1. Mayor Pro Tem Garza called meeting to order.
2. Budget Workshop.
City Manager indicated the only thing they have been discussing is Capital
Improvements.
Discussion.
Councilman Ervin indicated Amyx's drainage problem needs to be added to the C.LP.
he would also like to see the lot on the corner of Fourth and Bolivar Street put on the
plan.
Discussion regarding the Porter building for the Police and Court.
Councilman Ervin indicated he would like to have a bond election in May for the total
amount of the improvements
Discussed the lift station and other improvements.
Discussed revenues and how to fund the improvements.
Discussed water rates compared to the City of Denton's rates.
Discussed the City of Denton's commercial water rate.
Discussed raising the rates.
Councilman Evans asked what it would do to add $1.00 to the facilities charge.
City Secretary indicated about $32,000 a year.
Discussed the minimum charges on sewer rates.
Councilman Ervin indicated he would like to see the facilities charge for commercial
users on both water and sewer increased.
Discussion regarding bonds and bond ratings.
Discussed the electric facilities charge.
Council agreed to go Is $1.00 on the facilities charge for sewer.
The commercial facilities charge on sewer will go according the size of the meter.

Councilman Ervin indicated he did not want to go upon the residential. He does want
to go up on the commercial.
Discussed the rates.
Councilman Ervin asked staff to come up with facilities charges for each size
commercial meter.
Council indicated staff should come back with rate increases on water usage.
Discussion continued regarding the facilities charges.
Schedule workshop for 6:00 Monday before the regular meeting.
Discussed reviewed budget by department.
City Secretary indicated they adjusted the General Fund to give the Street Department
contractual services for tree limbs. They moved the $249000 in excess revenues to that
department. The debt was moved to the debt schedule which was used in the
calculation of the effective tax rate for this year.
Mayor recessed for the Planning and Zoning.
Reconvened at 7:30.
Councilman Ervin expressed concerns regarding the vehicle that was now being used
by the Police Department and whether or not it would be returned to the
Administration Department.
City Secretary indicated it would be returned to the Administration Department when
the new vehicle for the Police Department was purchased.
Discussed the Engineer position and if it was feasible to hire a full time engineer.
Councilman Ervin asked if any officers would be added to the Police Dept,
Police Chief indicated there would not be.
Discussed overtime in the police department.
Councilman Ervin asked why the drug prevention was cut.
Police Chief indicated it was for drug prevention materials, and for the drug dog. The
amount budgeted last year was too high.
(".ouncilman Ervin asked about the cell phones and how it was working.
Police Chief indicated it was working out fine.
Councilman Garza asked about the temporary salaries in Animal Control.
City Manager indicated that would be to hire someone when the Officer was on
vacation.
Councilman Ervin asked about dog pound expense.
Eddie Branham indicated it was for Euthanization and disposal.
Councilman Waggoner asked why the pension fund was so much less than last year.
City Manager indicated that is what the Fire Chief put in his budget proposal. She will
check into it.
Discussed the fire pay at the end of the year.
Councilman Ervin asked about lease equipment.
Staff indicated the fire truck was moved to debt service.
Discussion regarding the Fire Marshall position.
Discussion regarding contractual services in Municipal Court.
Councilman Ervin asked about the salary for the Code Enforcement Officer.
Councilman Garza indicated he would like to see a progressive pay scale. He would like
to start the person out at a lower salary and then increase the salary as they learn the6000
job.
Discussion regarding the position.
Councilman Garza indicated there should be some kind of salary structure.
Councilman Garza asked if it was decided what was going to happen with the streets
and parks.
City Manager indicated he and Rose had discussed getting someone to help more on the
secretarial side to help with scheduling and paperwork.

1. Mayor called meeting to order.
2. Budget Workshop.
Councilman Garza indicated they went through the budget except for revenues at the
last meeting.
Discussed the Capital Improvement Plan.
Discussed Sanitary Sewer and Water Improvements.
Discussed Street Improvements.
Total Improvements for 2001-2002 come to $3,611,000.00. Mayor asked how this
would be funded.
City Manager indicated they need to be kept separate for each Fund. the Enterprise
Fund is $1,981,000, and the General Fund is $1, 630,000.
Discussed the drainage situation at Clear Creek
Discussed Treatment Plant Expansion.
Continued discussion on the Capital Improvements Plan.
City Manager indicated the Cowling Rd. Pump Station can be moved to 2002-2003.
On Municipal Buildings they removed $50,000 for the lot on the corner of Fourth and
Bolivar.
Mayor indicated he did not feel that the citizens would mind the tax increase, because
they do want to see improvements.

City Secretary indicated the increased tax rate will pay for the General Fund side of
the improvements, then the revenue side will need to be looked at to see where those
funds will come from.

Councilman Evans moved to approve the Consent Agenda, Councilman Ervin
seconded. Motion carried unanimously.
3. Citizen's Input.
Jay Parr,134 Southside, indicated he wanted to find out what the status of the duplex
situation is his neighborhood was.
City Manager indicated Mr. Lynch is supposed to be bringing an affidavit stating they
aIV his relatives.
Mr. Parr asked how close they had to be related.
City Secretary indicated she would feel it would follow under the same criteria as the
consanguinity requirements for the Council.
Discussion.
4. Consider and Possible Action on Request From Gayland Howell Representing the
Tourism Board.
Gayland Howell, representing the Sanger Tourism Board, indicated he would like to

