Lot Width: The width of a lot shall be not less than twenty-four (24) feet at any point for a single family attached unit and eighty (80) feet as measured along the front building line for a multi -family unit. c. Lot Depth: The depth of a lot shall be not less than one hundred twenty (120) feet at any point. 3. Minimum Dwelling Size: family attached dwelling unit shall be one thousand (1000) square feet, exclusive of garages, breezeways and porches. The minimum floor area of a multi -family unit shall be seven hundred fifty (750) square feet per unit. 4. Lot Coverage: In no case shall more than forty percent (40%) of the total lot area be covered by the combined area of the main buildings and accessory buildings. 18.4 Parking Regulations: Two and one-half (2.5) off-street parking spaces shall be provided per unit. Required parking may not be provided within the required front yard. Off street parking spaces shall be provided in accordance with the requirements set forth in Section 32. 18.5 Refuse Facilities: Every dwelling unit in amulti-family complex shall be located within two hundred fifty (250) feet of a refuse facility, measured along the designated pedestrian and vehicular travel way. There shall be available at all times at least six (6) cubic yards of refuse container per thirty (30) multi -family dwelling units. For complexes with less than thirty (30) units, no less than four (4) cubic yards of refuse container shall be provided, three sides from persons standing at ground level on the site or immediately adjoining property, by an opaque fence or wall of wood or masonry not less than six (6) feet nor more than eight (8) feet in height or by an enclosure within a building. Refuse containers shall be provided and maintained in a manner to satisfy city public health and sanitary regulations. Each refuse facility shall be located so as to provide safe and convenient pickup by refuse collection agencies. 18.6 Border fencing of wood or masonry, not less than six (6) feet in height shall be installed by the builder at the time of construction of any multi -family complex, along the property line on any perimeter not abutting a public street or right-of-way. We have had a situation, where an individual has covered his entire yard with concrete and caused drainage problems for his neighbors. We would like to prevent this in the future. For all single family zoning categories, the current ordinance states: D. Maximum Lot Coverage: Forty percent (40%) by the main building; Sixty percent (60%) by main building, accessory building, driveway and parking. The City Attorney has recommended that we add or any other concrete, flatwork, etc. The Planning and Zoning recommended that it be added to all SF categories except SFl. The confusion was that in our code it only has the 40%; however, in another section of our code it does state the 60%. If council accepts, we will bring an ordinance at the next meeting for approval. CAPITAL IMPROVEMENTS Construction of water, sewer, street, and drainage facilities will begin within two (2) years after submissions of written request by landowners and payment of any development fees and construction costs required by the city in accordance with subdivision regulations and water and sewer extension policies. Construction will be completed within four and one half (44/2) years after request unless the construction process is interrupted by circumstances beyond the control of the city. No impact fees will be charged to any developer or landowner within the annexed area except in conformity with V.T.C.A., Local Government Code, ch. 395. Proposed facilities considered are presented below. Development of the Clear Creek Wastewater System The timing of development of the wastewater system in the Clear Creek Basin is dependent on the projected population growth and development in the basin. As previously discussed, the City of Sanger already has a projected population within the city and immediate area over a 20-year period. These projections along with TWDB projections for the basin outside the city are used as the basis for projecting the wastewater flows to a new plant. The combined population being projected for the total area studied within Denton County is approximately 30,000, In 2005, see Table 2, the potential wastewater flow is 1.03 MGD and in 2010 the projected wastewater flow is 1.27 MGD. Additional developments within the immediate area of the city of Sanger Ere projected for construction by 2013. The projected basin wastewater flow in 2015 is 1.90 MGD, most of which is coming from within subbasins 2 and 3. By 2020 and 2025, the wastewater flows are projected to be 2.09 MGD and 2.91 MGD, respectively. As previously mentioned, a new plant at the selected site will be needed as soon as possible to accept diverted flows when the Sanger plant reaches permitted capacity. It is assumed the existing Sanger plant will treat an average flow of 0.90 MGD. Wastewater flows greater than 0.90 MGD will