ORDINANCE No. 20-95
AN ORDINANCE OF THE CITY OF SANGER, TEXAS, REVISING THE
CODE OF ORDINANCES BY REDEFINING QUALIFICATIONS OF
LIBRARY BOARD MEMBERS AND FINES FOR DEFACING LIBRARY
MATERIALS; PROVIDING FOR CONFLICTING ORDINANCES AND
PROVISIONS OF THE CITY; ESTABLISHING SEVERABILITY OF THE
ORDINANCE; AND PROVIDING AN EFFECTIVE DATE FOR THE
ORDINANCE.
NOW BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SANGER,
TEXAS:
I. CODE OF ORDINANCES REVISED
B. That Chapter 8, Article 8.402 regarding Qualifications of Board
Members be revised such that it shall hereafter read as follows:
"ARTICLE 8.402 +QUALIFICATIONS OF BOARD MEMBERS
Members of the Sanger Library Board shall either reside in the Sanger
area or own or actively operate a business in Sanger.
H. That Chapter 8, Article 8.408 regarding Defacing of Library Materials;
Fine be revised such that it shall hereafter read as follows:
"ARTICLE 8.408 DEFACING OF LIBRARY MATERIALS; FINES
Every person, parent or guardian of a child under the age of seventeen
(17) years who shall willfully or wantonly cut, mutilate, mark, tear, write
upon, deface or otherwise destroy or injure in whole or in part, any book,
pamphlet, periodical, map or document, picture, or written or engraved or
printed paper or any other library property belonging to the city of The
Sanger Public Library, or shall suffer any such injury to be inflicted while
such property is in his custody, or shall willfully, or wantonly injure any of
the furniture or property in the building of The Sanger Public Library, or
shall willfully or wantonly mark or deface or in any way injure The Sanger
Public Library or any part thereof, or any fixtures therein or appurtenances
thereto, shall be deemed guilty of a misdemeanor and, upon conviction
thereof, shall be punished by a fine of not less than twenty five dollars
($25.00) nor more than five hundred dollars ($500.00) for each offense.

II. CONFLICTING PROVISIONS
Any and all Ordinances of the City of Sanger, Texas, heretofore adopted
which are in conflict with this Ordinance are hereby expressly repealed
insofar as the same are in conflict therewith.
III. SEVERABILITY OF ORDINANCE
If any section, subsection, paragraph, sentence, clause, phrase or word in
this Ordinance, or application thereof to any person or circumstances, is
held invalid by a court of competent jurisdiction, such holding shall not
affect the validity of the remaining portions of the Ordinance, and the City
Council of the City of Sanger, Texas, hereby declares that it would have
passed such remaining portions of this Ordinance despite such invalidity.
IV. EFFECTIVE DATE
This Ordinance shall take effect immediately from and after passage and
publication, as the law in such cases provides.
DULY ADOPTED BY THE CITY COUNCIL OF THE CITY OF SANGER, TEXAS,
ON THIS THE 2ND DAY OF JANUARY, 1996.
