MINUTES: CITY COUNCIL NOVEMBER 1, 2004 PRESENT: Mayor Tommy Kincaid, Councilman Jimmy Evans, Councilman Glenn Ervin, Councilman Mike Lawler. MEMBERS ABSENT: Councilman Joe Higgs and Councilman Andy Garza. OTHERS PRESENT: City Manager Jack Smith, City Secretary/Assistant City Manager Rose Chavez, Office Supervisor Paula Morales, Electric Superintendent Mike Prater, Alice Madden, Carolyn Frasier, Evelyn Eaton, Bea Eaton, Steve Eaton, Matthew Eaton; Wrenda Freeman; John Springer; Liz Springer; Shelley Ruland; Barbara Shepard, and Brenda Davis. 1. Mayor Called Meeting_ to Order, led the Invocation, followed by the Pledge of Allegiance. CONSENT AGENDA 2. a) Approve Minutes: b) Disbursements Motion made by Councilman Ervin to approve Consent Agenda. Seconded by Councilman Lawler. Motion carried unanimously. 3. Citizen's Iuput. Carolyn Frasier introduced some members of the Keep Sanger Beautiful, Wrenda Freeman and Alice Madden. She also introduced Matthew Eaton, his parent's Steve and Evelyn Eaton, and his grandmother Bea Eaton. She advised that Matthew had recently organized a clean up of Sullivan Cemetery as his Eagle Scout Project. Matthew logged 250 hours and there were 33 volunteers. Mrs. Frasier indicated the results were unbelievable. Carolyn Frasier presented Matthew with a "Make a Difference" award plaque from Keep Sanger Beautiful for his efforts in beautifying the community. 4. Consider and Possible Action on Appointing a Member to -the 4B Board. Motion made by Councilman Evans to appoint Tommy Kincaid to the 4B Board. Seconded by Councilman Lawler. Motion carried unanimously. 5. Consider and Possible Action Regarding Resolution #1144-04 Lease Purchase Agreement for the Purpose of Procuring Municipal Software System. Motion was made by Councilman Evans to approve Resolution #1144-04 Lease Purchase Agreement for the purpose of procuring municipal software system. Seconded by Councilman Lawler. Motion carried 2 to 1 vote with Councilman Ervin voting no. 6. Consider and Possible Action Regarding Ordinance #11-25-04 Prohibiting Drilling and Mining in Switzer Park III.. This item was tabled for the next City Council meeting on November 15, 2004. 7. Consider and Possible Action on Ordinance #11-26-04 -Amending the Requirements for Fire Alarms and Sprinkler Systems in Commercial Buildings. ORDINANCE #112604 THAT CHAPTER 3, ARTICLE 3.2100 REQUIRING FIRE ALARMS AND WATER SPRINKLERS FOR CERTAIN COMMERCIAL BUILDINGS OF THE CODE OF ORDINANCES OF THE CITY OF SANGER, TEXAS, IS HEREBY AMENDED; PROVIDING FOR THE REPEAL OF ALL ORDINANCES IN CONFLICT; PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR A PENALTY; AND PROVIDING FOR AN EFFECTIVE DATE. Motion was made by Councilman Evans to approve Ordinance #11-26-04. Seconded by Councilman Lawler. Motion carried unanimously. 8. Consider and Possible Action on Inter -local Agreement for Library Services with Denton County. Motion was made by Councilman Evans to approve Inter -local Agreement with Denton County for library services. Seconded by Councilman Evans. Motion carried unanimously. 9. MEMO November 4, 2004 o: Planning and Zoning Commission �Fr: Samantha Renz Re: OT Sanger LEE M lots 4A & 4B Attached is the information regarding this request. The last letter received from the engineer was the September 11, 2004 letter that is attached. He recommends denial in this letter due to the lot depth and the portion of lot 1 that remains unplatted. Lot 1 does not belong to Mr. Looper. I spoke with the City Attorney regarding this issue, and he indicated that Mr. Looper cannot replat the remaining portion of the lot because he does not own it. He recommended that the developer bring in a copy of the deed showing he owns the south portion of the lot and.that the city allow him to plat the portion that he owns:_ This will correct the illegal subdivision of this lot;: however, lot 1 will still be illegally. subdivided.,: This lot will have to be platted before any building permits can be issued. This land was illegally sold by metes and bounds in 1990. The only way to correct the problem is through platting. This plat will correct part of the problem. The City Engineer gave verbal approval of this replat since we have received the warranty deed and the tax certificate. The property owner is requesting a variance on the lot depth. The city engineer is out of town and could not write his approval letter. Council expressed at our last meeting that they wanted to be given enough time to consider any Board appointments. I have had a recommendation from Carroll McNeill to consider Fred Yeatts as a possible nominee. Fred served on the Board of Adjustment for six years prior to moving outside the city limits. It is not a requirement that the members of the 4A Board reside inside the city limits. Jerry Jenkins made a recommendation to consider Bob Montgomery. Please mark this on your calendar as it will be on the agenda December 6, 2004. The connection will be free as long as it is used for public access to the Internet. If the library uses it in the future for library uses, such as putting our catalog on the web, then they will charge us. In the meantime, it will be used for wireless access to the Internet for the public ADMINISTRATION: Submitted the Plan of Action to the State Library for this year's Loan Star grant. It will be used to update computers and computer equipment and to provide the hardware for the wireless access. Consulted with Tina Hager from Little Elm and Kathy Gilson from Aubrey in applying for a cooperative public awareness grant on behalf of the Denton County Library Advisory Board. Kathy wrote most of the grant, although I wrote the demographics section. Meetings attended: Support Staff meeting, 10/7, Flower Mound (attended by Lynne Smiland) Friends of the Library, 10/12 NTRLS Technology Committee Meeting, 10/20, Grapevine Denton County Library Advisory Board, 10/21, Little Elm COLLECTION: Updated many reference materials and travel guides by replacing them with copies purchased at the Fort Worth Public Library booksale.
