1. Mayor Pro Tem Andy Garza called Meeting to Order, Councilman Waggoner led the
Invocation, Councilman Ervin by the Pledge of Allegiance.
CONSENT AGENDA
2. a) Approve Minutes: November 6, 2000
b) Disbursements
Councilman McNeill asked about the expenditure to Southwest International.
City Secretary indicated one of the trucks in the street department broke down, and it
had to be towed and fixed.
Councilman McNeill asked about the expenditure to Robert Singletary and Hammet
& Nash.
City Secretary indicated this was for Walmart, and these people are not wanting to
wait for reimbursement from the State, so the City is paying them and will be
reimbursed by the State Capital Fund.
Councilman Waggoner moved to approve the consent agenda. Councilman Higgs
seconded. Motion carried unanimously.
3. Citizen's Input.
James Emery, Trey's Court, recently a new stop sign was put in, he purchased a new
home in that area, kids peel out and stop and throw out trash. He would like to oppose
the stop sign.
Mayor Pro Tem indicated they did not want to wait until someone got hurt in that area.
The main concern was safety.

Mr. Emery indicated he felt it was more of a hassle, and there was more trash since it
was put in.
Discussion regarding a traffic count on Freese.
4. Conduct Second Public Hearing on Proposed Annexation of the Following Properties:
ABSTRACT 29, RIJEBEN BEBEE SURVEY, TRACT 65A, 35.000 ACRES, AND
ABSTRACT 299 RUEBEN BEBEE SURVEY, TRACT 64A9 23.440 ACRES, OF
WHICH 14.35 ACRES ARE ALREADY IN THE CITY,

