1. Mayor called Meeting to Order, Councilman Higgs led Invocation which was followed by the
Pledge of Allegiance.

Councilman Ervin moved to accept Consent Agenda as presented. Motion was seconded by
Councilman Lawler. Motion carried unanimously.
3. Citizen's Input.
Mary Margaret Tocquigny, addressed City Council on participating in a Community Wide
effort to place some of the families that are displaced by Hurricane Katrina.
John Springer, 802 N. Keaton. Mr. Springer addressed City Council on a Thoroughfare Plan.
He expressed that a Master Plan and Thoroughfare Plan must be coordinated together.
Mr. Springer recommended that Council become familiar with Roberts Rules of Order to
assist them in their roles as elected officials.
4. Consider and Possible Action on Long Range Plan for Library.
Vicky Eliesen addressed City Council on the Long Range plans for the Library.
Lengthy Discussion.
Discussion on the purchase of property owned by SISD between Library and the Taxidermist
(owned by City). Staff is still pursuing this purchase.
Councilman Patton made motion to accept Long Range plan for the Library. Seconded by
Councilman Higgs.
Motion carried unanimously.
5. Consider and Possible Action on Duck Creek Drainage Improvements.
City Manager addressed City Council about the letter submitted by Mark Hill, Engineer on
this project which concluded that the house lies within the FEMA designated approximate
Zone A 100-year flood plain. City Manager also summarized the following issues addressed
by the engineer in his letter.
The proposed improvements to Duck Creek Road by the County will have minimal effect on
the water surface elevation at the house.
Channelization of the existing stream bed upstream of the road in conjunction with the County
improvements will have minimal effect on the water surface elevation at the house.
The water surface elevation would need to be lowered approximately 2.5-3 feet to bring it out
of the flood plain.
The issue concerning the berm around the house, assuming a 4:1 side slope and approximately
2.5' in height (aaproximate 20' base width), the berm would extend into the actual creek
channel, which is not feasible unless the creek channel is realigned.
If a wall were constructed instead of the berm above, the upstream properties could still be
adversely affected due to the narrowing of the natural flood plain.
Mr. Looper addressed City Council in regards to this item. He presented pictures in regards
to the drainage.
Mr. Looper discussed that if the creek were widened it will take care of the drainage problem.
Item tabled to allow staff to contact Commissioner White to see what can be done.
Motion made by Councilman Patton to table possible action item on Duck Creek
Improvements. Seconded by Councilman Higgs. Motion carried unanimously.
6. Consider and Possible Action on Awarding Bid for Construction of Santa Fe Yard Building.
City Manager addressed this item and explained the problem with the bid.
The building was bid with piers and slab. Rocking S bid the job without the piers. Rocking
S was rejected based on the fact that they did not do what City had on specifications.
Discussion about the direction of the building. New slab will be moved to the North East
corner. We will leave slab to utilize other equipment.
Discussion about the bids with the removal of the slab. The slab will not be removed and the
� bids were received with the removal of slab.
Motion was made by Councilman Ervin to reject all bids and rebid. Seconded by
Councilman Patton. Motion carried unanimously.
7. Discuss Items for Future Agenda.

These items are the steps necessary to adopt the Budget. The Public Hearing is the first step,
followed by adoption of budget and then setting the tax rate. The ordinances 09-14-05 are adopting
the Budget and 09-15-05 is adopting the tax rate.

AN ORDINANCE OF THE CITY OF SANGER, DENTON COUNTY, TEXAS,
ADOPTING THE BUDGET FOR THE CITY OF SANGER, TEXAS FOR THE
FISCAL YEAR BEGINNING OCTOBER 1, 2005 AND ENDING
SEPTEMBER 30, 2006 PROVIDING FOR THE INTRA AND INTER
DEPARTMENT AND FUND TRANSFERS; AND DECLARING AN
EFFECTIVE DATE.
WHEREAS, notice of a public hearing on the budget for the City of Sanger, Texas, for the
fiscal year 2004-2005 has been published in accordance with law; and,
WHEREAS, it is necessary, at this time, that said budget be adopted.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
SANGER, TEXAS, AS FOLLOWS.
SECTION 1: That the budget presented by the City Council and reviewed during the public
hearing is hereby approved and adopted for the fiscal year 2005-2006.
General Fund $4,216,525.68
Enterprise Fund $75294,114.32
SECTION 2: That the City Manager or his designee is authorized to invest any funds not
needed for current use, whether operating funds or bond funds, in United States Treasury bills,
savings accounts or certificates of deposit. Accrued interest from such investment may be deposited
in the General Fund, all of which investments shall be in accordance with law.
SECTION 3: That the City Manager be and is hereby authorized to make intra and inter
department fund transfers during the fiscal year as becomes necessary in order to avoid expenditure
of a particular account.
SECTION 4: This ordinance shall take effect and shall be in full force and effect from after
its passage.

