Discussion on a Residential Development Project from 455 and McReynolds Rd., East of the High School, to Union Road. City Manager introduced the Land Advisors Group and Dan Tomlin to make presentation. Dan Tomlin, Land Advisors 4265 Calway CIT. -Addison, addressed the Council with presentation of his company and their intentions to create a community. Mr. Tomlin introduced several past projects accomplished such as Stone Bridge Ranch, Savannah and Long Star Ranch. He brought forth growth developments from 1950-2004 to show the progress and direction of growth. Mr. Tomlin spoke of amenities such as a hike and bike trail, swimming pools, water slides, amenity center, etc. He indicated a Master Plan could be utilized to lay out the development, amenities and thoroughfares. Therefore a Community is developed not just a subdivision. Councilman Evans indicated concerns of what the low end to high end square footage would be. Mr. Tomlin indicated 1650 sq. ft. $120,fin .(in on low end and 6000-6500 sq. ft. lot. Councilman Evans indicated concerns with the intentions for McReynolds road and other ways to divert traffic. Mr. Tomlin indicated he would definitely be improving the road around the community but that he would also have to look for assistance from the city or the county on roads like McReynolds and FM455. Mayor indicated concerns on who would finance the development. Mr. Tomlin indicated that the Land Advisors Group and the homeowners would pay for this community. He indicated the community would not be taxed by the City because of the bond programs each home owner would be on. He suggested getting district assistance, and said it would help build a future tax base for the city. Discussion. Jimmy Evans discussed the community being in the city limits. Mr. Tomlin indicated he would not in the beginning because of his cost with the bonds. Discussion. 3. Meeting Adjourned. CONSENT AGENDA 2. a) Approve Minutes: February 22, 2005 b) Disbursements Councilman Evans moved to accept the minutes. Seconded by Councilman Higgs. 3. Citizen's Input. Dale Chadwick, President of Sanger Summer League, addressed the Council with an update on Railroad Park. Concession stand and fields are complete. April 9 2005 is opening day at 99.00 a.m. and City Council and the public are invited. 4. Consider and Possible Action on Sect. 6.02 of the Subdivision Ordinance Regarding Street Improvements. Councilman Ervin expressed concerns regarding the streets in the City. He felt the subdivision ordinances should be followed, and the perimeter improvements should be required. City Manager indicated he would get with the City engineer and other departments to ensure everyone is aware of the ordinance and make sure all developers comply. Discussion. No action taken. 5. Consider and Possible Action Regarding Ordinance # 02-04-OS -Amending the City of Sanger's Park and Open Space Requirements. City Secretary addressed the Council and gave clarification in regards to the $75,000.00 that was discussed at the last City Council meeting concerning the Parlcs Board's recommendation. Councilman Ervin inquired if the Parks Board had received the other cities' ordinances on Parks/Playground for subdivisions. City Secretary indicated they received the same information that the Council received. Discussion. Councilman Higgs moved to adopt Ordinance #03-04-OS - Amending the City of Banger's Parks and Open Space Requirements. ORDINANCE 03-04-OS THAT CHAPTER 10, SECTION 6.18 "PARK; OPEN SPACE; RECREATION AREAS, & PUBLIC USE DEDICATION" OF THE CODE OF ORDINANCES OF THE CITY OF BANGER, TEXAS, IS HEREBY AMENDED BY ADDING SUBSECTION L PLAYGROUND REQUIREMENTS; PROVIDING FOR THE REPEAL OF ALL ORDINANCES IN CONFLICT; PROVIDING A SEVERABI.,ITY CLAUSE; PROVIDING FORA PENALTY; AND PROVIDING FOR AN EFFECTIVE DATE. Motion was seconded by Councilman Evans. Motion Carried 4-1. Ervin voted No. 6. Consider and Possible Action Regarding Sewer Main Pro-Rata Reimbursement Agreement. City Manager discussed the $52,037.00 owed to Mr. Shaw by the City of Sanger, for the over sizing of the sewer line from a 12" to a 21 ". City Manager also advised that this money would be taken from Sewer Tap Fee Capital Fund. Lengthy discussion followed. City Manager advised that he will contact Mr. Shaw and get the correct information for the pro rata in regards to other development connecting to the line. Councilman Garza moved to reimburse Mr. Shaw $52,037.00. Seconded by Councilman Higgs. Motion carried unanimously. 