Please c t�actA N W 84r` MINUTES: CITY COUNCIL OCTOBER 159 2001 PRESENT: Mayor Tommy Kincaid, Councilman Glenn Ervin, Councilman Joe Higgs, Councilman Craig Waggoner, Councilman Andy Garza, Councilman Jimmy Evans OTHERS PRESENT: City Manager Jack Smith, City Secretary/Assistant City Manager Rose Chavez, Assistant City Secretary Samantha Renz, Water/Wastewater Superintendent Eddie Branham, Code Enforcement Officer Ken Wilson, Police Chief Curtis Amyx, Don Holson, Tim Evans, Hector Forestier 1. Mayor called meeting to order, Councilman Garza led the Invocation, Councilman Evans led the Pledge of Allegiance. CONSENT AGENDA 2. a) Approve Minutes: October 1, 2001 b) Disbursements Councilman Evans moved to approve the Consent Agenda, Councilman Garza seconded. Motion carried unanimously. 3. Citizen's Input. None. 4. Discussion Regarding Issues Concerning Plat for Don Holson. Don Holson, 777 F.M. 455 West, indicated he had put in a Plat for a subdivision in May, and was wondering why nothing has happened. He indicated he spoke with Jerry Jenkins in August and Jerry followed up with the City Secretary, who said she would follow up on it. The City Secretary called the surveyor who indicated they did not receive a copy of the Engineer's letter and she faxed it to them. City Secretary indicated she had faxed the letter and that Samantha had followed up on it as well, the surveyors indicated they were not sure if Mr. Holson was going to proceed with the plat. Don Holson indicated he did not receive a copy of the Engineer's letter, and he requested a refund on his plat fees. Mayor asked Mr. Holson to allow the staff to try to straighten out the situation prior to giving him a refund, and if it couldn't be worked out that a refu�would be given. ` Ti!00.0 City Manager indicated staff cannot straighten it out without the needed information requested on the Engineer's letter. Mr. Holson's surveyor will need to provide the Preliminary Plat and the Drainage calculations. Discussion regarding the Plat. Mr. Holson indicated he would get with his engineer and see what could be done. Mayor moved up Item #8. 8. Consider and Possible Action Regarding Johnson Control Consultants and Discussion of an Energy Savings Survey and Approval of the Project Time -line. Tim Evans, Johnson Controls in Irving, gave the Council a packet with a general outline of his discussion. He indicated there were three things that needed to be discussed which were, financial solutions, financial tools, and who the Company is. The Company financially helps cities and counties reduce their costs and raise there revenues, as well as maintaining there assets. They would try to find ways to decrease losses in water revenues and other areas. They are requesting to come look at the City to see if there are things they can work with. Basically they try to find ways to improve infrastructure but decrease the costs to the City. Discussed scenarios of average City expenses and revenues. Mr. Evans indicated they would help the City comply with Senate Bill 5, and use money that is already being spent ,they would help the City spend it more wisely. Hector Forestier, indicated the project must be self funding or budget neutral. The Company's creed is to exceed the expectations of the customers. He indicated that School districts take advantage of this program all of the time, and that they have a 97% success rate. He indicated the project is guaranteed, and if they guarantee a savings that is not reached, they will pay the city $Z0,000.00 a year until the problem is fixed. Mr. Forestier indicated it is a very easy process with four phases. The first phase is the planning phase, which is meeting with the staff regarding the project. The second phase is the data collection phase, then there will be a project development agreement, then walk throughs and one on one's with the staff to capture all possible savings. The Final phase is the implementation phase, which would take 4 to 6 months. Mayor asked how much this would cost. Mr. Forestier indicated that there is no cost to the City to get started. They will gather information, and compile it and bring the expected savings to the City along with the cost for implementation and ask for Council's approval at that time. Johnson Controls `a`�' � � rl (� t r, �� will get a percentage of the savings. Discussion. Mayor asked the City Manager if he wanted to do this. City Manager indicated he felt it was a good idea, and felt the City should proceed. Discussion continued. Tim Evans indicated that when the study is done, if they find ways to save money, a second study will be done, and they will advise the City how much they can save them, and guarantee it. He indicated they were only asking for a signature on the time -line so that they could get started on the preliminary phase. They are not asking for any money at this time. They will come back to the Council prior to any cost being incurred. Councilman Ervin moved to approve the project time -line, Councilman Garza seconded, Motion carried unanimously. 5. Consider and Possible Action Regarding a Preliminary and Final Plat for McKnight Addition, being 6.00 Acres in the B. Lynch Survey, Abstract 725 in the E.T.J. of the City of Sanger, Denton County, Texas, Brief Discussion regarding the location of the lot. Councilman Evans moved to approve the plat, Councilman Higgs seconded, Motion carried unanimously. 6. Consider and Possible Action on OrdinanceAdopting a New Personnel Policy for the City of Sanger. Councilman Ervin asked about vacation time and if it carries over from year to year. Staff indicated it does not carry over. Brief Discussion. Councilman Evans moved to adopt the new personnel policy, Councilman Higgs seconded, Motion carried unanimously. 