MINUTES: SPECIAL CALLED CITY COUNCIL MEETING Monday May 20, 2005 PRESENT: Mayor Tommy Kincaid, Councilman Glenn Ervin, Councilman Joe Higgs, Councilman Mike James, Councilman Andy Garza, Councilman Mike Lawler OTHERS PRESENT: City Secretary/Assistant City Manager Rose Chavez 1. Mayor called Meeting. 2. Consider and Possible Action to Issue Election Order for Second Election for City Council Place 5 and to Issue Notice of Election. City Secretary discussed the dates for the 2°� election June 1st-7th 2005 early voting and date of election is scheduled for June 11, 2005. Motion was made by Councilman James to issue election order and issue notice of election for June 11, 2005 and early voting to begin June 15t-7t". Seconded by Councilman Garza. Motion carried unanimously. 3. Consider and Possible Action on Appointment of Election Judge and Alternate Judge To Serve as the Early Voting Ballot Board. Motion was made by Councilman James to appoint the following Teresa Gannon -Presiding Judge has worked in the capacity of Presiding Judge in the past in our elections. Sherry Lewis - Alternate Judge - currently serves on the Board of Adjustments. Rose Anne Preston -Clerk - will work only part of the day. She will also work 2 days as a clerk in the Early Voting. Judy Yoast - Clerk Britanny Coffey - Clerk - will work part of the day. The following individuals have agreed to work as clerks during Early Voting: Evelyn Shaw Alice Madden -agreed to work Wed., Thurs., &Fri. Rose Anne Preston - agreed to work Mon., & Tues. Canvass Votes from the Saturday, May 7, 2005 City Election. Mayor canvassed votes as follows: Place 1. Consider and Possible Action to Order an Automatic Recount for Election held May 7, 2005, as Required by State Law. City Secretary explained that the re-count was set up for May 17, 2005 at 8:00 a.m. if Council approved. Councilman Higgs moved to order the automatic recount, Councilman Ervin seconded. Motion carried unanimously. CONSENT AGENDA 4. a) Approve Minutes: May 2, 2005 - Workshop May 2, 2005 b) Disbursements Councilman Garza moved to approve the Consent Agenda as presented. Councilman Ervin seconded. Motion carried unanimously. 5. Citizen's Input. Roy Lemons addressed the Council. He indicated that Dan Thomas, representative of a development company in Dallas, had asked that the land East of town be structured so that he could develop the property. Mr. Lemons explained the this property is being considered for annexation, and he asked the Council to consider looking at the proposal. He indicated there was a similar project in Frisco that he was familiar with, and expressed that if these developments were good enough for other cities that they should be good enough for Sanger. He asked Council to look at the proposal. 6. EXECUTIVE SESSION: In Accordance with Texas Government Code, Subchapter D, Section 551.071 (Consult with City Attorney): a. Edward Wolski v. Denton County, City of Sanger, Sanger Texas Industrial Development Corporation, and Wal-Mart Store East, Inc. Lawsuit Mayor convened into Executive Session at 7:10 p.m. 7. RECONVENE into Regular Session and Consider Action, if Any, on Items Discussed in Executive Session Mayor reconvened into regular session at 7:45 p.m. Councilman Mike James moved that Council gives the authority to the 4A Board and Council to sign legal documents as presented by the attorney, and that the motion include the following two comments: The agreement was fully explained to each party of attorneys before such parties signed the agreement and each party acknowledges that such party fully understands the terms of the legal consequences of the agreements and understands that the parties release in Section 5 shall operate as full complete and official release of settlement in any and all claims, and in Section 8.1 Full Satisfaction the parties understand and agree that no party will receive any other sum of money or legal fees, cost, expenses, taxes, or any other purpose from the other party. Councilman Higgs seconded. Motion carried unanimously. 8. Conduct First Public Hearing to Consider Proposed Annexation of the Following properties: A. ABSTRACT 1066A J.M.A. RUIZ SURVEY, TRACT 129 BEING 195.003 ACRES, AND B. ABSTRACT 1241- HENRY TIERWESTER SURVEY, TRACT 1, BEING 29.808 ACRES, AND C. ABSTRACT 29, REUBEN BEBEE SURVEY, TRACT 565 BEING 200.828 ACRES. Mayor declared public hearing open. John Springer spoke regarding the subdivision proposal on one of these tracts, he indicated Council should re -consider the proposal, and questioned why both public hearings were in the same meeting. Public Hearing closed. 9. Consider and Possible Action on Ordinance # 05-07-OS- Amending the Planned Development Ordinance on Property Legally Described as Lakeridge Estates, Lots 1.22 Block C Phase I, Lots 12-22 Block D, Phase I, Lots 3-5 Block E Phase I, and all lots in future phases II and III. Item Tabled. 10. Consider and Possible Action on Funding the Park Improvement Project. Discussed improvements to downtown park -lighting, parking and sprinkler system. Councilman Higgs moved to accept the proposal. Councilman James seconded. Motion carried unanimously. 