AN ORDINANCE OF THE CITY OF SANGER LEVYING THE AD VALOREM TAXES
FOR THE YEAR 2005 (FISCAL Year LOOS-2006) AT A RATE OF $0.507899 PER ONE
HUNDRED DOLLARS ($100) ASSESSED VALUATION ON ALL TAXABLE PROPERTY
WITHIN THE CORPORATE LIMITS OF THE CITY OF SANGER AS OF JANUARY 1, 20069
TO PROVIDE REVENUE FOR THE PAYMENT OF CURRENT EXPENSES; PROVIDING FOR
AN INTEREST AND SINKING FUND FOR ALL OUTSTANDING DEBT OF THE CITY OF
SANGER; PROVIDING FOR DUE AND DELINQUENT DATES TOGETHER WITH
PENALTIES AND INTEREST, PROVIDING A REPEALING CLAUSE; PROVIDING A
SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SANGER, TEXAS:
SECTION 1. That there be and is hereby levied for the year LOOS on all taxable property,
real, personal and mixed, situated within the corporate limits of the City of Sanger, and not exempt
by the Constitution of the State and valid State laws, a tax of $0.57899 on each one hundred dollars
($100) assessed valuation of taxable property, and shall be apportioned and distributed as follows:
(a) For the purposed of defraying the current operations and maintenance expenditures of the
municipal government of the City of Sanger, a tax of $0.419710 on each one hundred
dollars ($100) assessed value on all taxable property.
(b) For the purpose of creating a sinking fund to pay the interest and principal maturities of all
outstanding debt of the City of Sanger, not otherwise provided for, a tax of W.159280 on
each one hundred dollars ($100) assessed value of taxable property within the City of
Sanger, and shall be applied to the payment of interest and maturities of all such
outstanding debt.
SECTION 2. That all ad valorem taxes shall become due and payable on October 1, LOOS,
and all ad valorem taxes for the year shall become delinquent if not prior to February 1, 2006. There
shall be no discount for payment of taxes prior to February 1, 2006. A delinquent tax shall incur all
penalty and interest authorized by law, to wit:
(a) A penalty of six per cent on the amount of the tax for the first calendar month it is
delinquent, plus one percent for each additional month or portion of a month the tax
remains unpaid prior to July 1 of the year in which it becomes delinquent.
(b) Provided, however, a tax delinquent on July 1, 2006 incurs a total penalty of twelve per
cent of the amount of delinquent tax without regard to the number fo months the tax has
been delinquent. A delinquent tax shall also accrue interest at the rate of one percent for
each month of portion of a month the tax remains unpaid. Taxes for the year 2005 and
taxes for all future years that become delinquent on or after February 1 but not later than
May 1, that remain delinquent on July 1 of the year in which they become delinquent, incur
an additional penalty in the amount of twenty percent (20%) of taxes, penalty and interest
due, pursuant to Texas Property Tax Code Section 6.30 and 33.07, as amended. Taxes for
the year 2005 and taxes for all future years that remain delinquent on or after June 1 under
Texas Property Tax Code Sections 26.07(f), 26.15(e), 31.03, 31.031, 31.032 or 31.04 incur
and additional penalty in the amount of twenty percent (20%) of taxes, penalty and interest
due, pursuant to Texas Code Section 6.30 and Section 33.08, as amended.
SECTION 3. Taxes are payable in Sanger, Texas, at the City of Sanger, City Hall Offices.
The City shall have available all the rights and remedies provided by law for the enforcement of the
collection of taxes levied under this ordinance.
SECTION 4. That the tax roll as presented to the City Council, together with any
supplements thereto, be and the same are hereby approved.
SECTION 5. That all ordinances of the City of Sanger in conflict with the provisions of this
ordinance be, and the same are hereby, repealed.
SECTION 6. That should any sentence, paragraph, subdivision, clause, phrase or section
of this ordinance be adjudged or held to be unconstitutional, illegal or invalid, the same shall not
affect the validity of this ordinance as a whole or any part or provision thereof other than the part
thereof decided to be unconstitutional, illegal or invalid.
SECTION 7. This ordinance shall take effect immediately from and after its passage, as
the law and charter in such cases provide.