Public Hearing closed.
5. Consider and Possible Action on Awarding Bid for the TCF Walmart Water &
Sanitary Sewer Lines,
City Manager indicated the low bidder was Hebard Utilities out of Grand Prairie.
Discussion.
Councilman McNeill moved to award the bid in the amount of $187,150.00 to Hebard
Utilities out of Grand Prairie, Councilman Waggoner seconded. Motion Carried
unanimously.
6. Consider and Possible Action Regarding a Final Plat on Heritage West, Phase I, Being
7.82 Acres in the Henry Tierwester Survey, Abstract 1241. Property is located off of
F.M. 455.
Councilman McNeill expressed concerns regarding not having the engineering plans
showing all the utilities. He also expressed concerns regarding the width of the street.
Discussion regarding the street.
Councilman McNeill expressed concerns regarding drainage and the easements.
Discussion regarding the lot sizes in Block B.
Councilman McNeill indicated he felt the streets should be wider.
Councilman McNeill asked if they had a permit from TXDOT.
Frank Rodgers indicated they would not be able to get one until this got through the
City.
Councilman Ervin indicated he felt the streets should be wider since there are no
sidewalks.
Discussion regarding parking and the streets.
Discussed the commercial area in reference to the Land Use Study.
Councilman Ervin moved to approve the Final Plat on Heritage West, Phase I.
Councilman Higgs seconded. Motion Carried 4 to 1, Councilman McNeill voted no.
7. Consider and Possible Action Regarding a Preliminary/Final Plat for Sunset Lake
Estates, Phase H, Being 21.41 Acres in the Rueben Bebee Survey, Abstract 29.
Property is located off Huling Road, in the City of Sanger's E.T.J.
Councilman Higgs indicated there was something in this subdivision approved back in
December of 1999.
Peggy Arrington indicated that was Phase I, and this is Phase II.
Discussion regarding the road, and if it is to County Specs.
Councilman McNeill asked if there would be any restrictions.
Peggy Arrington indicated there would be.
Restrictions discussed.
Councilman McNeill asked what type of road would it be.
Ms. Arrington indicated it would be gravel.
Councilman Higgs expressed concerns regarding when the property is eventually
annexed, the city may have to pave the road.
Councilman McNeill asked for the City Manager's opinion.
City Manager indicated that the City would probably eventually go out that way, and
if they annex it they would have to pave the road.
City Secretary indicated the City could not offer them any services if they annex them,
therefore, probably not.
City Manager indicated if the City was not gong to annex them, he did not have a
problem with it.
Discussion regarding the septic system.
Discussion regarding the street.
Peggy Arrington indicated the reason they were not going to pave it was because of the
cost. It is not in the owner's budget. It has never been their intention to pave the road.
Councilman McNeill indicated he would be opposed to it for fear of what this would
lead to.
Councilman Higgs indicated he had property in the area, so he would probably have
to abstain.
Councilman Ervin asked if they could approve the plat and deny the variance.
Discussion regarding the street and that if the city requires a concrete street the whole
subdivision would change.
Councilman Waggoner expressed that he would be concerned if this is approved it will
set a precedent.
Councilman Ervin indicated he would like to see a minimum of Asphalt.
Councilman McNeill moved to deny Sunset Lake Estates, Phase II. Councilman
Waggoner seconded. Motion Carried 3 to 1, Councilman Ervin voted no, Councilman
Higgs abstained.
City Secretary pointed out that the precedent was already set. Ridgecrest and
Lakecrest Meadows both have asphalt streets. The streets have always been a concern.
Discussion regarding roads in the County.
8. Consider and Possible Action Regarding a Preliminary Plat for Beka Hill Addition,
Being 25.44 Acres in the J. P. B. January Survey, Abstract #658, in the E.T. J. of the
City of Sanger. Property is Located off of F.M. 455.
Item Tabled per owner's request.
9. Consider and Possible Action on Appointment to the Board of Adjustments and
Beautification Board.
Discussion regarding the term for the Beautification board appointment.
City Secretary indicated the term will be from 2000 to 2002.
Discussion regarding the appointments.
Councilman McNeill moved to appoint Belle Lawson to the Beautification Board, and
Jim Mann to the Board of Adjustments. Councilman Waggoner seconded. Motion
carried unanimously.
10. Consider and Possible Action to Rescind Resolution #09-22-00 -Joining the TXU
Lawsuit.
Mayor Pro Tem asked why this was not already sent when the Council passed it.
City Administrator indicated he had instructed the City Secretary to hold it after he
talked to TXU.
Discussion regarding what would be best for the City in regards to participating or not.
Lengthy Discussion.
Councilman Ervin moved not to rescind Resolution #09-22-00. Councilman McNeill
seconded. Motion carried unanimously.
lie Consider and Possible Action on Awarding the Bid for Electric Feeder
Project/Underground Substation Exits.
Staff recommended approval. If this bid is not approved it will put the project behind
schedule.
City Secretary explained that some of these projects will go over what was allocated in
the grant, the City will have to pay the difference, and if there is money left over, the
City will then get reimbursed.
Discussion regarding the bid.
Councilman Higgs moved to accept the bid. Councilman Waggoner seconded. Motion
carried unanimously.
12. Any Other Such Matters.
a) Discussed electrical project that needs to be done in town.
b) Mayor Pro Tem asked if we ever got an estimate regarding the utility billing for
Walmart.
City Secretary indicated she tried to contact the City of Paul's Valley, they would not
release it because it was disclosure information. She tried to contact Walmart to get
permission but had no success.
c) Councilman Ervin asked who was doing the Electrical Inspections for Walmarto
City Administrator indicated Bob is going with their inspector and inspecting with
them.

2. Consider and Possible Action Regarding aPreliminary/Final Plat for Sunset Lake
Estates, Phase H, Being 21.41 Acres in the Rueben Bebee Survey, Abstract 29.
Property is located off Huling Road, in the City of Sanger's E.T.J.
City Administrator indicated he spoke with Ms. Brodie who sent him the road
agreement that will be attached to the deed. The City engineer was concerned about
the upkeep of the road, the deed restrictions require them to keep up the road as
property owners. The road will never be deeded to the City, and will meet County
specifications.
City Administrator read some requirements the Council was considering adding to the
subdivision regulations.
1. Must be in the ETJ
2. Not more than six lots
3. No less than 3.5 acres
4. No less than 1800 square foot, site built homes
Discussion regarding the possible changes.
Councilman Ervin expressed concerns regarding the dust from the road.
Discussion regarding the road.
Councilman Higgs moved to accept the request with the stipulations proposed.
Councilman McNeill seconded the motion. Motion carried unanimously.
Councilman McNeill indicated he would like the regulations changed from 26 to 30 feet
on the cul-de-sac, face to face.
Staff advised to come back with an amendment to the ordinance.

