MINUTES. CITY COUNCIL - WORKSHOP
JANUARY 20, 2004
PRESENT: Mayor Tommy Kincaid, Councilman Joe Higgs, Councilman Jimmy Evans,

1. Mayor Called Meeting to Order.
2. Discussion Regarding a Proposed Planned Development Presentation by Centurion
(Rick Ezzell)
Kirk Wilson addressed the Council representing both development groups. He
indicated there was a commercial portion and a residential portion of the development.
Terry, addressed the council, and indicated along TH-35, on the East side, North of the
City Limits. He showed a plan with the different areas. They were looking at 3
different lot sizes. He indicated there would be a couple of different access points.
They were looking at about 1100 residential lots, and 50 plus acres of commercial.
Discussion continued regarding the layout.
Councilman Evans asked if the property would be brought into the City limits.
Mr. Wilson indicated there were two proposals, and one would bring it into the city,
it will depend on the choice that the Council makes.
Discussed sewer service.
Discussed lot sizes.
Discussed drainage.
Councilman James asked if they find it difficult to sell homes that backup to railroad
tracks.
Ross Calhoun, Centurion Development, indicated they have a subdivision in Los
Colinas that backs up to a Railroad track, they also have one in Saginaw. If they don't
sell them, they will make the lots deeper and put up some type of burn to help with
noise.
Mr. Calhoun indicated they try to put in walking trails and water features, thy use it
as a transition feature from the large homes to the smaller homes.
Discussed electric service would be provided by the City of Sanger.
3. Discussion Regarding a Proposed Planned Development Presentation by K.D.
Development (Johnson/Payne),
Kirk Wilson indicated that Greg Edwards is the project engineer for Sanger Ranch,
which is owned by Bob Johnson and Richard Payne.
Greg Edwards indicated this property is about 290 acres, and is just West of IH-35,
South of Lois Road. They are proposing about 60 acres of high density use along MH 35.
It is a mixture of commercial and multifamily. The wester portion of the property will
have open space, and they have a potential school site. They are thinking the primary
market will be 50' x 110' lots. They are proposing about 900 lots, and will have some
varying sizes. From a drainage stand point the open spaces and amenity feature will
be used for detention facilities.
Mayor asked about density.
Mr. Edwards indicated the overall density was about 3 lots per acre.
Discussion regarding detention ponds and drainage.
Councilman James indicated he liked the idea in the first plan of having varying size
lots.
Discussed lot sizes.
Kirk Wilson indicated they have been told it is the intention of the City to service the
sewer in the area. He indicated that they are willing to negotiate the transfer of the
water certificated area from Bolivar to the City of Sanger.
Discussed water service.
Mr. Wilson indicated that one proposal is to bring the entire development into the City
limits, and then they will float bonds to reimburse the items listed in the letter. The
other option is not to annex the residential portion, only annex the commercial, and
annex a ten foot tract around the entire development, and allow the residential to stay
out until the bonds are paid.
Mayor indicated both plans propose funds coming back to them from the City through
tax rebates or reimbursements. He did not like the idea.
Discussion continued regarding the development.
Mr. Wilson indicated he could go to TCEQ, plat the property, make a district and build
this development without working with the City.
Discussion regarding sewer service.
Councilman James indicated the developer should bear the cost of the development.
It appeared they were trying to get the City to help with the costs of development.
Mr. Wilson indicated they are not asking the City to pay any of the cost.

Councilman James indicated they are requesting a reduction in taxes, and in his
opinion that is subsidizing something.
Mr. Wilson indicated this type of subdivision is very competitive and will finish out a
lot quicker and have a better appearance than other subdivisions. There will be a
variety of things that will have a higher level of finish out because of the available
funds.
Councilman James asked where the funds were coming from.
Mr, Wilson indicated it would come from bonds, and the bonds would be paid out of the
tax assessments.
Discussion regarding the project continued.
Mr. Wilson indicated the commercial areas will develop quicker with the additional
roof tops.
Councilman Evans indicated he felt they should pay taxes like everyone else.
Mr. Wilson indicated they would not agree to that.
Discussion continued regarding taxes.
Mayor indicated he did not see how the City would benefit from this.
Mr. Wilson indicated the commercial area would not develop without roof tops. If they
take the commercial up front, and leave out the residential, the commercial area will
develop faster, and this will expedite the benefits to the City.
Discussion regarding the commercial development.
Discussion regarding taxes and bond issue.
Councilman James indicated he saw the value of the additional roof tops. It will help
the community long term. He did not feel that they were giving them enough time to
each agreement by stating they would like it accomplished by January 30'h. He
indicated he did not want to make a decision in two weeks. He did not think that was
ample time for the Council to make a decision.
Mr. Wilson indicated they did not have a problem giving them whatever additional
time they needed to review the proposals.
Discussion regarding fire and police protection.
Councilman Evans indicated he felt they need at least one more workshop to discuss
this.
Councilman Higgs asked where other subdivisions were located that were similar to
this.
Mr. Wilson indicated there were two on 380 in Denton. Providence and Savannah are
both East on 380.

