CITY COUNCIL June 3, 2001 PRESENT: Mayor Tommy Kincaid, Councilman Mike James, Councilman Glenn Ervin, Councilman Joe Higgs, Councilman Jimmy Evans, Councilman Andy Garza OTHERS PRESENT: City Manger Jack Smith, City Secretary/Assistant City Manger Rose Chavez, Assistant City Secretary Samantha Renz, Police Chief Curtis Amyx, Code Enforcement Officer Ken Wilson, C.G. Mayor called meeting to order, led the Invocation and the Pledge of Allegiance CONSENT AGENDA 2. a) Approve Minutes: April 29, 2002 - Special Called May 20, 2002 b) Disbursements Councilman James indicated on item #12, he thought that Councilman Evans made the motion instead of Councilman Ervin. Councilman Evans indicated he did. Councilman James moved to approve the Consent Agenda as corrected. Councilman Evans seconded. Motion carried unanimously. 3. Citizen's Input. one. 4. EXECUTIVE SESSION: In Accordance with Texas Government Code, Subchapter D, Section .551.071 (LEGAL), to Consult with City Attorney. Mayor convened into Executive Session at 7:05. 5. RECONVENE into Regular Session and Consider Action, if Any, on Items Discussed in Executive Session. Reconvened at 8:15 p.m. Councilman James moved to authorize the attorneys to enter into negotiations on the lawsuit. Councilman Evans seconded. Motion carried unanimously. 6. Consider and Possible Action on a Preliminary Plat of Clear Creek Commercial Park, Lots 1, 2, & 3, Block A. Property is located on Stemmons Rd. between Church and Austin Streets. Councilman James inquired about the width of the streets on either side of the property. Discussion regarding the streets. Ken Wilson indicated the developer is putting in the sewer. Councilman Higgs moved to approve the plat, Councilman Evans seconded. Motion carried unanimously. 7. Consider and Possible Action on a Final Plat for Clear Creek Commercial Park, Lots 1, 2, & 3, Block A. Property is located on Stemmons Rd. between Church and Austin Streets, Councilman Higgs moved to approve the Final Plat for Clear Creek Commercial Park. Councilman Evans seconded. Motion carried unanimously. 8. Consider and Possible Action on Preliminary Plat for Sanger Industrial Park, Property is Located on Loop 138 and F.M. 455, West of the Railroad Tracks. Discussion regarding the sewer to the properties. Councilman Evans moved to accept the Preliminary Plat. Councilman Higgs seconded. Motion carried unanimously. 9. Conduct Public Hearing to Consider a Replat on property legally described as Meadowlands Addition, Lots 13R1 and 13R25 Being a Replat of Lot 13. Property is located on Jennifer Circle. Public Hearing opened. No Discussion. Public Hearing closed. 10. Consider and Possible Action Regarding a Replat on property legally described as Meadowlands Addition, Lots 13R1 and 13R2, Being a Replat of Lot 13. Motion carried unanimously. 11. Conduct Public Hearing toConsider aReplat ofSangerIndustrial Park, Lots 1R-1, 1R-2, and 2WI, block A. Property is Located on F.M. 455 and Acker Street. Public Hearing opened. Vaughn Andres, 206 Water Creek Rd. Krum, indicated they were replatting the property from 455 back to the south end of the property. There are two lots on 455 and one on Acker. They have allowed for an additional 15 feet for R.O.W. on 455. Public Hearing closed. 12. Consider and Possible Action Regarding a Replat of Sanger I-35 Industrial Park, Lots IR-1, IW2, and 2R-1, block A. Property is Located on F.M. 455 and Acker Street. Councilman Evans moved to accept the Replat, Councilman Higgs seconded, Motion carried unanimously. 13. Consider and Possible Action on Amending the Building Permit Fees. Item Tabled. 14. Consider and Possible Action on Interlocal Agreement Between the Sanger Independent School District and the City of Sanger. City Secretary explained this had been sent to the attorney for review, the attorney returned his recommended changes and the school made the changes and resubmitted the agreement... Councilman Higgs moved to accept the Interlocal Agreement Between the Sanger Independent School District and the City of Sanger. Councilman Garza seconded. Motion carried unanimously. 15. Consider and Possible Action on Interlocal Agreement with Denton County for Tax Collection. Councilman Evans moved to accept the agreement. Councilman Higgs seconded, Motion carried unanimously. 