MINUTES: CITY COUNCIL OCTOBER 19 2001 PRESENT: Mayor Tommy Kincaid, Councilman Glenn Ervin, Councilman Joe Higgs, Councilman Craig Waggoner, Councilman Andy Garza, Councilman Jimmy Evans OTHERS PRESENT: City Manager Jack Smith, City Secretary/Assistant City Manager Rose Chavez, Assistant City Secretary Samantha Renz, Water/wastewater Superintendent Eddie Branham, Electric Superintendent Mike Prater, Streets/Parks Superintendent John Henderson, Code Enforcement Officer Ken Wilson, Jay Parr, Grace Garza, Chris Henderson, Kim and John Looper, Bob Kneis, Frank Pieczynski, Betty Robinson, Shelley Ruland 1. Mayor Called meeting to order, Councilman Higgs led the invocation, and Councilman Evans led the Pledge of Allegiance. CONSENT AGENDA 2. a) Approve Minutes: September 17, 2001 September 24, 2001- Special called b) Disbursements Councilman Evans moved to approve the Consent Agenda, Councilman Higgs seconded. Councilman Garza asked about the disbursement for Sanger Courier. City Secretary indicated it was for all of the legal notices that were published. Councilman Evans asked about the phone bill for the Library. Samantha Renz, Assistant City Secretary indicated it was for the Internet computer, and they would try to get a credit on the bill. Motion Carried Unanimously. 3. Citizen's Input. a) Kim Looper, Rising Star lane, indicated they had approached the Council regarding the drainage behind their home. The Wilson's were told to cease work until an engineer had come to review it. Mayor Tommy Kincaid indicated the engineer advised it was not the City's property; therefore, it was a dispute between two neighbors and there was not anything the City could do about it. City Secretary explained that Benny Parrent owns two tracts of land in that area, and there is one tract at the far end that belongs to Looper, and is adjacent to his property. Discussion. Mr. Looper asked about the trash that was being used to fill the creek. Mayor indicated the Inspector would need to go and look at it, and see if there is anything being dumped that is illegal. Councilman Ervin asked if the Engineer was supposed to give them something in writing. He indicated the Looper's should be advised of what actions they can take. Discussion regarding the property behind the Looper's home. Councilman Ervin asked about the tax lien on the property and if the City could pay the taxes. City Secretary indicated it would have to go on the tax sale before the City could buy it without it being deeded to the City by Benny Parrent. b) Betty Robinson, Sanger South, Blk 3, Lot 13, showed pictures of the easement next to her property and indicated it has not been cleaned out for a long time. She cannot even get down in the ditch to mow it. She expressed concerns regarding possible flooding. The curb is also broken and her yard is washing away. Staff indicated it would be taken care of. c) Jay Parr, Southside Dr., indicated the people in the duplex across the street from him have now put up Halloween decorations, and indicated it did not appear to him that they were planning on moving anytime soon. He indicated he would like something done. Ken Wilson indicated the owner has gone to court and was given 90 days to cease and desist. If in 90 days the people have not moved, the owner will be fined. 4. Consider and Possible Action on Presentation from I.E.S.I. Regarding a Possible Change to Front Loading Dumpsters from the Current Side Loading Dumpsters. Bob Kneis, IESI, indicated the current rates and service schedules are for front load dumpsters. Currently when someone needs and 8-yard dumpster, they have two (2) four yard containers. They will replace the dumpsters with new dumpsters if the change is approved. The contract and rates will not change. Councilman Ervin asked if the dumpsters will be relocated because of the overhead 4��UQ� lines. Mr. A eis indicated they would. He indicated they would also put signs on them. Discussion. Councilman Evans moved to let IESI change out the dumpsters. Councilman Higgs seconded. Motion carried unanimously. 5. Consider and Possible Action on Budget Amendments for 2000/2001 FY End. Amendments as follows: $18,000.00 from 50-6020 to 52-5420 $I9200.00 from 58-5420 to 58=5390 $700.00 from 42-6040 to 42-5310 For Holt Street Project. For purchase of radio For Internet wiring and AC repair Councilman Evans moved to approve the amendments. Councilman Waggoner seconded. Motion carried unanimously. 