Re: Item #7 -Mileage Reimbursement
The mileage reimbursement has been set at $0.32 cents for years. Bill Spore, City Auditor advised
last year that the state had raised their mileage reimbursement, however the City did not change their
rate at that time. Staff is asking to change the mileage since there are employees and council who
do use their personal vehicles for travel when attending educational seminars, etc.
The ordinance is to amend this in our Personnel Policy.

THAT CHAPTER 9, ARTICLE 9.2009 "PERSONNEL POLICIES ADOPTED" (7.7 EXPENSE
REIMBURSEMENT IN "EXHIBIT A"); OF THE CODE OF ORDINANCES OF THE CITY OF
SANGER, TEXAS, IS HEREBY AMENDED, PROVIDING FOR THE REPEAL OF ALL
ORDINANCES IN CONFLICT; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING
FOR AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SANGER, TEXAS:
Section 1. That Chapter 9, Article 9.2 of the Code of Ordinances, City of Sanger, Texas, (7.7
Expense Reimbursement in "Exhibit A") is hereby amended to read as follows:
7.7 Expense Reimbursement
You must have your supervisor's written authorization prior to incurring an expense on
behalf of the City of Sanger. To be reimbursed for all authorized expenses, you must
submit an expense report or voucher accompanied by receipts and it must be approved by
your supervisor. Please submit your expense report or voucher each week, as you incur
authorized reimbursable expenses. In order for the City of Sanger to keep records and
accounting accurate and current, please submit your expense reports in a timely fashion.
If you are asked to conduct the City of Sanger business using your personal vehicle, you
will be reimbursed at the rate of forty one and one half cents ($ .415) per mile. Please
submit this expense on your weekly expense report or voucher.
When away on business, the City of Sanger will reimburse employees for meals to a
maximum of thirty-five (35) dollars per diem.
Section 2. All ordinances or parts of ordinances in conflict herewith are, to the extent of such
conflict, hereby repealed.
Section 3. It is hereby declared to be the intention of the City Council that the sections, paragraphs,
sentences, clauses, phrases and words of this Ordinance are severable and, if any word, phrase, clause,
sentence, paragraph, or section of this Ordinance shall be declared unconstitutional by the valid judgment
or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the
remaining portions of this Ordinance, since the same would have been enacted by the City Council without
the incorporation in this Ordinance of any such unconstitutional word, phrase, clause, sentence, paragraph,
or section.
Section 4. This ordinance will take effect immediately from and after its passage.

Request for Nominations for Denton CAD Board of Directors

It is time again for the taxing jurisdictions to select five individuals to serve as the DCAD
Board of Directors. Each jurisdiction may nominate up to five people to be considered
for the Board of Directors. According to Section 6.03 of the Property Tax Code, it is the
chief appraiser's responsibility to initiate this process, which is the purpose of this
memo.
Please note that a chief appraiser does not have the authority, or the duty, to
investigate, or judge, the qualifications of the nominees. Further, a chief appraiser can
not extend the deadline for receiving nominations.
Attached is a nominee form. Please return a form for each nominee by October
15, 2005.
CALENDAR FOR APPOINTMENTS:
1. -.Prior to October 1st -Each jurisdiction will be advised of the number of votes they
are entitled to cast for appointing the Board members. (See Attached)
2. Prior to October 15th The governing body of each jurisdiction nominates candidates
to the DCAD Board of Directors. Each taxing jurisdiction can nominate up to five
candidates if they wish. The number of votes that each jurisdiction has is not relevant in
the initial nomination phase.
3. Prior to October 30th - A comprehensive list of the nominees will be compiled and
this information will be sent to the taxing jurisdictions in the form of a ballot.
4. Prior to December 15th -The taxing jurisdictions choose by written resolution the
candidate, or candidates, of their choice. The jurisdictions then submit the names of
their candidates and the votes they cast for each candidate prior to the December 15th
deadline.
5. Prior to December 31 st — A tabulation of the votes will be forwarded to the
jurisdictions. The five candidates that have received the most votes become the Board
of Directors as of January 1st.