request the remaining 50% of the Hotel/Motel tax. Tomorrow they will have the first
meeting to allocate money for the projects that have come before them.
City Secretary indicated her main concern was the budget they were supposed to
submit based on the agreement.
Gayland indicated this was a period of time when things were in limbo. When Jerry
Jenkins stepped down, things died for about two months. They will step in and prepare
something for the City.
Discussed that the contract required two City Council or City Employees to sit on the
Board. Councilman Ervin indicated he would sit in on the board if Council wanted.
Councilman Ervin indicated he would like to see Samantha sit on the board to comply
with the contract.
Gayland indicated the next meeting is tomorrow at 5:00 P.M., and the next meeting is
September 11, 2001.
Councilman Ervin asked what the people coming for the requests are asking for.
Gayland indicated the Historical Society wants to put out a brochure and flyer. The
Sanger Sellabration has requested funds for advertising, balloons and banners. The
Keep Sanger Beautiful board has requested funds for Banners.
Discussed the amount of funds the Tourism Board currently has.
Continued discussion regarding the Tourism Board.
Gayland Howell indicated he was asking for the remainder of the funds from the
Hotel/Motel Tax.
Councilman Garza asked about the contract and if it will be amended.
City Secretary indicated staff will bring back an amended contract.
Discussion.
Councilman Waggoner asked about amending the contract to have a seven (7) members
instead of five (5).
Councilman Waggoner moved to give the Tourism Board the remaining 50%, and to
amend the contract to have seven (7) members, to have two community members as
determined jointly by City Council and Chamber of Commerce and two City
Councilman or Employees, two Chamber members and one at large, and that the 50%
quarterly be changed to 10U% quarterly, and that this be done upon receipt of the
annual budget. Councilman Waggoner seconded. Motion carried unanimously.
5. Consider and Possible Action on Short Form/Final Plat for McDade Heights.
City Manager indicated this is one lot off of Railroad Avenue.
Councilman Waggoner moved to accept the Short Form/Final Plat for McDade Heights,
Councilman Evans seconded. Motion carried unanimously.
6. Consider and Possible Action on Short Form/ Final Plat for IESI Industrial Park.

7. Consider and Possible Action on Ordinance #08-10-01 -Park and Open Land Space
Ordinance.
City Manager indicated the issue of Money in Lieu of Land may need to be discussed.
Councilman Evans moved to approve. Councilman Ervin seconded. Motion carried
unanimously.
8. Conduct First Public Hearing for Annexation of Properties legally described as follows:

City Manager indicated that Triarch investments has requested to withdraw this for
annexation until they can talk to the Council.

9. Consider and Possible Action on Ordinance #08-13-01-Amending Water and Sewer

Tap Fees.
City Secretary indicated Council discussed that this would not affect anything that was
already platted.
Discussion regarding the cost of the installation and the meter for water and sewer.
Shelley Ruland indicated for larger homes the increase is not a problem, but on smaller
homes an extra thousand dollars is a big deal. She indicated there should be more input
from developers or citizens.
Councilman Evans moved to go with the $2,000 tap fee. Councilman Garza seconded.
Councilman Higgs indicated he felt this would be a deterrent to the growth of the City.
Councilman Evans indicated he was trying to get the money to fix what needs to be
fixed.
Motion carried 3 to 2, Councilman Higgs and Councilman Waggoner voted no.
10. Consider and Possible Action on Ordinance #OS-16-01-Amending Water Rates.
Discussion regarding the proposed increase in water rates.
Discussed rates from Argyle, Aubrey and Denton.
Councilman Higgs moved to accept Ord. O846-01 amending the water rates.
Councilman Evans seconded. Motion carried 3 to 2. Councilman Garza and
Councilman Ervin voted no.
Discussion regarding the facilities charge for commercial accounts.
Council discussed and agreed to table the commercial rate and bring back to the
Council after studying the rates further.

11. Consider and Possible Action on Ordinance #08-15mul - Amending Sewer Rates.
City Secretary indicated the Council had asked that the residential remain the same
and that the increase be on the commercial facilities charge.
Discussion regarding the ordinance, Councilman Garza as how it is decided on
churches and small businesses if they are Class A or B.
City Secretary indicated they are all billed under Class B. That line can be removed
from the ordinance if Council desires.
Discussed residential versus commercial users.
Councilman Ervin indicated he felt the per thousand charge should be raised to
$1.50/m.
Councilman Ervin moved to approve the ordinance with the amendments. Councilman
Evans seconded. Motion carried unanimously.

12. Consider and Possible Action Regarding Demand Charges.
Mike Prater indicated he looked at the rates that Brazos was charging on the demand
side. Brazos takes the four peak months, combines them and averages the peak. They
bill the City the average of those four months for the entire twelve months. This is a
recent change. Currently the City is billing the actual monthly demand that a customer
uses. In looking at it, he felt it would be better to bill as the City is being billed. CoSery
is similar to what the City is currently doing. They take 70% of the highest month that
year and bill it for twelve months. The City of Denton is quite a bit different and
difficult to compare. Whitesboro is looking at their rates also.
Mike indicated the City is not losing money, but could make more money if it is done
this way. The handout shows a few examples of the differences if it is billed this way.
Mike Prater indicated the current ordinance indicated that 6KW is billed as large
commercial, he did not feel this should be so, he felt it should be more like 25 KW.
Discussion regarding the rates.
Councilman Waggoner moved to accept the recommendation of the Electric
Superintendent on Demand Charges. Councilman Evans seconded. Motion carried
unanimously.
13. Consider and Possible Action on Awarding Fuel Bid.
Mike Prater indicated he could not get his trucks into the parking lot at Hunter's.
Councilman Ervin moved to award the bid to Lynch Food Mart. Councilman Evans
seconded. Motion carried unanimously.
14. Any Other Such Matters.
a) City Manager indicated he had been approached by some developers about the
Council reconsidering to possibly allow asphalt streets with concrete curb and gutter.
Discussion regarding the base for asphalt.
Councilman Garza indicated he felt it should stay concrete, but the water and sewer
lines should be fixed first.
Councilman Higgs indicated he knew of a place that had concrete streets that were
worse than asphalt streets.
b) Councilman Evans asked about the two buildings West on 455, they are metal.
Staff indicated they are not in the City Limits.
c) Councilman Waggoner asked about utility deposits.
City Secretary indicated the electric deposits are returned after a year if all payments
are made on time, and the water is kept until the customer moves.
d) Councilman Waggoner indicated he felt the Historical Society and/or the City should
be involved in the zoning or planning for the lot on the corner of Fourth and Bolivar
Street and determining what type of building should be put there.
e) Discussion regarding birds and the noise.
f) Councilman Higgs asked about the old hackberry trees that are growing in the City's
R.O.W.
Discussion.
g) Mike Prater indicated he had been talking to CoServ, there fees are unbelievable.
For service to his barn, he would be out tremendous money if he didn't already have a
transformer.

the Manufactured Housing Standards Act. By passing this ordinance, Council will prohibit the
installation of Mobile Homes in the City Limits, and require a permit for any addition, extension,
or installation of a HUM -Code Manufactured Home Park. In reviewing the statute it appears that
without this ordinance the City must allow HUD -Code Manufactured Homes into the City limits.

