1. Mayor Called Meeting to Order, and led the Invocation, Councilman Evans led the
Pledge of Allegiance.

2. a) Approve Minutes: August 16, 2001- workshop
August 20, 2001
b) Disbursements
Councilman Evans moved to approve the Consent Agenda. Councilman Ervin
seconded. Motion carried unanimously.
3. Citizen's Input.
Jay Parr, 124 Southside Dr., Indicated when the R.V. Park was put next to the
restaurant it was talked about that it would be new Recreational Vehicles. Currently
there are fifth wheels and used cars. He indicated he would like it investigated. He also
asked about the Single Family residence in his neighborhood that was being used as a
duplex.
City Manager indicated the owner of the Single Family residence has been issued a
citationI and the City will continue to issue citations until the situation is resolved. He
indicated on the R.V. lot that the zoning allows for car sales, and they received a
specific use permit for the motor homes.
4. Discuss Tax Rate; Take Record Vote; Schedule Public Hearing on Tax Rate.
The tax rate was discussed.
City Secretary indicated that previously Council had agreed to go to the rollback rate
of .58879.
City Secretary indicated the Public Hearing will be scheduled on September 24, 2001.
The notice will go to the newspaper this week.
Discussion.
Councilman Ervin moved to raise the rate to the rollback rate of .58879 and to schedule
the Public Hearing on September 17, 2001. Councilman Evans seconded. Motion
carried unanimously.
5. Conduct Second Public Hearing for Annexation of Properties legally described as
follows:

6. Consider and Possible Action on Ordinance #09-17-01 -Regarding the Texas
Manufactured Housing Standards Act.
City Manager indicated that manufactured homes after 1976 are now HUD -Code
Manufactured Homes, and as long as they meet the standards of the zoning of single
family, the City cannot prohibit them in a subdivision. This ordinance will allow the
City to prohibit these homes in a regular subdivision.
Brief Discussion.
Councilman Higgs moved to approve Ordinance #09-17-01. Councilman Garza
seconded. Motion carried unanimously.

7. Consider and Possible Action on the Sanger I.S.D. Water Line.
Mayor indicated the difference between the 12 line and the 16 line is $55,162.00.
The City agreed to pay for the oversize of the line.
City Manager indicated the first estimate was $84,000.00.
Councilman Higgs moved to oversize the line. Councilman Garza seconded. Motion

Councilman Waggoner moved to amend the motion that this be expensed out of the
water tap fees. Councilman Ervin seconded. Motion carried unanimously.
8. Consider and Possible Action on Final Plat for Porter Addition. (F &MBank)
Discussion regarding the plat.
City Manager indicated staff did not realize it needed to be platted, and a permit was
issued. The building was in process when the plat was requested.
Discussed corrections noted by P & Z, the corrections were relating to the General
Notes and the utilities.
Councilman Higgs asked about the driveway permit from TXDOT.
City Manager indicated the permit had been obtained.
Councilman Ervin moved to approve the plat. Councilman Waggoner seconded.
Motion carried 3 to 2. Councilman Higgs and Councilman Garza voted no.
9. Consider and Possible Action on Final Plat for Sanger Industrial Park Lot 1, Block B.
Property is Located at the Corner of F.M. 455 and Fifth Street.
City Manager indicated Mark Owens had submitted a letter in response to Mark Hill's
review letter addressing all items.
Councilman Garza asked about the Electric Service and who would serve it.
Staff indicated it would be Sanger Electric, and the plat has been corrected.
Discussion regarding the review letter and the plat.
Mike Prater indicated he needed an easement for the electric service.
Discussion regarding the easement.
Councilman Waggoner moved to approve the Plat. Councilman Evans seconded.
Motion carried unanimously. Councilman Higgs abstained.
10. Consider and Possible Action on Appointment to the Library Board.
Recommendation was made to appoint Francine Sullivan.
Councilman Ervin moved to appoint Francine Sullivan. Councilman Evans seconded.
Motion carried unanimously.
11. Consider and Possible Action on Ordinance #09-18-01-Amending Demand Charges.
City Manger indicated this was the demand charge that Mike Prater had discussed at
the last meeting.
Councilman Evans moved to approve Ordinance #09-18-01. Councilman Garza
seconded. Motion carried unanimously.

