1. Mayor called meeting to order, led the Invocation and the Pledge of Allegiance

Councilman James indicated on item #12, he thought that Councilman Evans made the
motion instead of Councilman Ervin.
Councilman Evans indicated he did.
Councilman James moved to approve the Consent Agenda as corrected. Councilman
Evans seconded. Motion carried unanimously.

4. EXECUTIVE SESSION: In Accordance with Texas Government Code, Subchapter D,
Section .551.071 (LEGAL), to Consult with City Attorney.
Mayor convened into Executive Session at 7:05.
5. RECONVENE into Regular Session and Consider Action, if Any, on Items Discussed
in Executive Session.
Reconvened at 8:15 p.m.
Councilman James moved to authorize the attorneys to enter into negotiations on the
lawsuit. Councilman Evans seconded. Motion carried unanimously.
6. Consider and Possible Action on a Preliminary Plat of Clear Creek Commercial Park,
Lots 1, 2, & 3, Block A. Property is located on Stemmons Rd. between Church and
Austin Streets.
Councilman James inquired about the width of the streets on either side of the
property.
Discussion regarding the streets.
Ken Wilson indicated the developer is putting in the sewer.
Councilman Higgs moved to approve the plat, Councilman Evans seconded. Motion
carried unanimously.
7. Consider and Possible Action on a Final Plat for Clear Creek Commercial Park, Lots
1, 2, & 3, Block A. Property is located on Stemmons Rd. between Church and Austin
Streets,
Councilman Higgs moved to approve the Final Plat for Clear Creek Commercial Park.
Councilman Evans seconded. Motion carried unanimously.
8. Consider and Possible Action on Preliminary Plat for Sanger Industrial Park, Property
is Located on Loop 138 and F.M. 455, West of the Railroad Tracks.
Discussion regarding the sewer to the properties.
Councilman Evans moved to accept the Preliminary Plat. Councilman Higgs seconded.
Motion carried unanimously.
9. Conduct Public Hearing to Consider a Replat on property legally described as
Meadowlands Addition, Lots 13R1 and 13R25 Being a Replat of Lot 13. Property is
located on Jennifer Circle.
Public Hearing opened.
No Discussion.
Public Hearing closed.
10. Consider and Possible Action Regarding a Replat on property legally described as
Meadowlands Addition, Lots 13R1 and 13R2, Being a Replat of Lot 13. Property is
located on Jennifer Circle.

Councilman Higgs moved to accept the Replat. Councilman Evans seconded. Motion
carried unanimously.
11. Conduct Public Hearing toConsider aReplat ofSangerIndustrial Park, Lots 1R-1,
1R-2, and 2WI, block A. Property is Located on F.M. 455 and Acker Street.
Public Hearing opened.
Vaughn Andres, 206 Water Creek Rd. Krum, indicated they were replatting the
property from 455 back to the south end of the property. There are two lots on 455 and
one on Acker. They have allowed for an additional 15 feet for R.O.W. on 455.
Public Hearing closed.
12. Consider and Possible Action Regarding a Replat of Sanger I-35 Industrial Park, Lots
IR-1, IW2, and 2R-1, block A. Property is Located on F.M. 455 and Acker Street.
Councilman Evans moved to accept the Replat, Councilman Higgs seconded, Motion
carried unanimously.
13. Consider and Possible Action on Amending the Building Permit Fees.
Item Tabled.
14. Consider and Possible Action on Interlocal Agreement Between the Sanger Independent
School District and the City of Sanger.
City Secretary explained this had been sent to the attorney for review, the attorney
returned his recommended changes and the school made the changes and resubmitted
the agreement...
Councilman Higgs moved to accept the Interlocal Agreement Between the Sanger
Independent School District and the City of Sanger. Councilman Garza seconded.
Motion carried unanimously.
15. Consider and Possible Action on Interlocal Agreement with Denton County for Tax
Collection.
Councilman Evans moved to accept the agreement. Councilman Higgs seconded,
Motion carried unanimously.
16. Consider and Possible Action on Interlocal Agreement between the City of Sanger and
Denton County Regarding Jurisdiction of Subdivisions in the E.T.J.
Mayor asked if this was for the County to give control to the City.
City Manger indicated it was; but that there were some concessions on bar ditches,
sewer, and culverts.