AND REQUIRING A LICENSE TO OPERATE A HUD CODE MANUFACTURED HOME
PARK AND SETTING FORTH THE SITE REQUIREMENTS, HUD CODE
MANUFACTURED HOME PARK STANDARDS AND OTHER PREREQUISITES TO
THE ISSUANCE OF A PERMIT OR LICENSE. PROVIDING DEFINITIONS, AND
PRESCRIBING REGULATIONS FOR MANAGEMENT OF HUD CODE
MANUFACTURED HOME PARKS, AND PROVIDING FOR NONCONFORMING HUD

WHEREAS, it has come to the attention of the City Council of the City of Sanger that
unregulatedHUD-Code Manufactured Home Parks can be dangerous and constitute a hazard to life

WHEREAS, it is in the best interest of the City that the health, safety and general welfare
of the City be promoted by preventing overcrowding of land through planned and orderly growth
of the City, and an undue concentration of the population be avoided; and
WHEREAS, the City Council of the City of Sanger finds it to be in the best interest of the
public safety, health and general welfare to regulate HUD -Code Manufactured Home Parks within
the City; therefore,
BE IT ORD?SNED BY THE CITY COUNCIL OF THE CITY OF SANGER:
Section 1. This Ordinance is hereby referenced as the Sanger HUD -Code Manufactured
Home Parks Ordinance,
Section 2. Definitions -For the purpose of this ordinance, certain terms, words and
phrases shall have the meaning hereinafter ascribed thereto.
(A) Building, Official: Designated inspection authority of the City, or its authorized
representative.

