Councilman Evans moved to approve the Consent Agenda, Councilman Higgs
seconded, Motion carried unanimously.
3. Citizen's Input.
Phil Waters, 206 S. 3rd Street, indicate with the recent work on the streets their were
considerable changes made to his property after he spent several thousand dollars on
landscaping. His indicated his concern was that since they hooked them up to the new
sewer main, they have had problems with sewage back up. Recently they had a
problem with the sewer backing up into the home. The plumber's bill was $140.00. He
discovered the problem was in the main and his equipment was not big enough to
correct the issue. His plumber said that the City workers ran 200 feet of cable into the
line and hit mud, they ran it a second time to clear it. Since that time it has been clean.
His plumber told him it was the main sewer line. He spoke to Rose when he received
the bill. At first, they indicated the problem was in the line, he was told that it was
probably something from his line that blocked the main. He was then told that the city
did not monitor the sewer line, and that he was responsible for the bill. His tax dollars
pay for the new sewer line, and he felt it should be the city's responsibility.
Mayor indicated he would look into it.
City Secretary explained it was turned over to TML, the city's insurance carrier.
4. Issue Election Order for May 15, 2004 Election.
Councilman Evans moved to Issue the Election Order for the May 151 2004 Election.
Councilman James seconded, Motion carried unanimously.
5. Conduct Public Hearing to Consider a Zoning Change from AG (Agriculture and MF2
(Multifamily - 2) to B2 (Business) and SF7 (Single Family 7) on property legally
described as Abstract 29, Reuben Bebee Survey, Tract 64 and part of Tract 63.
Property is located between F.M. 455 and McReynolds Road, West of the High School
site and Indian Lane.
Public Hearing opened.
No Discussion.
Public Hearing closed.
6. Consider and Possible Action Regarding a Zoning Change from AG (Agriculture and
MF2 (Multifamily - 2) to B2 (Business) and SF7 (Single Family 7) on property legally
described as Abstract 29, Rueben Bebee Survey, Tract 64 and part of Tract 63.
Property is located between F.M. 455 and McReynolds Road, West of the High School
site and Indian Lane.
City Manager indicated this come before Planning aand Zoning and was approved
unanimously.
Councilman James asked if there was any reason they chose B2 instead of B1.
Melvin January, engineer for the property developer, indicated they chose B2 to allow
a Home Depot or Lowe's or something of that nature.
Councilman James asked what size home was SF7.
City Manger indicated down to 1200 square feet.
Mr. January indicated they will be requesting a variance an the lot width, some of the
lots will be 60 feet wide.
City Manager indicated the minimum lot size is 7000 square foot, and advised they will
have to specify a letter for the home size.
Joe Smith indicated 1250 square foot minimum was what he was told.
City Manager asked if he had a problem with a 1350 square foot minimum on the home
size.
Joe Smith indicated he did not.
Councilman James moved to change the zoning from AG and MF2 to B2 and SF7F on
property legally described as Abstract 29, Rueben Bebee Survey, Tract 64 and part of
Tract 63. Property is located between F.M. 455 and McReynolds Road, West of the
High School site and Indian Lane. Councilman Garza seconded. Motion carried
unanimously.
7. Consider and Possible Action on Final Plat for Quail Run, Phase 2. Located off of
Cowling Road.
City Manager indicated the Planning and Zoning Commission also unanimously
approved this.
Councilman Higgs moved to approve the Final Plat for Quail Run, Phase 2.
Councilman Garza seconded. Motion carried unanimously.
8. Consider and Possible Action on Resolution #O1-03-04 -Providing for Exemption from
the Inscription Requirement for Unmarked Police Vehicles,
Police Chief indicated any police or city vehicle without markings cannot have exempt
tags. This is a formality, it is required for the police department to be able to apply for
regular plates.
Councilman Garza moved to approve Resolution #O1-03-04. Councilman James
seconded. Motion carried unanimously.
9. Consider and Possible Action on Ordinance #O1-03-04 -Amending the Metal Building
Ordinance.
Item tabled for changes to Ordinance.
10. Consider and Possible Action on Ordinance #02-04-04 -Amending the Park and Open
Space Requirements.

City Manager indicated we have allowed developers to utilize detention/retention
ponds for parks, this will at least require a trail and benches.

Consider and Possible Action on Real Estate Matters.

concerning Real Estate, of the local government code at 7:02 P.M.

Eddie Branham will address this item. This is for the line extension to tie F.M. 455 into Marion
Rd. and to loop back to the main from the Walmart overhead. Due to the growth East and North
of town this is necessary for fire protection. This item was budgeted in the 2003/2004 Capital
Improvements Plan; however, this bond has not issued.
Attached is the construction estimate for this item. The total estimate is $177,085.73.

Jerry Jenkins, Chairman of this board, is contacting these alternates to see who would be willing to
serve full time.