7. Consider and Possible Action on Adopting Building Permit Ordinance #03-05-05. City Manager and City Secretary addressed the Council on the adoption of ordinance for 03- OS-O5. She indicated these fees were adopted at the last City Council meeting, but the ordinance still needs to be adopted, and the fees do not go into effect until April 1, 2005. Councilman Evans moved to adopt Ordinance #03-O5-O5 -Amending Building Permit Fees. Caption as follows: AN ORDINANCE OF THE CITY OF BANGER, DENTON COUNTY, TEXAS, AMENDING CHAPTER 3, ARTICLE 3.200, AND APPENDIX ARTICLE 2.000(a), OF THE CITY OF SANGER CODE OF ORDINANCES; AND PROVIDING FOR THE REPEAL OF ORDINANCES IN CONFLICT; PROVIDING A SEVERABILITY CLAUSE; AND, PROVIDING FOR AN EFFECTIVE DATE. Motion seconded by Councilman Higgs. Motion carried 3-2. Councilman Garza and Councilman Ervin voted No. 8. Consider and Possible Action on the Feasibility Study for the Development of a Municipal Golf Course. Discussion regarding the study. Councilman Garza moved to abolish the Feasibility Study for the Development of a Municipal Golf Course. Motion seconded by Councilman Ervin. Motion carried unanimously. 9. Consider and Possible Action on the Appointment of Election Judges. City Secretary addressed the Council with a nomination of Polly Dwyer as Election Judge, Nel Armstrong as alternate judge, with two clerks working in shifts. Glen Ervin moved to appoint Polly Dwyer as Election Judge and Nel Armstrong as alternate. Motion was seconded by Councilman Lawler. Motion carried unanimously. 10. Consider and Possible Action on Resolution No. 03-01-OS for Setting Date, Time and Place for Public Hearing on Proposed Annexations: A. Abstract 1241, Tierwester Survey, Tract 2, Being 103.99 Acres, Old Denton County Appraisal District Sheet 6, Tract 1. B. Abstract 725 S.F. Lynch Survey, Tract 13A, Being 15.6924 Acres, Old Denton County Appraisal District Tract 2C. City Manager indicated the attached map showed the acreage for annexation. Councilman Garza moved to adopt Resolution No. 03-01-OS for Setting Date, Time and Place for Public Hearing on Proposed Annexations. Motion seconded by Councilman Evans. Motion carried unanimously. 11. Consider and Possible Action on Resolution #03-02-05, Concerning an Upper Trinity Regional Water District's Long -Range Water Supply Planning Efforts. City Manager indicated that this Resolution concerns planning for long range water supply for Upper Trinity's customers for the next 50 years as required by Senate Bill One. Upper Trinity is building a new lake and this resolution supports long term planning. Councilman Higgs moved to adopt Resolution #03-02-05. Motion seconded by Councilman Evans. Motion carried unanimously. 12. Consider and Possible Action on Moving Sewer Line on Sable Creek Property. City Manager addressed the Council and indicated that Mr. Joe Smith and Mr. January, representatives for Sable Creek, checked the County records and found that the sewer line that runs north of McReynolds and runs through the Sable Creek addition was put in more than 20 years ago. There is no easement on record. A commitment was made by a company, already on -site, to install a new manhole, reroute the line, and tie in with a 15" line. They will go underneath Ranger Creek without disturbing it. This will be done for a cost of $24,900.00, Discussion on the bid and the name of the company. This company is on site installing the infrastructure for Sable Creek. Councilman Ervin inquired as to now many feet of the line needs to be moved. Mr. Smith addressed the Council indicating there would be 460 ft. of line to connect into the existing sewer line and removal of 180 ft. of existing line underneath the lots. Councilman Ervin expressed concerns regarding the need for Council to have this information in the packet. Councilman Higgs inquired if the line would be removed and a new line installed for $24,900. City Manager and Water/Wastewater Superintendent both stated the removal of the old line and installation of the new line would be covered for the agreed amount. Councilman Lawler asked if the line could be flushed and capped. Mr, Joe Smith, developer of this property, indicated this line could not be flushed. Mr. Smith stated he has contacted the EPA, County Engineers, etc., but they all say the line must be removed. Discussion on statue of limitations; the line has been there for over 20 years. City Manager indicated that the City Attorney recommended the line be moved. Mr. Joe Smith indicated he would allow the city an easement, if needed, once the line has been moved, if part of the line is on his property. Councilman Evans moved to accept the $24,900.00 for the installation of the new line and removal of the old line. Seconded by Councilman Higgs. Motion carried unanimously. 