6. Consider and Possible Action on Ordinance #10-25-01 -Annexing the following Properties. ABSTRACT 1241, H. TIERWESTER SURVEY, TRACT 57A, BEING 1.86 ACRES SITUATED ON THE NORTH SIDE OF FM 455. (Acct. #R184931) ABSTRACT 1241, H. TIERWESTER SURVEY, TRACT 40, BEING 49.2 ACRES SITUATED ON THE SOUTH SIDE OF BELZ RD. Mayor read caption as follows: THE CITY OF SANGER, TEXAS AND EXTENDING THE BOUNDARIES OF SAID CITY SO AS TO INCLUDE SAID HEREINAFTER DESCRIBED PROPERTY WITHIN THE CITY LIMITS, AND GRANTING TO SAID TERRITORY AND TO ALL FUTURE INHABITANTS OF SAID PROPERTY ALL OF THE RIGHTS AND PRIVILEGES OF OTHER CITIZENS AND BINDING SAID FUTURE INHABITANTS BY ALL OF THE ACTS AND ORDINANCES OF SAID CITY. Consider and Possible Action on Ordinance #10-26-01 -Amending the Ordinance Regarding Movement of Used Buildings into the City Limits. Councilman Evans moved to approve Ordinance #10-26-01, Councilman Higgs Ut)�Q3 seconded. Motion carried unanimously. Caption as follows: AN ORDINANCE OF THE CITY OF SANGER, DENTON COUNTY, TEXAS, AMENDING CHAPTER 3, ARTICLE 3.901 OF THE CITY OF SANGER CODE OF ORDINANCES; PROVIDING FOR THE REPEAL OF ORDINANCES IN CONFLICT; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE 8. Consider and Possible Action to Solicit Bids for Completion of Railroad Park. Jack indicated this was to get bids for the completion of Railroad Park. They will need to prepare a bid packet with all items to be completed. City Secretary indicated they will get with the City of Corinth, and will put together a packet. There are two more fields, a concession stand and a park area. Councilman Garza moved to solicit bids, Councilman Ervin seconded. Motion carried unanimously. 9. Consider and Possible Action of Approval of 4A (Sanger, Texas Industrial Development Corporation and 4B (Sanger, Texas Development Corporation) FY 2000-01 Budget. City Manager indicated both boards have approved the budgets. City Secretary indicated there were some penciled in changes on the 4A Board because they wanted to try to reduce their current debt, and voted to not proceed with any new projects until the debt has been reduced. Discussion. Councilman Evans moved to approve the budgets. Motion carried unanimously. 10. Any Other Such Matters. Councilman Garza seconded. a) City Secretary explained the 4B expenditure that was approved at the meeting prior to this Council meeting. She indicated that the they had went over the amount allocated for infrastructure on the Wal-Mart project. There were not enough grant funds to cover the cost and the 4B Board voted to proceed with a loan to cover this over expenditure. b) City Manager indicated at 10:00 a.m. Wal-Mart will take Council members on a tour of the facility. tt��JUC Discussion. c) Councilman Ervin asked about the building behind Dairy Queen, and asked if they had a permit to put in the culvert. John Henderson indicated the culvert was coming out, and being replaced. d) Councilman Evans indicated he had asked Rose about putting an item on the Agenda about people putting things in the R.O.W. or alleys. He felt there should be a fee charged to insure the property is cleaned up properly. Discussion. 11. The City Engineer reviewed the Plat, and we received his comments on July S, 2001,(this was 36 days and our ordinance calls for 20) which also showed to have been sent to the surveyor and Mr. Holson. In August, Jerry Jenkins called and spoke to me regarding the status of this plat. I called the surveyor and they indicated they had not received the letter. I faxed the letter to them, and they indicated they would proceed with the corrections. Samantha called to follow up and was told by the surveyor that there was so much needed that he was not sure Mr. Holson was going to proceed with the plat, and that Mr. Holson would have to hire an engineer in order to comply. On October 5, 2001, Mr. Holson came into the office and was very upset because of the length of time we have had the plat and because of the Engineer's requirements. This Plan was provided in response to our request in our review letter dated July 26, 2001. Our comments are as follows: 1. The drainage plan appears to conform with City of Sanger standards. It should be noted that the runoff coefficient of 0.25 is relatively low compared to a normal residential lot. This coefficient represents a slightly higher coefficient than open land. However, due to the size of the lot (6 acres) this coefficient is acceptable as long as there is no excessive pavement or slab (i.e. impervious area) constructed. 2. We have not received a revised Plat addressing our remaining comments. This concludes our review of the above referenced development. SECTION III It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses, and phrases of this Ordinance are severable and, if any phrase, clause, sentence, paragraph, or section of this Ordinance shall be declared unconstitutional by the valid judgement or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs, and sections of this Ordinance, since the same would have been enacted by the City Council without the incorporation in this Ordinance of any such unconstitutional phrase, clause, sentence, paragraph, or section. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SANGER, TEXAS: SECTION 1. That Chapter 2, Article 2.100, of the Code of Ordinances, City of Sanger, Texas, is hereby amended, in part, as follows: "ARTICLE 2.100 DEFINITIONS Animal Control Authority. Shall mean the animal control officer of the City of Sanger. Dangerous Dopy. As used in this Article, "dangerous dog" means a dog that: a. Makes an unprovoked attack on a person or animal that causes bodily injury and occurs in a place other than an enclosure in which the dog was being kept and that was reasonably certain to prevent the dog from leaving the enclosure on its own$ or b. Commits unprovoked attacks in a place other than an enclosure in which the dog was being kept and that was reasonably certain to prevent the dog from leaving the enclosure on its own and those acts cause a person to reasonably believe that the dog will attack and cause bodily injury to a person or animal. Doa. Shall mean a domesticated animal that is a member of the canine family. 43720 Secure Enclosure. Shall mean a fenced area or structure that is. (a) Locked; (b) Capable of preventing the entry of the general public, including children; (c) Capable of preventing the escape or release of a dog; (d) Clearly marked as containing a dangerous dog; and (e) In conformance with the requirements for enclosures established by an ordinance of the City of Sanger. Serious Bodil�njury. Shall mean an injury characterized. by severe bite wounds or severe ripping and tearing of muscle that would cause a reasonably prudent person to seek treatment from a medical professional and would require hospitalization, without regard to whether the person actually sought medical treatment. SECTION 2. That Chapter 2, Article 2.300, of the Code of Ordinances, City of Sanger, Texas, is hereby amended, in part, as follows: "ARTICLE 2.300 DANGEROUS DOGS Section 2.301 Animal Control Officer to Investigate Incidents; to Rule on Dangerous Dogs; Appeals If a person reports an incident described in the definition of dangerous dog, the animal control officer may investigate the incident. If, after receiving the sworn statements of any witnesses, the animal control officer determines the dog is a dangerous dog, he shall notify the owner of that fact. An owner, not later than the fifteenth day after the date he is notified that a dog owned by him is a dangerous dog, may appeal the determination of the animal control officer to the municipal court of the City of Sanger. An owner may appeal the decision of the municipal court judge in the same manner as appeals for other cases from the municipal court. Section 2.302 Requirements for Owners of Dangerous Dogs Ue'4Ja.kt� 43720 (d) Comply with any applicable regulation, requirement, or restriction of the City of Sanger on dangerous dogs. (e) The owner of a dangerous dog who does not comply with the above requirements shall deliver the dog to the animal control officer not later than the thirtieth day after the owner learns that the dog is a dangerous dog; (f) If, on application of any person, the municipal court judge finds, after notice and hearing as provided below, that the owner of a dangerous dog has failed to comply with this section, the court shall order the animal control officer to seize the dog and shall issue a warrant authorizing the seizure. The animal control officer shall seize the dog or order its seizure and shall provide for the impoundment of the dog in secure and humane conditions. (g) The owner of the dangerous dog shall pay any cost or fee assessed by the City related to the seizure, acceptance, impoundment, or destruction of the dog. The City Council may establish the amount of the fees by appropriate resolution from time to time. (h) The court shall order the animal control officer to humanely destroy the dog if the owner has not complied with the provisions of this section before the eleventh day after the date on which the dog is seized or delivered to the animal control officer. The court shall order the animal control officer to return the dog to the owner if the owner complies with the provisions of this section before the eleventh day after the date on which the dog is seized or delivered to the animal control officer. (i) The court may order the humane destruction of a dangerous dog if the owner of the dog has not been located before the fifteenth day after the seizure and impoundment of the dog. (j) For purposes of this section, a person learns that the person is the owner of a dangerous dog when: (1) the owner knows of an attack described in the definition of "dangerous