Consider and Possible Action on a Preliminary Plat for Ridgecrest North, Phase II-B, and Phase III. Property is located within the E.T.J. 6. Consider and Possible Action on Licensing Agreement with NCTCOG for Aerial Photography. 7. Consider and Possible Action on Appointment of Street/Tho�•oughfare Committee. 8. Consider and Possible Action on Resolution #12-16-03 -Authorizing, and Setting Date, Time and Place for Public Hearing on Systemwide Land Use Assumptions and Capital Improvement Plan for the Designated Water/Wastewater Service Areas Under Which and Impact Fee May be Imposed. 9. Any final cti�n, decision or -vote on such matter will be made in open'session followmg.,the conclusio f the S�iLecutiv s (On. � Ii/ n:� ,^ iv ci December 15, 2003 MINUTES: CITY COUNCIL December 1, 2003 PRESENT: Mayor Pro-Tem Andy GaIZa, Councilman Mike James, Councilman Glenn Ervin, Councilman Joe Higgs ABSENT: Mayor Tommy Kincaid, Councilman Jimmy Evans OTHERS PRESENT: City Manager Jack Smith, City Secretary/Assistant City Manager Rose Chavez, Water/Wastewater Superintendent Eddie Branham, Police Chief Curtis Amyx, Justin Epker, Rodney Mahoffey, Rick Smith, Liz Springer, John Springer, Georgia Royal, Larry Jors 1. Mayor Pro-Tem Garza called Meeting to Order, led the invocation which was followed by the Pledge of Allegiance. 2. CONSENT AGENDA a) Approve Minutes: November l- 7, 2003 b) Disbursements Motion was made by Councilman Erwin to approve Consent Agenda. Seconded by Councilman James. Motion Carried unanimously. 3. Citizen's Input: Georgia Royal addressed City Council regarding the possibility of installing Christmas lights at Cammie Patton Park. She indicated that it might be too late to do it this Christmas but maybe it could be considered for next Christmas. They have small children that play in the park City Council requested this item be on the next city council agenda. Troy Waldrop, residing at 921 N. 8"', addressed City Council on whether anything had been done or action taken in regards to the lightning in his neighborhood. Mike Prater, Electric Superintendent, advised that it was up to the individual property owner. They just need to come to City Hall and request a security light, sign a contract. The cost is about $7.61 a month. Mr. Waldrop also inquired as to the robberies. He indicated that he understood there had been a couple more. Chief Erwin indicated that was not correct. Mr. Waldrop also inquired as to what action had been taken in regards to crime prevention in his area. Discussion. Mike Waldrop indicated he and his neighbors would like to set up a neighborhood crime watch. Councilman Garza indicated the "Neighborhood Night Out"was started a few years back and they could participate in it. Police Chief indicated he would get him information on who to contact. 4. Consider and Possible Action on Resolution #12-14-03- Authorizing the Award of a Contract for Administration Services and Soft Cost Project Management Services for the Home Investment Partnership Program ( Home) for the program ,years 2002, 2003, and 2004. Justin Epker, Grantworks, indicated this will cover the projects thru 2004. City Manager indicated these are owner -occupied homes. Discussion regarding the program. Discussed that homes would be 888 square feet. Mike James moved to approve Resolution #12-14-03. Councilman Ervin seconded. Motion carried unanimously. 5. Consider and Possible Action on Resolution #12-15-03 - approving HOME Program Policies and Procedures, Affirmative Marketing Policy, Texas Minimum Construction Standards and Construction Specification Manual for the HOME Owner Occupied Program. Discussion. Larry Jors asked if the Council was going to waive the square footage requirements and the brick requirements. He was concerned because he was at a previous meeting where they had discussed the brick requirements and the requirements were not waived. Council indicated they would. Councilman Ervin moved to approve Resolution #12-15-03. Councilman James seconded. Motion carried unanimously. 6. Consider and Possible Action on a Sign Variance on Property Legally Described as Ray Roberts Plaza, Block A, Lot 2. The Variance is for Subway. Rodney Mahoffey, Starlite Signs, indicated the Subway store was built 6 months ago. They would like to put up a 60 foot illuminated sign at a cost of about $25,000.00. They are hoping to get some additional business from the highway. The existing monument sign that is there is already filled up. If it wasn't filled up, you can't see the sign from the highway anyway. Discussed that sign would be able to be seen from both the North and the South from the highway. Discussion. Councilman Higgs moved to approve the variance. Councilman James seconded. Motion carried unanimously. City Secretary advised the Council that staff would be bringing them an ordinance to change the variance procedures so that in the future they would go before the Board of Adjustments. 