13. Meeting adjourned. These funds are for cost share reimbursements for a tanker. David Pennington, Fire Chief, has requested a proposal from Government Capital which is attached that is an estimated cost for a tanker. David Pennington will be at the meeting to address this item. This grant will not impact our expenses in this budget year. Fire Department Assistance Program Guidelines For Equipment Cost -Shares A. Requirements for cost -share are: 1. The volunteer fire department must be chartered, have 20 or fewer paid members and have a federal tax identification number. 2. If the department is using a. city or county tax. I.D. number, the city or county name must be listed on the vendor invoice along with the VFD name. In this .case, the check for cost -share payment will be issued listing both the VFD and the city or county. 3. The fire department must make formal application' for cost -share assistance by submitting an Application for Rural Fire Defense Assistance (Form FO-400) and a completed IRS W-9 - Form..___,:._ _ - - --- -- - 4. The fire department will be notified in writing when the request is approved. Following notification, the department may purchase the requested equipment. 5. A purchase made before the grant approval date will not be eligible for reimbursement. B. Responsibilities of the fire department following notice of grant approval: 1. Locate and purchase the requested item or items following notification of approval. 2. Provide the TFS with a copy of all vendor invoices and evidence of payment and please fax to 979-845-6160. 3. For those items with designated minimum requirements, the invoice or statement should indicate specifics of the required components. 4. The fire department must place decals (furnished by the TFS) on slip-on units and vehicles. 5. Rescue Equipment includes jaws of life, extrication tools, air lifting bags, etc. It does not include SCBA's7 PPE, entry tools, etc. 2. The purchase of pre -owned vehicles and equipment will be approved only on a case -by -case basis. All vehicles must be insured with Collision and Comprehensive insurance coverage for a period of 5=years following the date the vehicle is acquired. Coverage must be for "Actual Cash Value." If the vehicle is lost, insurance receipts must be used to purchase a replacement vehicle. 2. All department personnel must be trained in the proper operation and maintenance of trucks, pumps, systems, and related equipment. Personnel training must be documented. 3. All vehicles must be owned and maintained by the original acquiring department for 10 years, If a vehicle is sold before its 10th anniversary, the Department must reimburse the Texas Forest Service in cash equal to 90% of the gross sale receipts. 4. All vehicles must meet the minimum standards described in the attachment "Minimum Standards And Specifications For Firefighting Vehicles." 5. An "Affidavit of Non -Collusion" must be completed, signed, and. notarized by the Seller of a vehicle. The Fire Department must mail the completed affidavit to the Texas Forest Service before a grant reimbursement may be paid. 6. Departments are strongly encouraged to add capabilities and features as required to meet local needs. WEIGHT AND BALANCE The fully loaded.and equipped operating weight of the vehicle must not exceed the Gross Vehicle Weight Rating (GVWR) of the vehicle as determined by the manufacturer, nor the Gross Axle Weight Rating (GAWR) of the vehicle as determined by the manufacturer. The vehicle weight must be balanced so that the vehicle is easy to control The vehicle center=of-gravity must be low enough to safely operate in curves and on slopes. The vehicle must have effective brakes that can stop the vehicle without brake fade: TANKS All vehicles must have a water tank with a rninirriurn capacity of 200 gallons. All water tanks must be baffled. ARTHURWEMMAN March 14, 2005 City Council, City of Sanger 201 Bolivar Sanger,Texas 76266 Sanger Presbyterian Church Foundation Design Revisions The bid for new foundation and for floor structure restoration of this project was received November 17, 2004 from Mike James of Tekton in the amount of $83,666, This amount significantly exceeds the budget. Mr. James suggested to Jack Smith; City