1. Mayor called meeting to order. Councilman Lawler led Invocation followed by Pledge
of Allegiance.

2. a) Approve Minutes: October 17, 2005

Councilman Higgs moved to accept the Consent Agenda as presented. Motion was
seconded by Councilman James. Motion carried unanimously.
3. Citizen's Input.
Sherry Lewis, 600 South 10"' Street, addressed City Council concerning the building
requirements to add 8x15 room on back of the house. Ms. Lewis indicated that the
building requirements required by the City will cost more than the room. Ms. Lewis
requested council review the fees that residents have to pay to add to an existing
residential structure.
Jan Looper, 663 Rising Star Lane, addressed City Council. Ms. Looper indicated that she
wanted to correct an issue concerning her property. She advised Council that when
FEMA came to their property in 1996, FEMA placed them in the flood plain. They were
not aware when they bought property their property that it would be categorized in the
flood plain.
4. Consider and Possible Action for Interlocal Cooperation Agreement for Fire Protection
Services.
Fire Chief, David Pennington, addressed City Council and advised that the agreement is
the same, except that the Fire run fee was increased from $362.88 to $368.10.
Councilman Patton made motion to approve the Interlocal Cooperation Agreement for
Fire Protection Services. Seconded by Councilman Ervin. Motion carried unanimously.
5. Consider and Possible Action National Incident Management System.
Fire Chief Pennington indicated that the NIMS Program allows the Fire Department the
capability to apply for Grants. Chief Pennington indicated the Fire Department operates
under an IMS Plan and if the City wants the ability to get a Grant they have to fall under
this program.
Councilman Higgs made motion that we approve the NIMS presented by Chief
Pennington. Seconded by Councilman James. Motion carried unanimously.
6. Consider and Possible Action on Sidewalk Bid for 5"' Street.
Lee Allison, City Engineer addressed City Council regarding this bid and the contractor.
Discussion concerning coordinating with TXDOT to get permission to place sidewalks on
the South end; getting letters and permission from the homeowners, and coordinating
right of way issues with TXDOT and property owners.
Lee Allison and John Henderson met with the two lowest bidders to review bids,
construction and deadline commitments.
Lengthy discussion about tree removal and replanting of trees.
Councilman Patton made motion to approve the contract and award Sidewalk Bid to
Ameripaving, Inc. Seconded by Councilman Lawler. Motion carried unanimously.
7. Consider and Possible Action for Interlocal Cooperation Agreement for Library Services.
Vicky Elieson, Librarian, indicated that the Interlocal Agreement for Library Services has
only one change from the past. The County is asking that all computers in the Library
have filters on them. Ms. Elieson indicated the city currently does not have these in place,
however, they are in process of being installed.
Discussion concerning the county not wanting to fund Libraries. Ms. Elieson informed
the Council that there is a 20% reduction in funding.
Councilman Higgs made motion to approve the Interlocal Agreement for Library Services.
Seconded by Councilman James. Motion carried unanimously.
g. Consider and Possible Action on Nominees for Appraisal Review Board.
City Secretary advised that Shirley Haisler is serving on this Board and her term does not
expire until 12-31-06. She has not indicated that she wants to resign. The Denton Central
Appraisal District indicated the City can nominate another person to also serve on this
Board.
Councilman
James made motion that we do not make any nominations at this time.
Councilman Ervin seconded. Motion carried unanimously.
9. Consider and Possible Action for Economic Development Coordinator Incentive Package
Preparation.
City Manager advised that he checked with several Cities and at the Smaller Cities the 4A
and 4B Boards fund 100% of the cost for this position. In larger cities such as Lewisville
and Denton the position is paid 100% by the City.
Lengthy discussion concerning the funding of this poson and the incentive package.
Councilman James made motion that City Council will authorize and approve an Incentive
Package and an Economic Development Coordinator/Director position with the
appropriate incentives in the package: a Car Allowance, Travel Budget and
Compensation as discussed.
City Secretary asked that Councilman James retract his first motion. Councilman James
made motion to approve preparation of the Incentive Package. Seconded by Councilman
Higgs.
Motion carried unanimously.
10. Discussion Regarding Changing Building Construction Code.
Lengthy Discussion about Building Permits, Fees and changes that could be made.
11. Discuss Items for Future Agenda.