INTERLOCAL COOPERATION AGREEMENT FOR LIBRARY SERVICES
THIS AGREEMENT is made and entered into by and between
Denton County, a political subdivision of Texas, hereinafter
referred to as "COUNTY," and the City of Sanger, a municipality
of Denton County, Texas, hereinafter referred to as
"MUNICIPALITY."
WHEREAS, COUNTY is a duly organized political subdivision of
the State of Texas engaged in the administration of COUNTY
government and related services for the benefit of the citizens
of Denton County; and
WHEREAS, the City of Sanger is a duly organized MUNICIPALITY
of Denton County, Texas engaged in the provision of library
service and related services for the benefit of the citizens of
MUNICIPALITY; and
WHEREAS, COUNTY has requested and MUNICIPALITY has agreed to
provide library services for all residents of Denton County; and
WHEREAS, COUNTY and MUNICIPALITY mutually desire to be
subject to the provisions of V.T.C.A., Government Code Chapter
791, the Interlocal Cooperation Act; and V.T.C.A., Local
Government Code Chapter 323, COUNTY Libraries.
NOW, THEREFORE, COUNTY and MUNICIPALITY, for the mutual
consideration hereinafter stated,

The term of this agreement shall be for the period from
October 1, 2000 through September 30, 2001.
II.
For the purposes and consideration herein stated and
contemplated, MUNICIPALITY shall provide library services for the
residents of COUNTY without regard to race, religion, color, age,
disability and/or national origin. Upon proper proof by
individual(s) of residence in Denton County, Texas, such
individuals) shall be entitled to be issued, at no cost, a
library card to be used in connection with said library services.
MUNICIPALITY shall develop and maintain through the Library
one or more of the following programs of service:
Educational and reading incentive programs and
materials for youth.
Functional literacy materials and/or tutoring programs
for adults.
Job training/career development programs and/or
materials for all ages.
Outreach services to eliminate barriers to library
services.
Educational programs designed to enhance quality of
life for adults.
COUNTY designates the County Judge to act on behalf of
COUNTY and serve as liaison officer for COUNTY with and between
COUNTY and MUNICIPALITY. The County Judge or his designated
substitute shall insure the performance of all duties and
obligations of COUNTY herein stated and shall devote sufficient

time and attention to the execution of said duties on behalf of
COUNTY in full compliance with the terms and conditions of this
agreement, and shall provide immediate and direct supervision of
COUNTY's employees, agents, contractors, sub -contractors, and/or
laborers, if any, in the furtherance of the purposes, terms and
conditions of this agreement for the mutual benefit of COUNTY and
MUNICIPALITY.
IV.
MUNICIPALITY shall designate
to
act on behalf of MUNICIPALITY and to serve as liaison officer of
MUNICIPALITY with and between MUNICIPALITY and COUNTY to insure
the performance of all duties and obligations of MUNICIPALITY as
herein stated and shall devote sufficient time and attention to
the execution of said duties on behalf of MUNICIPALITY in full
compliance with the terms and conditions of this agreement, and,
shall provide management of MUNICIPALITY'S employees, agents,
contractors, sub -contractors, and/or laborers, if any, in the
furtherance of the purposes, terms and conditions of this
agreement for the mutual benefit of MUNICIPALITY and COUNTY.
MUNICIPALITY shall provide to COUNTY a copy of the annual
report submitted to the Texas State Library and shall respond to
COTJN'PY's annual questionnaire as documentation of expenditures
and provision of service.

The MUNICIPALITY shall be solely responsible for all
techniques, sequences, procedures, and means and for the
coordination of all work performed under the terms and conditions

Di: this agreement, shall insure, dedicate and devote the full
time and attention of those employees necessary for the proper
execution and completion of the duties and obligations of the
MUNICIPALITY stated in this agreement and give all attention
necessary for such proper supervision and direction.
VI
The MUNICIPALITY agrees that its library department shall
assume the functions of a COUNTY library and agrees to provide a
librarian who holds or secures a COUNTY librarian's certificate
from the Texas State Library and Archives Commission. Local
Government Code, section 323.011(b)
VII.
COUNTY agrees to and accepts full responsibility for the
acts, negligence and/or omissions of all COUNTY's employees,
agents, sub -contractors, and/or contract laborers and for those
of all other persons doing work under a contract or agreement
with the COUNTY.
VIII.
The MUNICIPALITY agrees and accepts full responsibility for
the acts, negligence, and/or omissions of all the MUNICIPALITY's
employees, agents, sub -contracts, and/or contract laborers, and
for those of all other persons doing work under a contract or
agreement with said MUNICIPALITY.
IX.
This agreement is not intended to extend the liability of
the parties beyond that. provided by law.

nor COUNTY waives any immunity or defense that would otherwise be
available to it against claims by third parties.
MUNICIPALITY understands and agrees that the MUNICIPALITY,
its employees, servants, agents and representatives shall at no
time represent themselves to be employees, servants, agents
and/or representatives of COUNTY.
XI.
COUNTY understands and agrees that COUNTY, its employees,
servants, agents and representatives shall at no time represent
themselves to be employees, servants, agents, and/or
representatives of MUNICIPALITY.