7. Consider and Possible action on Resolution #10-06-01- Setting a date time and place for Public Hearings on Proposed Annexations. City Secretary indicated this would close in the gaps in our City limits. kW � V V V L Councilman Garza asked if the City was going to send out letters to the property owners regarding the public hearings on these annexations. City Secretary indicated it is not required and staff was not planning to do We Councilman Garza indicated he would like to see letters sent out. City Secretary indicated the letters would be sent. Discussion. Councilman Higgs indicated he would like to annex one mile out on F.M. 455 East and West and one mile North on the highway. Lengthy discussion regarding annexation of the roads. Councilman Evans moved to adopt Resolution #10-06-01 as amended to include one (1) mile North on I 35 or to the County line and F.M. 455 East and West. Councilman Higgs seconded, Motion carried unanimously. 9. Consider and Possible Action on Ordinance #10-27-01 -Amending the Fees for Electrical Permits, Plumbing Permits, and Mechanical Permits. Councilman Evans moved to approve Ordinance #10-27-01. Councilman Garza asked about the exhaust fans and the AC unit being the same charge. Ken Wilson indicated they would be the same, and that this was done to reduce confusion on the costs of permits. Discussion. Councilman Waggoner seconded, Motion carried unanimously. 10. Eddie Branham indicated this is basically changing the wording of the current ordinance to include "attack on a person". This way the animal control can take care of a situation where there is an attack on a person or an animal and not just an animal. This is a state requirement and the attorney prepared the ordinance. Councilman Waggoner moved to adopt Ordinance #10-28-01, Councilman Evans seconded, Motion carried unanimously. To serve on the ARB, you must have lived in the appraisal district for at least two years before taking office. You don't need any special qualifications, but you may be ineligible to serve on the appraisal review board if the person is a member of the board of directors, an officer, or employee of the appraisal district, an employee of the comptroller, or a member of the governing body, officer, or employee of a taxing unit. In county of more than 100,000, a person is ineligible if the person: 1. Has served all or part of three previous terms. 2. Is a former member of the board of directors, officer, or employee of the appraisal district. 3. If the person served as a member of the governing body or officer of a taxing unit for which the appraisal district appraises property, until the 4th anniversary of the date the person ceased to be a member or officer 4. Has ever appeared before the ARB for compensation. You also may not serve as an ARB member if you are closely related to a person who operates for compensation as a tax agent or is in the business of appraising property for property tax purposes in the appraisal district. Relatives barred are those within the second degree of consanguinity or affinity. If you knowingly violate this provision, you commit a class B misdemeanor. This provision took effect September 1, 1989, and applies only to ARB members serving terms that began after that date. The law also bars from ARB service members who contract with the appraisal district or with a taxing unit in the appraisal district. The bar applies if the member or a business entity in which the member has a substantial interest contracts with the appraisal district or a taxing unit that participates in the appraisal district. Likewise, the same taxing units and the appraisal district are each prohibited from contracting with an ARB member or a business entity in which an ARB member has a substantial interest. Substantial interest is defined as either: 1. Combined ownership by the member or the member's spouse of at least 10 percent of the voting stock or shares of the business. 2. Service by the member or the member's spouse as a partner, limited partner or officer in the business entity. You may also not serve if you hold some other paid public office. The Texas Constitution does not allow a person to hold more than one paid public office. S. B. 1017 requires the Comptroller to approve curricula, provide materials and supervise a course for training ARB members. The Comptroller shall issue certificates indicating course completion. All ARB members must complete the course or may not participate in ARB hearings. ARB Terms and Size Members serve two-year staggered terms; approximately half the member's terms expire each year. Terms begin January 1. The appraisal district directors appoint ARB members by a �IAgj ,.icy vote and record their decision in a resolution. ARB Compensation The ARB receives a $50.00 for a half day and $12.50 an hour for any hours worked after the $50.00 minimum. The maximum pay is capped at $100.00 per day. ARB Meetings ARB regular meetings are the third Wednesday of each month at 9:00 A.M. These monthly meetings are approximately six to eight hours long. ARB reappraisal hearings will start on a daily basis, as needed, from late May until the appraisal roll is approved usually in late July. Meetings will normally be from 9:00 A.M. to 5:00 P.M. In October reappraisal hearings will start on the third Wednesday and usually continue for about a week from 9:00 A.M. to 5:00 P.M. Effective January 1, 1998, ARB's must provide hearing times in the evening and on a Saturday or Sunday. Currently the Board meets two nights a week during the summer months until 8:00 P.M. I am willing to discuss transferring the certification for the new school to Sanger if the City is willing to agree to terms and provide compensation that are acceptable to CoServ. I am open to compensation in the form of cash or service area swap. In addition, CoSery will need to be reimbursed for its investment in electric facilities constructed to provide service to the school. Terms and conditions, waivers, releases and indemnities are unknown at this time but will need to be developed and agreed upon. The best way to start might be for you and the City Council to discuss this and come back to CoSery with an offer as a starting point for further discussion.