Manager, and to myself in conference on November 23, 2004 that he can reduce his price significantly if we reduce the foundation depth to one foot below the soil surface. The Geotechnical Engineer, Ron Reed, recommended four fleet #oundation depth below the surface to control the vertical sinking of grade beams and spread footings common in your soil type. To save money, in our conference of March 10, 2005 you asked us to reduce this to 12 inches depth. If we control 0 surrounding vegetation, direct water runoff away from the building and maintain moist soil conditions during periods of drought, differential movement (unequal movement from end to end or side to side) can be controlled, but yearly foundation and building firaming maintenance will be required. You requested in our conference of March 10, 2005 chat we prepare the following modifications to the contract documents. These modifications have been prepared with revision date 3.11 V05V Your offices will submit these revisions to the Contractor with a request for price, as an alternate to reduce the project cost to meet the City budget. These revisions include: • Foundation depth (bottom face of foundation grade beam or fovfiing) at 12 inches minimum below existing or compacted grade. Overall grade beam height shall remain 24 inches minimum. • Alternate use of concrete filled round tube forms, with reinforcing, instead of reinforced concrete block for interior floor structure supports • Top and bottom of the exterior grade beam at the side of the sloping floor may follow the floor slope as long as grade beam height is 24 inches minimum. DIRECT EXPENSES. C&B's Direct Expenses shall be those costs incurred on or directly for the CLIENT's Project, including but not limited to necessary transportation costs including mileage at C&B's current rate when its automobiles are used, meals and lodging, laboratory tests and analyses, computer services, word processing services, telephone, printing and binding charges. Reimbursement for these expenses shall be on the basis of actual charges when furnished by commercial sources and on the basis of usual commercial charges when furnished by C&B. 4. OUTSIDE SERVICES. When technical or professional services are furnished by an outside source, when approved by CLIENT, an additional amount shall be added to the cost of these services for C&B's administrative costs. 5. COST ESTIMATES. Any cost estimates provided by C&B will be on a basis of experience and judgment. Since C&B has no control over market conditions or bidding procedures, C&B does notwarrant that bids or ultimate construction costs will not vary from these cost estimates. 6. PROFESSIONAL STANDARDS. C&B shall be responsible, to the level of competency presently maintained by other practicing professionals in the same type ofwo, in CLIENT's community, for the professional and technical soundness, accuracy, and adequacy of all design, drawings, specifications, and other work and materials furnished under this Agreement. C&B makes no warranty, expressed or implied. 7. ADDITIONAL SERVICES. Services in addition to those specified in Scope of Services will be provided by .C&B if authorized in wrng or otherwise confirmed by CLIENT. LIMITATION OF LIABILITY. C&B's liability to the CLIENT for any cause or combination of causes is in the aggregate, limited to an amount no greater than the fee earned under this Agreement. 10, DISPUTE RESOLUTION. All disputes arising out of this Agreement shall be mediated by the parties within a reasonable time after the first request for mediation, prior to either party filing a suit in a court of law, provided, however, that neither party shall be obligated to mediate prior to requesting injunctive relief. 11. ASSIGNMENT TO RELATED ENTITY. Notwithstanding anything in this Agreement to the contrary, in the event C&B is not qualified and licensed in the relevant jurisdiction to provide any Services required hereunder, C&B may, without the consent of any other party, assign all or any part of its obligation to provide such Services to an entity related to C&B which is qualified and licensed to provide such Services in the jurisdiction involved and which is contractually bound to C&B to provide such Services. 