THAT CHAPTER 3, ARTICLE 3.1700, "METAL BUILDINGS", IN THE CODE OF
ORDINANCES OF THE CITY OF SANGER, TEXAS, IS HEREBY AMENDED,
PROVIDING FOR THE REPEAL OF ALL ORDINANCES IN CONFLICT;
PROVIDING A SEVERABIL,ITY CLAUSE; PROVIDING FOR A PENALTY; AND
PROVIDING FOR AN EFFECTIVE DATE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SANGER, TEXAS:
Section 1. That Chapter 3, Article 3.1800 of the Code of Ordinances, City of Sanger,
Texas, is hereby amended to read as follows:
"ARTICLE 3.1700 METAL BUILDINGS
3.1701 Use of Metal Buildings Restricted
(a) This section establishes use of metal building requirements in zoning districts
134, B-25 13-3, and within All Zoning Districts within 250 feet of the Service
Road along IH-35 on the East and the West and all Specific Uses which specify
that the requirements of this section be met.
(b) The exterior walls of the building shall be constructed of materials other than
metal which includes and is limited to: stone, cast stone, stucco, brick,
limestone, granite, or native stone with the exception of windows and doors.
A maximum of ten (10} percent of the building facade visible from the
designated street may be comprised of "split face" concrete block. An
alternative building material consistent with the appearance of the materials
listed above may be approved upon recommendation of the City Administrator
to the Planning and Zoning Commission and City Council."
Section 2. All ordinances or parts of ordinances in conflict herewith are, to the
extent of such conflict, hereby repealed.
Section 3. It is hereby declared to be the intention of the City Council that the
sections, paragraphs, sentences, clauses, phrases and words of this Ordinance are severable
and, if any word, phrase, clause, sentence, paragraph, or section of this Ordinance shall be
declared unconstitutional by the valid judgment or decree of any court of competent
jurisdiction, such unconstitutionality shall not affect any of the remaining portions of this
Ordinance, since the same would have been enacted by the City Council without the
incorporation in this Ordinance of any such unconstitutional word, phrase, clause, sentence,
paragraph, or section.
Section 4. Any person, firm, or corporation who shall violate any of the provisions
of this article shall be guilty of a misdemeanor and upon conviction shall be fined in
accordance with the general penalty provision found in Section 1.109 of this Code.
Section 5. This ordinance will take effect immediately from and after its passage
and the publication of the caption, as the law and Charter in such cases provide.

b. Any area that does not meet the grant requirements of the State of Texas,
Department of Parks and Wildlife.
2. Drainage areas may be accepted as part of a park if no significant area of the park
is cut off by access to such channel and if suitable improvements may be made
within the area without unreasonable cost by the City.
3. Each park must have direct access to public streets.
4. Any detention/retention pond used as part of the open space requirement must be
approved by the city and must have a 4' wide sidewalk around the entire premises
of the pond and must have minimum 4` benches placed on concrete pads and spaced
not more than 500' apart."
Section 2. All ordinances or parts of ordinances in conflict herewith are, to the

Attached are the proposed Resolutions on this item from the tax attorneys. Also attached is a map
showing the location of the properties. The tax attorneys have not been able to sell these properties
at the market values indicated. These Resolutions will allow them to lower the market value in
order to be able to sell them. At one time, the Council discussed possibly trying to purchase the
property in Indian Springs. No action was ever actually taken to proceed.

HIGHLIGHTS:
The microfilms of the Sanger Courier have been checked to make sure that everything
that we own was actually filmed. Those back issues that were not filmed plus some that have
been recently donated will soon go to be microfilmed along with the 2003 issues.

Hosted the Denton County Library Advisory Board meeting for the month.

"The Sillies" was the Storytime theme for January. The children had lots of fun with
programs each week: "Inside, Outside, Upside Down", "Peek, Peek, Hide and Seek", "Mixed -Up
Creatures" and "Monster Bash".

Re: Claim for Phil Waters
Mr. Waters came to the Council at the last meeting regarding his sewer problem. We submitted the
claim to TML and they denied it. TML representatives have advised that if the city pays this claim
after being advised by them that the City is not liable, that we will be setting a precedent and will
open the door for more extensive problems in the future.
Attached is a copy of the letter from TML to Mr. Waters and the letter we submitted to TML
regarding the claim.

This letter is in regard to the claim that you have made against the City of Sanger for the above -referenced matter.
3ased on the facts revealed in our investigation of this claim, it appears that the City of Sanger has no legal liability
in this matter. The City is legally immune from liability for the property damage claim being brought against it as
afforded the City by common law of Texas. Although the Texas Tort Claims Act waives this immunity under
certain circumstances, the facts of your case and the damages which you seek do not fall under any of the waivers
set forth in this Act. For this reason, we must respectfully deny this claim in its entirety.

Dear Claims:
Enclosed is an incident report that occurred on January 19, 2003. Mr. Waters was told by his
plumber that this sewer problem was at the maim. Our employees did go to the address at 206 3'
Street. They first inspected the line at the main, which was running and apparently did not seem
to be blocked. They proceeded to run the jet sprayer through the line on the property owner's
property. The line was run for about 3 feet on the property owner's side. Enclosed are the
statements I received from the employees and from Mr. Waters.
