11/17/2003-CC-Minutes-RegularMINUTES: CITY COUNCIL NOVEMBER 17, 2003 PRESENT: Mayor Pro-Tem Andy Garza, Councilman Mike James, Councilman Jimmy Evans, Councilman Joe Higgs, Councilman Glenn Ervin ABSENT: Mayor Tommy Kincaid PRESENT: City Manager Jack Smith, City Secretary/Assistant City Manager Rose Chavez, Troy Waldrop, Larry George, Shelley Ruland 1. Mayor Pro-Tem Garza called Meeting to Order, and led the Invocation, which was followed by the Pledge of Allegiance. 0 3. 4. CONSENT AGENDA a) Approve Minutes: November 3, 2003 b) Disbursements Councilman Ervin moved to approve the Consent Agenda as presented. Councilman James seconded. Motion carried unanimously. Citizen's Input. A) Troy Waldrop addressed the Council, he indicated he had lived in Sanger for approximately 25 years, he indicated there had been several robberies in his neighborhood. He expressed concerns regarding this situation. He did not feel the police officers were doing anything about it. He felt more of an investigation should be going on. He felt the police department should be doing more. The police chief advised him that the street lighting was a problem and that he would try to get that corrected. It has not been done yet. He felt that people should be made aware of what's going on. Staff indicated they had discussed the lighting in the area, and were working on correcting it. B) City Manager indicated J.P. Haskins had double by-pass surgery today and was doing okay. Consider and Possible Action on a Temporary License Agreement and Sidewalk Sales Ordinance. Discussion regarding the permit process, cost and insurance cost for permit holders. Discussion regarding the permits, Downtown merchants and the Chamber. Councilman Ervin expressed concerns regarding how this would affect the Sanger Sellabration. Councilman Evans indicated he felt that the Chamber should be able to lease the park and the streets, but that they should keep the sidewalks clear for the businesses. He indicated the businesses could then lease the sidewalk in front of their respective stores. Discussion continued. Councilman James indicated he felt that staff should take care of issuing the permits. He did not feel they should come before Council. Councilman Higgs moved to accept the Temporary License Agreements for Business Owners and for Non -Business owners, and that staff be responsible for permitting. Councilman James seconded. Motion carried 4 to 1, Councilman Ervin voted no. 5. Conduct First Public Hearing on the Following Proposed Annexations: ABSTRACT 1241, TRACT 3, BEING 83.720 ACRES IN DENTON COUNTY TEXAS; AND METZ ESTATES, BLOCK 1, LOTS 1-6, AS RECORDED IN THE DEED RECORDS OF DENTON COUNTY, TEXAS; AND ABSTRACT 1241, TRACT 65A (1), BEING 1.4132 ACRES IN DENTON COUNTY TEXAS; AND ABSTRACT 1241, TRACT 67, BEING 0.057 ACRES IN DENTON COUNTY TEXAS; AND ABSTRACT 1241, TRACT 8, BEING 242.275 ACRES IN DENTON COUNTY TEXAS; AND ABSTRACT 1241, TRACT 330, BEING 390.387 ACRES IN DENTON COUNTY TEXAS. Public Hearing opened. Larry George had some questions regarding the annexations. He asked what the objective of annexing these properties was. City Manager indicated the purpose is to move the City Limits so that another City cannot engulf the City of Sanger. Sometimes smaller properties are annexed in order to get to the other properties. Mr. George asked how the properties were selected. Councilman Garza indicated it was based on their contiguity to the current city limits. Mr. George indicated according to his map the city was taking land that was developed and skipping other properties. According to his map there was a finger of property not being annexed. Discussed location of properties being annexed. Public Hearing closed. 6. Consider and Possible Action on Ordinance #11-34-03 - Amending Zoning Ordinance Relative to Mobile Homes, HUD -Code Manufactured Homes, and Industrialized Housing. City Manager indicated this was in reference to modular housing. Councilman Evans moved to adopt Ordinance #11-34-03. Councilman James seconded. Motion carried unanimously. 7. Meeting Adjourned.