12 PAYMENT TO C&B /INTEREST ON PAST -DUE AMOUNTS, Monthly invoices will be issued by C&B for all Services performed under the terms of this Agreement. Invoices are due and payable net 15 days. CLIENT agrees to pay interest at the rate of 1'/z%per month on all past -due amounts, unless not permitted by law. Any interest charged or collected in excess of the highest legal rate will be applied to the principal amount owing to C&B, and if such interest exceeds the principal balance of CLIENT's indebtedness to C&B, will be returned to CLIENT. It is the intent of C&B and CLIENT to abide by all applicable laws regulating the maximum amount of interest that may be charged. CLIENT shall also be responsible for all costs associated with collecting any past -due amounts. To the greatest extent allowed by applicable law, CLIENT and C&B agree that in the event CLIENT and C&B enter into any compromise or settlement calling for the payment of past due principal and accrued and unpaid interest on any past -due invoice, C&B may charge and CLIENT agrees to pay interest on such combined past due principal and accrued and unpaid interest amount (the "New Principal Balance") at the rate of 1'/2% per month or at the highest rate allowed by law, subject, as provided herein, to C&B's agreement to credit excess interest or return same to CLIENT after the New Principal Balance is paid. All payment obligations are performable In Tarrant County, Texas, and CLIENT agrees to submit to the jurisdiction of the courts of the Stpre of Texas in Tarrant County, Texas for enforcement of all obligations created by this r+ ment. 13 C&B'SRIGHT TOSUSPEND SERVICES, IfCLIENT fails topay any amount due C&B under this Agreement, C&B may, in addition to any other rights afforded under this Agreement or at law, suspend Services. Prior to suspending Services, C&B will provide CLIENT with written notice that C&B will suspend Services unless said failure to pay is cured within 7 days from CLIENT'S receipt of C&B's notice. If CLIENT does not cure the problem within such 7- day period, C&B may suspend Services under this Agreement. In the event of a suspension of Services, (a) C&B shall have no liability to the CLIENT for delay or damage caused the CLIENT because of such suspension of Services, (b) any periods for completion of work shall automatically be extended by the period of such suspension, and (c) before resuming Services, C&B shall be paid all sums due prior to suspension and any expenses incurred in the interruption and resumption of the Services. C&B's compensation for the remaining Services and the time schedules shall be equitably adjusted. If the Project is suspended for more than 30 consecutive days, (x) C&B shall be compensated for Services performed prior to notice of such suspension, (y) when the Project is resumed, C&B shall be compensated for expenses incurred as a result of the interruption and resumption of C&B's Services, and (z) C&B's compensation for the remaining Services and the time schedules shall be equitably adjusted. To the extent CLIENT'S failure to pay is related to a dispute between the parties, the dispute will be resolved in accordance with Article 10. 14. TERMINATION FOR NON-PAYMENT OF FEES. C&Bmayterm(natethisAgreementby giving written notice if any C&B invoice remains unpaid for more than 30 days. C&B's right to terminate this Agreement shall not be waived by C&B's continued performance during any period of investigation by C&B to determine the reasons for CLIENT'S nonpayment. 15. TERMINATION. Either CLIENT or C&B may terminate this Agreement with or without cause by giving 7 days' written notice to the other party. In such event CLIENT shall forthwith pay C&B in full for all work previously authorized and performed prior to effective date of termination. If no notice of termination is given, relationships and obligations created by this Agreement shall be terminated upon completion of all applicable requirements of this Agreement. 16. LEGAL EXPENSES. In the event legal action is brought by C&B to enforce any of the obligations hereunder or arising out of any dispute concerning the terms and conditions hereby created, CLIENT shall pay C&B reasonable amounts for fees, costs and expenses as may be set by the court. 17. SEVERABILITY. In case anyone or more of the provisions contained in this Agreement shalI be held illegal, the enforceability of the remaining provisions contained herein shall not be impaired thereby. 18. SURVEYING SERVICES. In accordance with the Professional Land Surveying Practices Act of 1989, CLIENT is informed that any complaints about surveying services may be forwarded to the Texas Board of Professional Land Surveying, 7701 North Lamar, Suite 400, Austin, Texas 78752, (512) 452-9427. Similar laws in other states may give CLIENT similar rights where surveying services are performed outside the State of Texas. In accordance with applicable sales tax law, certain surveying services may be taxable. 