12. Consider and Possible Action on Ordinance 09-19-01-Amending Commercial Water
Rate.
Councilman Evans moved to approve Ordinance #09-19-01. Councilman Ervin
seconded.
Councilman Higgs expressed concerns regarding raising the commercial water rate.
Discussion regarding if there should be a difference between residential and
commercial rates.
Discussed the rates for commercial sewer.
Continued discussion on the proposed increase.
Motion carried 5 to 1, Councilman Higgs voted no.

FOR WATER SERVICE RATES IN THE CODE OF ORDINANCES OF THE CITY

WATER UTILITY RATES; PROVIDING FOR THE REPEAL OF ORDINANCES IN

13. Consider and Possible Action on Proposed Collection Fee of 30% to Possibly be Added
to Collection Contracts for Municipal Court Fines.
Mayor indicated the new legislation allows for this 30% to be collected instead of being
talren from the mmannt of the fine rnllPrtp.&
Councilman Ervin moved to have the 30% collection fee added to the collection
contracts for Municipal Court. Councilman Evans seconded. Motion carried
unanimously.
14. Consider and Possible Action Regarding Water and Sewer Line Repair in Mobile Home
Parks/Private Property.
Councilman Garza asked why this was on the Agenda.
City Manager indicated one of the Council members asked why the City was repairing
lines in the mobile home park.
Councilman Garza asked if they were in the easement.
City Manger indicated they were in the easement; however, these lines were not
installed by the City and are not the standard size the City uses. He is asking for
direction on if the City should make the repairs and if the City should be paying for the
parts to make the repairs.
Discussion regarding the lines and what has been done in the net
Consensus of Council was that the lines are the City's and they will continue to repair
them.
City Secretary indicated the easements are there for both mobile home parks, so in the
future, if Mariam's Mobile Home Park asks for repair of the lines the City will have to
repair them too.
Council agreed.
Discussion regarding street repairs after the water repairs are done.

Council indicated if the line is in the easement and the City cuts the street the City will
have to repair the street.
15. Consider and Possible Action on Councilmen attending the TML Conference in
November.
City Secretary indicated this was November 28-309 2001.
Councilman Evans indicated he could not attend but did not mind if Councilman Ervin
attended. He indicated Councilman Ervin had brought him some tapes from the last
conference and they were very good.
Councilman Garza indicated he felt that one meeting a year should be efficient for each
- oiineil member.
Councilman Ervin indicated he would not attend this meeting; however, he felt that
every Council member should attend these meetings. They address a lot of the issues
that the Council has to deal with and will help them make better decisions.
City Secretary indicated she attends the legislative update seminars and gets a lot of the
updated information. She indicated she would like the Council to attend the seminars
that are not too far away, so that they can get the updated information also. This would
possibly allow Council to bring back information that could have been missed at the
seminars she has attended.
Councilman Ervin indicated he normally spends his own money to bring back tapes and
other materials to share with the other Council members.
Councilman Evans moved to allow any member who wants to, to be allowed to attend.
Councilman Higgs seconded. Motion carried 3 to 2. Councilman Ervin and
Councilman Garza voted no.
16. Any Other Such Matters.

City Manger gave Council a copy of the letter from Upper Trinity regarding a
Water Conservation Garden.
Mayor indicated this should be discussed with the Beautification Board.

