MINUTES: City Council Workshop April 2, 2001 PRESENT: Mayor Tommy Kincaid, Councilman Craig Waggoner, Councilman Andy Garza, Councilman Joe Higgs, Councilman Carroll McNeill ABSENT: Councilman Glenn Ervin OTHERS PRESENT: City Manager Jack Smith, City Secretary Rose Chavez, Administrative Assistant Samantha Renz, Ronnie Rucker, Ron Fraze, Woodrow Barton, Bob Kneis l . Mayor called meeting to order. 2. Discussion Regarding Moderate Housing Project, Presentation by Ronnie Rucker with Eastern Development. Ronnie Rucker, Eastern Development Company, addressed Council regarding the need for affordable housing in Sanger. He indicated they wanted to do a project that would help. The City would create a housing finance corporation which would own the project on behalf of the City. The city would have no liability, they look toward the bond holders and property owners to satisfy the debt. Discussed where other projects of this type exist. Councilman McNeill asked since it is affordable housing, do they pat Ad -Valorem tax. Mr. Rucker indicated they would not pay Ad Valorem Tax; basically it belongs to the City, and is exempt; however, the City will make the profit from this project. He indicated this is something they have available and can do with the city, but they wanted to make sure the city is behind it. Councilman McNeill asked if it didn't work out, who would pay for it. Mr. Rucker indicated the bond holders own it, they would sell it, and the city would still have the housing. Discussion regarding the project. Councilman McNeill asked what happens if it is sold, and the City doesn't own it, what will happen with the taxes. Ron Fraze indicated it would then go on the tax roll. These can be run as market rent projects, just like any other project. � F r Discussion regarding the rents, typically a 1 bedroom would be around $550, the 2 and 3 bedrooms would go as high as $750.00. The rent adjustments can be made by the city. Discussion regarding tax credits. Discussion continued regarding the project. Mayor indicated this is a work session, they can not make any decisions, but will put it on the agenda, and discuss it further. 3. Any Other Such Matters. None. 4. Meeting Adjourned. CONSENT AGENDA 2. a) Approve Minutes: March 19, 2001- Workshop March 19, 2001 March 12, 2001- Workshop b) Disbursements Councilman Garza asked about the TV of the lines, did they find anything. City Manager indicated they found a small problem and fixed it, with all the rain they haven't had the problems they used to. Councilman Garza moved to approve the Consent Agenda, Councilman Waggoner seconded. Motion carried unanimously. 3. Citizen's Input. None. 4. Consider and Possible Action Regarding Resolution #04-01-01-Setting the Date, Time, and Place for Public Hearings on Proposed Annexation. City Secretary indicated this is for Sanger Trails, it is a voluntary annexation. Councilman Garza asked if this was the entire project or the first phase. City Secretary indicated it was the entire project. Mayor read Resolution as follows: A RESOLUTION SETTING THE DATE, TIME AND PLACE ON PROPOSED ANNEXATION OF CERTAIN PROPERTY BY THE CITY OF SANGER, AND AUTHORIZING AND DIRECTING THE PUBLICATION OF NOTICE OF SUCH PUBLIC HEARINGS NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANGER, TEXAS: That such Public Hearings will be held by the Governing Body of the City of Sanger, in the City Hall at 7*00 P.M. on April 16, 2001 and May 7, 2001 considering annexation into the City limits of the following described property: ABSTRACT 29, RUEBEN BEBEE SURVEY, BEING 291.9467 ACRES, TO BE KNOWN AS SANGER TRAILS Councilman Waggoner moved to accept Resolution #04-01-01. Councilman Garza seconded. Motion carried unanimously 5. Consider and Possible Action on Extending IESI's Contract for Another 10 Years in Exchange for a Lease on 2 Acres for the New Water Well Site. Mayor indicated they all had a memo indicating they would sell the property to the City for $1.00 for an extension of ten years to their contract. Mayor indicated originally they were told five years. Bob Kneis, District Manager for HJSI, indicated they felt 10 years was fair to recoup the revenues for the land. Councilman Garza asked about the 25 acre landfill, and if it could be used for the well site. City Manager indicated after discussion, and doing some digging, they felt it was better not to dig on the landfill. Discussion regarding the ten year extension of the contract. Councilman Garza asked how are we going to get the water lines to the easement. City Manager indicated the water easement is already existing. Discussed location of the water well. Councilman Waggoner asked if ten years was a long contract. Bob indicated they didn't have any other ten year contracts, however, there were other cities that did. Discussion. Councilman McNeill moved to accept the memorandum dated March 309 2001 from Bob Kneis to Jack Smith regarding the 2 acre water well site, excluding the bottom two items noted. Councilman Waggoner seconded. Motion carried unanimously. 