XIII.
For the full performance of the services above stated,
COUNTY agrees to pay MUNICIPALITY fees as described herein.
COUNTY shall pay MUNICIPALITY fees in the amount of $1.25 per
capita, for a total of EIGHT THOUSAND FOUR HUNDRED SIXTY-FOUR
DOLLARS AND NO/100 ($8,464.00), based upon North Central Texas
Council of Governments population figures provided to Denton

County by the Library Advisory Board, payable in equal quarterly
installments to MUNICIPALITY commencing October 1, 2000. In
addition, the COUNTY agrees to pay MUNICIPALITY an amount not to
exceed TEN THOUSAND DOLLARS ($10,000) in matching funds upon the
following conditions. MUNICIPALITY shall attempt to secure
funding from sources other than Denton County. Upon receipt of
additional funding, MUNICIPALITY shall provide proof of the
receipt of such funds to the Denton County Auditor on a quarterly
basis. Denton County shall match MUNICIPALITY's additional
funding in an amount not to exceed $10,000.00. Payment by COUNTY
to MUNICIPALITY shall be made in accordance with the normal and
customary processes and business procedures of COUNTY, and
payment shall be satisfied from current revenues of the COUNTY.
XIV.
This agreement may be terminated at any time, by either
party giving sixty (60) days advance written notice to the other
party. In the event of such termination by either party,
MUNICIPALITY shall be compensated pro rata for all services
performed to termination date, together with reimbursable
expenses then due and as authorized by this agreement. In the
event of such termination, should MUNICIPALITY be overcompensated
on a pro rata basis for all services performed to termination
date or be overcompensated for reimbursable expenses as
authorized by this agreement, then COUNTY shall be reimbursed pro
rata for all such overcompensation. Acceptance of such
reimbursement shall not constitute a waiver of any claim that may
otherwise arise out of this agreement.

XV.
This agreement represents the entire and integrated
agreement between MUNICIPALITY and COUNTY and supersedes all
prior negotiations, representations and/or agreements, either
written or oral. This agreement may be amended only by written
instrument signed by both MUNICIPALITY and COUNTY.
XVI.
The validity of this agreement and any of its terms or
provisions, as well as the rights and duties of the parties
hereto, shall be governed by the laws of the State of Texas.
Further, this agreement shall be performable and all compensation
payable in Denton County, Texas.
XVII.
In the event that any portion of this agreement shall be
found to be contrary to law, it is the intent of the parties
hereto that the remaining portions shall remain valid and in full
force and effect to the extent possible.
XVIII.
The undersigned officers and/or agents of the parties hereto
are the properly authorized officials and have the necessary
authority to execute this agreement on behalf of the parties
hereto and each party hereby certifies to the other that any
necessary orders or resolutions extending said authority have
been duly passed and are now in full force and effect.

Hayes, Coffey & Berry is currently providing legal counsel to its municipal clients on many
aspects of annexation, voluntary as well as involuntary annexation. The law firm provides legal

to implement annexations and disannexations, on all procedures including notices, preclearance from
U. S. Justice Department, service plans, public hearings, and when necessary make sure all elections,

Lonnie Nowin is the gentleman who has requested this item be on the agenda. He is
proposing to open a private club/restaurant in Sanger. The TABC will issue a private
club liquor license to an applicant who wishes to sell liquor as long as they serve food,
this license will allow them to have operating hours and serve liquor until midnight.
Mr. Nowin has requested the City Council pass an extended hours ordinance.
According to the TABC, in order for a business to serve liquor and extend operating
hours to 2:00 A.M., the City has to have an Ordinance extending the hours. Mr.
Nowin has indicated he will be at the meeting to address this.