16. Consider and Possible Action on Interlocal Agreement between the City of Sanger and Denton County Regarding Jurisdiction of Subdivisions in the E.T.J. Mayor asked if this was for the County to give control to the City. City Manger indicated it was; but that there were some concessions on bar ditches, sewer, and culverts. brief Discussion. Councilman Evans moved to approve the agreement. Councilman Higgs seconded, Motion carried unanimously. 17. Consider and Possible Action on Resolution #06-09-02 -Setting Date, Time, and Place for Public Hearing on Proposed Annexations. City Secretary explained this is taking a small area in the front part of Rising Star Lane. Discussion. Councilman Ervin moved to approve Resolution #06-09-02. Councilman Garza seconded. Motion carried unanimously. 18. Consider and Possible Action Regarding Connect Fees in the Sanger Mobile Home Park. City Manager explained the Sanger Mobile Home Park is planning to add 25 lots to the park. Staff is asking for direction on now or if to charge tap fees. Carroll McNeill, 701 Denton, indicated they are wanting to tie into their own lines in the park This was platted years ago before the new fees were put in place. Discussion. Councilman Evans indicated if the lines belong to the City and the City maintains them he felt they should be charged tap fees. Councilman Ervin asked what Mr. McNeill would do if he were sitting in their seats. Mr. McNeill indicated he wanted it to be fair, and realizes it will cost money. The tap fees bring more money than the water rates. City Manger indicated Joe Falls will pay $4,000.00 per lot when his previously platted property is developed. Discussion regarding the property. Mr. McNeill asked what would the Council like to see on the property if he can't develop because of the tap fees. He indicated he could develop it as commercial property. Lengthy Discussion. Councilman Evans indicated if the City kept ownership of the lines he would like $2,000 for each tap. No Action Taken. 19. As previously stated the 12" waterlines should be accurately shown.There is a 7' dimension shown but it_is_ diflicult to_ determine what Lne-dimension is referring to Preliminary Drainage Study 1. It hard to differentiate between phase lines and drainage area delineation lines. It help my evaluation if this could be clarified. 2. An offsite drainage area map is shown. The offsite drainage area should be shown to scale at a much larger scale than shown. SECTION II All Ordinances or parts of Ordinances in conflict herewith are, to the extent of such conflict, hereby repealed. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses, and phrases of this Ordinance are severable and, if any phrase, clause, sentence, paragraph, or section of this Ordinance shall be declared unconstitutional by the valid judgement or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs, and sections of this Ordinance, since the same would have been enacted by the City Council without the incorporation in this Ordinance of any such unconstitutional phrase, clause, sentence, paragraph, or section. We have been in discussion with Mr. Stevens regarding easements. Mr. Stevens is requesting compensation for these easements. He is requesting that the City lay a line in front of his property along F.M. 455 and approximately 3100 feet alongside his property. I have advised him that the Council may agree to giving him taps for the easement, but that the cost for what he is asking would be approximately $105,000.00, I have advised him to go before the Council to make his request. ("Wal-Mart"), for the purposes and considerations herein expressed, agree as follows: 1. The City has constructed an elevated water storage tank approximately one hundred feet from the Wal-Mart water storage facility in the City as shown on Exhibit A hereto. 2. Wal-Mart has electric service to its water storage facility on its property. 3. FAA regulations require a lighted beacon on top of the City's elevated water storage tank. 4. Wal-Mart agrees to allow the City to make connection to Wal-Mart's electric service to furnish power for the required beacon on top of the City's elevated storage tank. 5. The parties agree that the electrical work required and all appurtenances necessary to place the beacon on the City's elevated water storage tank will be installed by a licensed Master Electrician in accordance with all applicable codes and ordinances of the City and in compliance with all applicable FAA regulations. 