Mayor Pro Tem Andy Garza called Meeting to Order, Councilman Waggoner led the Invocation, Councilman Ervin by the Pledge of Allegiance. CONSENT AGENDA 2. a) Approve Minutes: November 6, 2000 b) Disbursements Councilman McNeill asked about the expenditure to Southwest International. City Secretary indicated one of the trucks in the street department broke down, and it had to be towed and fixed. Councilman McNeill asked about the expenditure to Robert Singletary and Hammet & IN City Secretary indicated this was for Walmart, and these people are not wanting to wait for reimbursement from the State, so the City is paying them and will be reimbursed by the State Capital Fund. Councilman Waggoner moved to approve the consent agenda. Councilman Higgs seconded. Motion carried unanimously. 3. Citizen's Input. James Emery, Trey's Court, recently a new stop sign was put in, he purchased a new home in that area, kids peel out and stop and throw out trash. He would like to oppose the stop sign. Mayor Pro Tem indicated they did not want to wait until someone got hurt in that area. The main concern was safety. Mr. Emery indicated he felt it was more of a hassle, and there was more trash since it was put in. Discussion regarding a traffic count on Freese. 4. Conduct Second Public Hearing on Proposed Annexation of the Following Properties: ABSTRACT 299 RUEBEN BEBEE SURVEY, TRACT 65A, 35.000 ACRES, AND ABSTRACT 29, RUEBEN BEBEE SURVEY, TRACT 64A1 23.440 ACRES, OF WHICH 14.35 ACRES ARE ALREADY IN THE CITY. Public Hearing open. Council Discussed, no other discussion for or against. Public Hearing closed. 5. Consider and Possible Action on Awarding Bid for the TCF Walmart Water & Sanitary Sewer Lines. City Manager indicated the low bidder was Hebard Utilities out of Grand Prairie. Discussion. Councilman McNeill moved to award the bid in the amount of $187,150.00 to Hebard Utilities out of Grand Prairie. Councilman Waggoner seconded. Motion Carried unanimously. 6. Consider and Possible Action Regarding a Final Plat on Heritage West, Phase I, Being 7.82 Acres in the Henry Tierwester Survey, Abstract 1241. Property is located off of F.M. 455. Councilman McNeill expressed concerns regarding not having the engineering plans showing all the utilities. He also expressed concerns regarding the width of the street. Discussion regarding the street. Councilman McNeill expressed concerns regarding drainage and the easements. Discussion regarding the lot sizes in Block B. Councilman McNeill indicated he felt the streets should be wider. Councilman McNeill asked if they had a permit from TXDOT. Frank Rodgers indicated they would not be able to get one until this got through the City. Councilman Ervin indicated he felt the streets should be wider since there are no sidewalks. Discussion regarding parking and the streets. Discussed the commercial area in reference to the an Use Study. Councilman Ervin moved to approve the Final Plat on Heritage West, Phase I. Councilman Higgs seconded. Motion Carried 4 to 1, Councilman McNeill voted no. 7. Consider and Possible Action Regarding aPreliminary/Final Plat for Sunset Lake Estates, Phase II, Being 21.41 Acres in the Rueben Bebee Survey, Abstract 29. Property is located off Huling Road, in the City of Sanger's E.T.J. Councilman Higgs indicated there was something in this subdivision approved back in December of 1999. Peggy Arrington indicated that was Phase I, and this is Phase II. Discussion regarding the road, and if it is to County Specs. Councilman McNeill asked if there would be any restrictions. Peggy Arrington indicated there would be. Restrictions discussed. Councilman McNeill asked what type of road would it be. Ms. Arrington indicated it would be gravel. Councilman Higgs expressed concerns regarding when the property is eventually annexed, the city may have to pave the road. Councilman McNeill asked for the City Manager's opinion. City Manager indicated that the City would probably eventually go out that way, and if they annex it they would have to pave the road. City Secretary indicated the City could not offer them any services if they annex them, therefore, probably not. City Manager indicated if the City was not gong to annex them, he did not have a I problem with it. Discussion regarding the septic system. Discussion regarding the street. Peggy Arrington indicated the reason they were not going to pave it was because of the cost. It is not in the owner's budget. It has never been their intention to pave the road. Councilman McNeill indicated he would be opposed to it for fear of what this would lead to. Councilman Higgs indicated he had property in the area, so he would probably have to abstain. Councilman Ervin asked if they could approve the plat and deny the variance. Discussion regarding the street and that if the city requires a concrete street the whole subdivision would change. Councilman Waggoner expressed that he would be concerned if this is approved it will set a precedent. Councilman Ervin indicated he would like to see a minimum of Asphalt. Councilman McNeill moved to deny Sunset Lake Estates, Phase II. Councilman Waggoner seconded. Motion Carried 3 to 1, Councilman Ervin voted no, Councilman Higgs abstained. City Secretary pointed out that the precedent was already set. Ridgecrest and Lakecrest Meadows both have asphalt streets. The streets have always been a concern. Discussion regarding roads in the County. 8. Consider and Possible Action Regarding a Preliminary Plat for Beka Hill Addition, Being 25.44 Acres in the J. P. B. January Survey, Abstract #658, in the E.T. J. of the City of Sanger. Property is Located off of F.M. 455. Item Tabled per owner's request. 9. Consider and Possible Action on Appointment to the Board of Adjustments and Beautification Board. Discussion regarding the term for the Beautification board appointment. 11. 12. City Secretary indicated the term will be from 2000 to 2002. Discussion regarding the appointments. Councilman McNeill moved to appoint Belle Lawson to the Beautification Board, and Jim Mann to the Board of Adjustments. Councilman Waggoner seconded. Motion carried unanimously. Consider and Possible Action to Rescind Resolution #09-22-00 -Joining the TXU Lawsuit. Mayor Pro Tem asked why this was not already sent when the Council passed it. City Administrator indicated he had instructed the City Secretary to hold it after he talked to TXU. Discussion regarding what would be best for the City in regards to participating or not. Lengthy Discussion. Councilman Ervin moved not to rescind Resolution #09-22-00. Councilman McNeill seconded. Motion carried unanimously. Consider and Possible Action on Awarding the Bid for Electric Feeder Project/Underground Substation Exits. Staff recommended approval. If this bid is not approved it will put the project behind schedule. City Secretary explained that some of these projects will go over what was alllocated in the grant, the City will have to pay the difference, and if there is money left over, the City will then get reimbursed. Discussion regarding the bid. Councilman Higgs moved to accept the bid. Councilman Waggoner seconded. Motion carried unanimously. Any Other Such Matters. a) Discussed electrical project that needs to be done in town. b) Mayor Pro Tem asked if we ever got an estimate regarding the utility billing for Walmart. City Secretary indicated she tried to contact the City of Paurs Valley, they would not j release it because it was disclosure information. She tried to contact Walmart to get permission but had no success. c) Councilman Ervin asked who was doing the Electrical Inspections for Walmart.
