed where he would like to extend water and wastewater lines. The water lines would need to go down Lois Road and back up service to Belz Road. The wastewater lines would need to extend north of FM 455. 4. Discussion on Updating the Retail Marketing Plan. In 2006/2007, the Buxton group performed a retail study. City Manager has been in contact with a company called the Retail Coach. This company checks to see where customers are actually coming from by zip code. They've recently done a similar study for the City of Watauga. City Manager will contact the Retail Coach to have them come do a presentation. City Manager said there is a need for a new grocery store and has met with the owner of two parcels to see if they would be interested in selling. No price was discussed at that time. 5. FINANCIAL SUMMARY ®N/A ❑GRANT FUNDS ❑OPERATING EXPENSE QREVENUE ❑CIP ❑BUDGETED ❑NON -BUDGETED BACKGROUND/SUMMARY OF ITEM The subject property is a 20-acre portion of a larger tract, located on the south side of Union Hill Road, west of the intersection of Union Hill Road and FM 455. The property was annexed into the city limits by the City Council on March 21, 2011 following a petition by the landowner. All property is zoned A — Agricultural District when first annexed into the city limits. The applicant, Denton County, is requesting that the property be rezoned from A — Agricultural District to I-1 Industrial District. The County is proposing to be a road and bridge facility on the site. The proposed design of the facility includes buildings for offices and vehicle maintenance, storage areas for supplies, and asphalt parking for employees. The I4 Industrial District is intended for non -nuisance type wholesale, manufacturing and research land uses. The applicant's proposed use would be permitted within the I4 District. The 2007 Comprehensive Land Use plan designates the area for residential uses. However, many non-residential uses are present along FM 455 and FM 1190 between Union Hill Road and Lake Ray Roberts. The proposed facility will include office area for Road and Bridge administrative staff; vehicle maintenance garage and parts storage; fueling station (above ground tanks in secondary containment and covered); stockpile storage for flexbase, chip seal aggregate and embedment material; and equipment storage. The envisioned design includes a metal building for the office and vehicle maintenance area; possibly one or two accessory buildings, which would probably be metal, gravel yard areas asphalt staff parking; bins for the stockpiles; covered parking for the equipment if the budget allows; water supplied by Bolivar Water Supply; and the septic provided by a private onsite system. Because of its poor condition, Union Hill Road will also be reconstructed as part of this project to handle the Road and Bridge traffic. C A A A A A A A City of Sanger, Texas SECTION 25 "I-1" INDUSTRIAL DISTRICT General Purpose and Description: The I -I District is established to accommodate those uses which are of a non -nuisance type located in relative proximity to residential areas, and to preserve and protect lands designated on the comprehensive plan for industrial development and use from the intrusion of certain incompatible uses which might impede the development and use of lands for industrial purpose. Development in the I-1 District is limited primarily to certain wholesale and jobbing commercial uses and certain industrial uses, such as the fabrication of materials, and specialized manufacturing and research institutions, all of a non -nuisance type. No use or types of uses specifically limited to the I-2 District may be permitted in the I-1 District. 25.1 Use Regulations: Uses permitted in the 1-1 District are subject to the following conditions: 1. All business, servicing, or processing, except for off-street parking, off-street loading, display of merchandise for sale to the public, and establishments of the "drive-in" type, shall be conducted within completely enclosed areas. 2. All storage within one hundred feet (100') of a residence district, except for motor vehicles in operable condition, shall be within completely enclosed buildings or effectively screened with screening not less than six feet (6) nor more than eight feet (8') in height, provided no storage located within fifty feet (50) of such screening shall exceed the maximum height of such screening. 3. Permitted uses in the I-1 District shall not disseminate dust, fumes, gas, noxious odor, smoke, glare, or other atmospheric influence. 4. Permitted uses in the I-1 District shall produce no noise exceeding in intensity, at the boundary of the property, the average intensity of noise of street traffic. 5. Permitted uses in the I-1 District shall not create fire hazards on surrounding property. Permitted uses in the I-1 District include the following: 1. Advertising products, such as signs and billboards (manufacturing of). 