all . of our previous comments have been addressed. We remain concerned about the

development of the industrial park will only serve to exacerbate the traffic conflicts with

Attached are revised copies of the plans. Also attached is a copy of the TxDOT comments
from Tracy Beck and the latest construction plans for F.M. 455 that we obtained from
TxDOT. The revised plans show the planed F.M. 455 expansion at the bridge. Per my
meeting with Dave Hensley and Tracy Beck, it appeared that locating the culvert outside the
existing TxDOT R.O.W. would be the most expedient design. We have also changed the
TxDOT connection from Concrete to Asphalt to match the future expansion of F.M. 455 and
increased the return radii to 30' to address some TxDOT concerns. Although TxDOT did a
courtesy review for us, Tracy indicated that the City of Sanger must make the official
submission. In your request to connect the proposed street to F.M. 455, Tracy asked that you
indicate your awareness of the separation conditions between Proposed Industrial Avenue
and existing lst and 2nd streets.
Please verify that we have made the appropriate revisions and schedule the Final Plat for
approval. The following is a summary of the revisions we have made to address your
comments.
Plat Sheet
Comment 1. Industrial Avenue is not shown on the preliminary plat on file at the City of
Sanger. Please provide a copy of the approved Preliminary Plat that shows Industrial
Avenue. We are concerned about the alignment if Industrial Avenue with regard to the
adjacent intersections of lst and 2nd streets. A TxDOT Permit is required and we also do not
believe that the location will meet TxDOT's intersection (access) spacing requirements. We
recommend that a meeting be scheduled with City Staff to discuss these issues.

Comment 8. ON sheet 4 clearly label the extent of the proposed TxDOT crossing on the
profile view. Crossing will need a TxDOT permit. Crossing is anticipated to be by bore and
casing. Finish labeling diameter and thickness of casing pipe.

SECTION 25
"I-1" INDUSTRIAL DISTRICT
General Purpose and Description: The I-1 District is established to accommodate those uses
which are of a non -nuisance type located in relative proximity to residential areas, and to
preserve and protect lands designated on the comprehensive plan for industrial development and
use fiom the intrusion of certain incompatible uses which might impede the development and use
of lands for industrial purpose. Development in the I4 District is limited primarily to certain
wholesale and jobbing commercial uses and certain industrial uses, such as the fabrication of
materials, and specialized manufacturing and research institutions, all of a non -nuisance type. No
use or types of uses specifically limited to the I-2 District may be permitted in the I-1 District.
25.1 Use Regulations: Uses permitted in the 1-1 District are subject to the following conditions:
1. All business, servicing, or processing, except for off-street parking, off-street loading,
display of merchandise for sale to the public, and establishments of the "drive-in"
type, shall be conducted within completely enclosed areas.
2. All storage within one hundred feet (100') of a residence district, except for motor
vehicles in operable condition, shall be within completely enclosed buildings or
` effectively screened with screening not less than six feet (6) nor more than eight feet
(8') in height, provided no storage located within fifty feet (50) of such screening shall
exceed the maximum height of such screening.
3. Permitted uses in the I-1 District shall not disseminate dust, fumes, gas, noxious odor,
smoke, glare, or other atmospheric influence.
4. Permitted uses in the I-1 District shall produce no noise exceeding in intensity, at the
boundary of the property, the average intensity of noise of street traffic.
5. Permitted uses in the I-1 District shall not create fire hazards on surrounding property.
Permitted uses in the I-1 District include the following:
1. Advertising products, such as signs and billboards (manufacturing of).
2. Ambulance, bus, train, and taxi stations, truck yards;
3. Awnings, Venetian blinds, and window shades (manufacturing of);
4. Bakery, candy, dairy and other food products, but not including fish and meat

products, sauerkraut, vinegar, yeast, alcohol or alcoholic beverages;
5. Building materials yard, contractor's yard, lumberyard;
6. Cameras and other photographic equipment (manufacturing of);
7. Ceramic products, such as pottery, figurines, and small glazed tiles;
8. Ice plants, cold storage plants;
9. Jewelry;
10. Machine shops and fabrication of metal not more than ten (10) gauge in thickness;
11. Metal stamping and extrusion of small products, such as costume jewelry, pins and
needles, razor blades, bottle caps, buttons, and kitchen utensils;
12. Milk and ice cream processing.
13. Mobile home sales.
14. Musical instruments;
15. Orthopedic and medical appliances, such as artificial limbs, braces, supports, and
stretchers;
16. Repair of farm, household, office machinery or equipment;
17. Scientific and precision instruments (manufacturing of);
18. Sheet metal shops;
19. Public utility and public service uses as follows:
(a) Bus stations, bus terminals, bus turnaround (off-street), bus garages, and bus
lots;
(b) Electric substations;
(c) Radio and television towers;
(d) Railroad passenger stations;