7. Conduct Second Public Hearing on the Following Proposed Annexations: METZ ESTATES, BLOCK 1, LOTS 1-6, AS RECORDED IN THE DEED RECORDS OF DENTON COUNTY, TEXAS; AND ABSTRACT 1241, TRACT 65A (1), BEING 1.4132 ACRES IN DENTON COUNTY TEXAS; AND ABSTRACT 1241, TRACT 67, BEING 0.057 ACRES IN DENTON COUNTY TEXAS; AND ABSTRACT 1241, TRACT 8, BEING 242.275 ACRES IN DENTON COUNTY TEXAS; AND ABSTRACT 1241, TRACT 330, BEING 390.387 ACRES IN DENTON COUNTY TEXAS. Public Hearing opened. Larry Jors indicated he was opposed to his properties being annexed. Public Hearing closed. 8. Consider and Possible Action on Longevity Pay for the City Employees. City Manager addressed this item. He indicated in the past we have paid longevity pay. This has been on -going for numerous years. Staff felt it was something that should be put in the personnel policy. He indicated staff had checked with other cities and the $4.00 per month is the norm. He indicated they wanted the Council to be aware of it. Councilman Garza asked if this was just to make it official. QUU'J.l Councilman Ervin indicated he did not have a problem with it, but wanted to know what the numbers would be. Councilman James indicated he would like to see it in the budget as a separate line item. Councilman Garza asked why would they want to cap it. City Secretary indicated she had been here 27 years, and other department heads had been at the city for numerous years as well, and they did not want the Council to think it was for them. They want it for the employees. Councilman James indicated he did not think there should be a cap on it. Councilman James moved to authorize staff to proceed with incorporating longevity pay into the personnel policy at $4.00 per month and not to have any cap on the months of service, and that in next year's budget it be shown as a separate line item. Councilman Ervin seconded. Motion carried unanimously. 9. Consider and Possible Action on Appointments to the Parks Board. We have already ordered the photos; however, they need this agreement before they will send them. LICENSING AGREEMENT BETWEEN THE NORTH CENTRAL TEXAS COUNCIL OF GOVERNMENTS AND THE CITY OF SANGER, TEXAS WHEREAS, the North Central Texas Council of Governments (NCTCOG) has an interest in assisting local governments in providing information for planning, engineering, public safety, and municipal management; WHEREAS, the City of Sanger, Texas (Entity), wishes to have its map -based information system include the most current digital aerial photography and has determined that the creation of this resource provides information for a multitude of uses throughout the Entity and thus serves a valid public purpose, WHEREAS, the Entity requires this information to accomplish this purpose and has determined that NCTCOG can fulfill this need, and NCTCOG is willing to reciprocate, and NOW THEREFORE, the parties, Entity and NCTCOG, agree to the following terms and conditions regarding the creation of digital aerial photography. I. LICENSE AGREEMENT The following provisions are a license agreement between NCTCOG and the Entity with respect to data products that are identified in Appendix A. The personnel specified in Appendix B will serve as points of contact for their respective organizations. NCTCOG is the owner of and has the right to grant a license to use the said data products free of all liens, claims, encumbrances, and other restrictions and without otherwise violating any rights of any third party, including any patent, copyright, trade secret, or other proprietary rights. The NCTCOG data product may be distributed to the Entity on CD-ROM or other media described in the documentation. The Entity will need to install and operate the NCTCOG data product on properly configured and compatible computer equipment running third party system and application software supplied by the Entity. The Entity will also need to insure that any required data not supplied by NCTCOG is in proper format and no other software or equipment having an adverse impact on the NCTCOG product is present. A. Licensed Operating Environment (1) Operating Equipment. In exchange for monetary consideration described in the Authorization Letter, the Entity will be granted an exclusive operation license to install, store, load, execute, and display (collectively, "Use") the NCTCOG data product on as many local area networks and/or end -user workstations as the Entity reasonably needs in support of its own operation (the "Licensed Operating Environment"). Any software components of the NCTCOG data product are provided in machine-readable executable format only. (2) Authorized Users. Unless otherwise agreed in writing, the NCTCOG data product will be used by Entity officials, officers, employees, and authorized contractors only ("Authorized Users"). A contractor shall be deemed authorized to Use the data products by the Entity or NCTCOG if such Use is incidental to a larger relationship between the contractor and the Entity, and is used for