11. Conduct Second Public Hearing to Consider Proposed Annexation of the Following properties: (7:30 P.M.) A. ABSTRACT 1066A J.M.A. RUIZ SURVEY, TRACT 12, BEING 195.003 ACRES, AND B. ABSTRACT 1241- HENRY TIERWESTER SURVEY, TRACT 1, BEING 29.808 ACRES, AND C. ABSTRACT 29, REUBEN BEBEE SURVEY, TRACT 56, BEING 200.828 ACRES. Mayor declared public hearing open. Woodrow Barton, 807 N. 7, addressed the Council, he indicated these public hearings had been published two months ago, it was left off of the last agenda, and had to be re- published. He explained that there are some people who want to form a water district, this is a way for them to get cheap money without risks, and without being brought into the City, however, they still want fire and police protection. This development would not be taxed by the City, but they will pay the city so much money for the police and fire. They do not want to follow city regulations, and they want to obligate future buyers to pay for the development. There are other developers taking the risk with their own money. He indicated that he felt the Council should represent the current citizens of Sanger, and not people from outside the city. Public Hearing closed. 12. Consider and Possible Action for 2005 Interlocai Agreement for Property Tax Collection with the Denton County Tax Office. City Secretary explained that there is a ten cent increase per statement, they have not had an increase a since they tools over the tax collection. There are approximately 3400 statements. Councilman Ervin moved to accept the Interlocal Agreement, Councilman Garza seconded. Motion carried unanimously. 13 . MAINTENANCE OF ROADS AND STREETS AND DRAINAGE Maintenance of roads and streets and drainage will be provided within (60) days after the effective date of the annexation on the same basis and at the same level as provided throughout the City. STREET LIGHTING Street lighting will be made available within sixty (60) days after the effective date of the annexation on the same basis and at the same level as provided throughout the City. MAINTENANCE OF CITY PARK AND RECREATION FACILITIES If any city park and recreation facilities are located within the annexed area, they will be maintained within sixty (60) days after the effective date of the annexation on the same basis and at the same level as similar facilities are maintained throughout the city. OTHER SERVICES Other services that may be provided by the city such as planning, code enforcement, animal control, library, park and recreation, court, and general administration will be made available within (60) days after the effective date of the annexation on the same basis and at the same level as provided throughout the city. CAPITAL IMPROVEMENTS Construction of water, sewer, street, and drainage facilities will begin within two (2) years after submissions of written request by landowners and payment of any development fees and construction costs required by the city in accordance with subdivision regulations and water and sewer extension policies. Construction will be completed within four and one half (44/2) years after request unless the construction process is interrupted by circumstances beyond the control of the city. No impact fees will be charged to any developer or landowner within the annexed area except in conformity with V.T.C.A., Local Government Code, ch. 395. Construction of other capital improvements shall be considered by the city in the future as the needs dictate on the same basis as such capital improvements are considered throughout the city. UNIFORM LEVEL OF SERVICES MAY NOT BE REQUIRED Nothing in this plan shall require the city to provide a uniform level of full municipal services to each area of the city, included the annexed area, if different characteristics of topography, land use, and population density are considered a sufficient basis for providing different level of service. TERM This service plan shall be valid for a term of ten (10) years unless the majority of landowners or registered voters of the area vote by petition submitted to the city for disannexation, then this service plan shall no longer be binding upon the city. SUBJECT: Duck Creek Road Drainage Improvements MEMO DATE: May 13, 2005 As requested, we have begun work on the investigation of the drainage issues near the Duck Creek Road area. Since being authorized to proceed, we have met with Mr. Chris Steubing, P.E. with Denton County. He sent us information he utilized to prepare the memorandum provided to the City Council regarding his findings on improvements to the Duck Creek Road Drainage Structure. We have reviewed his data and have scheduled our field survey crews to provide additional topographic data upstream of Duck Creek Road within the Sanger park area. The crews are scheduled to arrive later next week or the following week. Their work should take one (1) day to complete. Upon receipt of the processed data, we will utilize our hydrologic modeling software to develop a plan of improvement for the City upstream of Duck Creek Road. Director of Public Works Date: March 17, 2005 Re: Duck Creek Road at Duck Creek Culvert At your request the Engineering Department has reviewed the data submitted from Teague, Nall and Perkins and has conducted an analysis of the culvert crossing to determine the water surface elevation over the road for the 100-yr design storm frequency. The attached cross section shows the water surface elevation compared to the paving elevation at the centerline of Duck Creek Road at the culvert crossings. You will see that the water surface elevation shown due to the 100-yr