Discussion continued regarding locations of previously developed subdivisions.
Discussion regarding scheduling of a future workshop.
Workshop scheduled for Tuesday, January 26 at 6:00 p.m.
Councilman James asked for a list of subdivisions similar to what was being proposed.
Mr. Wilson indicated he will give them a list of projects, but will then talk about what
type of amenities they were proposing for the one in Sanger.
Discussion followed.

Councilman Evans moved to approve the Consent Agenda, Councilman Garza
seconded, Motion carried unanimously.
3. Citizen's Input.
Mike Dobrovolsky expressed concerns regarding the parking on Bolivar Street. He
indicate the angle of the lots did not allow enough parking. He asked the Council to
consider options for more customer parking.
Council indicated a workshop should be scheduled to discuss this.
4. Consider and Possible Action on a Final Plat for Fallmeadows, Phase III. Property is
Located within the City of Sanger's E.T.J.
Mayor asked if the Planning and Zoning Commission had approved this.
City Manager indicated they had.
Brief Discussion.
Councilman James moved to approve the Final Plat for Fallmeadows, Phase III.
Councilman Evans seconded. Motion carried unanimously.
5. Consider and Possible Action on Architectural Study for Downtown Area and Sidewalk
Repair.
City Manager indicated when this was brought up previously, there was a group
working on a proposal for downtown. At that time the Mayor requested they bring it
back to the Council in January; therefore it was put on this agenda. There has been
preliminary work done on wheelchair access to the drugstore. They need to visit with

the downtown group to determine what their plan is before they proceed with repairs
at the drugstore.
Discussion regarding the sidewalk in front of the drugstore and possible grant funds.
Councilman Higgs indicated he felt they needed some type of plan, and indicated the
Keep Sanger Beautiful Board was already working on a plan, and he felt they should
get with them.
John Springer addressed the Council concerning the sidewalks on Bolivar Street. He
indicated there is a lot of interest from the University. He has been visiting with
Gayalnd Howell, President of the Alumni Association, and he is willing to help them
with projects and he has several other people willing to help as well. He indicated there
were individuals in Sanger who had the expertise to assist with infrastructure and
possible engineering. He indicated they were looking at taking the artist's plan and
consider using it to form the permanent plan. If they could do a project plan, even in
phases, it should satisfy the immediate needs and the needs of the future.
Discussion followed.
Council agreed to schedule workshop for Thursday, January 29"' at 7:30 p.m.

Attached is a letter from Phil Waters regarding a sewer problem. He requested to be on the agenda,
we advised him that he could address the Council under Citizen's Input. We have forwarded the
invoice, employee statements and his statement to TML and are awaiting a response. We have been
advised in the past that the city is not liable for sewer stop -ups unless it is due to negligence by the
City. If contractors, hired by the city, cause the stop -ups while doing construction work, we do
request the contractor reimburse the citizen. This was not due to negligence or caused by one of our
contractors. The water department has indicated the stop -up was on the property owners side of the
line.

money and I would like a full discussion on this.

Dear Mr. Smith:
Per your request I have reviewed a a Final Plat for and Construction Plans for Quail Run, Phase
Two as submitted by Dowdey, Anderson & Associates, Inc. Comments are referenced by the
Subdivision Ordinance of the City of Sanger, Texas as adopted September 21, 1987, Zoning
Ordinance adopted August 3, 1987, and Ordinance No. 05-0&01. My review comments are as
follows:
Final Plat:
• All Existing Easements should be shown on the Plat.
• The Point of Beginning should be shown on the Plat.
• The first two call -outs on the metes and bounds description should be shown on the Plat.
Construction Plans:
Plate No. 3
• On the Plan view for First Street, the note for station 6+15.01 identifies a detail on sheet
6 of 6 for a street header, which is not shown on sheet 6 of 6.
• On First Street at Station 6+15.01 future grade needs to be transitioned to existing grade.
• How will drainage be provided at station 6+15.01 at the end of First Street? It appears
that it will pond.
Plate No. 4
• On the profile view of Ringneck Drive, it identifies a compacted fill, the specifications
for the compacted fill need to be provided.

exceeds the capacity of the pipes. From the calculations it shows an excess flow of 21.6
cfs. How is this excess flow dealt with?