(e) Telephone exchanges, microwave relay towers, telephone transmission
equipment buildings and service yards;
(f) Privately owned water pumping stations and water reservoirs;
20. Radar installations and towers;
21. Radio and television studios and stations;
22. Schools, trade.
23. Storage and warehousing establishments.
24. Storage yards, but not including junkyards;
25. Swimming pool (manufacturing of).
26. Trailer sales and rental, for use with private passenger motor vehicles;
27. Weighing stations;
28. Wholesaling establishments;
29. Accessory uses, including but not limited to temporary buildings for construction
purpose for a period not to exceed the duration of such construction;
30. Other wholesale, light manufacturing, construction or service uses which are similar
in character to those enumerated in this subsection, and which will not be dangerous
or otherwise detrimental to persons residing or working in the vicinity thereof, or to
the public welfare, and will not impair the use, enjoyment, or value of any property;
31. Factory outlet retail or wholesale store for the sales and servicing of goods or
materials on the same premises as the manufacturing company to which they are
related, including sales and service in a separate building or buildings;
32. Other uses as listed in Section 30 of this ordinance.
The following specific uses shall be permitted in the I4 District when granted in accordance with
Section 31:
1. Railroad freight terminals, railroad switching and classification yards, repair shops,

and roundhouses.
2. Stadiums, auditoriums, and arenas.

Allison Engineering recommends denial of the final plat. The development is located in
the ETJ. The City has an interlocal agreement regarding such developments where the
City is the prime reviewer but they agree to require that all public works improvements
meet or exceed the county requirements.
Our comments regarding Final Plat are as Follows:
• The ETJ certification in the lower right hand corner is for Plainview Farms
Subdivision within the City of Denton ETJ. This needs to be corrected.
• The P&Z signature block is missing. (The one shown is for Denton).
• An exhibit is needed to indicate the location of water facilities, general
topography (a USGS map is sufficient) and a drainage analysis. This may have
been submitted with preliminary plats or final plats of the previous phases. If so,
then copies of these documents may be acceptable.
• A plan/profile of the borrow ditch along Creekview Road and a schedule of
culvert sizes is needed to provide for the future installation of driveways. A
waiver from the County Engineer is also acceptable.
• A letter from the County Engineer indicating that improvements to Creekview
Road are not required, or an engineering report (and design if applicable)
determining what road improvements, if any, are needed.

Attached is a copy of the letter from the City Attorney regarding plat approvals. To summarize, The
Local Government Code requires the Planning and Zoning to approve a plat that meets City
regulations within 30 days of the date the plat is received. If the Commission does not meet this
deadline the plat is considered approved and will be submitted to the City Council. The Council
must act on a plat within 60 days of the date the Plat is received. If not it is considered approved by
Council as well.
Two plats that were on the last agenda, O.T. Sanger Lot 1 and Lot 1R, Block 17 and Sanger
Industrial Park Tracts 1 & 2. Both of these plats are considered approved by the Planning and
Zoning Commission and will be forwarded to City Council for approval. They have met all
requirements of the City.
If the Commission denies a plat they must certify the reasons for the denial. If they fail to do so or
those reasons are inadequate in the view of the property owner, the Commission members would be
subject to Mandamus and potentially could be personally liable for the cost.

