05-07-01-Ordinance-Amending the Fees for Food Service Establishments-05/21/2001CITY OF SANGER, TEXAS ORDINANCE No. 405-07-01 AN ORDINANCE OF THE CITY OF SANGER, DENTON COUNTY, TEXAS, AMENDING CHAPTER 6, ARTICLE 6.503 AND APPENDIX ARTICLE 20.000 OF THE CITY OF SANGER CODE OF ORDINANCES; PROVIDING FOR THE REPEAL OF ORDINANCES IN CONFLICT; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SANGER, TEXAS: SECTION I THAT CHAPTER 6, ARTICLE 6.503 AND APPENDIX ARTICLE 20.000 OF THE CITY OF SANGER CODE OF ORDINANCES IS HEREBY AMENDED TO READ AS FOLLOWS: ARTICLE 20.000 FEES FOR FOOD SERVICE ESTABLISHMENTS (a) Application Fee - (one time) $200,00 (b) Annual Permit Fee - $150.00 (c) Day Care Facilities - $50.00 base plus $1.00 per child licensed. (d) All required Inspections are subject to a fee consistent with the amount charged to the City to have the Inspections performed. (e) Re -inspections or Inspections in addition to the two yearly inspections - $50.00 (f) Plan review for newly constructed, remodeled, or converted structure, including on - site review and/or written comments regarding compliance with state law requirements for any new food establishment - $50.00 SECTION H All Ordinances or parts of Ordinances in conflict herewith are, to the extent of such conflict, hereby repealed. SECTION III It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses, and phrases of this Ordinance are severable and, if any phrase, clause, sentence, paragraph, or section of this Ordinance shall be declared unconstitutional by the valid judgement or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs, and sections of this Ordinance, since the same would have been enacted by the City Council without the incorporation in this Ordinance of any such unconstitutional phrase, clause, sentence, paragraph, or section. SECTION IV This Ordinance will take effect immediately after its passage. PASSED AND APPROVED this 21 st day of May, 2001, by the City Council of the City of Sanger, Texas.
