1. Mayor called meeting to Order and led the Invocation, Councilman Evans led the
Pledge of Allegiance.

2. a) Approve Minutes: March 3, 2003

Councilman Evans moved to approve the Consent Agenda as presented, Councilman
James seconded. Motion carried unanimously.
3. Citizen's Input;
None.
4. Consider and Possible Action on Resolution #03-08-03 -Authorizing Submission of the
Application for the 2003 HOME Grant Application for Owner -Occupied
Rehabilitation/Reconstruction Program,
City Secretary indicated she was real pleased on the way the grant project went this
time. There are a lot of homes that have been targeted for reconstruction. She wants
to reapply, this is the process to submit the application. The match will need to be put
in the next budget.
Discussed grant homes, and the number of homes that would be built.
Councilman Ervin indicated the size of the homes did not meet our ordinance. He
asked if we could cut back on the number of homes and make the homes fit our
ordinance.
She indicated the Citys match could not pay for the additional square footage.
Councilman James asked if they had the right to dictate where the homes were built.
City Secretary indicated they could not, if the individuals qualify the home is built on
their lot.
Discussion regarding IV
Councilman James asked if the funds were In Kind or cash.
City Secretary indicated the City would pay $5,000.00 in cash, and the balance In Kind
services.
Discussion regarding the size of the homes.
Discussion.
Councilman Garza moved to adopt Resolution #03-08-03, Councilman Ervin seconded.
Motion carried unanimously.
5. Consider and Possible Action on Resolution #03-09-03 -Regarding Appointment of a
Capital Improvements Advisory Committee and Adoption of Committee By -Laws.
City Manager indicated this was for the Impact Fee study. He felt they should use the
Planning and Zoning, and appoint Jerry Jenkins and Mary Lou Abney,
Councilman James moved to approve Resolution #03-09-III , Councilman Ervin
seconded. Motion carried unanimously.
Councilman Ervin moved to appoint the Planning and Zoning Commission along with
Jerry Jenkins and Merrie Lou Abney as the Advisory Committee. Councilman James
seconded. Motion carried unanimously.
6. Consider and Possible Action on the Final Plat for Sanger Trails, Phase 2A, Being 8
Residential Lots and 2 Common Areas.
Discussed this item with Item 446. Action taken on both together.
7. Consider and Possible Action on the Final Plat for Sanger Trails, Phase 2B, Being 50
Residential Lots and 2 Common Areas. Property is Located off of Marion Road.
City Manager indicated that the City Engineer had some family issues, and could not
be at the meeting. On Item #4 he wanted the street for Phase I to be put in. Mr.
Hebard would like to pave that street and the streets in these two plats at the same time.
He indicated the easements have all been taken care of. On Phase 2B, Mr. Hebard's
engineer is making the changes as the City Engineer requested. On the detention area,
3:1 slopes is the standard for detention ponds; although, the City would prefer a 6:1
slope, it is not the standard. The Home Owners Association will maintain the detention
pond.

Discussion regarding The detention pond.
Councilman James moved to accept the Final Plats for Phase 2A and 2B of Sanger
Trails and stipulated they provide a document stating the Homeowners Association is
responsible for maintaining the detention pond. Councilman Evans seconded. Motion
carried unanimously.
8. Consider and Possible Action on Awarding Bids for The Construction of Sidewalk and
Concrete Bleacher Pads for Railroad Park.
City Manager indicated the 4B is not going to pay for any of these bids. He felt the
Council should reject all bids.
Councilman Evans moved to reject all bids, Councilman Ervin seconded. Motion
carried unanimously.
9. Consider and Possible Action on Awarding Bid for Second Phase of Street
Rehabilitation/Reconstruction Project,
City Manager indicated that Osage had the low bid and the City Engineer did not have
a problem with them.
Mayor indicated that he did not know anything about Osage, but felt the City had
problems with low bidders in the past. He felt that the city normally ends up paying
more than is bid anyway.
Discussion regarding the bidders.

