Councilman Evans moved to approve the Consent Agenda, Councilman Higgs seconded.
Motion carried unanimously.
3. Citizen's Input.
Jason Driskill, 902 Church St., indicated that on August 1, 2002, he had submitted a
variance request to the Board of Adjustments to enclose his garage. 1-le was unable to
attend the meeting and was told the next day that the City Attorney had indicated the
Board of Adjustments could not issue the variance. He is expecting a new family
member and at this time a new home does not fit their budget.
Discussion.
Mr, Driskill indicated there is a concrete drive in front of the house. They also have a
place on the side where he intends to put a driveway.
Mayor indicated they cannot do anything tonight except give their opinion.
Councilor an Evans indicated he felt it should be put on the next agenda.
Discussion. Rose indicated it was on the last agenda and the Council denied it.
Discussion continued.
I. Driskill indicated as a tax payer he would like them to consider that something be
done to where he can enclose his garage.
Council agreed to put it back on the agenda for the next meeting.
4. C:onsider and Possible Action on Resolution #08-11-02 -Authorizing the Submission of
a 2003-2004 Texas Community Development Program Application to the Office of
Rural Community Affairs for the Community Development Fund.
Considered with Item #S.
5. Consider and Possible Action on Resolution #08-12-02 - Autho�•izing the Award of
Service Provider Contracts for the Texas Community Development Program (TCDP)
Contingent upon the Receipt of a TCDP Grant Award.
City Secretary explained this is the Capital Improvement Grant that the City has
applied for the past three years.
Brief Discussion.
Councilman Evans moved to adopt Resolution 8-11-02, and 8-12-02, C;ouncilman James
seconded. Motion carried unanimously.
5. Consider and Possible Action on Closing Streets for the Sanger Sellabration.
City Manager indicated the Chamber wanted to close the same streets as before.
Councilman .Tames moved to honor the Chamber's request to close the streets.
Councilman Riggs seconded. Motion carried unanimously.
7. Consider and Possible Action on a Preliminary Plat for Tiffany's Addition. Property
is Located at 600 Denton.
City Manager indicated the City Engineer's letter is in the packet. The Engineer
recommended scull -de -sac far emergency vehicles. He is abutting a City Street and
does not need the cull -de sac. Mr. Koch will dedicate the land, but he does not want to
bear the expense of the extension. He indicated that Oak Street is on the capital
improvement plan.
Councilman Evans indicated he did not feel the City should bear the cost.
Mayor asked now much land would he dedicate.
1VIr•. Ieoch indicated it would be 80 feet in diameter.
Discussion regarding lot width.
Steve Koch., 6415 Stags Leap Rd, cated there are plenty of house plans that will fit
on these lots with these setbacks. The lots do have more square footage than the
required lot size, and he will not ask for a variance on the setbacks.
Discussion.
Mayor indicated he would not want this to get passed and then come back with a
variance request.
Discussed where the water will tie in.
Steve indicated !at 5 will tie in off of (7ak street, and lot 1 thru 4 wi!! tie in off of ®enton
Street. He has also given electrical easements to the city for the current electric line.
t;ouncilman Evans asked about the drainage situation,
Mr. Koch indicated he is talang the water down South and will bring it over to Denton
Street.
City Engineer indicated if this happens he will have to give a drainage easement for the
area.
Discussion regarding drainage.
Steve Koch indicated he was willing to give whatever was needed to put in the
cu i 1-de-sac.
Councilman James asked if they would be rear or front entry garages.
Steve Koch indicated they would be franc entry garages.
Councilman Evans asked if the City had the money to build the cull -de -sac.
City Manager indicated they could put it in the first phase of the street improvements.
Discussed if Mr. Koch furnished the water• line would the City install the line.
Mayor indicated he did not want to do that, because if the City installed the line they
would have to do it for all developers.
Steve Koch indicated he would have it installed.
Shelley Ruland indicated the Planning and Zoning did approve the plat, and they would
like it stipulated in the motion that he dedicate the land for the cull -de -sac.
Steve indicated he would donate more land if they could save the large tree currently
in that area..
Discussion,
Councilman Higgs moved to accept the plat with the stipulation that Mr. Koch deed
the land for the cull -de -sac and extend the sewer and water to the end of the cull -de -sac,
Councilman James seconded. Motion carried unanimously.
8. Consider and Possible Action on a Preliminary Plat for Chisam Road Estates. Property
is Generally Located North of Sanger along I-35 in the Northern Portion of the City's
E.T.J.
Considered with Item #9.
9. Consider and Possible Action on a Final Plat for Chisam Road Estates. Property is
Generally Located North of Sanger along I-35 in the Northern Portion of the City's
E.T.J.
Ricic Ezzel, ®eveloper of the property, indicated this was a plat request that had been
submitted to the County and they had it for quite some time. He has withdrawn it from
the County and is submitting it to the City for approval.
Discussion regarding the roads.
Councilman Higgs moved to accept the Preliminary and Einal Plat for Chisam IYoad
Estates. Councilman Evans seconded.
Councilman James asked if the road would have acull-de-sac.
1VIr•. Ezzel indicated they are going to re -craft the intersections where the old road will
flow into the new road.
Councilman Garza asked if the county had a problem with the plat.
Mr. Ezzel indicated he was not aware of any problem.
Motion carried unanimously.
10. Consider and Possible Action on Awarding Fttel Bid.
Councilman Evans indicated the four bay requirement was discriminating against the
small guys.
Discussion.
City Secretary indicated the advertisement for the bid did not include this requirement.
Discussion.
Mayor indicated staff should remove that requirement in the future.
Councilman Evans moved to award the bid to Lynch Food Mart. 1Ie has been doing it
for ten years and is doing a good job.
Discussion.
Councilman Garza indicated he did not see why they should award the bid to the higher
priced company.
Councilman Evans indicated last year Lynch Food llilart was higher and they sti[1 got
the bid.
Councilman Garza indicated there was an issue with access.
Motion died for a lack of a second.
Councilman James moved to award the bid to The Sportsman.
Discussion.
Councilman Garza asl{ed if neither one of the companies got the bid tonight what would
happen.
City Secretary indicated it would be re -bid.
Discussion.
Councilman James indicated he felt the C',ity should have a right to dictate the
requirement on their bids.
Councilman Garza seconded. Motion carried 3 to 1, Councilman Evans voted no.
I1. Consider and Possible fiction on Using Tap Fees to Fay for Infrastructure/Water
Improvements to the �v�Jal-mart IAisti-ibutiori Center and to C3versize Sewer Line F�•orn
It3ridle Path Estates.
City Manager indicated on the vval4lart pi°oject, the City lead -received tine texas
Capital Fund Grant and the 4Ps Board helped fund the infrastructure. after all of the
improvements there was still $60,000 in i:nproveinents that were not covered. part of
the expense was the elevated storage to get pressure back into the system
C"ity 14'funuger ia�dicuted the over suing on Il'ridip Path is them®ney that the City owes
the School for over sizing the line. This was oversized at the City's request. It is about
39,000.
CGuiacilman Garza indicated he had a problem `$pith using the money ciit of those Binds,