6. Consider and Possible Action Regarding Possible Placement of Stop Signs on Wood and 2"d Streets, and Wood and 3rd Streets, John Henderson indicated there were yield signs on those corners. Councilman Waggoner indicated he felt that the street department and police department could do a traffic study and come back to them with their recommendations. Council agrees, and took no action on this item. 7. Consider and Possible Action on Awarding Vehicle Bid for Police Department. City Secretary indicated this was to replace the wrecked police vehicle. She addressed how they would pay for it, they have money in savings for replacement of equipment, and they have the money from the insurance company. Councilman Garza moved to accept the bid from Jim McNatt Chevrolet for $19,175.20, and use the balance of LP042.00 from the insurance on the wrecked car, and the $4900.00 in the current budget, and get the additional $6,233.00 from the General Fund Equipment Replacing Account to pay for the vehicle. Councilman McNeill seconded. Motion carried unanimously. 8. Consider and Possible Action on Order of Cancellation for the May 5', 2001 Election. City Secretary indicated the candidates were unopposed. Councilman McNeill moved to approve the Order of Cancellation of for the May election. Councilman Waggoner seconded. Motion carried unanimously. 9. Any Other Such Matters. a. Councilman McNeill asked if the City Secretary would put a note in their packet stating what the collection on electric, and the amount of the bill from Brazos. b. Councilman Higgs asked when they were going to annex down the freeway. City manager indicated TX DOT had not received some of the information they need, and they need to provide this. 10. Also instead of the city bringing water to the site, I got from the meeting and the issues with Heritage West and the school, developers now have to pay the cost to pick up the water lines across other people's property. I also understood that Heritage West paid for the initial cost for buying water rights, but recoups that when residents pay for the connection, but when I addressed the council I was told that that is now a cost to the developer. Am I on tract here? Also it doesn't look like that hill is getting knocked down anytime soon, which would mean a pump station to move the sewer along the front of the property, is that correct? Is the hill also an issue as to how soon you could get water to my land if the City did get the water rights? Would it be more practical from your views to just de -annex this piece of property since all the pieces are not failing together as we had first discussed. F.M. 455, P.S. Black Survey A#0103A. This land was purchased with plans for developing a housing addition. Bolivar Rural Water District presently has the water rights for this particular tract of land. After attending the Bolivar Water board meeting and being informed by the attorney for Bolivar that I had two options: one would be for us as developers to rebuild their pump station that would feed that area so that it could supply the necessary pressure for routine water to those homes and allow fire protection for the homeowners, or for us as developers to give them a portion of land and build them a water tower on that land for the necessary supply and protection. In addition to either option, I was to improve the water line from the point of origination to the development to carry the water supply. In addition to that I was to pay an additional $2000 per residence for impact fee. As an individual developer I cannot improve their water system and pay them an impact fee (on top of which they will charge the residents a membership.fee and a connection fee of approximately $3000; plus naturally the monthly revenue they will benefit from the property). The developer costs alone would extinguish any development Into any area Bolivar Water District has control of except for undeveloped acre lots. 1 have requested to be annexed into the City of Sanger, which has been approved.