Councilman James indicated he would like to use the lowest bid, but to have staff check
out references.
Councilman Evans moved to accept Jagoe's bid of $1,469,374.00.
City Secretary indicated staff could get references on the companies and call a special
meeting.
Council agreed.
Councilman Evans withdrew his motion. Item tabled.
10. Consider and Possible Action on North Texas Tooling/Howard Ashcraft's
Overpayment.
Mayor indicated he had spoken to Mr. Ashcraft twice, and explained that we do not
have any record other than the 4 years. It has been a few weeks, and he has decided to
take the $24,419.13,
Discussion regarding the situation.
Discussion regarding now it would be paid and where the money would come from.
City Secretary indicated it would be paid from current revenues and it is not a
budgeted item.
Councilman Evans moved to pay Howard Ashcraft $24,419.13, Councilman Garza
seconded. Motion carried unanimously.
11. Consider and Possible Action on Using Tap Fee Funds for Freese Drive Line Extension.
Eddie Branham indicated he would like to replace the water and sewer lines along
Freese Drive and use $11,000 in tap fee funds to correct a problem. He indicated it was
water and sewer lines that needed replacement/extension. This will help all of the
surrounding subdivisions.
Discussion regarding the project.
Councilman Evans asked how much the second part would be.
Eddie indicated he did not know, he had to get with Rose on the Engineering fees,
because he did not have money in his budget. The Engineering will be about $1500.00
to $1800.00.
Mayor asked what the total would be.
Eddie indicated 17 to 18 thousand to do sewer, water and engineering.
Councilman James asked if the land behind No Frills could be watered and sewered.
Eddie Branham indicated this would allow it to be.
Councilman James moved to use Tap Fee funds for the Freese Drive Line Extension.
Councilman Ervin seconded. Motion carried unanimously.
12. Consider and Possible Action on Ordinance #0342-03 -Annexing the Following
Property:
ABSTRACT 1241, TRACT 43, BEING 2.5 ACRES (MICHAEL GREGORY), AND
ABSTRACT 29, TRACT 57, BEING 25.230 ACRES (AL MCNATT), AND
ABSTRACT 29, 'TRACT 58 & 599 BEING 49.419 ACRES (AL MCNATT), AND
ABSTRACT 1241, TRACT 37, BEING 32.8617 ACRES
Councilman Evans moved to adopt Ordinance #0342-03 ,Councilman James seconded,

1. Mayor called meeting to order.
2. Consider and Possible Action on Awarding Bid for Phase 2 of the Street Rehabilitation
Project.
Discussion regarding the references.
Councilman Garza indicated he would like to see a time frame put on the contract.
Discussed that there were some requirements in the bid.
Councilman James asked if there was a penalty clause in the maintenance bond.
City Engineer indicated there was not a penalty clause, there was a two year
maintenance bond. This is a maintenance contract, they are going to isolate a few
streets, and finish them completely and then move to the next section. They learned a
lot from the first phase. They will not start paving until all of the utilities are done.
This one will be managed a lot better.
Councilman James moved to award the bid to Osage Aggregates in the amount of
$1,126,109.00. Councilman Evans seconded. Motion carried unanimously.
3. Consider and Possible Action on Appointment of Election Judge and Alternate Judge
for May 3, 2003 Election.
Councilman Evans moved to appoint Polly Dwyer and Jennifer Noah as Election Judge
and Alternate Judge and that they be allowed to appoint one clerk. Councilman James
seconded. Motion carried unanimously.

L. Jones will receive the Eagle Scout Award, and

Mr. Sadau will be addressing the Council regarding this item. He wishes to sell one acre out of a
17 acre tract, if I understand correctly. He is willing to plat the property; however, because he is in
the E.T.J. He does not feel he should have to do a Preliminary plat, a drainage study or construction
details as no major improvements will be involved. There is a provision for a waiver of
requirements in our current ordinance as listed below:
10.01 -Exceptions
These rules and regulations are the standard requirements of the city. A variance or waiver
of a_y of these rules and regulations may be granted by the city council, upon a showing that
there are special circumstances or conditions affecting the property in question and that
enforcement of the provisions of this ordinance will deprive the applicant of a substantial
property right, and that such variance or waiver, if granted, will not be materially detrimental
to the public welfare or injurious to other property rights in the vicinity.
Mr. Sadau wishes to request a waiver on the requirement of a Preliminary plat, the construction
details and the drainage study. Council may waive one, all, or none of these requirements at their
discretion. Mark Owens, City Engineer felt the drainage study may not be necessary because he is
only selling one lot which should not affect the drainage; however, he did feel that if any more lots
are developed, at that time a complete drainage study should be required.