event is approximately 3 feet over the road. The calculations were based on the existing developed conditions for the drainage basin identified. The Natural Resource Conservation Service (MRCS) peak discharge methodology was used to develop the total peak runoff for this basin. The total net runoff generated was 2600 cfs. This runoff exceeds the culvert capacity by 5 times and therefore overtops the road at a maximum depth of approximately 3 feet. For the 100-yr design frequency storm, the ultimate improvements would consist of eight (8) 8'x5' box culverts with an approximate cost of $160,000,00, An alternate that was analyzed looked at the installation of three (3) additional Christopher Steubing, P.E. 54 culverts to supplement the existing culverts. This alternate would cost Mgineenng Director approximately $60,000.00 but would only lower the water surface elevation by .5 tielly Mulholland feet at Duck Creek Road due to the size of the drainage basin. In order to lower ,ngineering Tech I the water surface elevation throughout this area the channel would have to be designed appropriately and significantly widened both up and down stream of 'had Guest Duck Creek Road. Anything outside of the ROW should be the City of Sanger's duality Control Tech responsibility and not Denton County. The survey shots that have been taken .obin Freeman -Davis show some siltation of the channel downstream of the culverts. This siltation .dministrative Asst. causes a slight increase in water surface elevation for a short distance but again has no effect on the property in question. This portion of the channel should be graded to drain and promote positive fall away from the road crossing. Page l of 2 Duck Creek Road Drainage Report Denton County, Texas It appears that the storm that occurred during June 2004 did exceed that of the 100-yr design frequency. I have taken a look at the area in question and the residence that was damaged due to the downpours and feel that the Duck Creek Road culvert situation did not cause any flooding to the property in question. From the topographic information available it appears that the structure in question is at an elevation of approximately 660 feet. The top of Duck Creek Road at the lowest point is 648.82 feet. The water surface elevation as shown on the cross section is 651.87 feet. The residence is located at the confluence of a roughly defined channel and two large sub -drainage basins. The channel in this area is heavily overgrown with scrub trees and vegetation that commonly collect debris during heavier rainfall events. A site visit to the area showed debris in trees and shrubs as mentioned indicating the water level in this area. In order to accurately obtain the water surface elevation at this location a more in depth hydraulic analysis should be conducted for the entire channel and drainage basin. Again as stated earlier, the City of Sanger should be responsible for anything outside of the ROW for Duck Creek Road. From the field survey and design analysis of the culvert crossing in relation to the rainfall events studied, I would recommend conducting the downstream clearing and removal of siltation to promote positive drainage away from the structure and to prevent the ponding that is occurring today. From this information it is my opinion that conducting any improvements to the structure would not be justified due to the fact that the upstream properties are not affected by the current condition of the structure during a 100-yr rainfall event. The installation of additional culverts, as stated previously, will not have a significant effect on lowering the water surface elevation in this area and the road will still be overtopped during more frequent rain events. ORDINANCE #OS-07-OS AN ORDINANCE OF THE CITY OF SANGER, TEXAS, AMENDING THE COMPREHENSIVE ZONING ORDINANCE BY AMENDING THE SPECIAL CONDITIONS FOR LAKE RIDGE ESTATES PLANNED DEVELOPMENT GRANTED BY ORDINANCE #09-29-03 TO PROVIDE REAR YARD SETBACKS FOR SINGLE FAMILY LOTS; PROVIDING FOR THE REPEAL OF ALL ORDINANCES IN CONFLICT; PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR A PENALTY OF FINE NOT TO EXCEED THE SUM OF TWO THOUSAND DOLLARS ($25000) FOR EACH OFFENSE; AND PROVIDING FOR AN EFFECTIVE DATE. Section 3. All ordinances or parts of ordinances in conflict herewith are, to the extent of such conflict, hereby repealed. Section 4. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses, phrases and words of this ordinance are severable and, if any word, phrase, clause, sentence, paragraph, or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining portions %J this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional word, phrase, clause, sentence, paragraph, or section. Polly Dwyer and Jerry Jenkins have recommended that Mike Walker be appointed. Mike Walker ran for City Council in our May 7, 2005 election. Jack Smith has recommended Adam Whitfield with Isbell Engineering to be appointed; however, we could not find where Mr. Whitfield is residing. Polly Dwyer and the Mayor have also recommended Jimmy Evans be appointed. There are four openings on this board; however, we are needing these two appointed in order to have a quorum for our next scheduled meeting in June. I have already sent the advertisement to the paper and the other appointments can be made on the June 201" meeting with the other board appointments.