(B) Certificate of Occupancy: Certificate issued by the City Council for the use of a building,
structure and/or land , when it is determined by it that the building, structure and/or land complies
with the provisions of all applicable City Codes, ordinances and regulations.
(C) Cam: As used herein reference to the City shall mean the City of Sanger, Denton County,
Texas, and its extraterritorial jurisdiction.
(D) City Council: City Council of the City of Sanger, Texas.
(E) Common Access Route/Internal Street: Private drive allowing principal means of access
to individual HUD -Code Manufactured Mobile Home lots or auxiliary buildings.
(F) Drive Wav: Minor entrance way off the cpmmon access route within the park, into an
off-street parking area serving one or more HUD -Code Manufactured Mobile Homes.
(G) HUD -Code Manufactured Home: Means a structure constructed on or after June 15,
1976, according to the rules of the United States Department of Housing and Urban Development,
transportable in one or more sections, which, in the traveling made, is eight body feet or more in
width or 40 body feet in length, or, when erected on site, is 320 or more square feet, and which is
built on a permanent chassis and designed to be used as a dwelling with or without a permanent
foundation when connected to the required utilities and includes the plumbing, heating, air
conditioning and electrical systems. Anything less than the length and/or width specified in this
paragraph shall not be allowed in a HUD -Code Manufactured Home Park.
(H) License: Written license issued by the City Council, permitting a person to operate and
maintain aHUD-Code Manufactured Home Park under the provisions of this ordinance.
(I) Mobile Home: A structure that was constructed before June 15,1976, transportable in one
or more sections, which, in the traveling mode, is eight body feet or more in width or 40 body feet
in length, or, when erected on site, is 320 or more square feet, and which is built on a permanent
chassis and designed to be used as a dwelling with or without a permanent foundation when
connected to the required utilities and includes the plumbing, heating, air conditioning and electrical
systems. Mobile homes shall not be allowed in a HUD -Code Manufactured Home Park.
(J) HUD -Code Manufactured Home Park: A parcel of land under single entity ownership
which has been placed and improved for the placement of HUD -Code Manufactured Homes,
accessory uses and service facilities, meeting all requirements of this ordinances and any applicable
deed restrictions and state laws.
(K) Parkina Street. Off -Street: A minimum space ten feet (101) m width by twenty feet (20')
in length, located within the boundary of a HUD -Code Manufactured Home space, or in common
parking and storage area having unobstructed access to an internal street,
(L) Permit: Written permcertification issued by the City Council permitting the
construction, alteration orextension of aHUD-Code Manufactured Home Park under the provisions
of this Ordinance and regulations issued hereunder,
(M) Person: Any natural individual, firm, trust, partnership, association or corporation.
(N) Plot Plan/Site Plan, Graphic presentation, drawn to scale, in a horizontal plane,
delineating the outlines of the land included in the plan and all proposed use locations, accurately
dimensioned, the dimensions also indicating the relation of each use to that adjoining and to the
boundary of the property.
(0) Sewer Connection: Connection consisting of pipes, fittings and appurtenances from the
drain outlet of a HUD -Code Manufactured Mobile Home to the inlet of the corresponding sewer
service riser pipe of the sewage system serving the HUD -Code Manufactured Home Park.
(P) Sewer Service Riser Pine: That portion of sewer service which extends vertically to the
ground elevation and terminates at a HUD -Code Manufactured Home space.
(Q) Space: Plot of ground within a HUD -Code Manufactured Home Park designated for
accommodation of one HUD -Code Manufactured Home, together with such open space as required
by this Ordinance. Term includes "lot" and "site".
Section 3. PERMITS
(A) Permit Required on, It shall be unlawful for any person to construct, alter, extend or
expand and HUD -Code Manufactured Home Park within the limits of the City of Sanger without
a valid permit issued by the City Council in the name of such person for the specific construction,
alteration or extension proposed.
(B) Application Requirements -All applications for permits shall be made upon standard
forms provided by the City Council and shall contain the following:
(1) Name and address of the applicant
(2) Location and legal description of the HUD -Code Manufactured Home Park.
To this application shall be attached five (5) copies of a site plan, at a minimum scale of 1" -
200' for sites of 30 acres or more, and at a minimum scale of 1" to 100' for sited under 30 acres. The
site plan shall include all data required under this Ordinance, including, without limitation, the data
required in Section 8.
(C) Permit Fee -All applications to the Building Official shall be accompanied by a fee of
One Hundred Dollars. ($100.00).
(D) Issuance of Permit - In considering the application, the City Council may take into
account the proposed location of the HUD -Code Manufactured Home Park in relation to the present
and anticipated land use and development. After review of the application and determining the
application and the proposed park complies with thi4 Ordinance and other applicable laws, codes
and regulations, the permit shall be issued.
(E) Denial of Permit/Hearina -Any person whose application for a permit under this
Ordinance has been denied, may request in writing a rehearing on the matter and offer additional
evidence if desired.
Section 4. LICENSES
(A) License Required - It shall be unlawful for any person to establish, operate or maintain
or permit to be established, operated or maintained upon any property owned or controlled by such
person and HUD -Code Manufactured Home Park within the limits of the City of Sanger unless such
person holds a valid license issued annually by the City Council. All applications for licenses shall
be made in writing to the City Council, who shall issue a license upon compliance by the applicant
with provisions of this Ordinance. The City Council shall not issue a license unless the applicants
a valid holder of a Certificate of Occupancy which shall be issued by the City Council upon
compliance with applicable ordinances and laws. At any time a Certificate of Occupancy is
revoked, the license shall be canceled. Licenses issued shall expire on December 31 of each year.
(B) Application for Original License -Application for original license shall be in writing
signed by the applicant accompanied by an affidavit of the applicant as to the truth of the application
and by the deposit of the license fee hereinafter provided, and shall contain:
1. The name and address of the applicant
2. A copy of a valid Certificate of Occupancy
3. The location and legal description of the park.
4. A site plan of the park prepared in accordance with Section 8 hereof.
(C) Hearing Granted Applicants -Any person whose application for a license under this
Ordinance has been denied may request in writing and within ten (10) days a rehearing which shall
be granted by the City Council.
(D) Application for License Renewal - Application for renewal of a license shall be made
in writing by the licensee on forms furnished by the City on or before December 1 of each year. The
application shall contain any change in the information occurring after the original license was
issued or the latest renewal granted and be accompanied by the HUD -Code Manufactured Home
Park register as hereafter provided.
(E) License Fee -All original license applicatipns or renewals hereof shall be accompanied
by a fee of Fifty Dollars ($50.00). All renewal fees shall be due on the issuance of the license.
(F) Transfer of License -Every person holding a license shall give notice in writing to the
City Council within fifteen (15) days after having sold, transferred, given away or otherwise
disposed of interest in or control of any HUD -Code Manufactured Home Park. Application for
transfer of license shall be made not later than fifteen (15) days after the date of the sale, transfer,
or gift, or other disposition of interest in or control of HUD -Code Manufactured Home Park and the
City Council shall act thereon at the next regularly scheduled meeting.
(G) Transfer of License Fee - All application for license transfer shall be accompanied by
a fee of Fifty Dollars ($50.00).
(H) Violations. Notice. Suspension of License -Whenever, the City Council finds that
conditions or practices exist which are in violation of any provisions of this Ordinance it shall give
notice in writing in accordance with Section 6 of this Ordinance, to the Permittee or licensee or the
Permittee's or licensee's agent that unless conditions or practices in violation of this Ordinance are
corrected within a reasonable period of time of not less than thirty (30) days nor more than one (1)
year as specified in such notice, the license or permit shall be suspended. At the end of the period
of time granted for correction if the conditions or practices have not been corrected, the City
Council may suspend the license and give notice in writing of the suspension, the licensee shall
cease operation of the HUD -Code Manufactured Home Park within ten (10) days after the notice
is issued.
Section 5. INSPECTION
Any duly authorized inspector of the City shall be permitted to make reasonable inspections
of any HUD -Code Manufactured Home Park to determine compliance with this Ordinance.
Section 6. NOTICES, HEARINGS AND ORDERS.
Notice of Violations; Requirements of Notice -Whenever it is brought to the attention of
the Council that there has been a violation of any provisions of this Ordinance, the City Council
shall give notice of such alleged violation to the Permittee, licensee or agent, as hereinafter
provided. The notice shall (1) be in writing; (2) shall include a statement for the reasons of its
issuance; (3) allow a reasonable time of not less than thirty (30) days nor more than one (1) year,
based upon the nature and severity of the violation and having due regard for the safety and
protection of the community, for the performance gf the act it requires; (4) be served upon the
licensee or the licensee's agent; provided that the notice or order shall be deemed to have been
properly served upon the licensee or agent when a copy thereof has been sent by mail to the
licensee's or agent's last known address, or when the licensee or agent has been served with the
notice by any method authorized or required by the laws of this State; and (5) contain an outline of
remedial action when and if taken. Will effect compliance with the provisions of this Ordinance.
If the violation is not remedied in accordance with the Notice, and a breach of the Ordinance
continues, then the Council may revoke any permits or licenses issued in addition to any punishment
provided in Section 9 hereof.
Section 7. MOBILE HOMES PROHIBITED IN THE CITY OF SANGER
The installation of mobile homes for use or occupancy as a residential dwelling in the City
of Sanger, Texas, is prohibited. This provision is prospective and shall not apply to any mobile
home used and occupied as residential dwellings in the City on the effective date of this Ordinance.
Section 8. HUD -CODE MANUFACTURED HOME PARK
(A) Site Plan -The site plan shall be fled as requires by Section 3 (B) of this Ordinance and
shall show the following:
l . The name, address, fee owner and record owner of the proposed or existing
HUD -Code Manufactured Home Park.
2. Name of subdivision where the park is located.
3. Names of adjacent public streets and roads.
4. Contour lines at two foot (2') intervals.
5. Locations and dimensions of all HUD -Code Manufactured Mobile Home
spaces, utility easements, drives, recreation areas, streets and sidewalks.
Each HUD -Code Manufactured Mobile Home space shall be numbered.
6. Scale of plan (no smaller than 1" - 200) and complete dimensions.
7. Density in units per gross acre.
8. Area and dimensions of site.
9. Areas defined for waste containers and method of disposal of garbage and
refuse.
10. Location of shower and toilet facilities.
11. Water and Sewer Plans: Water and sewer plans be submitted showing the
following:
a. Sewer line locations, grades and sizes.
b. Water line locations, sizes and source of water supply.
126 Paving and Drainage Plans: Paving and drainage plans must show the
directions and calculated quantities of runoff and the proposed specifications
for streets.
The City shall notify the applicant in writing as to whether the plan was approved or
disapproved, stating the reasons for disapproval and the modifications or conditions that must be
made or met before approval can be obtained upon subsequent submission.
(B) HUD -Code Manufactured Home Park -Any HUD -Code Manufactured Home Park
constructed after adoption of this Ordinance, and any extension/addition to an existing HUD -Code
Manufactured Home Park into City shall be in compliance with the following site requirements:
1. Density - A HUD -Code Manufactured Home Park shall have no more than
. two (2) spaces per acre.
a. Park Areas, Each HUD -Code Manufactured Home Park shall be
planned for and shall provide a minimum of five (5) acres in area.
2. Basic HUD -Code Manufactured Mobile Home Minimum Site Requirements:
a. Height Requirements:
1. The height limit for any structure intended for occupancy in
the HUD -Code Manufactured Home Park shall bethirty-five
feet (35')0