be diverted to the new WWTP. Therefore, the wastewater flows to the new plant will be 0.13 when it comes on line and 0.37, 1.00, 1.19, and 2.01 MGD in years 2010, 2015, 2020, and 2025, respectively. A 0.5-MGD plant is recommended to be on line as soon as possible at the new site. An expansion of 0.5 MGD will be required about 2010. A second 0.5-MGD expansion would be required about 2015. In about 2022, the plant would need to start expansion to accommodate additional flows. It is assumed that the existing plant will continue to operate. At any point a decision could be made to phase out the existing plant. At that time, an additional 1.0 MGD of capacity will be required. A graph of projected design flows to the new WWTP at the selected five-year intervals and the expected capacity needs are depicted in Figure 2. 7 F:\projects\449\3601\Doc\Final_Report\Sanger Reportdoc 5/12/2004 ALAN PLUMMER ASSOCIATES, INC The collection system will have to be expanded to the new plant. The City has already planned capital improvement projects including lift stations and sewer mains to the new plant site. As development increases in each outlying basin, local developers will need to build sewer systems that would direct the main flow towards the new plant. To collect flow from the various systems within each subbasin, a major interceptor is proposed. Development Outside the Immediate Service Area of Interceptors It is possible and maybe even probable that a developer may propose a development in an outlying subbasin at a location where the construction of a major interceptor is not economically feasible. In that case, we recommend that the Authority take the position that a permit for a package plant would not be protested provided that Authority and the developer developed an agreement which provided for the package plant to be removed when interceptor capacity becomes available. PROJECTED CAPACITY REQUIREMENTS The noncumulative and cumulative :flows anticipated over the next 20 years from the subbasins, in geographic order starting at the downstream end of the Clear Creek Basin, are listed in Table 4. The projected average flows were totaled for each five-year period starting in 2005. The highest density of development, as described above and also evident in Table 4, will occur in the immediate area of Sanger in subbasins 1, 2, and 3. The cumulative flow of subbasins 1, 2, and 3 will provide the majority of the flow within the basin and, therefore, the expanded collection system planned by the City in these areas will provide the capacity to deliver these increased flows to the existing and a new WWTP. The remaining subbasins will require separate collection systems to deliver flows from west of the city to the new WWTP. Collection systems within each subbasin would be constructed by the local developers to deliver flows to the major interceptor. This sewer main could be constructed to divert flows to a new 18-inch interceptor along Clear Creek sending flows to the new WWTP. In Phase 1 an 18-inch interceptor would extend approximately 7,500 linear feet (LF) from the new WWTP to subbasin 3 (the Duck Creek confluence into Clear Creek) and would serve flows from subbasins 2 and 3. Phase 2 would require approximately 18,000 LF of 15-inch diameter pipe to extend the interceptor from subbasin 3 through subbasin 4. Phase 3 would extend a 12-inch line approximately 36,500 LF from subbasin 4 through subbasin 6 to serve the upper portion of the basin. This system along with the collection system in subbasins 1 and 2 would have sufficient capacity until almost 2020. At that time, the 18-inch interceptor would need to be paralleled with at least a 24-inch pipeline. The size would be determined by calculating the next 20 years of projected flow at that time. Following construction of the parallel to the 7,500 LF 18-inch section, the 18,000 LF 15-inch section would be paralleled. As stated above, the size should be determined at that time based on available population projections. 11 F:\projects\449\3601 \Doc\Final_Repoxt\Sanger_Report.doc S/12/2004 ALAN PLUMMER ASSOCIATES, INC trees, permitting may require an area wider than 504eet be left in native state. The extent of buffer areas to be preserved will need to be determined during the preliminary design. Avoiding jurisdictional, wetlands, and riparian cover areas will minimize required mitigation that can add significant cost to the project. An opinion of cost for Section 404 permitting is included in the preliminary opinion of probable project cost. The new WWTP and the proposed collection system for the Sanger area and Clear Creek Basin will be constructed in phases. The total preliminary opinion of probable cost for the WWTP and the interceptor through 2025 is approximately $27,500,000 in 2004 dollars. The following table, Table 6, presents the opinion of probable cost for the phased construction of the interceptor and the new WWTP to be constructed south of Sanger along the BNSF railroad north of Clear Creek. Construction start and end dates for individual project phases have been assumed, and total costs for each phase as presented on the following page are in present value terms (2004 dollars). The preliminary opinion of probable cost is approximately $4,250,000 in 2004 dollars for the first section of the interceptor and the initial 0.50-MGD plant. In 2010, the second section of the inceptor would be constructed, and the WWTP would be doubled in size to 1.0 MGD for an additional $5,610,000 in 2004 dollars. Additional phases constructed from 2015 to 2025 are also listed. Project costs may vary depending on market conditions at the time of construction. 