As requested, we have reviewed a Replat of the above referenced location as prepared by Alliance
Area Surveying, dated May 29, 2001. Our comments are as follows:
1. All fees shall be paid in accordance with all City rules, ordinances and policies.
2. Additional camments may be received from Public Works, Code Enforcement, Sanger
Electric and the Fire Department.
3. The property is located at the northeast corner of the intersection of Fifth Street and Plum
Street.
4. This tract is in an area currently zoned B-1 . There appears to be a residence on Lot 3R which
is does not conform with the current zoning. A waiver could be provided if this is to remain
a residential structure.
5. In accordance with B-1 zoning, the front building line should be 25', the side building line
adjacent to the street should be 25', the other side building line should be 10' and the rear
yard should be 20' . A 6' masonry or wood wall is required along the rear property line. Lot
4R has two structures that do not conform with the building line requirements. A waiver
could be provided.
6. The City Engineer certificate should be placed on the Replat.
7. Reference to Bolivar Water Supply Corporation should be removed and replaced with the
City of Sanger.

THAT CHAPTER 8, ARTICLE 8.200 OF THE CITY OF SANGER CODE OF ORDINANCES IS
HEREBY AMENDED TO READ AS "EXHIBIT A" ATTACHED HERETO,
SECTION II
All Ordinances or parts of Ordinances in conflict herewith are, to the extent of such conflict,
hereby repealed.
SECTION III
It is hereby declared to be the intention of the City Council that the sections, paragraphs,
sentences, clauses, and phrases of this Ordinance are severable and, if any phrase, clause, sentence,
paragraph, or section of this Ordinance shall be declared unconstitutional by the valid judgement
or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the
remaining phrases, clauses, sentences, paragraphs, and sections of this Ordinance, since the same
would have been enacted by the City Council without the incorporation in this Ordinance of any
such unconstitutional phrase, clause, sentence, paragraph, or section.
SECTION IV
This Ordinance will take effect immediately from and after its passage and the publication

WITNESSETH that the said Lessor does by these presents lease and demise unto the
said Lessee the following described property, to -wit: Lying and being situated in the City of
Sanger and County of Denton, State of Texas, and being described as 311 North Fifth Street,
Sanger, Texas, for the term of one (1) month beginning October 1, 2001, to be occupied as a
taxidermy shop and not otherwise, Lessee paying therefor the following, to -wit:
(1) The rental for the lease period shall be $350.00 per month.
(2) Rental payment shall be due on the first day of each month in advance, with a ten
percent (10%) late charge if paid after the fifth (5'h) day of each month.
(3) The lease period shall commence October 1, 2001.
This lease is entered into upon the following conditions and covenants, to -wit:
(1) That the Lessee shall pay the rent at City Hall, City of Sanger, Texas, monthly in
advance as aforesaid as same shall fall due.
(2) That the Lessee shall take good care of the property and its fixtures, and suffer in
no waste, and shall, at Lessee's own expense and cost, keep said premises in
good repair. Lessee agrees to accept the possession of the premises in its present
condition and allow for changes in such condition occurring by reasonable
deterioration between the date hereof and the date Lessee occupies said
premises, that no improvements or alterations shall be made in or to the hereby
demised premises without the consent of the Lessor in writing.
(3) That the Lessee shall promptly execute and fulfill all of the ordinances of the City
of Sanger applicable to said premises, at Lessee's expense.
(4) That the Lessee shall not assign this agreement or underlet the premises, or any
part thereof, without the consent of the Lessor in writing.
(5) That the Lessor shall not be liable to the Lessee or the Lessee's employees,
patrons, or visitors, for any damage to personal property caused by the act
of negligence caused by tenant or tenant's employees on the demised
premises, or due to the building on said premises or any appurtenance

there being improperly constructed or becoming out of repair nor for any
damages from any defects or want of repair of any part of the building of
which the leased premises form a part, but the Lessee accepts said
premises as suitable for the purposes for which same are leased and

defects therein and agrees to hold the Lessor harmless from all claims for
any such damage.
(6) It is agreed that this lease shall operate and be construed as a tenancy