You have requested that we furnish you a written opinion with regard to the plat approval
prod ss.
The approval of a subdivision plat is governed by your; subdivision ordinance and its
regu .ations. That ordinance is authorized by Chapter 212 of the Texas Local Government Code
which authorizes a city to adopt rules governing plats and subdivisions of land within the City's
juris fiction.
In your case, the municipal authority responsible for approving plats is the Planning and
Zone ng Commission. The City of Sanger has by ordinance also lIoquired the approval of the City
Cou ieil of a plat in addition to the approval of the Planning and Zoning Commission.
Chapter 212 contains standards for approval of a plat. A plat must conform to the general
plan of the city and its current and future streets and utilities, among other things.
You have advised me that on several occasions, the City Engineer has reviewed and
recc mmended approval of subdivision plats, indicating that all the City's requirements had been
met by the plat. In spite of that recommendation, the Planning and Zoning Commission has
den' ed the plat.
Section 212.005 provides:
"The municipal authority responsible for approving plats must appzove a
plat or replat that is required to be prepared under dhis subchapter and that
satisfies all applicable regulations."

What is important about this provision is that the Commission does not have the
same discretion in plat review that it does in a zoning case where i� is "recommending" a
course of action to the City Council, which is the exclusive decision making body. In
plat rc view, it is an "approving authority" but is required to approve a plat that complies
with f ie City's regulations.
Section 212.009 provides that the municipal authority shall act upon a plat within thirty
days tfter the date that that plat is tiled. A plat is considered approved by the municipal
author. •ity unless it is disapproved within that period. In addition, the City Council shall act upon
the plat within thirty days after the date that the plat is approved by the Planning and Zoning
C01111fission or is considered approved by the inaction of the Commission, A plat is considered
approved by the City Council unless it is disapproved within that period. If a plat is
disap: )roved, on request of an owner of an affected tract, the municipal authority shall certify the

You have mentioned several plats that have been considered by the Planning and Zoning

You have mentioned that on a couple of occasions the pft was not acted on because the
Plan ing and Zoning Commission did not have a quorum at the scheduled meeting.
Unfc rtunately, there is no exception in the statute that would extiend any time on account of the
lack of a quorat the Commission meeting. In those cases, if the thirty days passed without
um
action by the Commission, the plat is deemed approved and lould be taken directly to the
Cow Leif for consideration, the same as if the plat had been considered and approved by the
Corn mission within the first thirty days.
In none of the cases you mentioned have you stated that ;there was any reasort expressed
by the Commission for denial of the plat. The next step would i be up to the property owner to
requ Est a certificate from the City stating the date the plat was Bled and that the authority failed
to a( t on the plat within the thirty days. That certificate is effective in place of the endorsement
of tf e plat. See Section 212.009 of the Local Government Code.
A plat that was timely denied by the Commission may be filed again by the property
owner at any time and the Commission will be required to consider the plat again. Unless the
plat is approved by the Commission, or is deemed approved because the Commission has not
acte 1 on it within thirty days, it cannot be forwarded to the City ;Council for consideration. This
is bi:cause Section 212.006(a) requires "approval" by the Commission prior to consideration by
the ".ity Council. In other words, it is not like an "appeal" of the:: Commission denial.
Although you stated to me that I had previously stated that the Commissions could not
den r a plat if the plat were in compliance with the regulations that is not exactly what I said.
Whit I said is that the language of Section 212.005 quoted, above makes it clear that the
legi slature intended that the Commission "must approve a plP t....that satisfies all applicable
regi dations." If they deny the plat, they may be requested to certify the reasons for that denial.

I want to emphasize that I have no personal knowledge 'of any of the facts concerning
any cf these plats and the Commission may have had legitimate ;reasons for denial of the ones
they 11enled. If so, the next step is up to the property owner' to seek the remedy authorized by
Chap :er 212.
On the plats which have not been acted on within thirty days, they ate simply approved
as a r tatter of law by the statute. For example, you have indicates} that a plat was received for an
addit .on known as "Indian Country" on October 12_ It was scheduled for the Commission
Meeting on November 3, but there was not quorum present, The next Commission meeting is
Novt mber 17, which is outside the thirty days. Because of that, that plat is deemed approved by
the Commission by virtue of Section 212.009(a) as of November 11, 2005. You have advised
that i he City Council is scheduled to consider the plat on Novex>iher 21. This is within twenty
days after November 11 and thus the Council will be in complianoe with the rules established by
Section 212.009. The plat for "Choctaw Ridge" is subject to the dxact same conclusions.
In sti nmary, Chapter 212 of the Local Government code Fontrols the rules and timing of
plats in the City of Sanger. As stated herein, the Commission and the Council must act on plats
with n the thirty days allotted each, If a plat meets the City's subdivision regulations, it "mast"
be approved by both the Commission and the Council. If it does not, both the Commission and
the (;ouncil must be prepared to certify the reasons that it doesn It. It is possible that there were
suffi �.ient reasons that the Commission denied plats that were recommended by the City
Engineer. If so, it is up to the property owner to seek a certificate of those reasons and proceed
with the remedies available to him at law. I believe it is a common practice for property owners
to a, Tree to "waive" the thirty day requirement so as to not have to start over again on a plat
appr )val process.
if you would like, I would be glad to come to a rneetin� of the Commission to explain
thes, b various rules and situations. Also, on the plats that have been. denied, you should probably
require the property owner to file a new application so as to start another thirty days running,
rathi sr than simply just placing the plat back on the agenda without a new application.