2. Ambulance, bus, train, and taxi stations, truck yards; 3. Awnings, Venetian blinds, and window shades (manufacturing of); 4. Bakery, candy, dairy and other food products, but not including fish and meat products, sauerkraut, vinegar, yeast, alcohol or alcoholic beverages; 5. Building materials yard, contractor's yard, lumberyard, 6. Cameras and other photographic equipment (manufacturing of); T Ceramic products, such as pottery, figurines, and small glazed tiles; 8. Ice plants, cold storage plants; 9. Jewelry; 10. Machine shops and fabrication of metal not more than ten (10) gauge in thickness; lie Metal stamping and extrusion of small products, such as costume jewelry, pins and needles, razor blades, bottle caps, buttons, and kitchen utensils; 12. Orthopedic and medical appliances, such as artificial limbs, braces, supports, and stretchers; 16. Repair of farm, household, office machinery or equipment, 17. Scientific and precision instruments (manufacturing of); 18. Sheet metal shops, 19. Public utility and public service uses as follows: (a) Bus stations, bus terminals, bus turnaround (off-street), bus garages, and bus lots; (b) Electric substations; (c) Radio and television towers; (d) Railroad passenger stations; (e) Telephone exchanges, microwave relay towers, telephone transmission equipment buildings and service yards; (f) Privately owned water pumping stations and water reservoirs; 20. Radar installations and towers; 21. Radio and television studios and stations; 22. Schools, trade. 23. Storage and warehousing establishments. 24. Storage yards, but not including junkyards; 25. Swimming pool (manufacturing of). 26. Trailer sales and rental, for use with private passenger motor vehicles; 27. Weighing stations; 28. Wholesaling establishments; 29. Accessory uses, including but not limited to temporary buildings for construction purpose for a period not to exceed the duration of such construction; 30. Other wholesale, light manufacturing, construction or service uses which are similar in character to those enumerated in this subsection, and which will not be dangerous or otherwise detrimental to persons residing or working in the vicinity thereof, or to the public welfare, and will not impair the use, enjoyment, or value of any property; 31. Factory outlet retail or wholesale store for the sales and servicing of goods or materials on the same premises as the manufacturing company to which they are related, including sales and service in a separate building or buildings; 32. Other uses as listed in Section 30 of this ordinance. The following specific uses shall be permitted in the I-1 District when granted in accordance with Section 3 Is l . Railroad freight terminals, railroad switching and classification yards, repair shops, and roundhouses. Zoning Ordinance City of Sanger, Texas 2. Stadiums, auditoriums, and arenas. 3. Other uses as listed in Section 30 of this ordinance. 25.2 Height Regulations: Maximum height one hundred (100) feet. 25.3 Area Regulations: 1. Size of Yards: a. Front Yard: Minimum required, twenty (20) feet. b. Side Yard: Minimum side yard of ten (10) feet except a corner lot adjacent to a street shall be twenty (20) feet. When the industrial district is adjacent to any residential district, a minimum side yard of twenty (20) feet shall be observed and a six (6) foot solid masonry or wood wall shall be constructed adjacent to the residential district's property line. c. Rear Yards: There shall be a rear yard of depth of twenty (20) feet, unless adjacent to a residential district, in which case a fifty (50) foot rear setback shall be observed. 2. Size of Lot: a. Minimum Lot Area: None. b. Minimum Lot Width: None. c. Minimum Lot Depth: None, 3. Lot Coverage: In no case shall more than fifty (50%) percent of the lot area be covered by the aggregate area of all buildings constructed on the lot. 25.4 Parking Regulations: Required off-street parking shall be provided in accordance with the specific uses set forth in Section 32. WHEREAS, the City Council heretofore adopted a juvenile curfew ordinance; and WHEREAS, the City Council has reviewed the ordinance and determined that it is the public interest to continue it in effect; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SANGER, TEXAS: SECTION I Tha#Chapter 8, Article 8.600, of the Code of Ordinances shall continue in force and effect, reading as follows: "8.600 Definitions a. Curfew Hours 1. 11:00 p.m. on Sunday, Monday, Tuesday, Wednesday or Thursday until 6:00 a.m. of the following day; and 2. 12:01 a.m. until 6:00 a.m. on any Saturday or Sunday b. Emergency Shall mean: An unforeseen combination of circumstances or the resulting state that calls for immediate action. The term includes, but is not limited to, a fire, a natural disaster, an automobile accident, or any situation requiring immediate action to prevent serious bodily injury or loss of life. c. Establishment Shall mean: Any privately -owned place of business operated for a profit to which the public.is invited, including, but not limited to, any place of amusement or entertainment. d. Guardian shall mean: 1. A person who, under court order, is the guardian of the person of a minor; or 2. A public or private agency with whom the minor has been placed by a court. e. Minor shall mean: Any person under 17 years of age. f. Operator shall mean: Any individual, firm, association, partnership, or corporation