The average height of the HUD -Code Manufactured Mobile
Home frame above ground elevation, measured at 90 ° to the
frame, shall not exceed four feet from the top of the pad.
b. Spacing Regulations -HUD-Code Manufactured Homes shall be
located no closer than twenty feet (20') from any exterior wall to the
closest exterior wall of the nearest HUD -Code Manufactured Home.
c. HtJD-Code Manufactured Home Space. Each and every HUD -Code
Manufactured Home shall be located on separate spaces which shall
conform to the followipg standards:
1. Be served with sanitary sewer, water, electrical power,
telephone service and natural gas.
2. Provide a minimum average width of forty feet (40') and a
minimum average depth of eighty feet (80').
3. Abut and/or have access to a private street for a minimum
distance of twelve feet (121).
4. Provide a minimum area of two thousand two hundred
(2,200) square feet, said area to e determined by the boundary
lines of the space.
5. Provide aHUD-Code Manufactured Home pad which shall
provide an adequate foundation for the placement and tie -
down of one single-family HUD -Code Manufactured Home
thereby securing the superstructure against uplift, sliding
rotation and overturning. Said pad shall:
a. Be constructed of material which shall support the
weight of the HUD -Code Manufactured Home placed
thereon and be durable and well drained under normal
use and weather conditions.
b. Provide anchors and tie -downs such as cast -in -place
concrete "dead men", eyelets embedded in concrete
foundations or runaway screw augers, arrowhead

anchors or other devices which secure the stability of
the HUD -Code Manufactured Home, and shall be
placed at %oaav at each corner of the HUD -Code
Manufactured Home.
c. Cover an area at least to hundred forty (240) square
feet or at least one-third the area of the largest de Manufactured Manufactured Home Park space, whichever is
greater. No surface provided for a purpose other than
the foundation of HUD -Code Manufactured Home
shall be considered a part of such HUD -Code
Manufactured Home pad.
6. Provide a minimum of two (2) off-street parking spaces
which shall be constructed of concrete.
7. Double street frontage of HUD -Code Manufactured Home
spaces shall be avoided.
8. No vehicular access to a HUD -Code Manufactured Home
space is permitted from a public dedicated street.
9. Drainage. The ground surface in all parts of every HUD -
Code Manufactured Home Park and especially beneath
HUD -Code Manufactured Homes and other structures shall
be graded and equipped to drain all surface water in a safe
efficient manner so as not to permit water to stand or become
a stagnant.
(C) Design and Location of Storage Facilities -Storage facilities with a minimum capacity
of 200 cubic feet per HUD -Code Manufactured Home space, maybe provided on the space, or in
compounds located within 200 feet of space. Where provided, storage facilities shall be faced with
a durable, fire resistant material. Storage outside the perimeter walls of the HUD -Code
Manufactured Home shall be permitted only if in such facilities. No storage shall be permitted
under aHUD-Code Manufactured Home. Storage facilities shall not be located within ten feet (10')
of the boundary line of any HUD -Code Manufactured Home space boundary.
(D) Location of HUD -Code Manufactured Home and Accessory Structures. No HUD -Code
Manufactured Home or accessory structure such as a refuse container, carport cabana, awning, fence
or storage locker shall be permitted within ten feet (10') of a private street or the boundary line of
a HUD -Code Manufactured Home space boundary line. Provided further that two (2) HUD -Code
Manufactured Homes shall not be placed less than twenty feet (20') apart.
(E) Setbacks and Screening.
1. No HUD -Code Manufactured Home or Structure in a H[JD-Code
Manufactured Home Park shall be located within the yard setback area. The
minimum setback area for each space is:

Front yard - 25'
Rear yard - 15'
Side yard - 10'
2. The following screening requirements shall be applicable:
a. A landscape strip, not less than ten (10) feet in width or a screening
device as defined herein shall be located along all HUD -Code
Manufactured Home Park boundary lines abutting upon a public
dedicated street or abutting residential property. The landscaped
strip shall be continuously maintained and shall be devoted
exclusively to the planting, cultivation, growing and maintenance of
site obscuring trees, shrubs, plant life, as described below. Trees,
shrubs, cane and/or other vegetation shall be planted, cultivated and
maintained as a sight and noise obscuring buffer that will effectively
achieve sight and noise obstruction within approximately five (5)
years. At least one row of trees with a minimum initial height of five
feet (5') shall be planted on twenty-five foot centers. Also, two (2)
rows of cane, non -deciduous shrubs and/or other suitable screening
plants shall be planted on ten -foot centers. The buffer strips are
intended to provide a seventy-five percent (75%) or more opaque
screen when viewed horizontally between two and ten feet (2' and
10') above the natural ground at the end of the growing period of five
(5) years from the date of planting. Additional planting, cultivation
and maintenance may be required by the City officials during the use
period of the buffer strip to achieve and maintain this effect.
(F) Access: Traffic Circulation: Parking:
l . Internal streets shall be privately owned, built and maintained. Streets shall
be designed for safe and convenient access to all spaces and facilities for
common use of park residents.
2. All internal streets shall be constructed to specifications set by the City
Council and shall be maintained by the owner.
3. All private streets shall be constructed with concrete ad shall be durable and
well drained under normal use and weather conditions.
4. Internal Street Dimensions; Parking:
a. .Internal streets shall be minimum pavement width of 20 feet (ZO').
Parking shall not be allowed on the minimum street width. An
additional lane of nine feet (9') minimum width may be added to one
or both sides for off street parking.
b. Internal streets shall permit unobstructed access to within at least 200
feet (200') of any portion of each HUD -Code Manufactured Home.
c. Within each HUD -Code Manufactured Home Park, streets shall be
named, and HUD -Code Manufactured Home numbered. Park signs
and numbers shall be of standard size and placement to facilitate
location by emergency vehicles.
y d. Private streets which may connect two (2) public street right of
way(s) shall, by the use of curves, off -sets, location and/or the use of
two (2) or more streets be located so as to discourage through traffic.
e. Private street intersections shall generally be at right angle, offsets at
intersections of less than 125 feet (125') (centerline to centerline)
shall be avoided, intersection of more that two streets at one point
shall be avoided.
f. Dead-end private streets shall be limited to a maximum length of one

thousand feet (1,000) and shall be provided with a vehicular turning
space, with a turning circle of eighty feet (80') in diameter.
g. Layout Streets and Blocks. Streets shall be laid out to provide a
minimum distance %J two hundred and forty feet (240'), center to
center of parallel streets between intersections.
h. Lighting. The private streets., parking lots, walks and service areas
shall be lighted at all times so the HUD -Code Manufactured Home
Park shall be safe for occupants and visitors, provided further all
entrances and exits shall be lighted.
(G) Fire Safetv Standards:
1. The storage, handling and use of liquified petroleum gases and flammable
liquids shall be done in compliance with applicable City ordinances and state
statutes.
2. Access toHUD-Code Manufactured Home for Fire Fighting - Approaches to
all HUD -Code Manufactured Home shall be kept clear for emergency
vehicles.
3. Fire Protection. Water Lines and fire hydrants shall be provided and suitably
located for adequate fire protection as determined by the Fire Chief or City
Council but in no case shall the park provide less than a system of standard
hydrants located not more than five hundred feet (500') from each HUD -
Code Manufactured Home space and served by water lines not less than six
inches (6") in diameter installed in a looped system.
4. � The HUD -Code Manufactured Home Park licensee or agent shall provide an
adequate system of collection and safe disposal of rubbish.
(H) Water Supply:
1. All approved water supply for domestic use and fire protection purposes shall
be supplied to meet the requirements of the HUD -Code Manufactured Home
Park.
2. All plumbing shall be in accordance with applicable ordinances of the city
of Sanger
(I) Sewage Disposal- From and after the effective date of this Ordinance, the following shall
apply.
1. Waste from all toilets, lavatories, sinks and showers in HUD -Code
Manufactured Home Park shall be discharged into a public sewer or a private
disposal system approved by the City Council.
2. All plumbing shall comply with applicable plumbing codes
3. Each HUD -Code Manufactured Home pad shall have a sewer riser pipe of
at least four inches (4") which shall be capped when not in use.
(J) Electrical and telephone Distribution Systems -From and after the effective date of this
Ordinance, the electrical distribution system shall comply with applicable electrical codes and other
applicable laws of the State.
(K) All Rooms Containing Bathroom or Laundry Facilities shall: Have fire-resistant walls
extending to the ceiling between male and female sanitary facilities. Walls and partitions around
showers, tubs, lavatories and other plumbing fixtures shall be constructed of dense, nonabsorbent,
waterproof materials or covered with moisture resistant materials.
(L) Refuse and Garbage -Solid waste shall be stored in fly proof, water proof containers,
which shall be emptied regularly and maintained in a usable, sanitary condition and the collection
and disposal of said refuse and garbage shall be so conducted as to create no health hazard. A refuse
pickup easement shall be granted by the owner of the HUD -Code Manufactured Home Park to the
City of Sanger, if these facilities are located so as to require the entrance of a municipal vehicle into
the trailer park.
(M) Maintenance of Park -The owner of the park shall be responsible to insure that is
maintained in a manner in which will not attract or aid the propagation of insects or rodents or
create a hazard. Growth of plant material such as weeds and grass, especially beneath HUD -Code
Manufactured Homes and other structures shall be continuously controlled. All streets, parking and
storage areas shall be maintained to provide a fully pave surface.
(N) Conform toCodes -All HUD -Code Manufactured Home Park facilities andHUD-Code
Manufactured Homes contained therein shall conform without limitation to the codes and