A minimum of fifty (50) percent of all walls visible from any side street and not
visible from the designated street must be constructed of materials other than
metal, consistent with the appearance of the materials listed above.
A maximum of ten (10} percent of the building facade visible from the
designated street may be comprised of "split face" concrete block. An
alternative building material consistent with the appearance of the materials
listed above may be approved upon recommendation of the City Administrator
to the Planning and Zoning Commission and City Council.
3.1802 Penalty for Violations
Any person, firm, or corporation who shall violate any of the provisions of this
article shall be guilty of a misdemeanor and upon conviction shall be fined in
accordance with the general penalty provision found in Section 10 of this Code.

that might present a difficulty for you and this seems to be working very well.
The closeness that you feel for many of the residents of Sanger seems to be a
detriment to your job and places you in an unfair position of passing
judgement on friends and acquaintances. It appears that a more appropriate
action would be for an "out-of4own" judge to preside over the court. I feel
that in the best interests of the City, it would be best to replace you as our
judge effective October 1, 2001.

Dear Sir,
It has been brought to my attention by officers of a continuous
problem with citations being dismissed by Judge Danny Spindle. One
officer in particular feels he has been singled out and states he will no
longer write citations because they will only be dismissed. Other
complaints that have been voiced are that citations are being dismissed
without a prosecutors motion and allowing juveniles to come in and take
care of citations without appearing in court (State Law). The violators
have told officers on numerous violator contacts that they would call
Judge Spindle at home or at work and he would take care of the ticket.
On numerous occasions people have came into the court clerks office
and stated they have contacted Judge Spindle at home. The violator is
telling the court clerk that the Judge advised them tell the court clerk to
process for deferred.
On 5-1-01 Judge Harfless was assigned to adult cases and Judge
Spindle was assigned to juvenile cases. Since this date the municipal
court fine intake has increased. (See attached list)
I realize that a Judge has the right to dismiss cases for lack of evidence
or other circumstances that may hold a bearing on the situation at the
time. It appears that officers have lost confidence in Judge Spindle's
decisions and are at this time refusing to write certain citations based on
the lack of backing in the courtroom. I personally have nothing against
Judge Spindle and this letter is not meant to put him down in any way.
This letter is wrote in order to let you know of the problems and comments
we are receiving about the current municipal court situation.

CODE OF CRIMINAL PROCEDURE
(c) Notwithstanding Article 45.45 of this code, the
defendant may apply for a new trial within the period
provided by Subsection (b) of this article, and the court
shall grant the application if the application is made within
the period. On the new trial, the court shall permit the
defendant to withdraw the previously entered plea of nolo
contendere and waiver of jury trial.
Art, 45.24. Defendant May Waive Jury
The accused may waive a trial by jury; and in such case, the
justice shall hear and determine the cause without a jury.
Art. 45.25. Jury Summoned
If the accused does not waive a trial by jury, the justice shall
issue a writ commanding the proper officer to summon
forthwith a venire from which six qualified persons shall be