6. Wal-Mart will furnish the electric service for the beacon at its expense and cost and at no cost to the City, except for the installation. 7. That in consideration of the furnishing of the electric service to the beacon, the City agrees to indemnify and hold Wal-Mart Stores, Inc., its officers and employees, harmless from and against any and all claims, liabilities, damages, penalties, losses, costs or expenses incurred by any of them incident to, resulting from, or in any way arising out of an injury to a person or damage to property in any way related to the connection of the electric service from the Wal-Mart property to the beacon on the City's elevated water storage tank and arising from the negligence or willful conduct of an employee of the City, except for any such claims, liabilities, damages, penalties, losses, costs, or expenses incurred resulting from the negligence or willful conduct of an employee of Wal-Mart, provided however, that the City does not waive sovereign immunity or any other defense it may have to any such claim by any third party. 8. Three programs were presented, one to each grade level. Over 150 children in each grade participated in an active story and listened to one being read. In addition, the Library Clerk, Lynne Smiland, was invited to speak about the Titanic to the Special Education kids in fifth grade at Clear Creek Intermediate. ADMINISTRATION: Completed a survey about the benefits we have received from the Telecommunications Infrastructure Fund Board. Future funding for this agency is in jeopardy. Our six newest computers were purchased and our building network wiring was upgraded using TIF funds. Completed a survey about the future possibility of putting the library catalog on the Internet. This would not currently be possible because our T4 connection through the school has security measures in place that prevent it. Submitted the 2002-2003 budget proposal to the City Manager. Recruited sponsors for the Summer Reading Club. Sponsors are Radio Shack, Friends of the Library, McDonald's, Video Corner, Whataburger, Jack -in -the -Box and The Tomato. Meetings attended: Library Board by-laws workshop, 5/14 Denton County Library Advisory Board, 5/16, Lake Dallas North Texas Regional Library System Meeting, 5/23, Fort Worth CIRCULATION: Took a fresh set of books to the Senior Citizens' Center. Prepared a packet of 25 videos to circulate among other Denton County libraries. PUBLIC RELATIONS: Distributed a flyer about the Summer Reading Club to kids in grades 1 through 5. Put up posters about the Summer Reading Club in local businesses and schools. SPECIAL PROJECTS: Shipped the next set of newspapers to be microfilmed. Took Doctor's account books from John Chapman's grandfather to be microfilmed. He is funding this for the history and genealogy records at the library. PROGRAMS: "Music" was the Storytime theme. Every week children played with rhythm instruments. At the first program of the month the children danced around a Maypole. Other activities were simplified square dancing and playing with a parachute. Weekly themes were "May Music", "Percussion", "Musical Instruments", "Dancing" and "Silly Songs". Crafts included a May basket, a drum, a rubber -band guitar, a dancing puppet and a kazoo. Entertaining pro- grams each week will feature stories, songs, activities and crafts from the Piney Woods to the oil fields, from Palo Duro to the Rio Grande. Programs for school -age children will be on Tuesday mornings at 10 a.m. Preschool programs will be on Wednesday mornings at 10 a.m. Kicking off the summer fun will be a special program called "Read- ing is Magic!" It will be performed by Gerald Edmundson who was called "a sleight of -hand virtuoso" by the Fort Worth Star Telegram. Kids will be mesmerized by the magic and entertained by the humor. Magic on TV can seem rigged. Magic seen first hand can truly be amaz= ing. "Reading is Magic!" will be presented at the Library on Tuesday, June 4 at 10 a.m. Register now by calling 458-3257.
