06-11-01-Ordinance-Installation of Underground Electrical Service-06/04/2001CITY OF SANGER, TEXAS ORDINANCE No. #06-11-01 AN ORDINANCE OF THE CITY OF SANGER, DENTON COUNTY, TEXAS, AMENDING CHAPTER 119 ARTICLE 11.1300 OF THE CODE OF ORDINANCES OF THE CITY OF SANGER; PROVIDING FOR THE REPEAL OF ORDINANCES IN CONFLICT; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A PENALTY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. BE IT ORDAINED AND ORDERED by the City Council of the City of Sanger Texas: That Chapter 11, Article 11.1300 of the Code of Ordinances, City of Sanger, Texas, is hereby amended to read as follows: SECTION I ARTICLE 11.1300 INSTALLATION OF UNDERGROUND ELECTRICAL SERVICE When underground service is requested by a customer or developer, whether it be for primary or secondary service, the difference in estimated cost of overhead and underground service will be paid by the customer or developer in advance of construction. The difference in actual cost shall also be paid by the customer or developer upon completion of the job before service is connected. The construction to be according to the specifications required by the City. The customer or developer shall be responsible for furnishing and installing, and the expenses related thereto, of conduit for the installation of all on -site underground development feeder, lateral and service lines utilized to provide electric utility service to the subdivision. The specifications for the conduit shall be approved by the Electrical Department prior to installation. SECTION 11 All Ordinances or parts of Ordinances in conflict herewith are, to the extent of such conflict, a hereby repealed. SECTION III It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses, and phrases of this Ordinance are severable and, if any phrase, clause, sentence, paragraph, or section of this Ordinance shall be declared unconstitutional by the valid judgement or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs, and sections of this Ordinance, since the same would have been enacted by the City Council without the incorporation in this Ordinance of any such unconstitutional phrase, clause, sentence, paragraph, or section. SECTION IV This Ordinance will take effect immediately after its passage and the publication of the caption as the law in such cases provides.