summoned shall remain in attendance as jurors in all cases
that may come up for hearing until discharged by the court.
Any person so summoned who fails to attend may be fined not
exceeding $100 for contempt.
Art. 45.251. Demand for Jury Trial in Justice Court or
Municipal Court; Failure to Appear
(a) A justice or municipal court may order a party who
demands a jury trial in a justice or muniapal court and who
fails to appear for the trial to pay the costs incurred for
impaneling the jury.
(b) The justice or municipal court may release a party from
the obligation to pay costs under this section for good
cause.
(c) An order issued by a justice or municipal court under
this section may be enforced by contempt as prescribed by
Section 21.002(c), Government Code.
Art. 45.26. Complaint Read
If the warrant is issued upon a complaint made to the justice,
the complaint shall be read to the defendant. If issued by the
justice without previous complaint, he shall state to the
defendant the accusation against him.
Art. 45.27. Not Discharged for Informality
A defendant shall not be discharged by reason of any
informality in the complaint or warrant. The proceeding before
the justice shall be conducted without reference to technical
rules except as provided in Article 4.15.
Art. 45.28. Challenge of Jurors
In all jury trials in the justice court the State and each
defendant in the case shall be entitled to three peremptory
challenges, and also to any number of challenges for cause,
which cause shall be judged of by the justice.
Art. 45.29. Other Jurors Summoned
If, from challenges or any other cause, a suffiaent number of
jurors are not in attendance, the justice shall order the proper
officer to summon a sufficient number of qualified persons to
foam the jury.
Art 45.30. Oath to Jury
The justice shall administer the following oath to the jury:
' "Each of you do solemnly swear that you will well and truly try
the cause about to be submitted to you and a true verdict
render therein, according to the law and the evidence, so help
you God".
Art. 45.31. Defendant Shall Plead
After the jury is impaneled, or after the defendant has waived
trial by jury, the defendant may plead guilty or not guilty or may
enter a plea of polo contendere, or the special plea named in
the succeeding Ankle.
Art. 45.32. The Only Special Plea
The only special pleas allowed are those defined in Article
27A5 of this code.
Art. 45.33. Pleading is Oral
All pleading of the defendant in justice court may be oral or in
writing as the defendant may elect. The justice shall note upon
his docfcet the plea offered. ,
(a) If a defendant is younger than '17 yeas of age end his
not had the disabilities of minority removed, the court:
("l�jj must take the defendant's plea in open court; and
(�� shall issue a summons to compel the defendant's
parent, guardian, or managing conservator to be
present during:
(A) the taking of the defendants plea; and
(B) all other proceedings relating to the case.
(b) If the court is unable to secure the appearance of the
defendants parent, guardian, ar managing conservator by
issuance of a summons, the court may, without the
defendants parent, guardian, or managing conservator
present, take the defendants plea and proceed against the
defendant.
(c), If the defendant. resides in a county other than the
county in which the alleged offense occurred, the
defendant may, with leave of court, enter the plea,
including a plea under Article 45.55, before a justice in the
county in which the defendant resides.
Art, 45.34. Plea of Guilty
Proof as to the offense may be heard upon a plea of guilty and
a plea of nolo contendere and the punishment assessed by the
court or jury.
Art. 45.35. If Defendant Refuses to Plead
The justice shall enter a plea of not guilty if the defendant
refuses to plead.
Art. 45.36. Witnesses Examined by Whom ,
The justice shall examine the witnesses if the State is not
represented by counsel.
Art 45.37. May Appear by Counsel
The defendant has a right to appear by counsel as in all other
cases. Not more than one counsel shall conduct either the
prosecution or defense. State's counsel may open and •
conclude the argument.
Art. 45.38. Rules of Evidence
The rules of evidence which govern the trials of criminal
actions in the district court shall apply to such actions in justice
courts.

attached agreement reflects an increase from $10.00 per capita to $12.00 per capita to cover
increasing costs to provide premium emergency medical service to your city. Your per capita
charge is based on the estimated population as of January 1, 2001 provided by the North Central
Texas Council of Governments (see attached).
Please submit the enclosed contract to your Council for approval and signatures and return to us
by September 19, 2001. Once we have submitted the contracts to our council for approval and
have obtained the appropriate signatures, we will mail one of the executed documents to you and

INTERLOCAL AGREEMENT FOR AMBULANCE SERVICE
BETWEEN THE CITY OF DENTON AND
THE CITY OF SANGER
The City of Denton currently provides emergency medical services to the citizens of
Denton. The City of Sanger would like to contract with the City of Denton to receive emergency
medical services for its citizens. Pursuant to Chapter 774 of the Tex. Health and Safety Code