Thank you for your attention to the above.plans dated February 2003. What follows is my
response to the review comments.
COMMENT RESPONSE
1. The horizontal scale of 1"=50' was chosen due to the length of the site and
roadway. A scale of 1 "=40' would cause the unnecessary use of extra plan

9. Note #5 in the General Notes reads (THE HOMEB UILDER SHALL B E
REQUIRED TO CONSTRUCT ALL FINISHED PADS AT ELEVATIONS 12" GREATER
THAN SURROUNDING FINISHED GRADE.). The home builder as also required to
construct finished floors 6" higher than pad elevation. It is my opinion that
homes near drainage areas will be sufficiently protected from storm water. No
revision made.
10. Culverts 2, 3 & 18 exceed maximum open channel velocities defined to be 8
#.p.s. in the Denton County Subdivision Rules and Regulations. The open
channel flow velocities at the outlet of these culverts do not exceed 3.4 f.p.s. as
shown in Deer Run cross -sections Sta. 2+00, 4+00 & 6+00 on Sheet 6.1. The
tailwater effect and the expansion of storm water as It exits the culvert to spread
the width of the channel causes the flow velocity to slow to the free flow velocity
of the channel. As the water begins laminar flow, its velocity increases to match
the channels free flow velocity. It is my opinion that velocities are not sufficient
to cause erosion at the outlet end of the culverts in question. No revision made.
11. Lengths shown along frontage of cul-de-sac are shown on the engineering
plan. Any other information is solely for the Surveyor use during staking and for
legal descriptions. Revised per comment.

We have completed our initial review of the construction plans and the final plat provided by you
for the referenced project. Our review is based on good engineering practice and the
requirements established in the City of Sanger's Subdivision Ordinance (hereafter referred to as
"ordinance".) Our review does not relieve the design engineer of his responsibilities as the
engineer of record in accordance with the Texas Engineering Practices Act. Below, please find a
list of our comments:
1. The ordinance calls for 1" = 40' scales for horizontal plan views.
2. The Subdivision Ordinance calls for sidewalks along Residential streets. No sidewalks
are shown in the construction .plans.
3. There is not a Sewer Plan. It is assumed the individual lots will be serviced by an
system, There should be a note added to the General Notes concerning individual on -site
system permitting.
4, No street lights are shown in the construction plans. The ordinance requires street lights
with 400' being the maximum spacing between the lights.
5. The planned water supply system is not a looped system. In addition, the ordinance calls
for 8" water lines for dead-end street sections, Plans presently show dead-end 6" trunk
line with a 2" loop at the Cul-de-sac.
6. The development has only one point of access. Discussions with the Fire Department
should be had to assure this will be acceptable.

It shall be unlawful to install, erect, change the use of or maintain any sign, or contract for such
service within the City of Sanger, except in compliance with the provisions of this article and any

Sec.3.1402 Definitions

principally refer to the sale, lease or rental ofthe real property upon which such sign is situated, and
whose message can be changed or altered by interchangeable letters, numbers or panels.
Read Estate Sign. A temporary accessory sign pertaining to the sale, rental or lease of the property on
which the sign is placed.
Political -Si.orn. A sign used exclusively to identify a candidate, place or ballot measure for a
designated election.

cost exceeds fifty per cent (50%) of its replacement value shall be removed by the sign owner,
(d) No billboard, poster panel or painted bulletin structure shall contain more than one (1) sign
panel facing in the same direction not more than two (2) sign panels per structure.
(e) political signs not be larger than thirty-two (32) square feet in area and not more than one (1)
sign for each candidate or ballot measure may be erected on one (1) lot or tract of land, except in the
case of a corner lot on which two (2) signs shall be allowed. No political sign may be placed, erected
or allowed to remain upon any portion of the public street right -of --way of the City of Sanger or upon
private property if such sign conflicts with the right-of-uvay or line of vision of a public street.
(f) No portable advertising signs he located withizl ten feet (10') of the edge of the traveled
portion of any public street of the City of Sanger.
(g) In the various districts zoned Business, no sign mounted at ground level shall exceed thirty-six
(36) square feet in area, and no pole sign shall exceed two hundred (200) square feet in area.
(h) No sign, except an official sign authorized by law, shall be erected in, on, or so as to project
into, any public right -of --way of any street or alley, or any easement or other public property,
including utility poles or structures, in the City.
(i) One (1) sign shall be allowed within the required front yard as permitted in the above schedule;
however, such businesses that are located on cornet' lots with appropriate Zoning on all sides may
erect a second general business sign in the side yard, provided the second sign does not exceed sixty-
five (65) square feet in area, with no dimension exceeding ten feet (10'), and not exceeding seven
feet (7') in height.
**No portable sign shall be utilized on business lots where a second general business sign is
erected.