not the sewer fund,

placed back on the agenda. This changes the parking requirement from "two enclosed parking
spaces" to "two off-street parking spaces" in Single Family districts and from "one enclosed parking
space per unit" to "two off-street parking spaces per unit" in the 2F zoning district.

a buffer between areas expected to remain in agricultural use for an extended period of time and
areas expected to experience residential development.

SECTION 17
" 2-F" TWO-FAMILY RESIDENTIAL (DUPLEX DISTRICT)
General Purpose and Description: The " 2F" district is intended to provide the opportunity for
development which istwo-family (duplex) in character, but which encourages individual ownership
of each dwelling unit. The typical duplex lot is divided from front to back, thus encouraging the sale
of each dwelling unit, together with the land upon which it is situated, to the occupant.
17.1 Use Regulations: A building or premise shall be used for only the following purposes:
1. Two-family residence (duplex).
2. Other uses as listed in Section 30 of this ordinance.
The following specific uses shall be permitted in a " 2F" District when granted in accordance with
Section 31:
1. Uses as listed in Section 30 of this ordinance.
17.2 Height Regulations: No building shall exceed thirty (30) feet in height. Accessory buildings
shall not exceed ftfteen (15) feet in height.
17.3 Area Regulations:
1. Size of Yards:
a. Front Yard: There shall be a front yard having a required depth of not less than
twenty-five (25) feet as measured from the front property line. Accessory buildings
shall have a setback of sixty (60) feet or greater.
b. Side Yard: There shall be a side yard on each side of a structure of not less than eight
(8) feet. A side yard adjacent to a side street shall be not less than twenty (20) feet.
No side yard for allowable nonresidential uses shall be less than twenty-five (25)
feet.
c. Rear Yard: There shall be a rear yard having a depth of not less than twenty-five (25)
feet. Minimum rear yard for accessory buildings shall not be less than ten (10) feet.
2. Size of Lot:
a. Lot Area: No building shall be constructed on any lot of less than six thousand five
hundred (6,500) square feet or three thousand two hundred fifty (3,250) square feet
per unit.
b. Lots in the 2F District must be platted in pairs such that a duplex unit may be placed
on each pair of lots. The subdivision plat shall designate the pairs of lots and which
lot lines are to be outside lot lines of each pair. There shall be only one dwelling unit
per lot and no dwelling unit shall cross a lot line. No single family detached dwelling
maybe constructed on one of the designated pair of lots.
c. Lot Width: The width of the lot shall be determined by the construction width of
individual dwelling units or dwelling units considering side yards as required above,
but in no case shall the width of a pair of lots be less than sixty-five (65) feet.
d. Lot Depth: The average depth of the lot shall be not less than one hundred (100) feet.
3. Minimum Dwelling, Size: Each dwelling unit shall be not less than nine hundred (900)
square feet, exclusive of garages and porches and breeze ways.
4. Lot Coverage: In no case shall more than forty percent (40%) of the total lot area be covered
by the combined area of the main building. Accessory buildings, driveways and parking may
account for an additional twenty percent (20%) of the total lot area.