(Vernon 1994), a city may contract to provide emergency medical services to the county or another
city.
WHEREAS, both the City of Denton and the City of Sanger have the authority to perform
the services set forth in this Agreement individually and in accordance with Tex. Gov't Code Ann.
§791.011(c)(2); and
WHEREAS, the City of Sanger will make all payments for services out of available current
revenues and the City of Denton agrees that the payments made by the City of Sanger hereunder
will fairly compensate it for the services performed; NOW, THEREFORE,
WITNESSETH
This Agreement is made on the day of , 2001, between the
City of Denton, Texas ("Denton"), and the City of Sanger ("Sanger").
The parties agree as follows:
1. Definitions. Fmergimnsy Medical Rervices or R-M-S- means personnel and ground
transportation vehicles used to respond to an individual's perceived need for immediate medical
care and to prevent death or aggravation of physiological or psychological illness or injury.
2. Denton to Provide EMS to Sanger. Denton shall provide emergency medical
services to Sanger in response to requests for emergency medical services in accordance with this
Agreement. All requests for emergency medical services for persons residing in the corporate
limits of Sanger shall be communicated to Denton in the manner specified by Denton.
3. Discretion in Providing E.M.S. Sanger understands that Denton must also
respond to requests for emergency medical services for persons in Denton and that Denton has
other contracts to provide emergency medical services to other entities.: Denton shall have the sole
right and discretion, without being in breach of this Agreement and without liability to Sanger, to

(b) Whether and when personnel or equipment are available to respond to a request
for emergency medical service;
(c) The order is which to respond to a request for emergency medical service; and
(d) The time in which to respond to a request for emergency medical service.

Sanger agrees to pay to Denton the sum of $55,008.00 for fiscal year 2001-2002 based on a
population of 4,584 multiplied by $12.00. The population figure used is contained in the latest
edition of the North Central Texas Council of Governments estimate for January 1, 2001. The
annual payment shall be paid to Denton in equal quarterly payments on or before October 1,
January 1, April 1, and July 1, of each annual term. Denton may, after giving prior notice, suspend
service to Sanger during any period of time Sanger is delinquent in the payment of any undisputed
service fee.
5. Patient Charges. In addition to the service fee paid by Sanger, Denton may charge and
collect from persons provided emergency medical services, the patient fees established by ordi-
nance of Denton.
6. Governmental Immunity Not Waived. Neither Denton nor Sanger waives, nor shall
be deemed hereby to waive, any immunity or defense that would otherwise be available to it against
claims made or arising from any act or omission resulting from this Agreement.
7. Term. The term of this Agreement shall be in one-year increments, beginning on
October 1, 2001 and continuing to September 30 of the following year and thereafter from year to
year until terminated in accordance with this Agreement.
8. Termination; Default. Either party may terminate this Agreement at any time without
cause by giving 90 days advance notice in writing to the other, specifying the date of termination.
If either party breaches a provision of this Agreement, the other party shall give the defaulting party
written notice of the default: Should the defaulting party fail to correct the default within thirty
days of the date notice of default is sent, the other party may declare the Agreement terminated.
Sanger shall be liable to Denton pro rata for the payment of emergency medical services provided
up to the date of termination.
9. Notices. All notices sent under this Agreement shall be mailed, postage prepaid, to the
respective addresses, as follows:

10. Agreement Not for Benefit of Third Parties. This Agreement is not intended and
shall not be construed to be for the benefit of any individual or create any duty on Denton to any
third party.
11. Assignment. Neither party shall assign this Agreement except upon the prior written
consent of the other.