A RESOLUTION OF THE CITY COUNCIL, OF THE CITY OF
SANGER, TEXAS, PROVIDING FOR EXEMPTION FROM THE
INSCRIPTION REQUIREMENT FOR UNMARKED POLICE VEHICLES
AND OTHER VEHICLES USED TO PERFORM AN OFFICIAL DUTY;
REQUESTING REGULAR LICENSE PLATES FOR SUCH VEHICLES;
AND PROVIDING AN EFFECTIVE DATE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANGER,
TEXAS:
SECTION 1, That the City Council hereby exempts from the requirements of Section
721,004 of the Texas Transportation Code the automobiles listed in Exhibit "A" when used to
perform an official duty or by the police department.
SECTION 2. That Jack Smith, City Manager, shall request the Texas Department of
Transportation to issue specially designated license plates for the exempt vehicles listed in
Exhibit "A."
SECTION 3. That this Resolution shall take effect immediately from and after its
passage, and it is accordingly so resolved.

Attached is the proposed Ordinance. This is the same ordinance as previously presented. Council

ORDINANCE 01-03-04
THAT CHAPTER 3, ARTICLE 3,1800, "METAL BUILDINGS", OF THE CODE
OF ORDINANCES OF THE CITY OF SANGER, TEXAS, IS HEREBY
AMENDED TO RESTRICT THE USE OF METAL BUILDINGS; PROVIDING
FOR THE REPEAL OF ALL ORDINANCES IN CONFLICT; PROVIDING A
SEVERABILITY CLAUSE; PROVIDING FOR A PENALTY; AND PROVIDING
FOR AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SANGER,
TEXAS:
Section 1. That Chapter 3, Article 3.1800, Section 3.1801(a) of the Code of
Ordinances, City of Sanger, Texas, is hereby amended to read as follows:
ARTICLE 3.1800 METAL BUILDINGS
3.1801 Use of Metal Buildings Restricted
(a) This section establishes use of metal building requirements in zoning districts
B-1, 13-21 13-3 and for all Specific Uses that specify that the requirements of
this section be met.
(b) The exterior walls of a metal building shall be constructed of materials other
than metal, including and limited to stone, cast stone, stucco, brick,
limestone, granite, or native stone.
A maximum of ten per cent (10%) of the building facade visible from the
designated street may be comprised of "split face" concrete block. An
alternative building material consistent with the appearance of the materials
listed above may be approved, upon recommendation of the City Manager
and the Planning and Zoning Commission, by the City Council."
Section 2. All ordinances or parts of ordinances in conflict herewith are, to the
extent of such conflict, hereby repealed.
Section 3. It is hereby declared to be the intention of the City Council that the
sections, paragraphs, sentences, clauses, phrases and words of this Ordinance are
severable and, if any word, phrase, clause, sentence, paragraph, or section of this
Ordinance shall be declared unconstitutional by the valid judgment or decree of any court
of competent jurisdiction, such unconstitutionality shall not affect any of the remaining
portions of this Ordinance, since the same would have been enacted by the City Council
without the incorporation in this Ordinance of any such unconstitutional word, phrase,
clause, sentence, paragraph, or section.
Section 4. Any person, firm, or corporation who shall violate any of the
provisions of this article shall be guilty of a misdemeanor and upon conviction shall be
fined in accordance with the general penalty provision found in Section 1.109 of this
Code.
Section 5. This ordinance will take effect immediately from and after its passage
and the publication of the caption, as the law and Charter in such cases provide.

RECREATION AREAS & PUBLIC USE DEDICATION", IN THE CODE OF
ORDINANCES OF THE CITY OF SANGER, TEXAS, IS HEREBY AMENDED;
PROVIDING FOR THE REPEAL OF ALL ORDINANCES IN CONFLICT;
PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR A PENALTY, AND
PROVIDING FOR AN EFFECTIVE DATE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SANGER, TEXAS:

Department of Parks and Wildlife.
2. Drainage areas may be accepted as part of a park if no significant area of the park
is cut off by access to such channel and if suitable improvements may be made
within the area without unreasonable cost by the City.
3. Each park must have direct access to public streets.
4. Any detention/retention pond used as part of the open space requirement must be