Councilman Evans moved to approve the agreement. Councilman Higgs seconded,
Motion carried unanimously.
17. Consider and Possible Action on Resolution #06-09-02 -Setting Date, Time, and Place
for Public Hearing on Proposed Annexations.
City Secretary explained this is taking a small area in the front part of Rising Star
Lane.
Discussion.
Councilman Ervin moved to approve Resolution #06-09-02. Councilman Garza
seconded. Motion carried unanimously.
18. Consider and Possible Action Regarding Connect Fees in the Sanger Mobile Home
Park.
City Manager explained the Sanger Mobile Home Park is planning to add 25 lots to the
park. Staff is asking for direction on now or if to charge tap fees.
Carroll McNeill, 701 Denton, indicated they are wanting to tie into their own lines in
the park This was platted years ago before the new fees were put in place.
Discussion.
Councilman Evans indicated if the lines belong to the City and the City maintains them
he felt they should be charged tap fees.
Councilman Ervin asked what Mr. McNeill would do if he were sitting in their seats.
Mr. McNeill indicated he wanted it to be fair, and realizes it will cost money. The tap
fees bring more money than the water rates.
City Manger indicated Joe Falls will pay $4,000.00 per lot when his previously platted
property is developed.
Discussion regarding the property.
Mr. McNeill asked what would the Council like to see on the property if he can't
develop because of the tap fees.
He indicated he could develop it as commercial property.
Lengthy Discussion.
Councilman Evans indicated if the City kept ownership of the lines he would like $2,000
for each tap.
No Action Taken.

In general the Final Plat, Preliminary Utility Layout, and Preliminary DrainageStudy
comply with City ordinances and with standard engineering practices and principles.
Pwsuant to Section 19.3.d of the zoning ordinance a solid masonry or wood wall having a
minimum height of six (6) feet above the average grade of the residential property shall be
constructed adjacent to rear property line adjacent proposed Phase II Serendipity Place
residential subdivision.
Detailed site grading plans and utility plans will be required for each lot within the subdivision
prior to approval of a building permit.

No. 05-06-01. My review comments are as follows:
General
1. The property is generally located at the southeast comer of the intersection of FM 455 and North
Keaton Road within the City of Sanger city limits.
Final Plat
1. The arrow pointing to the additional 15 feet of ROW to be dedicated is pointing to the wrong
lines. This comment was identified m my last letter but was not addressed.
2. Pursuant to Item 4.04.P of the Subdivision Ordinance, construction plans should show and
evaluate all existing and proposed drainage facilities. This comment was identified in my last
letter but was not addressed completely. The existing driveway culvert for Lot 1 and the culvert
crossing Keaton Road need to be evaluated.
3. According to the ditch profile on Sheet 2 the ditch is going to be re -graded. The stationing of the
re -graded ditch needs to be shown. The re -graded portion of the ditch appears to require that the
existing driveway culvert in front of Lot 1 be lowered. The lowered culvert is not shown in the
profile. I would suggest that a new culvert be placed in front of Lot 1 with standard TxDOT
safety end treatments be constructed in accordance with the drainage evaluation.

Per your request I have reviewed a Final Plat as prepared and submitted by Isbell Engineering
Group, Inc. for the project referenced above. Comments are referenced by the Subdivision
Ordinance of the City of Sanger, Texas as adopted September 21, 1987, Zoning Ordinance
adopted August 3, 1987, and Ordinance No. 05-06-01. My review comments are as follows:
General
1. All comments received from Public Works, Fire Department and Code Enforcement
should also be addressed prior to approval of the Final Plat.
2. The property is generally located at the southeast corner of the intersection of FM 455
and North Keaton Road within the City of Sanger city limits.
Final Plat
1. The typical setback detail shown applies to -interior lots -only and does notapply to Lot l
2. Pursuant to Section 19.3.d of the zoning ordinance a solid masonry or wood wall having
a minimum height of six (6) feet above the average grade of the residential property shall

provided. The typical lot grading plan shown is not sufficient for determining impact on
adjacent properties.
4. Pursuant to Item 4.04.P of the Subdivision Ordinance, construction plans should be
provided showing ditch improvements along FM 455 and all proposed drainage

