10-27-00-Ordinance-Adding Street Variances requirements in the Extra Territorial Jurisdiction-12/04/2000CITY OF SANGER, TEXAS ORDINANCE No. #10-27-00 AN ORDINANCE OF THE CITY OF SANGER, DENTON COUNTY, TEXAS, AMENDING CHAPTER 91 SECTION 9 OF THE CODE OF ORDINANCES; CITY OF SANGER BY ADDING A PARAGRAPH TO BE NUMBERED 9.03; PROVIDING FOR THE REPEAL OF ORDINANCES IN CONFLICT; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A PENALTY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. BE IT ORDAINED AND ORDERED by the City Council of the City of Sanger Texas: That Chapter 9, Section 9 (9.03) of the Code of Ordinances, City of Sanger, Texas, is hereby added to read as follows: SECTION I 9.03 - A street variance may be given on a street in the Extra Territorial Jurisdiction if it conforms to the following requirements: (a) There are no more than six lots touching the street. (b) No lot shall be less than 3.5 gross acres. (c) Required 1800 sq. ft. minimum dwelling size. (d) All dwellings must be site built, standard construction. SECTION II All Ordinances or parts of Ordinances in conflict herewith are, to the extent of such conflict, hereby repealed. SECTION III It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses, and phrases of this Ordinance are severable and, if any phrase, clause, sentence, paragraph, or section of this Ordinance shall be declared unconstitutional by the valid judgement or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs, and sections of this Ordinance, since the same would have been enacted by the City Council without the incorporation in this Ordinance of any such unconstitutional phrase, clause, sentence, paragraph, or section. SECTION IV This Ordinance will take effect immediately after its passage and the publication of the caption as the law in such cases provides, PASSED AND APPROVED this 4th day of December, 2000, by the City Council ofthe City of Sanger, Texas.