Sec. 3.1405 Obstructing Traffic Visibility at Corners
No obstruction of trattic visibility shall be permitted on any lot in the city limits,
Sec.3.1406 Maintenance
All signs and advertising st etures shall be maintained in good and safe structural condition, shall
be painted on all exterior parts, unless coated or made of rust resistible material, and shall be
maintained in good condition of appearance. If upon inspection by the building official, a sign is not
found to conform to the above, written notice shall be given to the owner giving the owner thirty
(30) days to either put the sign in acceptable condition or remove the sign.
Sec. 3.140'7 Removing Clbsolete Signs
All signs relating to a product no longer available for purchase by the public and al! signs relating to
a business which is closed or has moved away shall be removed or the advertising copy shall be
removed. Painted wall signs shall be painted over with a color that resembles or matches the wall. If
the owner of, or person responsible for the sign, or if the tenant closing the business fails to remove
or paint over the sign, the owner of the premises shall be responsible and the work shall be done
within thirty (30) days following the date of obsolescence.
Sec. 3.1408 Permit Required
When a permit is required as indicated in Section 3,1403, the permit fee shall be as set forth in the
fee schedule in the appendix of this code. Application for a permit shall be submitted to the city
secretary on such forms as may be required by the city. The application shall be accompanied by a
drawing indicating the size and location of the sign on the property.
Sec.3.1409 Variances
When it appears that the provisions of this article would work a manifest injustice ox an unnecessary
hardship, a person may appeal to the Zoning Board of Adjustment for a variance from the provisions
of this article. Such variance may be granted subject to special restrictions and for a fixed time
subject to expiration at the discretion and order of the Board of Adjustment.
Sec. 3.1410 Penalty for Violation
(a) Any person, firm or corporation who violates any provision of this article shall be deemed

guilty of a misdemeanor and, upon conviction thereof in the municipal court, shall be subject to a
fine in accordance with the general penalty provision set forth in Section 1,109 of this code for each
offense, and each and every day that the violation of this article shall be permitted to continue shall
constitute a separate offense.
(b) By passage of this article, no presently illegal use of signs shall be deemed to have been
legalized, and no offense committed, and no liability, penalty or forfeiture, either civil or criminal,
incurred prior to the time existing sign ordinances or regulations were repealed and this article
adopted shall be discharged or affected by such repeal; but prosecutions and suits for such offenses,
liabilities, penalties or forfeitures may be instituted, or causes presently pending proceeded within all
respects as if such prior article, or portion of such article had not been repealed.
(c) If any portion of this article shall conflict with any portion or all of any existing ordinances of
the City of Sanger not specifically repealed herein, the city council hereby declares that this article
shall prevail and that it is hereby attempting to repeal any conflicting provisions of any conflicting
provisions of any existing ordinance of the city."
Section 2. That Appendix Article 3.0007 Section 3,900, of the Code of Ordinances, City of
Sanger, Texas, is hereby amended, which said article shall read as follows:
"Sec. 3.900 Sign Fermits
When a sign permit is required, the permit fee shall be twenty-five dollars ($25.00), due upon
submission of application for permit, and is not refundable if application is withdrawn after review,
or if it does not meet the requirements as outlined in Article 3.1400."
Section 3. All ordinances or parts of ordinances in conflict herewith are, to the extent oisuch
conflict, hereby repealed.
Section is hereby declared to be the intention of the City Council that the sections,
paragraphs, sentences, clauses, phrases and words of this Ordinance are severable and, if any word,
phrase, clause, sentence, paragraph, or section of this Ordinance shall be declared unconstitutional by
the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not
affect any of the remaining portions of this Ordinance, since the same would have been enacted by
I he City Council without the incorporation in this Ordinance of any such unconstitutional word,
phrase, clause, sentence, paragraph, or section.
Section 5. Any person, firm, or corporation who shall violate any of the provisions of this
article shall be guilty of a misdemeanor and upon conviction shall be fined in accordance with the
general penalty provision found in Section 1.109 of this Code.
Section 6. This ordinance will take effect immediately from and after its passage and the
publication of the caption, as the law azzd Charter in such cases provide.

Directors for the District, will expire on May 31, 2003.
Mr. Smith has done an outstanding job as your representative on the Board. We suggest that

resides within the City's boundaries or within the boundaries of the Upper Trinity Regional Water
District.

HIGHLIGHTS:
The Gates Foundation recently donated Word 2000 for all public access computers, not
just the computers the library obtained through the Foundation. So the word processing software
was installed on the stand-alone public computer.
ADMINISTRATION:
Completed the questionnaire for the Denton County Commissioners' Court and applied
For funding for next fiscal year. From that report is the following breakdown of borrowers:

CIRCULATION:
More items were checked out this March than any previous March.
PROGRAMS:
"Exploring the World" was the theme for Storytime. Individual programs titles were
"Africa", "The Orient", "Latin America" and "Australia". Besides the usual stories and crafts,
kids enjoyed food, music, games and items to touch or dress up in. Some children have also
brought items from home to show at Storytime.