Per your request I have completed a final review of a Preliminary Plat, Preliminary Utility
Layout, and Preliminary Drainage Study as prepared and submitted by Crannel, Crannel &
Martin Engineering for the project referenced above. My review comments are as follows:
In accordance with the current City's Park Ordinance a total of 7.60 acres of park space is
required. The plat shows a total of 9.40 acres if the City allows the developer to utilize detention
pond area as park space. This would be acceptable under the condition that the detention ponds is
designed to minimize water depth and facilitate access to adjacent park space.
In general the Preliminary Plat, Preliminary Utility Layout, and Preliminary Drainage Study
complies with City ordinances and with standard engineering practices and principles.
Before approval of the final plat for any phase of the project by Town Council, I would
recommend that an evaluation of the capacity of lift station, forcemain and existing downstream
sewer be evaluated relative to the potential impacts this project will have and to insure capacity
to service this subdivision.

Dear Mark,
Our office received your comments dated May 29, 2002 on June 4, 2002. We revised the
drawings as follows:
General

2. Our detention pond is designed for 3' of water depth. There is a 1.3' freeboard
from the proposed 100 year water surface elevation to the top of spillway. We
could reduce or increase the freeboard if necessary.
3. Lot 19, Block C vas adjusted to be 60' wide.
4. �Ve have located the water lines approximately on the drawing and dimensioned
to the property line. tiVe will need to excavate and exactly locate the lines during
final engineering plan preparation. `Ve will reduce the 30' wide easement once
the lines are visually located.
6. The requested note vas added to the plan.
6. The heavy dashed line on Lot 29, Block N has been removed. A drainage line
into the detention pond is proposed in this location.

l . We will prepare a study on the existing sanitary sewer lift station. We would
prefer to make this study at the time of final engineering plan preparation. The
developer will agree to upgrade the existing lift station, upgrade the existing force
main if necessary. The developer will also agree to construct a lift station within
this development and, if possible, extend the force main to* the east under the
railroad track thereby bypassing the existing lift station.
2. Water line dimensioned to the property line as measured from above ground
evidence.
Preliminary Drainage Plan
1. Line weights adjusted to provide clarity. Phase line removed from the plan.
2. Offsite drainage area map revised to show USGS contours.

Dear Mr. Smith:
Per your request I have completed a first review of a Preliminary Plat, Preliminary Utility
Layout, and Preliminary Drainage Study as prepared and submitted by Crannel, Crannel &
Martin Engineering for the project referenced above. As you may recall a preliminary plat with
the same name was previously submitted and brought before council by a different devloper for
the same piece of property. The previous plat was never approved be cause the developer
withdrew it because the City was not going to grant a variance for 5' sideyard setbacks. My
review comments are as follows:
General
1. It is my understanding that the original zoning classification for this property before the
current zoning ordinance was adopted was SF-3 or 6,000 square foot lots and that after
the new ordinance was adopted this property retained a 6,000 square foot lot zoning
designation which equates to the current zoning classification of SF-8 with a minimum
lot area of 6,000 square feet. Consequently the lot sizes shown in this plat are in
conformance with the ordinance. _
2. In accordance with the current City's Park Ordinance a total of 7.60 acres of park spac is
required. The plat shows a total of 9.40 acres if the City allows the developer to utilize
detention pond area as park space under the condition that the detention ponds is
designed to minimize water depth and facilitate access to adjacent park space.
Preliminary Plat
1. Contrary to the previous plat 8' sideyard setbacks are provided.
2. The drainage plan indicates that the detention pond is a little over 7 feet contrary to what
is shown on the plat.