dog" above; (2) the owner receives notice that the municipal court has found that the dog is a dangerous dog; or 43720 (3) the owner is informed by the animal control officer that the dog is a dangerous dog after determination by the animal control officer. Section 2.306 Notice and Hearing (a) The municipal court, on receiving a report of an incident involving a dog or on application by any person, shall set a time for a hearing to determine whether a dog is a dangerous dog or whether the owner of the dog has complied with the requirements of this section. The hearing must be held not later than the tenth day after the date on which the dog is seized or delivered. (b) The court shall give written notice of the time and place of the hearing to: (1) The owner of the dog or the person from whom the dog was seized; and (2) The person who made the complaint. (c) An interested party, including the City Attorney, is entitled to present evidence at the hearing. (d) An owner or person tiling the action may appeal the decision of the municipal court in the manner provided for the appeal of cases from the municipal court. ARTICLE 2.500 PREVENTION OF PUBLIC NUISANCES (a) Every owner shall exercise proper care and control of his animals to prevent them from becoming a public nuisance. (b) It shall be unlawful and an offense for any person to cause, suffer, or permit any animal owned by him to be a public nuisance as defined in this Article; (c) In addition to dangerous dogs and other public nuisances defined herein, the municipal court and the animal control officer shall have authority to deal with dogs that are a danger to persons, and have caused death or serious bodily injury of persons, in the manner provided by Subchapter A, Chapter 822, Texas Health and Safety Code. 43720 (d) A dog that has caused death or serious bodily injury of a large domesticated animal, such as defined in Section 2.1301 of this Chapter, shall be subject to seizure and disposition in the same manner as a dangerous dog or a dog that is a danger to persons. SECTION 3. That all ordinances of the City of Sanger in conflict with the provisions of this ordinance be and the same are hereby repealed. SECTION 4. If any section, paragraph, sentence, subdivision, clause, phrase or provision of this ordinance be adjudged or held to be unconstitutional, illegal, or invalid, the same shall not affect the validity of this ordinance as a whole or any part or provision hereof other than the part so decided to be unconstitutional, illegal, or invalid and shall not affect the validity of the remainder of this ordinance or any other provision of the Code of Ordinances of the City of Sanger. SECTION 5. That any person, firm or corporation violating any of the provisions or terms of this ordinance as amended hereby shall be deemed guilty of a misdemeanor and subject to a penalty as provided for in this ordinance, and upon conviction shall be punished by fine not to exceed the sum of two thousand dollars ($2,000.00) for each offense, and each and every day such violation shall continue shall constitute a separate offense. SECTION 6. MONTHLY REPORT SANGER PUBLIC LIBRARY SEPTEMBER 2001 ACTIVITIES Submitted by Victoria Elieson HIGHLIGHTS: The Friends of the Library held their most successful Book Sale ever at the Sanger Sellabration, netting $775.79. They have earmarked the entire amount for the Sanger Courier microfilming project. ADMINISTRATION: Inventoried and documented the computer network and organized the hard copies of the :c #ware for future access. Reported the theft of about $110 to the Sanger Police. It disappeared between noon on Saturday, September 22 and early afternoon on Monday. Meeting attended: Library Board, 9/10 Denton County Library Advisory Board, 9/20 NTRLS System Meeting, 9/27, Witchita Falls CIRCULATION: Consolidated Books, Paperbacks and Videos into one collection. Revised circulation procedures to reflect that consolidation and current practices. COLLECTION: Took afresh collection of books to the Senior Center. Those books will remain there for four months so that the Seniors can check them out. PUBLIC RELATIONS: Participated in the Community Health Fair sponsored by the Lawrence/McWhorter Foundation and the Denton County Health Department. Our booth featured a sample of the health materials in our collection. We signed up people for library cards and gave away used books related to health issues. PROGRAMS: The Storytime theme was "Basic Concepts". Programs included "Alphabet", "Numbers", "Colors" and "Shapes". Programs continue to include books, fingerplays, songs, crafts, activities and videos based on the theme. Program attendance has dropped since some of our regular attendees in the past have now started school.