17.4 Parking Regulations: Not less than two (2) off-street parking spaces per unit behind the front
yard line is required. Off-street parking spaces shall be provided in accordance with the
requirements for specific uses set forth in Section 32.
Section 2. All ordinances or parts of ordinances in conflict herewith are, to the extent of
such conflict, hereby repealed.
Section 3. It is hereby declared to be the intention of the City Council that the sections,
paragraphs, sentences, clauses, phrases and words of this Ordinance are severable and, if any word,
phrase, clause, sentence, paragraph, or section of this Ordinance shall be declared unconstitutional
by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall
not affect any of the remaining portions of this Ordinance, since the same would have been enacted
by the City Council without the incorporation in this Ordinance of any Such unconstitutional word,
phrase, clause, sentence, paragraph, or section.
Section 4. Any person, firm, or corporation who shall violate any of the provisions of this
article shall be guilty of a misdemeanor and upon conviction shall be fined in accordance with the
general penalty provision found in Section 1.109 of this Code.
Section 5. This ordinance will take effect immediately from and after its passage and the
publication of the caption, as the law and Charter in such cases provide.

Section 1. That chapter 13, article 13.500 and appendix article 4.000, section 4.1200 of
the City of Sanger Code of Ordinances is hereby amended to read as follows:
"Section 4.1200 SEWER SERVICE RATES
The rates to be charged by the City for sanitary sewer service are hereby established as follows:
(a) Residential -Class A: Class A customers shall include all residential type users including, but not
limited to, single-family residences, apartment units, trailer court units, duplexes, or any other
service primarily intended for domestic or residential use. The City may include similar low volume
users such as churches and small business offices or stores in Class A.
All Class A customers of municipal wastewater facilities will be charged a minimum of fifteen
dollars ($15.00) per monthly cycle and one dollar ($1.00) per thousand gallons of metered water in
excess of the first one thousand (1,000) gallons, but in no case to exceed thirty ($30.00) per month.
(b) Commercial -Class B: Class B customers shall include commercial users such as, but not limited
to, restaurants, cafes, car washes, schools, hospitals, nursing homes, offices, hotels, motels,
laundries, grocery stores, department stores, and other commercial business operations as may be
identified as not a Class A type user.
All Class B customers of municipal wastewater facilities shall be charged the following rates for
the monthly facilities charge and one dollar ($1.00) per thousand gallons of metered water in excess
of the first one thousand (1,000) gallons.

(c) Multi -family Dwellings: The amount due for multi -family dwellings shall be the Class A rate
multiplied by the number of occupied dwelling units."
Section 2. All Ordinances or parts of Ordinances in conflict herewith are, to the extent of
such conflict, hereby repealed.
Section 3. It is hereby declared to be the intention of the City Council that the sections,
paragraphs, sentences, clauses, and phrases of this Ordinance are severable and, if any phrase,
clause, sentence, paragraph, or section of this Ordinance shall be declared unconstitutional by the
valid judgement or decree of any court of competent jurisdiction, such unconstitutionality shall not
affect any of the remaining phrases, clauses, sentences, paragraphs, and sections of this Ordinance,
since the same would have been enacted by the City Council without the incorporation in this
Ordinance of any such unconstitutional phrase, clause, sentence, paragraph, or section.
Section 4. Any person, firm, or corporation who shall violate any of the provisions of this
article shall be guilty of a misdemeanor and upon conviction shall be fined in accordance with the
general penalty provision found in Section 1.109 of this Code.
Section 5. This Ordinance will take effect immediately from and after its passage and the
publication of the caption as the law in such cases provides.

Water/Sewer:
We are waiting on Wal-mart to sign the agreement for us to use
their electricity Co our SCADA system and we will be ready to go.
Streets:
We had the contractor meeting for Phase I of the street
program. None of the contractors felt comfortable with both the street
project and the utility project. The engineer feels we should re -bid the
project.
Contacts/New Businesses:
Quail Run: Cowling Road: Final details are being discussed between
the City engineer and the engineer for the developer.
Sanger Trails: Roger Hebard: Mr. Stevens is currently out of town
but he has verbally agreed to the price of $ 12,500.00 plus he wants
grass seeded on the easement. I spoke with Ralph Amyx, he will sow
the seed free if the City will purchase the seed. Cost should be less
than $ 3000000
Radio Shack: New sewer lines have been completed. Also the sewer
line for the car wash just west of the railroad track.
Brooke Hill Village: Sonny Hill's place: The architect has brought in
a conceptual plan. He would like to have a workshop to discuss some
of the aspects of the project.
Jim McNatt: Don Frazier and an architect visited with Mark and I
today. This property is east of the new high school on McReynolds
Rd. where the apartments are. The subdivision will be 243 single
family residences and an area for either apartments or retail. This
area is not in our water CCN.