I write to you "in your capacity as City Attorney for the City of Sanger on behalf of my
client "ierigodt Advertising. On October 14, the City denied Herigodt Advertising's application
to moz e one of its existing sign locations 20 feet. The sign has been standing along Interstate 35
for 20 years. Now, because of the needs of the other tenant on the parcel, the sign must be
moved. Despite the modest nature of Herigodt's request, the City denied the application by
stating: "This type of sign is not allowed in any zoning district w/in city."
I hope that you will review this situation. We feel that the City has misapplied its sign
regular ions. Moreover, a review of those regulations reveals that they are wholly
mcon, titutional and invalid for any number of reasons. For example, the content -based
restricl ions of noncommercial speech cannot survive the strict scrutiny test applicable to
restrict ions on noncommercial speech; the favoritism of commercial speech over noncommercial
speech is impermissible; the failure to limit the time in which City officials must grant or deny
the pez mit in unacceptable; and the grant of unbounded discretion to City officials to determine
what s gns will be posted in the City.
For these reasons, I hope that the City will reconsider its decision. Please call me to let

Our client, the City of Sanger; has authorized me to review and respond to your letter of
October 17, 2005 with regard to the referenced sign application.
The City of Sanger is a home rule city of the State of Texas. As such, it looks to the
statutes of the State of Texas for limitations of its power rather than for the granting of power. It
has all the power of the state legislature that is not in conflict with state law or the state or federal
constitutions. The City Council enacted Article 3.1400 of the Sanger Code of Ordinances,
entitled "Sign Regulations".
Section 3.1401 of the Code of Ordinances makes it unlawful to install or erect any sign
except in compliance with provisions of Article 3.1400. Section 3.1408 requires a permit to be
issued for the erection of a new sign.
The sign you refer to is apparently a billboard sign as that term is defined in the Code of
Ordinances. The definition, contained in Section 3.1402, is as follows:
"Billboard, posterpanel or painted bulletin. Large signs which usually
promote and advertise commodities or services not limited to being offered on the
premises on which such signs are located."
Section 3.1403 contains a schedule of uses permitted by class of zoning district. A
review of that section indicates that a billboard type sign is not a permitted sign in any zoning
district of the City of Sanger.
However, because your client's sign has been in place for twenty years, it is considered a
nonconforming sign under' the sign regulations. Section 3.1402 defines a nonconforming sign as
follows:

