City Council Workshop November 19, 2007 PRESENT: Mayor Joe Higgs, Councilman i Thomas Muir, Councilman Mike Walker, Councilman Robert Patton, Councilman Glenn Ervin, Councilman Andy Garza OTHERS PRESENT: City Manager Mike Brice, City Secretary/Asst. City Manager Rose Chavez, Economic Development Director Cecile Carson 1. Call Meeting to Order. Mayor called meeting to order 6:03 p.m. 2. Discussion of Changes to the City of Sanger Employee Manual. City Manager, Mike Brice, addressed the Council with the proposed changes to the Employee Manual. He gave a general overview of the changes. Currently, any changes or corrections require that it be done by ordinance. City Manager indicated that he would like the ordinance to be amended to allow the City Manager to amend the document with notification to the Council of the changes. City Manager advised that the document would be forwarded to the City Attorney for review and recommendation, He could possibly have the document to the Council by the first or second meeting in December for approval. Lengthy discussion followed concerning the changes. Education and tuition reimbursement was an item that the City Manager and Council reviewed in length. 3. Discussion of the Ten Year Capital Improvement Plan. City Manager presented the Council with a Proposed Ten Year Capital Improvement Plan, City Manager advised Council that these projects were identified by staff as needed over the next ten years. He asked the Council to look at the plan and if other projects are needed he will add them to the list. City Manager asked Council to rate each improvement in the order of importance. Brief discussion on some of the projects. City Manager asked Council if they could try to get their lists to him by the next Council meeting. 4. Questions From the Council. There were not any questions to address. 5. Mayor adjourned the meeting. City Manager advised that this is an item for discussion later on in the meeting. Councilman Muir made two corrections to the minutes as follows: November 5, 2007 -Work session, Item 3, paragraph 3- to add this statement to the end of the paragraph: "Staff confirmed this change was implemented." November 5, 2007 -City Council Meeting, Citizen's Input - to correct the spelling of E. L. McNeill to E.L. McNeal. Motion was made by Councilman Muir to approve the Consent Agenda with the minor changes. Seconded by Councilman Garza. Motion carried unanimously. 4. Consider any Items Removed from Consent Agenda. There were not any items to discuss. 5. Conduct Public Hearing on Ordinance #11-44-07 -Amending the Comprehensive Zoning Ordinance by Granting a Specific Use Permit for an Organic Fertilizer Packaging Facility on Property Legally Described as Original Town of Sanger, Lots 1- 8, Block 1; Lots 140, Block 2; Lots 14 and 942, Block 7. Property is Located at 103 Bolivar Street. Mayor declared Public Hearing opened. City Manager advised that Samantha Renz had provided a handout with the recommendation from Planning and Zoning for approval with the one change in the SUP to Item 6, indicating that no outside display, storage or sales will be permitted. Mayor declared Public Hearing closed. 6. Consider and Possible Action on Ordinance #11-44-07 -Amending the Comprehensive Zoning Ordinance by Granting a Specific Use Permit for an Organic Fertilizer Packaging Facility on Property Legally Described as Original Town of Sanger, Lots 1- 8, Block 1, Lots 140, Block 2;Lots 14 and 9=12, Block 7. Property is Located at 103 Bolivar Street. Councilman Muir asked if the City Manager could describe the operation since it indicates that it is organic and he is concerned about possible odor. City Manager advised that there should not be an odor since they will not be using manure or hazardous materials in the process. Rob Woods, Cecile Carson, and he visited the complex in Frisco where they are moving from and there was no odor detected. It should be a fairly clean operation that will be contained within the building. There should not be any EPA issues and if there were, it would be between the company and the EPA. Motion was made by Councilman Patton to accept Ordinance #1144-07 -Amending the Comprehensive Zoning Ordinance by granting a specific use for an organic fertilizer packaging facility, and to add Item 6: No outside display, storage or sales will be permitted. Seconded Councilman Ervin. Motion carried unanimously. Conduct Public Hearing on Ordinance #11-46-07 -Adopting the Comprehensive Plan, Brochure Plan and Amending the Thoroughfare Map. Mayor declared Public Hearing opened. Dan Boutwell, MPRG addressed Council and discussed the brochut°e map and the text documentation. The brochure map summarizes the text documentation and the brochure plan is a marketing tool that can be used for economic development. This information can be provided to developers. Local Government Code