AN ORDINANCE FIXING AND ESTABLISHING A NEW SPEED LIMIT FOR VEHICLES,
UPON THE BASIS OF AN ADDITION , ENGINEERING AND TRAFFIC INVESTIGATION IN
SNIDER ESTATES WITHIN THE LIMITS OF THE CITY OF SANGER, TEXAS AS SET OUT
IN THIS ORDINANCE. PROVIDING THAT VIOLATION OF THIS ORDINANCE SHALL
CONSTITUTE A MISDEMEANOR, AND PROVIDING A PENALTY UPON CONVICTION OF
A FINE NOT TO EXCEED THE AMOUNT ALLOWABLE UNDER STATE LAW FOR
VIOLATION OF SAID ORDINANCE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SANGER, TEXAS:
SECTION I
That based upon an engineering and traffic investigation heretofore made as authorized by
the provisions of TEX. REV. CIV. STAT. ANN. article 6701d, section 169, the following speed
limit is hereby determined and declared to be prima facie the maximum reasonable and safe speed
for traffic on Brooke Dr., Benjamin Dr., and Laney Dr. The present speed limits shall be revoked
and new ones shall be fixed for all vehicles traveling upon the herein after designated streets. The
change is as follows:
SPEED ZONE
Brooke Drive
Benjamin Drive
Laney Drive
SPEED LIMIT
20 mph
20 mph
20 mph
The above speed limits fixed and established for the respective speed zones, shall be
applicable to all vehicles traveling within each zone.
SECTION II
All Ordinances or parts of Ordinances in conflict herewith are, to the extent of such conflict,
hereby repealed.
SECTION III
It is hereby declared to be the intention of the City Council that the sections, paragraphs,
sentences, clauses, and phrases of this Ordinance are severable and, if any phrase, clause, sentence,
paragraph, or section of this Ordinance shall be declared unconstitutional by the valid judgement
or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the
remaining phrases, clauses, sentences, paragraphs, and sections of this Ordinance, since the same
would have been enacted by the City Council without the incorporation in this Ordinance of any
such unconstitutional phrase, clause, sentence, paragraph, or section.
SECTION IV
That an individual adjudged guilty of exceeding this speed limit, when signs are erected
giving notice thereof, shall be guilty of a misdemeanor, and punished by a fine not to exceed the
maximum amount allowable by State law.
SECTION V
This Ordinance will take effect immediately from and after its passage and the publication
of the caption as the law in such cases provides.
PASSED AND APPROVED this 2nd day of July, 2001, by the City Council of the City of
Sanger, Texas.