19. ELECTRONIC MEDIA. (a) As a component of the services provided under this Agreement, C&B may deliver electronic copies of certain documents or data (the "Electronic Files") in addition to printed copies (the "Hard Copies") for the convenience of CLIENT. CLIENT and its consultants, contractors and subcontractors may only rely on the Hard Copies furnished by C&B to CLIENT. if there is any discrepancy between any Electronic File and the corresponding Hard Copy, the Hard Copy controls. (b) CLIENT acknowledges that Electronic Files can be altered or modified without C&B's authorization, can become corrupted and that errors can occur in the transmission of such Electronic Files. CLIENT agrees that it will institute procedures to preserve the integrity of the Electronic Files received from C&B until acceptance. CLIENT further agrees that it will review the Electronic Files immediately upon receipt and conduct acceptance tests within thirty (30) days, afterwhich period CLIENT shall be deemed to have accepted the Electronic Files as received. C&B will undertake commercially reasonable efforts to correct any errors in the Electronic Files detected within the 30-day acceptance period. C&B shall not be responsible to maintain the Electronic Files after acceptance by CLIENT. (c) C&B does not warrant or represent that the Electronic Files will be compatible with or useable or readable by systems used by CLIENT or its consultants, contractors and subcontractors. C&B is not responsible for any problems in the interaction of the Electronic Files with other software used by CLIENT or its consultants, contractors and subcontractors. Professional Services Agreement,— City of Hackberry Revised 12-09-03 ATTACHMENT "A" SCOPE OF WORK Carter &Burgess, Inc. ("C&B") will provide General Professional Services as requested by the Client to include, but not be limited to the following: ENGINEERING SERVICES: 1. Review concept plans, preliminary and final plats, developer agreements, construction plans, etc. for developments within the Client's jurisdiction. Provide written comments to the Client. Reviews shall be completed within ten (10) working days after receipt of documents at the C&B office. Prior to providing the documents to C&B for review, the Client shall examine the documents to insure that all items required by applicable Ordinances -and policies have been provided. 2. Provide engineering design for Client projects including new, improvements, upgrades, expansion or additions tothe water, wastewater, water revs_ e, street, drainage, storm water, and park systems -and facilities. 3. Attend Client meetings, as requested. 4. Represent the Client in communications with Developers and/or their engineers or representatives. This includes telephone, email, fax, and meetings. 5. Assist in situations involving CCN boundaries, ETJ limits, corporate boundaries, etc. 6. Provide hydrologic and hydraulic modeling, analysis and design and prepare FEMA flood studies. 7. Represent the Client in matters concerning government and quasi -government agencies such as Texas Commission on Environmental Quality (TCEQ), Texas Department of Transportation (TxDOT), Environmental Protection Agency (EPA), Corps of Engineers (COE), other municipalities, counties, Utility Districts (SUD, MUD), Fresh Water Supply Districts (FWSD), etc. 8. Provide expert testimony for legal issues involving the Client. PLANNING SERVICES: 1. Assist the Client in developing ordinances relating to zoning, land use, development standards, construction standards, etc. 2. Develop comprehensive plans involving water, wastewater, land use, zoning, drainage, thoroughfares, parks, etc. 3. Provide services for park and recreation development including planning, � landscape architecture, facilities, infrastructure, trail/greenway planning, etc. SURVEY SERVICES: 1. ENVIRONMENTAL SERVICES: 1. Provide environmental services including design, planning, permitting, expert testimony, monitoring and remediation. Several years ago a presiding Council entered into an agreement to maintain utility lines at the Sanger Mobile Home Park. In order for this to legally be correct, easements were granted to the City. The City Attorney has recommended several times that the City needs to abandon these easements because the City is still on private property.