Currently, we are charging $50.00 plus $3.00 per 100 sq. ft. for the application fee,
and $25.00 plus $3.00 per employee for the annual permit, along with the inspection
fees at the rate we are billed for the inspections.
With the growth we are experiencing the calls, inquiries, and time with the applicants
is becoming more and more lengthy than it has been in the past. It is taking up more
of my time and Samantha's. I do not feel the current fees are covering the cost for the
time we spend with these applicants, setting up inspections, and providing them with
the information they need to open the businesses.
I feel these proposed fees will come closer to covering the cost for the administrative

A RESOLUTION DESIGNATING THE MONTH OF DECEMBER,
20009 AS FAIR HOUSING MONTH AND SUPPORTING FAIR
HOUSING ACTIVITIES WITHIN THE CITY.
Whereas, Title VIII of the Civil Rights Act of 1968, as amended, prohibits discrimination
in housing and declares it a national policy to provide, within costitutional limits, for fair
housing in the United States; and
Whereas, the principle of Fair Housing is not only national law and national policy, but a
fundamental human concept and entitlement for all Americans; and
Whereas, this proclamation, during the month of December, provides an opportunity for
all Americans to recognize that complete success in the goal of equal housing opportunity
can only be accomplished with the help and cooperation of all Amercians.
NOW THEREFORE, WE, the City Council of the City of Sanger, do proclaim December
as Fair Housing Month in the City of Sanger and do hereby urge all the citizens of this
locality to become aware of and support the Fair Housing law.

BE IT ORDAINED AND ORDERED by the City Council of the City of Sanger Texas:
That Chapter 9, Section 6(C)(1) of the Code of Ordinances, City of Sanger, Texas, is hereby
amended to read as follows:
SECTION I
C. Paving; Width Requirements
(1) Residential Streets. Collector Streets. and Allevs
Residential street paving shall be a minimum of thirty feet (30') in width, measured
between the faces of curbs.
Collector street paving around schools shall be a minimum of thirty six feet (36') in
width, measured between the faces of the curbs. The width for collector streets in
industrial and commercial areas must be a minimum of forty feet (40') in width,
measured between the faces of the curbs.
Alley paving shall be ten feet (10') wide in residential areas and twenty feet (20')
wide in commercial and industrial areas. Alley turnouts shall be paved to the
property line and shall be at least two feet (2') wider than the alley paving at that
point. Paving radius where alleys intersect residential and collector streets shall be
ten feet (10') and where alleys intersect thoroughfare streets the radius shall be
fifteen feet (15'). Paving radius shall be twenty-five feet (25') where alleys intersect
one another.
SECTION II
All Ordinances or parts of Ordinances in conflict herewith are, to the extent of such conflict,
hereby repealed.
SECTION III
It is hereby declared to be the intention of the City Council that the sections, paragraphs,
sentences, clauses, and phrases of this Ordinance are severable and, if any phrase, clause, sentence,

paragraph, or section of this Ordinance shall be declared unconstitutional by the valid judgement
or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the
remaining phrases, clauses, sentences, paragraphs, and sections of this Ordinance, since the same
would have been enacted by the City Council without the incorporation in this Ordinance of any
such unconstitutional phrase, clause, sentence, paragraph, or section.
SECTION IV
This Ordinance will take effect immediately after its passage and the publication of the
caption as the law in such cases provides.

Any proposed pavement section of lesser thickness or alternate materials shall
be fully documented by the design engineer to substantiate the fact that such

On roadways, adjacent to the proposed subdivision, that are designated to be
major or secondary thoroughfares (except Class A Loop Highway), the
subdivider shall be required to construct, at his own cost and expense, one-half
(1/2) of the street section, up to a width of twenty-four feet (24'), measured to
face of curbs, with integral curbs on each side.
Where thoroughfares traverse a subdivision, the subdivider shall be required, at
his own cost and expense, to construct a twenty-four foot (24') wide section on
each side of the roadway.
Thoroughfares shall be designed and constructed with an eight inch (8")
thickness of three thousand five hundred (3,500) p.s.i. reinforced concrete
pavement on a compacted subbase. All steel reinforcing shall be deformed No.
3 bars at twenty-four inch (24") centers both ways.

(1,000') between two (2) 4-way (perpendicular) intersections. (Street
width shall not vary between intersections.)
(d) Residential street intersects another roadway more than once (i.e. U-
shaped, semi -circle or loop streets).
Collector street paving around schools shall be a minimum of thirty-six feet
(36') in width, measured between the faces of curbs. The width for collector
streets in industrial and commercial areas must be a minimum of forty feet (40')
in width, measured between the faces of the curbs.