ordinances of the City of Sanger, including the Building, Plumbing, Electrical and Fire Codes and
all applicable laws of the State of Texas.
(0) Office - Every HUD -Code Manufactured Home Park shall have an office in which a
copy of the park permit or license shall be posted and the park register shall be in such office. It
shall be the duty of the licensee to keep a register of park occupancy which shall contain the
following information:
1. Name and address of owner and occupant.
2. The make, model, serial number, year and dimensions of all HUD -Code
Manufactured Homes. r
3. The date of arrival and departure of each HUD -Code Manufactured Home.
The park operator shall submit the park register to the City Council each. year upon
requesting a license renewal and shall make said register available to any authorized City official
upon reasonable request. Upon gaining knowledge of a departure of any HUD -Code Manufactured
Home, the park operator shall notify the City tax assessor. Failure to do so shall place the operator
in violation of this ordinance.
(P) Ordinance compliance - It shall be the responsibility of the licensee to insure that all
requirements of this ordinance are met ad mainlined. Any HUD -Code manufactured Home Park
issued an initial license after adoption of this Ordinance that is found to e in violation of any
provisions of this Ordinance shall be notified in writing by the City Council in accordance with
Section 6 and upon failure to comply said license shall be revoked.
(Q) Nonconforming; HUD -Code Manufactured Home Park.
1. . Any HUD -Code Manufactured Home Park in use and/or existence on the
effective date of this Ordinance, and not complying with all applicable
provisions of this Ordinance shall be considered a nonconforming HUD -
Code Manufactured Home Park. Nonconforming parks shall comply with
the requirements of Section 4 (D), (E), (F), (G) and (H) hereof.
2. Any land area added to a nonconforming HUD -Code Manufactured Home
Park shall conform to all requirements of this Ordinance.
(R) Miscellaneous requirements:
1. Responsibilities of Park Management:
A. All responsibilities set out elsewhere in this Ordinance shall apply.
Be The licensee or licensee's agent shall operate the park in compliance
with this and other applicable ordinance shall provide adequate
supervision to maintain the park and all facilities in good repair, and
in clean and sanitary condition.
C. The licensee or agent shall notify park occupants of all applicable
provisions of this Ordinance and inform them of their duties and
responsibilities under this Ordinance
2. Responsibilities of Park Occupants:
A. All responsibilities of occupants set our elsewhere in this Ordinance
shall apply.
Be The Park occupant shall comply with all requirements of this
Ordinance.
C. The park occupant shall be responsible for proper placement of his
HUD -Code Manufactured Home in its HUD -Code Manufactured
Home pad and proper installation of all utility connections in
accordance with the instruments of the park management.
D. The use of space immediately beneath aHUD-Code Manufactured
Home for storage shall not be permitted.
3. Mobile Homes shall not be permitted in a HUD -Code Manufactured Home
Park,
4. Only HUD -Code Manufactured Homes shall be permitted in a HUD -Code
Manufactured Home Park
Section 9. PENALTY PROVISIONS
Any person, firm or corporation violating this Ordinance or any portion thereof shall upon
conviction be guilty of a misdemeanor and shall be fined not less than $1.00 nor more than $500.00
and each day that such violation continues shall be considered a separate offence and punishable
accordingly.

If any section or part of any section or paragraph of this Ordinance is declared invalid or
unconstitutional for any reason, it shall not be held to invalidate or impair the validity, force or
effect of any other section or sections or part of a section or paragraph of this ordinance.
Section 11. EFFECTIVE DATE
This ordinance shall be effective immediately upon its passage, approval and publication.

In response to a letter dated May 1, 2001 to you from Mark D. Hill containing his review
comments for the above referenced plat, I am providing a revised set construction drawings and
the following information relative to the project and construction plans.
Item 6 — A City Engineer approval block is included on the cover sheet.
Item 7 —The location map shown on the cover sheet has been revised to a 1" = 2000' scale..
Item 9 —All building setback lines are shown on site plan drawing.
Item 10 —The 30' access and utility easement is shown on site plan drawing.
Item 13 — It is my understanding the City has the permit.
Item 15 —The current undeveloped acreage for this plat is 1.35 acres. The amount of acreage that
will actually be developed is 0.47 acres. As shown on the attached drainage analysis the total
additional flow that will be discharged from the site is 1.65 cfs. It is my opinion that this minimal
amount of additional flow will not have adverse impact on the adjacent property owners. To
reduce the potential for soil erosion that could occur from the stormwater discharge existing the
site through the curb cut, a 4' x 4' rock riprap energy dissipater shown on the site plan drawing
has been placed at the discharge point to reduce the velocity of flow exiting the parking area.
In addition the developer of this parcel has obtained permission from all adjacent downstream
property owners to discharge onto their property.
Item 18 —The plans have been revised to show the 12" plug bolted directly onto the TEE.
Item 20 — It is my understanding the City has the permit.
Item 21 —The manhole shown was shown in error, it does not exist.

As requested, we have reviewed a Preliminary Plat prepared by Alliance Area Surveying dated April
3, 2001 and construction plans, with accompanying letter, prepared by Mark T. Owens, P.E. dated
August 3, 2001. Reference is made to our comments dated May 1, 2001. Our additional comments
are as follows:
l . Additional comments may be received from Public Works, Code Enforcement and the Fire
Department.
2. The Preliminary Plat provided encompasses the complete 25.83 Acres. The remainder is
designated as Lot 3 and is not to be developed at this time. Drainage and utility plans have
not been provided for the entire property. Due to the nature of this project, we recommend
that these be provided when any additional property is developed.
3. A Final Plat, suitable for filing with Denton County and conforming to Sanger
standards, has not been provided.
4. The Subdivision Name should be provided on the cover sheet of the construction plans.
5. It does not appear that any soil stabilization is being provided under the parking area. A copy
of the geotechnical study should be provided that shows that soil stabilzation is not required.
6. A 12" valve should be located at the end of the water line to prevent disruption of service
when the water line is extended in the future.
7. Have ADA required parking spaces and ramps been provided? A summary of required and
available parking spaces (regular and ADA compliant) should be provided.