Please accept this in response to your inquiry, dated September 5, regarding the city's
repair of water and sewer lines located on private property inside aHUD-
Manufactured Housing, or Mobile Home, Park in the city.
Article 3, Section 52 of the Texas Constitution prohibits the city from loaning its
credit, expending funds, or otherwise allowing the use of a public thing of value solely
for the benefit of an individual or corporation. Accordingly, if the city is expending
public runds to repair water and sewer lines that are located on private property and
which belong to one or more individuals, then the city is probably out of compliance
with Article 3, Section152.
A corollary to the foregoing is that any city expenditure must be for a public purpose,
and it is conceivable that in some circumstances a public purpose could be served by
repairing a privately -owned utility line with public funds, assuming the city had the
permission of the owner and the governing body found that a public purpose was
being served. E.g., if a break in a private line was causing severe inflow and
infiltration, so that the city was experiencing sanitary sewer overflows and was in
danger of enforcement by EPA or TNRCC, or the break was causing a severe loss of
water or pressure, such that the entire system was threatened, a city council's finding
of public purpose would probably withstand judicial scrutiny. Nevertheless, in the
absence of such a situation, or something else that is detrimental to the general health,
safety, and welfare of the public, the practice you described is probably
unconstitutional. Accordingly, the council's decision to cancel the repairs is well-
advised.

It is time again for the taxing jurisdictions to select five individuals to serve as the DCAD
Board of Directors. According to Section 6.03 of the Property Tax Code, it is the chief
appraiser's responsibility to initiate this process, which is the purpose of this memo.
Please return the nomination form as soon as possible.
Generally the following will take place:
1. Prior to October 1st - I advise each jurisdiction of the number of votes they are
entitled to cast for appointing the Board members.
2. Prior to October 15th -The governing body of each jurisdiction nominates candidates
to the DCAD Board of Directors and advises my office of the nominees. Each taxing
jurisdiction can nominate up to five candidates if they wish. The number of votes that
each jurisdiction has is not relevant in the initial nomination phase.
Please note that a chief appraiser does not have the authority, or the duty, to
investigate, or judge, the qualifications of the nominees. Further, a chief appraiser can
not extend the deadline for receiving nominations.
3. Prior to October 30th - My office compiles a comprehensive. list of the nominees and
this information is sent to the taxing jurisdictions in the form of a ballot.

4. Prior to November 15th -The taxing jurisdictions choose by written resolution the
candidate, or candidates, of their choice. The jurisdictions then submit the names of
their candidates and the votes they cast for each candidate to my office prior to the
November 15th deadline.
Please note that the maximum number of votes needed to place a candidate on the
Board is 1,000. Accordingly, there is little reason for a candidate to receive greater than
1,000 votes.
5. Prior to December 1st - I tabulate the votes and forward the results back to the
jurisdictions. The five candidates that have received the most votes become the Board
of Directors as of January 1st.
The following information might be useful to a jurisdiction when selecting a nominee for
the Board of Directors.
AUTHORITATIVE GUIDELINES -The selection process is set forth in Section 6.03 of
the Property Tax Code. This process is not an "election" governed by the Texas
Election Code. It is an independent procedure unique to the property tax system.
ELIGIBILITY - An appraisal district director must reside in the appraisal district for at
least two years immediately preceding the date he or she takes office. Most residents
are eligible to serve as a director. An individual that is serving on the governing body of
a city, county, or school district is eligible to serve as an appraisal district's director. The
common-law doctrine of incompatibility (holding offices that have conflicting demands on
the holder) does not prohibit the same person from holding both offices. All five board
members may be elected officials of taxing jurisdictions.
An employee of a taxing unit served by the appraisal district is not eligible to serve as a
director. However, if the employee is an elected official, he or she is eligible to serve.
A statute relevant to the Board selection process prohibits nepotism and conflict of
interest for appraisal district directors and chief appraisers. In summary, the law states
that:
.........."a person may not serve as director if closely related to anyone in the appraisal
district or if related to anyone who represents owners in the district, or if the person has
an interest in a business that contracts with the district or a taxing unit. A chief
appraiser may not employ someone closely related to a member of the board of
directors".
EXPERIENCE - In considering individuals to serve as directors, taxing units should look
for expertise in such areas as accounting, finance, management, personnel
administration, contracts, computers, real estate or taxation. Historical involvement in
local government activities also indicates that someone should make an excellent Board
member.