operating, managing, or conducting any establishment. The term includes members or partners of an association or partnership and the officers of a corporation. g. Parent shall mean: A person who is: 1. A natural parent, adoptive parent, or step-parent of another person; or 2. At least 18 years of age and authorized by a parent or guardian to have the care and custody of a minor h. Public Place shall mean: Any place in which the public or substantial group of the public has access and includes, but is not limited to, streets, highways, and the common areas of schools, hospitals, apartment houses, office buildings, transport facilities and shops. Remain shall mean: 1. Linger or stay; or 2. Fail to leave premises when requested to do so by a police officer or the owner, operator, or other person in control of the premises. j. Serious Bodily Iniury shall mean: Bodily injury .that creates a substantial risk of death or that causes death, serious permanent disfigurement, or protracted loss or impairment of the function of any bodily member or organ. 8.602 Offenses a. Any minor commits an offense if he/she remains in any public place or on the premises of any establishment within the City during curfew hours. b. A parent or guardian of a minor commits an offense if he knowingly permits, or by insufficient control allows, the minor to remain in any pubic place or on the premises of any establishment within the City during curfew hours. c. The owner, operator or any employee of an establishment commits an offense if he knowingly allows a minor to remain upon the premises of the establishment during curfew hours. 8.603 r�efenses a. It is a defense to prosecution under. Section 8.602 that the minor was: (1) Accompanied by the minor's parent, guardian or adult spouse; (2) On an errand at the direction of the minor's parent or guardian without any detour or stop; (3) In a motor vehicle involved in interstate travel.; (4) Engaged in an employment activity, or going or returning home firom an employment activity without any detour or stop; (5) Involved in an emergency; (6) On the sidewalk abutting the minor's residence or abutting the residence of a next door neighbor if the neighbor did not complain to the police department about the minor's presence; (7) Attending an official school, religious or other recreational activity supervised by adults sponsored by the City of Sanger, a civic organization, or another similar entity that takes responsibility for the minor, or going to or returning home from, without any detour or stop, an official school, religious or other recreational activity supervised by adults and sponsored by the City of Sanger, a civic organization or another similar entity that takes responsibility for the minor; (8) Exercising First -Amendment rights protected by the United States Constitution, such as the free exercise of religion, freedom of speech and the right of assembly; or (9) A minor who has had disabilities of minority removed in accordance with Chapter 31 of the Texas Family Code. b. It is a defense to prosecution under Section 8.602 ( c )that the owner, operator or employee of an establishment promptly notified the police department that a minor was present on the premises of the establishment during curfew hours and refused to leave. c. With respect to the hours between 8:00 a.m. and 3:00 p.m. on Monday, Tuesday, Wednesday, Thursday or Friday only, it is a defense that the school which the minor attends was not in session, that the minor is a high school graduate or has equivalent certification, the minor is on an excused absence from his or her place of schooling or that the minor is participating in a work study program which requires the minor to be off campus during school hours. 8.604 Enforcement Before taking any enforcement action under this article, a police officer shall ask the apparent offender's age and reason for being in the public place. The officer shall not issue a citation or issue an arrest under this article unless the officer reasonably believes that an offense has occurred and that, based on any response and other circumstances, no defense in Section 8.603 is present. 8.605 Penalties a. A person who violates a provision of this article is guilty of a separate offense for each day or part of a day during which. the violation is committed, continued or permitted. Each offense upon conviction is punishable by a fine as set forth in the general penalty provision found in Section 1.109 of this code. b. When required by Section '51.08 of the Texas Family Code, as amended, the municipal court shall waive original jurisdiction over a minor who violates Section 8.602(a) of this article and shall refer the minor to juvenile court." SECTION 11 All ordinances or parts of ordinances in conflict herewith or to the extent of such conflict, hereby repealed. SECTION III It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses, and phrases of this ordinance are severable and, if any phrase, clause, sentence, paragraph or section of the ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of the ordinance since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section.