states that a comprehensive plan has to be in place if a city has zoning regulations and that they must be adopted in accordance with the comprehensive plan. They have incorporated some goals and objectives into the land use plan. Mr. Boutwell went over the different land uses. The map does not serve the same purpose as the City's zoning map and does not constitute zoning. It allows the city to make judgement decisions on how zoning occurs in the future and the same applies to thoroughfares. Mr. Boutwell indicated that the thoroughfare plan is coordinated with the Future Land Use Plan and provides the tools to develop a transportation system that can accommodate the needs of existing and future land use. Larry Hess, citizen in Sanger, expressed that he had not seen a map showing where roads may go. He owns property on the north side of Clear Creek. Cecile Carson explained that they do not know the exact location of roads, but the goal is that the end points have to match. Dan Boutwell, indicated that the alignment of future roads will be worked out at a later date and at that time the existing structures have to be located. Usually the alignments will miss those structures and they will try to utilize the property lines. This plan does not establish the alignment of any roads. Mr. Boutwell advised that the alignments will not happen until the market is developing in those areas. Discussion. Mayor declared public hearing closed. 12 9. Consider and Possible Action on Ordinance #1146-07 - Adopting the Comprehensive Plan, Brochure Plan and Amending the Thoroughfare Map. Brief discussion. Motion was made by Councilman Ervin to approve Ordinance #11=46-07 - Adopting the Comprehensive Brochure Plan and Amending the Thoroughfare Map. Seconded by Councilman Walker. Motion carried unanimously. That the City Council shall hold at least two regular meetings each month and as many additional meetings as it deems necessary to transact the business of the City. SECTION 2. The regular meetings of the City Council shall be held on the first and third Mondays of each month in the City Council Chambers at City Hall at 7:00 o'clock P.M., Central Time. If the date of a regularly scheduled meeting falls on a holiday, the meeting will be held on the Tuesday following the Monday holiday, and if the Tuesday is also a holiday, the meeting will be held on the next available week day as determined by the City Council. SECTION 3. Special meetings of the City Council shall be held on the call of the Mayor or a majority of City Council members. SECTION 4. FIRE PROTECTION AND FIRE PREVENTION Fire protection and fire prevention services will be provided within ten (10) days after the effective date of the annexation at the same level as provided throughout the city. EMERGENCY MEDICAL SERVICES Emergency medical services will be provided within ten (10) days after the effective date of an annexation on the same basis and at the same level as provided throughout the city. SOLID WASTE COLLECTION AND DISPOSAL Solid waste collection and disposal services will be provided within (60) days after the effective date of the annexation on the same basis and at the same level as provided throughout the city. MAINTENANCE OF WATER AND WASTEWATER FACILITIES THAT ARE NOT WITHIN THE SERVICE AREA OF ANOTHER WATER OR WASTEWATER UTILITY Maintenance of water and wastewater facilities that are not within the service area of another water or wastewater utility will be continued to be maintained immediately after the effective date of the annexation on the same basis and the same level as provided throughout the city. MAINTENANCE OF ROADS AND STREETS AND DRAINAGE Maintenance of roads and streets and drainage will be provided within (60) days after the effective date of the annexation on the same basis and at the same level as provided throughout the City. STREET LIGHTING Street lighting will be made available within sixty (60) days after the effective date of the annexation on the same basis and at the same level as provided throughout the City. MAINTENANCE OF CITY PARK AND RECREATION FACILITIES If any city park and recreation facilities are located within the annexed area, they will be maintained within sixty (60) days after the effective date of the annexation on the same basis and at the same level as similar facilities are maintained throughout the city. OTHER SERVICES Other services that may be provided by the city such as planning, code enforcement, animal control, library, park and recreation, court, and general administration will be made available within (60) days after the effective date of the annexation on the same basis and at the same level as provided throughout the city. Construction of water, sewer, street, and drainage facilities will begin within two (2) years after submissions of written request by landowners and payment of any development fees