purposes no greater than reasonably needed to achieve the objectives of an actual project undertaken in connection with that relationship. The contractor must agree in writing to be bound by the provisions of this Agreement. B. Permitted Uses (1) Use of NCTCOG Products. The Entity's Authorized Users may Use the NCTCOGdata product in the Licensed Operating Environment for any use that furthers the Entity's internal operations or in furtherance of the Entity's mission. (2) Use of Generated Output or Other Data. Except as stated, the Entity will own all original works of authorship it may independently create. Digital output from the Entity's Use of the NCTCOG Data Product may be resized as desired and printed on black and white, color printers, or map plotters. Such printed hardcopies may be distributed to the Entity's officers, employees, citizens, contractors, or other persons in the regular course of business for their internal use or in connection with an actual transaction. Such printed output may be further copied, photographed, or reproduced digitally on the Internet. The Entity may charge a fee for such hardcopy printouts that exceed the actual direct cost of production. Without the prior written consent of NCTCOG, the Entity may not otherwise provide copied, digitized, reproduced, transmitted or disseminated, in whole or in part, any of the original digital data product in any form. (3) Mandatory Copyright Notice. Any permitted printing or reproduction of output material generated by the N%d I ka data product requires a copyright notice. As a courtesy to the participating Entity, the copyright notice can include the Entity name. This funding has strengthened Denton County libraries since 1985, especially small libraries. ADMINISTRATION: Computer issues caused problems this month. An older laser printer is balking. And some network issues are preventing some PCs from connecting to the Internet and preventing other PCs from accessing the color printer. Sam Renz, IT person from city hall, will be helping resolve these issues. Meetings attended: Public Library Standards Task Force meeting, 11/7, Austin Library Board meeting, 11/11 Denton County Library Advisory Board, 11/20, Roanoke PC Troubleshooting Workshop, 11/21, Fort Worth SPECIAL PROJECTS: The Friends of the Library in collaboration with the Sanger Area Historical Society received notification that they will get a grant from the Denton Benefit League. The grant will be $2000 toward the purchase of a microfilm reader/printer. Stanley Lovelace has maintained the Library flower beds as a public service for several years. He notified us this month that he can no longer afford to do so. His contribution will be missed. PROGRAMS "Family" was the Storytime theme for November. Programs on "Parents", "Kids", "Aunts, Uncles and Cousins" and "Grandparents" were enjoyed by those who attended. Attendance fell from the first of the month to the last. The cause may be illness or perhaps the busyness of the season. Box 1729 Sanger, TX 76266 Dear Ms. Elieson, During the budget process for 2004 I expressed my concerns regarding the high level of library funding currently provided by Denton County. After the budget process was finished, I requested my staff complete a survey to determine how Denton County compared to other counties in this regard. Neighboring counties and other counties with similar populations were included in the survey. Counties that have their own library systems were excluded. The results of the survey are attached for your review. Of the eight counties included in the survey, only Denton and Collin continue to provide funding based on a "per capita" farmula5 while three counties (Tarrant, Hidalgo, and Williamson) provide no funding at all. Three other counties (Dallas, Grayson, and Cameron) provide funding based on a flat rate determined on criteria other than "per capita". You will notice that both the total dollar amount, and the "per capita" rate, provided by Denton County are significantly higher than any other county included in the survey. Denton County's actual per capita rate is $ f .56 (this includes $10,000 to each library that was originally intended to be "seed" money, but has remained in the budget). The closest competitor to Denton County is Cameron County's per capita rate of .49, which is three times less than Denton County! For 2004, the Grayson County Commissioners Court reduced their amount of library funding by 50%, and intend to reduce it another 50%next year. Dallas County is operating under a policy that decreases the amount provided each year until it will eventually be eliminated. I am of the opinion that the taxpayers of Denton County have provided this funding at an excessive level for many years and certainly at an excessive level compared to other counties. Therefore, the dine has come to begin eliminating this funding and I wanted to make sure you were given notice to begin planning for such a reduction.