13 F:\projects\449\3601 \Doc\Final_Repoxt\Sanger_Repoxt.doc 5/12/2004 ALAN PLUMMER ASSOCIATES, INC RECOMMENDATIONS Through reconnaissance of wastewater treatment options for Sanger and the Clear Creek drainage basin, it was determined that phased development of a new VWVTP and regional interceptor will provide for the successful incorporation of the northwester . Denton County and Sanger CCN area into UTRWD's regional wastewater system. The following recommendations resulted from the study: Phase I • Initiate design and construction of a new 0.5 MGD VVWTP south of Sanger to provide wastewater treatment to be on line as soon as possible. This would include the development of a master plan of the VWVTP site to accommodate at least 5.0 MGD of treatment capacity. • Develop a route study, and design and construct an 18-inch wastewater collection line approximately 7,500 feet from the new VWVTP site to the approximate confluence of Duck Creek and Clear Creek. This would require that the City of Sanger construct their 15-inch line from basin drainage 3A south to the Clear Creek Interceptor instead of easterly route shown on their existing master plan. Phase II • Prepare a conceptual design report for the remainder of the Clear Creek collection system. I understand that Mr. and Mrs. Summers were not happy about the sewer backup claim -- they filed being denied. I understand they came to a council meeting and insisted that the City Manager advised them that the damages would be taken care of by the City. Apparently the claimants taped the City Manager making this statement. I would highly recommend and suggest that you all ask the Summers to produce this alleged tape so that you all may hear for yourselves exactly what was said in the conversation. I also understand that the City Council is insisting that this claim be paid. The law that governs liability against a governmental entity, the Texas Tort Clazms Act, prescribes exactly when and how a govenuiiental entity may be held liable for someone's damages. A City is .immune from a person's property damage unless they waive that immunity by. causing the property damage by its use of motorized equipment. In this particular claim, the sewer backup occurred due to excess rainwater in the sewer system at the time. The sewer was unable to handle the volume of water that infiltrated the pipes and as such, had nowhere to go but into the claimants' home. There was no use of motorized equipment to cause the Summers' damages and as such, denial was proper based on no waiver of immunity. The Risk Pool will not be able to make payment for this claim. Should the City decide that it wants to take care of the Summers' damages, I would suggest that prior to making payment, that you all ask them to produce the tape where the City Manager told them that the damages would be paid for by the City. Also, I would highly recommend that if you do make a payment, that you have them sign the enclosed Release for whatever amount you all agree to settle for. I understood that you all were considering having a City crew perform this work. From a risk management standpoint, I would not advise this activity. This can create all sorts of liability issues that could make a bad situation even worse. If the City decides that it wants to pay for replacement of the service line, I would suggest that you have the Summers select an independent contractor to perform the work who is licensed and bonded and carries insurance. This will protect the City in the event there is a problem. - - Finally, I am 'enclosing samples of sewer backup reports from two different cities that may be helpful to you in handling your own sewer backups. As I advised, the City of Paris used to have the oldest sewer system in the State of Texas. They have over the last several years upgraded and replaced all of their old clay pipe lines and have virtually eliminated most of their problems. Before -they -replaced their lines, they experienced a very large volume of claims and developed the attached form to address each and every backup. The information on this form is basically what the Risk Pool requires as far as investigation of the claim. "Further, they have a computer -database that lists this information so that if prior records are needed at a later date, they are able to be recovered.
