Call Meeting to Order, Invocation, Pledge of Allegiance. Mayor Joe Higgs called meeting to order, Councilman Garza led invocation, followed by Councilman Ervin leading the Pledge of Allegiance. Z. Citizens Input: Citizens are allowed 3 minutes to speak. The City Council is unable to respond or to discuss any issues that are brought up during this section. Larry Hess inquired about a possible road east of town. City Manager advised that this is an item for discussion later on in the meeting. CONSENT AGENDA 3. a) Approve Minutes: November 5, 2007 -Work Session November 5, 2007 - City Council b) Disbursements c) Approval of Resolution #11-16-07 -Cause #2004-1066-362, County of Denton vs. Paul Henderson et al. d) Approval of Resolution #11-17-07 -Nominating Steve Mossman for Board Member of the Denton Central Appraisal District. e) Approval of Resolution #11-18-07 -Authorizing and Approving the Creation of Sanger Cultural Education Facilities Finance Corporation; Approving the Articles of Incorporation and Bylaws Thereof, Appointing the Initial Directors Thereof; and Containing Other Provisions Relating to the Subject. Councilman Muir made two corrections to the minutes as follows: November 5, 2007 - Work session, Item 3, paragraph 3- to add this statement to the end of the paragraph: "Staff confirmed this change was implemented." November 5, 2007 -City Council Meeting, Citizen's Input - to correct the spelling of E. L. McNeill to E.L. McNeal. Motionwas made by Councilman Muir to approve the Consent Agenda with the minor changes. Seconded by Councilman Garza. Motion carried unanimously. 4. Consider any Items Removed from Consent Agenda. There were not any items to discuss. 5. Conduct Public Hearing on Ordinance #11-44-07 -Amending the Comprehensive Zoning Ordinance by Granting a Specific Use Permit for an Organic Fertilizer Packaging Facility on Property Legally Described as Original Town of Sanger, Lots 1- 8, Block 1; Lots 140, Block 2; Lots 14 and 942, Block 7. Property is Located at 103 Bolivar Street. Mayor declared Public Hearing opened. City Manager advised that Samantha Renz had provided a handout with the recommendation from Planning and Zoning for approval with the one change in the SUP to Item 6, indicating that no outside display, storage or sales will be permitted. Mayor declared Public Hearing closed. 6. Consider and Possible Action on Ordinance #11-44-07 -Amending the Comprehensive Zoning Ordinance by Granting a Specific Use Permit for an Organic Fertilizer Packaging Facility on Property Legally Described as Original Town of Sanger, Lots 1- 8, Block 1; Lots 140, Block 2;Lots 14 and 942, Block 7. Property is Located at 103 Bolivar Street. Councilman Muir asked if the City Manager could describe the operation since it indicates that it is organic and he is concerned about possible odor. City Manager advised that there should not be an odor since they will not be using manure or hazardous materials in the process. Rob Woods, Cecile Carson, and he visited the complex in Frisco where they are moving from and there was no odor detected. It should be a fairly clean operation that will be contained within the building. There should not be any EPA issues and if there were, it would be between the company and the EPA. Motion was made by Councilman Patton to accept Ordinance #1144-07 -Amending the Comprehensive Zoning Ordinance by granting a specific use for an organic fertilizer packaging facility, and to add Item 6; No outside display, storage or sales will be permitted. Seconded Councilman Ervin. Motion carried unanimously. AN ORDINANCE OF THE CITY OF SANGER, TEXAS, AMENDING THE COMPREHENSIVE ZONING ORDINANCE OF THE CITY OF SANGER, AS HERETOFORE AMENDED, BY GRANTING A SPECIFIC USE PERMIT FOR AN ORGANIC FERTILIZER PACKAGING FACILITY ON A TRACT OF LAND 4.4798 ACRES MORE PARTICULARLY DESCRIBED IN EXHIBIT "A" ATTACHED HERETO AND MADE A PART HEREOF; PROVIDING SPECIAL CONDITIONS; PROVIDING A REPEALING CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR A PENALTY OF FINE NOT TO EXCEED THE SUM OF TWO THOUSAND DOLLARS ($2,000) FOR EACH OFFENSE, AND PROVIDING AN EFFECTIVE DATE. 7. Conduct Public Hearing on Ordinance #11-46-07 -Adopting the Comprehensive Plan, Brochure Plan and Amending the Thoroughfare Map. Mayor declared Public Hearing opened. Dan Boutwell, MPRG addressed Council and discussed the brochure map and the text documentation. The brochure map summarizes the text documentation and the brochure plan is a marketing tool that can be used for economic development. This information can be provided to developers. Local Government Code states that a comprehensive plan has to be in place if a city has zoning regulations and that they must be adopted in accordance with the comprehensive plan. They have incorporated some goals and objectives into the land use plan. Mr. Boutwell went over the different land uses. The map does not serve the same purpose as the City's zoning map and does not constitute zoning. It allows the city to make judgement decisions on how zoning occurs in the future and the same applies to thoroughfares. Mr. Boutwell indicated that the thoroughfare glare is coordinated with the Future Land Use Plan and provides the tools to develop a transportation system that can accommodate the needs of existing and future land use. Larry Hess, citizen in Sanger, expressed that he had not seen a map showing where roads may go. He owns property on the north side of Clear Creek. Cecile Carson explained that they An not know the exact location of roads, but the goal is that the end points have to match. Dan Boutwell, indicated that the alignment of future roads will be worked out at a later date and at that time the existing structures have to be located. Usually the alignments will miss those structures and they will try to utilize the property lines. This plan does not establish the alignment of any roads. Mr. Boutwell advised that the alignments will not happen until the market is developing in those areas. lliscussion. Mayor declared public hearing closed. 8. Consider and Possible Action on Ordinance #1146-07 - Adopting the Comprehensive Plan, Brochure Plan and Amending the Thoroughfare Map. Brief discussion. Motion was made by Councilman Ervin to approve Ordinance #11-46-07 - Adopting the Comprehensive Brochure Plan and Amending the Thoroughfare Map. Seconded by Councilman Walker. Motion carried unanimously. Caption as follows: AN ORDINANCE OF THE CITY OF SANGER, TEXAS ADOPTING THE SANGER COMPREHENSIVE PLAN; PROVIDING FOR AN EXHIBIT "A," BEING `THE CITY OF SANGER COMPREHENSIVE LAND USE PLAN'; PROVIDING FOR EXHIBIT "B" BEING THE BROCHURE TITLED `COMPREHENSIVE LAND USE PLAN AND THOROUGHFARE PLAN'; AMENDING AN ORDINANCE ADOPTING THE THOROUGHFARE PLAN; PROVIDING A SAVINGS CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR ENGROSSMENT AND ENROLLMENT; AND PROVIDING AN EFFECTIVE DATE. 9.