3. The frontage at the building line should be a minimum of 60 feet. Lot 19 Block C appears
not to meet this requirement.
4. A 30-foot permanent easement is shown along the north side of Block A. I realize that
there are two (2) existing water lines (12" Upper Trinity feed line and 12" city line)
located somewhere close to or within the proposed easement. The plat should show the
location of these two (2) lines to verify that the proposed easement will accommodate
future maintenance of these lines. A 30-foot easement may or may not be required.
S. A note should be placed on the plat stating that the 20' ingress/egress easement will be
abandoned when Quail Crossing and Primrose Drives are constructed.
6. There is heavy dashed line along the south side of Lot 29 Block N that has not been
defined and which needs to be defined.
7. Three 15-foot utility easements are shown crossing Block G. Utility easements cannot be
split onto two lots and should be contained entirely within one lot. Apparently these
easement are to be used for drainage purposes.
Preliminary Utility Layout
1. Before approval of the preliminary plat by Town Council, I would recommend that an
evaluation of the capacity of lift station, forcemain and existing downstream sewer be
evaluated relative to the potential impacts this project will have and to insure capacity to
service this subdivision. I see no problem sending the plat to planning and zoning for
their review but prior to placing this plat on the Town Council agenda, I would require
that the impact study be completed per Eddy's and my satisfaction.
2. As previously stated the 12" waterlines should be accurately shown.There is a 7'
dimension shown but it_is_ diflicult to_ determine what Lne-dimension is referring to
Preliminary Drainage Study
1. It hard to differentiate between phase lines and drainage area delineation lines. It help my
evaluation if this could be clarified.
2. An offsite drainage area map is shown. The offsite drainage area should be shown to
scale at a much larger scale than shown. It should also show at least USGS contour
intervals with drainage area delineations to assist in evaluating the drainage calculations.
3. A table showing drainage calculations is provided. It should show the time of
concentration utilized in the calculations. It should also show a comparison of development and and post development stormwater flow projections.

Attached is the proposed ordinance for de -annexing this property and a copy of the request for de -
annexation. This property was previously taken in as the owners had plans to develop it. Once it
was annexed the Council turned down the zoning change request to Single Family because it is in
Bolivar Water Supply's CCN. Bolivar will not release the CCN and the property owners cannot
develop the property. The City cannot provide them services; therefore, they have requested to be
de -annexed.

WHEREAS, sparsely populated and uninhabited areas in Home -Rule municipalities
may be disannexed under the provisions of V.T.C.A., Local Government Code, Section 43.1441

municipality and contains fewer than one occupied residence or business structure for every
two acres and fewer than three occupied residences or business structures on any one acre and

After reviewing our current fees with our City Engineer, staff feels it is in the best interest of the
City to raise the plat review fees to make sure we are covering the cost of the review and
administrative costs as well. Sometimes the City Engineer has to review the plats 4 or 5 times before
the surveyors get them processed correctly. We pay our engineer by the hour and this is consuming
a lot of his time. We feel the increase is necessary to cover this cost.
The ordinance also includes a fee for review of construction plans. The City Engineer has come up
with this fee, and feels it should cover Lite cost of review.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SANGER, TEXAS:
SECTION I
THAT CHAPTER1099 ARTICLE 10.1007 SECTION 7 OF THE CITY OF SANGER CODE
OF ORDINANCES IS HEREBY AMENDED TO READ AS FOLLOWS:
SECTION 7.01 -The schedule of fees and charges shall be paid to the city when any plat is
tendered for approval. Each of the fees and charges shall be paid in advance.
SECTION 7.02 -The City Administrator or the Building Inspector or those duly designated,
shall calculate the basic fees and charges for Plat review in accordance with the following
schedule:

BUILDINGS, TO THE CODE OF ORDINANCES OF THE CITY OF SANGER, TEXAS,
AND PROVIDING FOR THE REPEAL OF ORDINANCES IN CONFLICT; PROVIDING
A SEVERABIL,ITY CLAUSE; AND, PROVIDING FOR AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SANGER, TEXAS:
THAT CHAPTER 3, ARTICLE 3.1900 OF THE CITY OF SANGER CODE OF
ORDINANCES IS HEREBY ADDED AND TO READ AS FOLLOWS:
ARTICLE 3.19 PORTABLE OFFICE BUILDINGS
Sec. 3.1901 Use of Portable Office Buildings Restricted
This article establishes the use of portable office buildings in all zoning districts
Definition: Portable Office Building shall mean a portable building either transported
by skids on a flatbed trailer or equipped with axles and wheels. The building may have
multiple rooms and a restroom but may not have a kitchen area.
No Portable office building shall be used in any "SF", "MF", or "MH" zones.
Only under extreme circumstances may a portable office building be used in
zone. Extreme circumstances shall include the following:
(a) Disaster -Fire, tornado, flood, etc. — A portable office building may be utilized as
temporary space until repairs andlor reconstruction is completed. Once repairs and/or
reconstruction is completed, the owner has 30 calendar days to remove the building
from the premises.
(b) Major Remodeling of Permanent Structure - When a business located in the
zones can continue business, while remodeling, by using a portable office building, a
temporary "Certificate of Occupancy" may be issued for a period of time not to exceed
6 months. If a six month time limit is not long enough to complete the project,
additional time may be requested and granted if, to the satisfaction of the Code
Enforcement Officer, additional time is needed.
Appearance -The outside of the building shall have a pleasant appearance. The paint
shall be complete, trim and moldings shall be finished and in good repair and the roof
shall have an attractive appearance. If the design of the building requires that blocks
are used for a foundation, skirting shall completely enclose the underneath of the
building and shall extend to the ground.
Sec. 3.1902 Penalty for Violations
Any person, firm or corporation who shall violate any of the provisions of this article
shall be guilty of a misdemeanor and upon conviction shall be fined in accordance with
the general penalty provision found in Section 1.109 of this code.
SECTION II
All Ordinances or parts of Ordinances in conflict herewith are, to the extent of such
conflict, hereby repealed.
It is hereby declared to be the intention of the City Council that the sections,
paragraphs, sentences, clauses, and phrases of this Ordinance are severable and, if any phrase,
clause, sentence, paragraph, or section of this Ordinance shall be declared unconstitutional by
the valid judgement or decree of any court of competent jurisdiction, such unconstitutionality
shall not affect any of the remaining phrases, clauses, sentences, paragraphs, and sections of
this Ordinance, since the same would have been enacted by the City Council without the
incorporation in this Ordinance of any such unconstitutional phrase, clause, sentence,
paragraph, or section.
SECTION IV
This Ordinance will take effect immediately after it's passage and publication.

of the City of Sanger, Denton County, Texas.

As you are aware, to service the sewer to Sanger Trails, it is necessary to cross Mr. Stevens property.
We have been in discussion with Mr. Stevens regarding easements. Mr. Stevens is requesting
compensation for these easements. He is requesting that the City lay a line in front of his property
along F.M. 455 and approximately 3100 feet alongside his property. I have advised him that the
Council may agree to giving him taps for the easement, but that the cost for what he is asking would
be approximately $105,000.00, I have advised him to go before the Council to make his request.
He should be present at the meeting to address this item.

Enclosed please find a very basic agreement I prepared for getting the electric service
from Wal-Mart to your elevated storage tank. You could expand this agreement somewhat by
providing a little more descriptive language about what the service will involve and by adding a
diagram as Exhibit "A". Please let me know if you have any questions or if there are any
changes or corrections necessary in the form of this agreement.

AGREEMENT FOR PROVISION OF ELECTRIC SERVICE
The City of Sanger, Texas ("City") and Wal-Mart Stores, Inc. ("Wal-Mart"), for the
purposes and considerations herein expressed, agree as follows:
1. The City has constructed an elevated water storage tank approximately one
hundred feet from the Wal-Mart water storage facility in the City as shown on
Exhibit A hereto.
2. Wal-Mart has electric service to its water storage facility on its property.
3. FAA regulations require a lighted beacon on top of the City's elevated water
storage tank.
4. Wal-Mart agrees to allow the City to make connection to Wal-Mart's electric
service to furnish power for the required beacon on top of the City's elevated
storage tank.
5. The parties agree that the electrical work required and all appurtenances necessary
to place the beacon on the City's elevated water storage tank will be installed by a
licensed Master Electrician in accordance with all applicable codes and
ordinances of the City and in compliance with all applicable FAA regulations.
6. Wal-Mart will furnish the electric service for the beacon at its expense and cost
and at no cost to the City, except for the installation.
7. That in consideration of the furnishing of the electric service to the beacon, the
City agrees to indemnify and hold Wal-Mart Stores, Inc., its officers and
employees, harmless from and against any and all claims, liabilities, damages,
penalties, losses, costs or expenses incurred by any of them incident to, resulting
from, or in any way arising out of an injury to a person or damage to property in
any way related to the connection of the electric service from the Wal-Mart
property to the beacon on the City's elevated water storage tank and arising from
the negligence or willful conduct of an employee of the City, except for any such
claims, liabilities, damages, penalties, losses, costs, or expenses incurred resulting
from the negligence or willful conduct of an employee of Wal-Mart, provided
however, that the City does not waive sovereign immunity or any other defense it
may have to any such claim by any third party.
8. This Agreement has been approved and executed by the appropriate officers of
Wal-Mart and the City and is effective on the day of