"Nonconforming sign. Any sign that is placed, located or erected on any
property or structure in the City of Sanger after the effective date of this Article
which does not comply with the requirements of this Article."
It appears from the facts you have recited and from what I have been told by the City of
Sanger that your client's sign was in place prior to the enactment of the sign regulations or, at
least, prior to the prohibition of billboard type signs in the City. As you know, the voluntary
removal of a nonconforming sign would terminate the nonconforming right for that sign in its
current location. Even though your client only wants to move the sign twenty feet, removal of
the nonconforming sign will terminate its nonconforming right and the City staff is prohibited by
ordinance from issuing a new permit for a new billboard sign at a new location by the provisions
recited above.
To make sure that the City's regulations with regard to billboard signs did not conflict
with state law, we have also reviewed the provisions of Chapter 216 of the Texas Local
Government Code, which provides for regulation of signs by municipalities. In that chapter, a
sign that includes a billboard and an off premises sign means a sign displaying advertising copy
that pertains to a business or product not principally located or primarily manufactured or sold on
the premises on which the sign is located. Thus you can see that the City's definitions are
consistent with state law. Chapter 216 primarily has to do with payment of compensation by the
City to a sign owner when the sign owner is required to remove or relocate his sign. In this
instance, the City of Sanger is not requiring your client to remove or relocate its existing
nonconforming sign. One exception is contained in Section 216.013(b) which provides:
"The requirements of this subchapter do not apply to a sign that, having
been permitted to remain in place as a nonconforming use, is required to be
removed by a municipality because the sign, or a substantial part of it, is blown
down or otherwise destroyed or dismantled for any purpose other than
maintenance operations or for changing the letters, symbols, or other matter on
the sign.''
However, in this case, the City is not requiring the nonconforming sign to be removed,
but does take the position that if your client voluntarily removes the existing nonconforming
sign, its nonconforming right is terminated and cannot simply be relocated to another place,
whether it is twenty feet, two hundred feet, or two miles away.
Section 216.901 of the Local Government Code specifically states:
"(a) A home rule municipality may license, regulate, control, or prohibit the
erection of signs or billboards by charter or ordinance."
This is exactly what the City of Sanger has done in this case.

Finally, to seek relief from this requirement, your client may apply for a variance under
Section 3.1409 of the Sanger Code of Ordinances. That section provides:
"When it appears that the provisions of this Article would work a manifest
injustice or unnecessary hardship, a person may appeal to the City Council for a
variance from the provisions of this Article. Such variance may be granted
subject to special restrictions and for a fixed time subject to expiration at the
discretion of the City Council."
If your client desires to seek such a variance, please ask him to contact the appropriate
city official to begin that process.

MONTHLY REPORT
OCTOBER 2005

HIGHLIGHTS:
Circulation was 35% higher than last October, and new card applications were
almost three times last October's. This higher use is at least partly the result of the $50
fee that Denton Public Library is charging for a library card.
ADMINISTRATION:
Adam Beatty of the North Texas Regional Library System spent four days
upgrading computer operating systems, installing software, setting up printers and
rehabilitating older computers. We now have two staff computers in the public area, so
that one staff person can do a search while the other computer is being used for
circulation. We also have two computers in the workroom, so that a staff person can
work in there even when we have a community service worker on the other computer.
One of the computers in the public area was not upgraded to Windows XP because we do
not yet have the XP drivers for the Microfilm scanner.
The Loan Star Plan of Action was submitted to the state. This year the grant will
be used for a computer maintenance contract and for Tutor.com, an online homework
help -line.
Library Clerk Lynne Smiland underwent surgery to remove a tumor (benign)
from her thyroid.
The Library Director was elected the Denton County Library Advisory Board
Proposal Coordinator. She will gather data for and formulate the budget request for the
participating Denton County libraries. She will also present the request to the
Commissioners' Court.

SPECIAL PROJECT:
Participated in the Safe Spook night.
PROGRAMS:
The Storytime theme was "My Body" with weekly themes being "Parts of My
Body", "Taking Care of My Body", "Exercise and Rest" and "Sometimes I Get Sick",
The last two sessions of the Genealogy class were held.
A lecture by Steven Ashley was attended by twenty people. He spoke about a

Steve Ashley, artist and amateur
archeologist, is coming to Sanger to
discuss his discovery of a rare type
of Native American ceremonial art
found just outside of town. He will
speak and present a slide show at the
Sanser Public Library on Thursday.
October 20. The painted deer femur,
used in prayer ceremonies of the
Plains Indians, is one of only a hand-
ful of painted bones in the Texas ar-
cheological record.
Ashlev, a resident on Austin, was
in Sanger during the summer of 1999
visiting friends when he went hiking
along Duck Creek and Clear Creek.
Erosion along the creek walls had re-
vealed a portion of the bone, which
he carefully dug out. Since then he
has been researching the artifact and
working with the Texas Archeologi-
cal Research Laboratory at the Uni-
versity of Texas in Austin, to estab-
lish a date range and comparison with
other artistic Native American finds,
both in Texas and in other states.
The Sanger Public Library, lo-
cated at 501 Bolivar in Downtown
Sanger will host Ashley's appearance
October 20 in its meeting room at 7
p.m. Reservations to attend may be