FREQUENCY OF MEETINGS -The applicable statutes require the board of directors to
meet not less often than once each calendar quarter. The DCAD Board meets more
often than is required by law.
Page four of this document provides your jurisdiction with the number of votes it has for
electing DCAD's Board. The final page is a form that is to be used to advise my office
of your jurisdiction's nominees to the Board. Each individual receiving a copy of this
memo is receiving a copy of the nomination form for their information. There is no need
to provide my office with more than one completed copy of the nomination form.

AUGUST 2001 ACTIVITIES

HIGHLIGHTS:
The new oak printer stand and standing computer workstation were stained and finished
by Ernest McCoulsky at no charge. We have almost completed the TIF grant that funded most of
the recent computer updates.
ADMINISTRATION:
Samantha Renz from the city office replaced the hard drive and mother board on the
Pentium computer that provides the dial -up Internet connection in the library.
Meeting attended:
NTRLS Focus Group, 8/20, Witchita Falls
COLLECTION:
The annual inventory is complete except for the fiction paperbacks. Books that had been
missing for three years were deleted from the collection.
The library's three collections: Books, Fiction Paperbacks, and Video Entertainment were
integrated into one. This will make check out easier and patron searches clearer.
PUBLIC RELATIONS:
Spoke to the Sanger Lion's Club about Answering Reference Questions.
PROGRAMS:
The Summer Reading Club Party was held at the Sanger Pool. A favorite activity was
passing around blocks of ice until the prizes that were firozen inside melted out. This year, 153
children signed up for the Reading Club and 70 earned a certificate by reading for at least 2
hours. Last year 151 signed up and 72 earned a certificate.

Ted Conover wanted to write
"from the inside" about the
realities of prison life for both
inmates and guards.
Denied access to various
prisons and correctional
departments for interviews,
Conover took a Civil Service
exam and two years later was
'accepted into the. Albany
Training Academy's seven -week
military -style boot camp to
become a correctional officer.
This experience provided a rich
opportunity to examine in-depth
the dynamics between guards
and inmates, the rules as they
conflict with practicality, and
preconceptions each group has
about the other and even
themselves. The result of his
experiences is the National Boole
Critics Circle Award Winner,
"Newjack: Guarding Sing Sing."
Conover's assignment after
training was to Sing Sing, the
infamous New York prison
which gave us the expression
"up the riveras it is located
there from New York City, home
of 80 percent of its inmates. Sing
Sing, built in 1826 by prisoners,
became fainillar to Inaliv
Americans through its frequent
appearance in gangster navvies
of the 1930s and 1940s. The
prison complex now covers 55
acres, and holds close to 2400
inmates, primarily violent felons.

The sale will begin at 8 a.m.
and will be held inside the
library and in the park in the city
square. All proceeds will benefit
the Sanger Public Library.
Volunteers are needed during
this time, both inside the library
Although no stranger to
experiential journalism, Conover
admits to unprecedented fear
about his first clays as a
corrections officer. from the
very beginning, when "hostage
photos" are taken — photographs
expressly made to give to the
media if the officer is seriously
ured or taken hostage while at
work — little is done to appease
those fears. In fact, any physical
altercations that occur are
described to incoming shifts,
presumably to stress the need for
constant vigilance.
The majority of the book is
devoted to explaining typical
days at various locations in the
prison, with some duties rather
routine and others
overwhelmingly stressful and
even dangerous. Conover shows
his journalistic roots as he
describes situations and inmates
very factually and thoroughly.
There appears to be no
sensationalism even though this
subject would be easy to exploit,
and his writing is clear and
matter of fact.
Both interesting and
informative, "Newjack" should
appeal to many non-fiction
readers. It can be found, along
with many other new books, at
your Sanger Public Library,
and out in the city park.
The Sanger Public Library
also is still collecting back issues
of The Sanger Courier to
complete their collection, which
will eventually be microfilmed
for preservation and community
use. Issues prior to 1970 are
especially needed.