SANGER PUBLIC LIBRARY
MAY 2002 ACTIVITIES

HIGHLIGHTS:
The Library Director visited Chisholm Trail Elementary School to promote the Summer
Reading Club. Three programs were presented, one to each grade level. Over 150 children in
each grade participated in an active story and listened to one being read.
In addition, the Library Clerk, Lynne Smiland, was invited to speak about the Titanic to
the Special Education kids in fifth grade at Clear Creek Intermediate.
ADMINISTRATION:
Completed a survey about the benefits we have received from the Telecommunications
Infrastructure Fund Board. Future funding for this agency is in jeopardy. Our six newest
computers were purchased and our building network wiring was upgraded using TIF funds.
Completed a survey about the future possibility of putting the library catalog on the
Internet. This would not currently be possible because our T4 connection through the school has
security measures in place that prevent it.
Submitted the 2002-2003 budget proposal to the City Manager.
Recruited sponsors for the Summer Reading Club. Sponsors are Radio Shack, Friends of
the Library, McDonald's, Video Corner, Whataburger, Jack -in -the -Box and The Tomato.

Denton County Library Advisory Board, 5/16, Lake Dallas
North Texas Regional Library System Meeting, 5/23, Fort Worth
CIRCULATION:
Took a fresh set of books to the Senior Citizens' Center.
Prepared a packet of 25 videos to circulate among other Denton County libraries.
PUBLIC RELATIONS:
Distributed a flyer about the Summer Reading Club to kids in grades 1 through 5. Put up
posters about the Summer Reading Club in local businesses and schools.
SPECIAL PROJECTS:
Shipped the next set of newspapers to be microfilmed.
Took Doctor's account books from John Chapman's grandfather to be microfilmed. He
is funding this for the history and genealogy records at the library.
PROGRAMS:
"Music" was the Storytime theme. Every week children played with rhythm instruments.
At the first program of the month the children danced around a Maypole. Other activities were
simplified square dancing and playing with a parachute. Weekly themes were "May Music",
"Percussion", "Musical Instruments", "Dancing" and "Silly Songs". Crafts included a May
basket, a drum, a rubber -band guitar, a dancing puppet and a kazoo.

Summer fun at the Library
Kids can "Read Across Texas" this summer as the Sanger Public
Library presents the Texas Summer Reading Club. Entertaining pro-
grams each week will feature stories, songs, activities and crafts from
the Piney Woods to the oil fields, from Palo Duro to the Rio Grande.
Programs for school -age children will be on Tuesday mornings at 10
a.m. Preschool programs will be on Wednesday mornings at 10 a.m.
Kicking off the summer fun will be a special program called "Read-
ing is Magic!" It will be performed by Gerald Edmundson who was
called "a sleight of -hand virtuoso" by the Fort Worth Star Telegram.
Kids will be mesmerized by the magic and entertained by the humor.
Magic on TV can seem rigged. Magic seen first hand can truly be amaz=
ing. "Reading is Magic!" will be presented at the Library on Tuesday,
June 4 at 10 a.m. Register now by calling 458-3257.
Kids who can't come to library programs can still have fun this sum-
mer by signing up to Read Across Texas. After picking up a Reading
Log, they can read anywhere and any time they like. Each time they
read for two hours, they earn something. The first thing they earn is a
ticket to the Reading Club Swimming Party in August. The Library is
located on the corner of Bolivar and 5th Streets. Come in for summer