As requested, we have reviewed a Minor Plat prepared by Alliance Area Surveying dated Apri13,
2001 and construction plans prepared by Mark T. Owens, P.E. dated April 5, 2001. Our comments
are as follows:
1. All fees shall be paid in accordance with all City rules, ordinances and policies.
2. Additional comments may be received from Public Works, Code Enforcement and the Fire
Department.
3. The property is located north of FM 455 and west of the Kwik Kar Addition.
4. This tract is in an area currently zoned B-2.
This appears to be part of a larger 26.385 acre tract that has not been platted.
The City Engineer approval block is missing.
7 The location map should be at a scale of 1 "=2000%
A basis of bearing has not been provided on the Minor Plat.
9 All building setback lines should be shown.
10. A 30' access and utility easement is being provided along the northern property line of Lots

15 It appears that the majority of the drainage will be discharged through a 2' curb opening.
Calculations regarding the quantity of water, including any impact on adjacent properties,
have not been provided for review. Where does this water go after it leaves ft parkinarea?
Depending upon the amount of water to be discharged, retention may be required or, if
applicable, a letter from the ad acent rky-_owner acknowledging and-aceepling_the
additional flows maybe provided. If a letter is to be provided, it must -be -provided -prior -to

construction. Regardless, flow calculations and "offsite" drainage should be provided.
It appears that the grading and erosion control encroaches upon the adjacent property to the
north. The Owner should provide written permission from the adjacent land owner that this
encroachment is acceptable.
17 The roadway extends west from the northwest corner across the adjacent property. An
access easement or Right -of -Way should be obtained. A copy of this should be provided to
the City, if a separate instrument, or as a part of the Minor Plat.

19. Attached is a standard fire hydrant installation detail.

The Planning and Zoning recommended approval on the Final Plat for Sanger Industrial Park, Lot
I. Block B. Jeff Higgs addressed the items on the Engineer's letter at the meeting, we have sent
the corrected plat to the Engineer and expect his comments by the end of the day. Mr. Higgs has
indicated the items have been corrected, but we are waiting for the engineer's verification.

Dear Mr. Smith:
As requested, we have reviewed a Final Plat prepared by Alliance Area Surveying dated June 5, 2001
and construction plans prepared by Mark T. Owens, P.E. dated July 20, 2001 for the above referenced
project. Our comments are as follows:
l . All fees shall be paid in accordance with various City Ordinances and/or policies.
2. Comments maybe received from Public Works, Code Enforcement and the Fire Department.
3. The property is located on the northeast corner of the intersection of FM 455 and Spur 138.
4. The property is currently zoned I-1.
J5. The Final Plat shows this to be in Block B. This should be changed to Block A,
/6. The first bearing call in the field notes does not match the drawing.
7. The City Engineer certificate has not been placed on the Final Plat.
J8. The Final Plat states that water service is to be by Bolivar WSC. This should be the City of
Sanger.
9. A 15' R.O.W. dedication along FM 455 should be provided to allow for future road widening to
a 100' R.O.W.

10. A minimum 15 utility easement should be dedicated along Spur 138 and the proposed FM 455
R.O.W.
11. A copy of the easement for the sanitary sewer service line should be provided to the City.
12. Will the north and east edges of the parking/drive area be curbed? If so, drainage would be
routed to the ditch along FM 455. r
13. Copies of all permits for driveways and drainage from the TxDOT should be provided to the City
prior to construction.
14. Due to the potential for truck traffic on the pavement, we recommend consideration of a
minimum 6" thick concrete pavement.
15. It does not appear that the subbase will be lime stabilized. A geotechnical report supporting the
method of subbase construction should be provided.
16. Driveway culvert sizes and locations should be shown. Culverts should be sized in accordance
with TxDOT requirements.
17. Waterline embedment should be Class "B-1", not "D+".
18. Reference to Bolivar in the Waterline Installation Notes should be changed to Sanger.
19. The pipe should be blue in color and be installed with tracer tape.
20. The 8" waterline should extend to the east and north property lines for future extensions.
Provisions for flushing should be provided. These waterlines should be located within the 15'
utility easement.
21. An erosion control plan should be provided in addition to the erosion control details. This plan
should show locations of the various erosion control details.

In response to a letter dated August 24, 2001 to you from Mark D. Hill containing his review
comments for the above referenced plat, I am providing a revised construction drawings and the
following information relative to the project and construction plans.
Item 9 —Through the driveway permitting process with TxDOT, they have not indicated they
want the additional 15 feet of R-O-W. I would assume that it is their call as to whether 15 feet of
additional R-O-W be dedicated to them or not. Therefore, an additional 15 feet of R-O-W was
not dedicated as part of this plat.
Item 10 — An easement has been shown on the plat and construction drawings.
Item 11 - An easement has been shown on the plat and construction drawings.
Item 12 —There is no curb.
Item 13 —Driveway permit should be in the City's possession by the receipt of this letter.
Item 14& 15 — No soils report was prepared. The parking lot paving will be constructed
according standard street paving standards- 5" thick reinforced concrete on 6" of 6%lime
stabilized base. -
Item 16 —There are no driveway culverts associated with this project.
Item 17 —Standard detail drawing has been changed to call out Class "B-1" type embedment.
Item 18 —Reference has been changed.
Item 19 —Note has been included on standard detail drawing.
Item 11—The drawing has been changed to show 8" waterline extensions to the east and north
property lines. The lines have been located within the 15' utility easement.

As the Police Chief addressed in a previous meeting, new legislation allows the City to add an
additional 30% to fines that are to be collected through the collection agency to pay the collection
agency fees. However, in order to do this, the legislation requires that Council take action and
decide to do this.

Currently, the City of Sanger has an easement through the Sanger Mobile Home Park for the water
and sewer lines. The City has recently had to repair lines in that area. The Mobile Home Park is
considered to be private property, and the City normally does not do repairs on private property.
Staff is asking for direction concerning this.

Conference in November. The conference is from November 28 - 30, 2001, in Houston. The basic