THIS AGREEMENT ("Amendment") is made and entered into as of ,
. by and between UPPER TRINITY REGIONAL WATER DISTRICT, (the "District")
and CITY OF SANGER, (herein "Member") to amend the Participation Contract. dated
November 13, 19900 as amended (the "Contract"), which Contract provides for Member to
participate in the District's Regional Treated Water System (the "System").
WHEREAS, Member began receiving water from of the System in August 1998; and
WHEREAS, the Contract in Exhibit B thereof, provides for Members Minimum Demand to be
0.5 MGD; and
WHEREAS, the Contract, in Section 4.07 thereof, provides that Member may submit future
requests for changes in Demand with "..,such advance notice as will be necessary to allow
for financing, design and construction of the needed facilities"; and
WHEREAS, based on continued growth, Member has requested an increase in Demand from
0,5 MGD to 1.0 MGD, effective June 1, 2001, and has requested District to proceed on an
expedited schedule, to make appropriate arrangements to meet such Demand; and
WHEREAS, to enable water service to Member under the Contract, District purchases water
under a separate agreement from City of Denton, under which agreement a limited supp{y of
water is available; and
WHEREAS, the City of Benton has indicated that it is willing to increase its delivery of water
to District to enable fulfillment of Member's request; and
WHEREAS, the District and Member desire to amend the Contract to confirm and to provide
far such increased Demand, conditioned upon availability of increased water volume from the
City of Denton; and

WHEREAS, the District has used State Participation Funds from the Texas Water
Development Board to help finance the System and the District has implemented an Equity
Fee that applies to all new requests for Demand, which Equity Fee will be used to repurchase
portions of the System owned by the Texas Water Development Board; and
WHEREAS, Member agrees to pay an Equity Fee for the requested 0.� MGD increase in
Demand as a condition of this Amendment; and
WHEREAS, Member agrees to pay for the revised Demand as specified herein in

NOW, THEREFORE, in consideration of the foregoing and the mutual covenants and
agreements contained in the Contract, the District agrees to provide increased Demand
under the Contract, and to use its best efforts to assure availability of water from City of
Denton, and if necessary to issue its Bonds and to acquire, construct and complete facilities
for the System upon and subject to the terms and conditions of the Contract and of this
Amendment as hereinafter set forth, to -wit:
Section 1. Adoption of Preamble. All of the matters stated on the preamble of this
Amendment are true and correct and are hereby incorporated into the body of this
Amendment as though fully set forth in their entirety herein.
Section 2. Demand. The Minimum Demand as specified in Exhibit B of the Contract is
hereby agreed to be 1.0 MGD, effective June 1, 2001.
Section 3. Equity Fee. Member agrees to pay to District aone-time Equity Fee of
$6g,.00 for the 0.5 MGD of increased Demand as agreed Kul" this Amendment. Said fee
shall be due and payable 60 days after the date of this Amendment.
The first sentence of Section 6.04 of the Contract is hereby
amended to read as follows:
"Title to all water supplied to Member shall be in the District up to the Point of Delivery, at
which point the title shall pass to Member, except that the District reserves the right of
reuse of wastewater treated effluent, to the extent authorized by State of Texas."
Section 5. Contract Provisions. All other provisions of the Contract, as amended, shall
continue in full force and effect.

Re: Proposed Legislation by the Upper Trinity Regional Water District
Minor Amendment To Enabling Statute
Dear Mayor Kincaid and Members of the City Council:
The Upper Trinity Regional Water District was created in 1989 to assist its Members with
Regional Water and Wastewater Programs. With your help, the District has been very
successful in getting adequate water to the cities, towns, and utilities of the Denton County area.
The enabling statute that created the District has served you and other Members very well.
After ten years, a renew of the statute indicates that a minor housekeeping amendment would
be advisable and in the best interest of Members.
The Board of Directors of the Upper Trinity Regional Water District (the District) conducted an
extensive review of its enabling statute over the last few months and received a
recommendation from a Committee of Board Members appointed by the undersigned. On
November 2, 2000, the Board unanimously approved and directed its Executive Director,
Thomas E. Taylor, and General Counsel, John F. Boyle, Jr., to seek introduction and passage
of a bill amending the District's Act, Chapter 1053, Acts of the 715t Legislature, Regular Session
1989.
The proposed amendments are incorporated into a bill, a copy of which is attached. The bill
addresses three (3) topics that the District's Board believes should be addressed to give the
Board of Director's clear authority to carry out the directions and desires of its Members. If you
desire a copy of the District's enabling legislation, please call Nancy Tam, or Thomas E. Taylor,
Executive Director at 972.219.1228.
The enclosed bill addresses the following topics:
1. Membership Rules Amends Section 6 (d) to make it clear that the District's
Board has the authority to establish rules regarding membership on the Board,
authority of members to vote, and the weight to be given each vote for any entity
that contracts with the District after March 13, 2000, (the date of the Validation
Suit Judgment). The amendment will eliminate any question relative to the
Board's ability to establish rules to protect the interest of the District and its
Members.