SELECTING A NOMINEE
AUTHORITATIVE GUIDELINES - The selection process is set forth in Section 6.03 of
the Property Tax Code. This process is not an "election" governed by the Texas
Election Code. It is an independent procedure unique to the property tax system.
ELIGIBILITY - An appraisal district director must reside in the appraisal district for at
least two years immediately preceding the date he or she takes office. Most residents
are eligible to serve as a director. An individual that is serving on the governing body of
a city, county, or school district is eligible to serve as an appraisal district's director.
An employee of a taxing unit served by the appraisal district is not eligible to serve as a
director. However, if the employee is an elected official, he or she is eligible to serve.
A statute relevant to the Board selection process prohibits nepotism and conflict of
interest for appraisal district directors and chief appraisers. In summary, the law states
that.
..."a person may not serve as director if closely related to anyone in the appraisal
district or if related to anyone who represents owners in the district, or if the person has
an interest in a business that contract with the district or a taxing unit. A chief appraiser
may not employ someone closely related to a member of the board of directors".
EXPERIENCE - In considering individuals to serve as directors, taxing units should look
for expertise in such areas as accounting, finance, management, personnel
administration, contracts, computers, real estate or taxation. Historical involvement in
local government activities also indicates that someone should make an excellent Board
member.
FREQUENCY OF MEETINGS -The applicable statutes require the board of directors to
meet not less often than once each calendar quarter.

A RESOLUTION REGARDING A LEASE PURCHASE AGREEMENT FOR TIC
PURPOSE OF PROCURING A "UTILITY METERING SYSTEM."
WHEREAS, the City of Sanger, Texas ("the City"), subject to document review by the City's attorney, desires to
enter into that certain Lease -Purchase Agreement dated as of September 19, 2005 by and between the City and

Project"). The Board desires to designate Jack Smith, City Manager, as an authorized signer of the Agreement.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BANGER, TEXAS:
Section 1. That the City enter into aLease-Purchase Agreement with Government Capital
Corporation for the purpose of procuring the UTILITY METERING SYSTEM.
Section 2. That the Lease -Purchase Agreement dated as of September 19, 2005, by and between the
City and Government Capital Corporation is designated by the City as a "qualified tax-exempt obligation" for the
purposes of Section 265 (b) (3) of the Internal Revenue Code of 1986, as amended.
Section 3. That the City designates Jack Smith, City Manager, as an authorized signer of the Lease -

AGREEMENT FOR LEGAL REPRESENTATION
THIS AGREEMENT made and entered into this
day of
2005, between the CITY OF SANGER, Denton County, Texas, hereinafter referred to as the Client,
and Law Office of Steven Poston, P.C., by and through its duly authorized and designated counsel,
Steven Poston, hereinafter referred to as the Attorney; and
WHEREAS, the Client is engaged in the administration of a municipality and related
services and desires the services, advice, and consultation of Attorney concerning the conduct of that
business and related matters; and
WHEREAS, Law Office of Steven Poston, P.C., a Texas corporation, acting by and through
its duly authorized and designated attorneys duly licensed to practice law in the State of Texas and
various federal courts, inter alia, desires to render professional services for the Client as provided
herein.
NOW THEREFORE, the Client hereby engages the services of the Attorney, and in
consideration of the mutual promises herein contained, the parties hereto agree and understand as
follows:
I.
DESIGNATION OF ATTORNEY
Client and Attorney hereby agree that the following individual attorney is to be designated
and hereby duly appointed as set out herein, in the capacity as attorney for Client:

II.
SERVICES OF ATTORNEY
(a) The Attorney will advise the Client and the Client's employees in the regular conduct
of the Client's governmental, quasi -governmental, and proprietary activities, if any,
by telephone and office conferences, both at the Client's facilities and at the
Attorneys office, and the Attorney will prepare and/or review any correspondence or
documents reasonably necessary and incidental to those consultations.
(b) The Attorney will prepare and conduct such appearances, hearings, conferences, and
other proceedings as are appropriate to the advancement of the Client's interests,
including attendance at meetings of City Council, Planning and Zoning Commission,
and Board of Adjustment hearings, as set out elsewhere herein, ail such services to be
rendered according to the fee schedule set out in Paragraph IIl hereof at the hourly
compensation referenced therein.
(c) Services of the Attorney in connection with litigation or adversary proceedings in any
Court or before any administrative agencies brought by or against Client, shall be
provided at the hourly compensation set out in Paragraph IlI hereof, and shall be
conducteA and pursued from time to time as requested by the City Council by
majority vote or other delegation of authority by said Council. Maximum use shall
be made of paralegal time in all matters where appropriate in an effort to control
costs to Client.
III.
COMPENSATION
Client agrees to pay the sum of $125.00 per hour for attorneys() and $60.00 per hour for legal
assistant time rendered.

IV.
DEVOTION OF TIME
The Attorney shall make himself available for consultation pursuant hereto with the Client at
reasonable times upon reasonable notice at the request of the Client. Further, the Attorney agrees to
dedicate sufficient time, within a reasonable period of time after Client's request fora particular
service, in both Attorney and support staff time, to properly and efficiently handle matters entrusted
by the Client to the Attorney.
V.
TERM
This Agreement shall be effective on , 2005, and shall continue in
effect until , 2006, for the initial term only. Thereafter, this Agreement
shall be extended from year to year provided, however, that this agreement may be canceled by either
party hereto at any time during the initial or any renewal term hereof, upon sixty (60) days advance
written notice to the other party. Further, amendments of any type or adjustments in services or
compensation shall not be implemented or effective upon less than sixty (60) days advance written
notice and to be effective not less than one (1) year following any preceding amendment or
adjustment.
VI.
NOTICES
The Client shall send any and all notices to the attorneys office at P.O. Box 1473, Sanger,
Texas 76266, and the Attorney shall send any and all notices to the Client's office at
unless and until either party shall notify the other of a different address.

VII.
CO -COUNSEL
It is agreed and understood that Co -Counsel may be retained upon any terms mutually
agreeable to both parties hereto at any time that it appears to be necessary or beneficial to the interest
of the Client herein. Further, the Attorney herein agrees to use due diligence and best efforts in the
process %J locating and screening said Co -Counsel and recommending said Co -Counsel to Client
herein if or when said Co -Counsel participation is deemed proper or advisable by the Attorney.
VIII.
GOVERNING LAW
The validity of the Agreement and of any of its terms or provisions, as well as the rights and
duties of the parties hereunder, shall be governed by the laws of the State of Texas. Further, all
obligations of all parties under this Agreement shall be performable and deemed entirely performed
and all compensation and expenses earned and payable in Denton County, Texas regardless of where
said services are actually rendered or payments actually made or received.
IX.
AUTHORITY
The undersigned officers and agents of the Parties hereto are the properly authorized officials
and have been granted the necessary authority to execute this Agreement on behalf of the Parties
hereto, and each Party hereby certifies to the other that any necessary resolutions extending said
authority have been duly passed and are now in full force and effect, and the Attorney certifies that
the individual duly licensed attorneys whose services are contracted are actually associated with the
law firm and notice will be provided to Client immediately of any personnel change affecting this
Agreement.

AUGUST 2005 ACTIVITIES

HIGHLIGHTS:
The Denton County Commissioners' Court decided to continue funding libraries for
another year. Funding has been reduced overall by 20%, and they have added a stipulation that
all public access computers be filtered. All of our older computers are already filtered, and the
new ones will be within a few months. Denton County funding for our library will actually
increase from $17,356 to $17,748. The biggest reason for this increase is that Denton Public
Library is no longer accepting funding, so their per capita amount is divided among the
remaining libraries.