and construction costs required by the city in accordance with subdivision regulations and water and sewer extension policies. Construction will be completed within four and one half (44/2) years after request unless the construction process is interrupted by circumstances beyond the control of the city. No impact fees will be charged to any developer or landowner within the annexed area except in conformity with V.T.C.A., Local Government Code, ch. 395. Construction of other capital improvements shall be considered by the city in the future as the needs dictate on the same basis as such capital improvements are considered throughout the city. Nothing in this plan shall require the city to provide a uniform level of full municipal services to each area of the city, included the annexed area, if different characteristics of topography, land use, and population density are considered a sufficient basis for providing different level A service. TERM This service plan shall be valid for a term of ten (10) years unless the majority of landowners or registered voters of the area vote by petition submitted to the city for disannezauon, then this service plan shall no longer be binding upon the city. AMENDMENTS The plan shall not be amended unless public hearings are held in accordance with local Government Code, Section 43.052. i Exhibit "A" . • '. STREET LIGHTING Street lighting will be made available within sixty (60) days after the effective date of the annexation on the same basis and at the same level as provided throughout the City. MAINTENANCE OF CITY PARK AND RECREATION FACILITIES If any city park and recreation facilities are located within the annexed area, they will be maintained within sixty (60) days after the effective date of the annexation on the same basis and at the same level as similar facilities are maintained throughout the city. OTHER SERVICES Other services that may be provided by the city such as planning, code enforcement, animal control, library, park and recreation, court, and general administration will be made available within (60) days after the effective date of the annexation on the same basis and at the same level as provided throughout the city. Construction of water, sewer, street, and drainage facilities will begin within two (2) years after submissions of written request by landowners and payment of any development fees and construction costs required by the city in accordance with subdivision regulations and water and sewer extension policies. Construction will be completed within four and one half (44/2) years after request unless the construction process is interrupted by circumstances beyond the control of the city. No impact fees will be charged to any developer or landowner within the annexed area except in conformity with V.T.C.A., Local Government Code, ch. 395. Construction of other capital improvements shall be considered by the city in the future as the needs dictate on the same basis as such capital improvements are considered throughout the city. Nothing in this plan shall require the city to provide a uniform level of full municipal services to each area of the city, included the annexed area, if different characteristics of topography, land use, and population density are considered a sufficient basis for providing different level of service. Rainbow Valley is home to a substantial portion of the less than one percent of original Blackland Prairie that is still in existence today. With the goal of providing refuge for our native plants and wildlife, Rainbow Valley granted a conservation easement on seventy-eight of its two hundred twenty acres to the Natural Area Preservation Association (NAPA). This agreement with NAPA is a major accomplishment for our Community in our commitment to protect the land we call home. The members of Rainbow Valley have recognized that the Sanger Master Plan map shows proposed roads that either cut through or come very close to our Community. Such roads would in no way benefit Rainbow Valley or its Wildlife Preserve. The April 29, 2007 Back to the Land article published in the Denton Record Chronicle and the Dallas Morning News quoted CYity AdminisuatoJack Smith as saying, "We stay away from private property if possible and negotiate if it's not possible." The article stated, "Smith said he had a hard time imagining the road cutting through the heart of Rainbow Valley, with the bottomlands around Clear Creek and the area's hills. `The engineering would be a major undertaking,' Smith said. Smith said the city respects Rainbow Valley residents' privacy, as well as the community's values." The members and friends of Rainbow Valley respectfully ask that Sanger route no new roads through or adjoitvng our Community. The City of Sanger would be doing its part to help preserve its natural Blackland Prairie heritage for generations to come.