2. Member Consent for Eminent Domain. The Board proposes to amend Section
21 (c) to continue the present requirement for the District to obtain the consent of
the governing body of Member municipalities, to authorize the exercise of the
power of eminent domain before the District can exercise its power within their
boundaries. This requirement would apply to existing Members at the time and
also to any Municipality who was a member as of January 1, 2001. The District
would coordinate with, but would not be required to obtain consent from other
Municipalities.
3. Storm Water /Watershed Pro rams Section 27 is amended to allow the District,
if requested by Members, authority to enact rules to preserve and protect the
integrity of .its water, sanitary sewage and storm water. Such rules would be
enacted only pursuant to a contract with a county, municipality or water district.
This legislation would authorize the District to act on behalf of its Members
pursuant to contracts to promulgate and to assist Members in enforcing mutually
desirable rules to protect water quality.
Attached is a draft resolution that we respectfully request your governing body to review and
adopt supporting the proposed legislation. Please feel free to modify the draft and to call me if
there are any questions. Mr. Taylor, Mr. Boyle and the undersigned are available to meet with

A RESOLUTION APPROVING AND SUPPORTING AMENDMENTS
TO UPPER TRINITY REGIONAL WATER DISTRICT LEGISLATION.
WHEREAS, the Upper Trinity Regional Water District (The District) was authorized in 1989 by
an Act of the Texas Legislature (the Act) to allow the citizens of Denton County to utilize the
District to work with, plan and provide a wholesale system of water, sewage treatment and solid
waste disposal for the citizens of this fast-growing County; and
WHEREAS, the District has carried out the Legislature's mandate and the dP�0W
constituent Cities and Districts in its contracts with the District; and
WHEREAS, the District's Board. of Directors has voted unanimously to request our legislative
delegation to introduce legislation to amend the 1989 Act by amending sections dealing with
Director's authority to promulgate membership rules, to exercise the power of eminent domain
within the boundaries of non-members, and to approve environmental regulations pursuant to
Contracts with its member constituents, and
WHEREAS, the proposed legislation has been reviewed carefully and the City (Town) Council
desires to go on record in favor of the proposed legislation.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY (TOWN) COUNCIL OF THE
Section 1: That all matters stated in the preamble are found to be true and correct and are
incorporated herein as if copied in their entirety.
Section 2: That the City (Town) Council does hereby approve and support the proposed
legislation and does urge its legislative delegations to sponsor and support the legislation.

domain to acquire:
(1) any property located in a municipality leeated in Miele or in paft in the-eeunty
that has a director on the board or that had a director on the board on January 1 2001,
without the prior consent by resolution of the governing
body of the municipality in whose jurisdiction the subject property is located;
(2) any property located outside the county to be
used as a water supply reservoir without the consent of the county
or counties in which the reservoir is to be located;
(3) any properly owned by the county, any
municipality, or any agency or instrumentality of a county or
municipality; or
(4) a waterworks system or a wastewater system
that is owned by a municipality, a political subdivision of the
state, private parties, or a nonprofit corporation.
SECTION 4. Section 27, Chapter 1053, Acts of the 71st
Legislature, Regular Session, 1989, is amended by adding
Subsections (d)-(h) to read as follows:
(d) Under a contract with a county municipality or water
district, the district may adopt and enforce rules applicable in
the boundaries of that county, municipality, or water district and
in other areas under the jurisdiction of the county, municipality,
or water district to:
(1) preserve and protect the quality and sanitary
condition of all water sanitary sewage and storm water that m�
affect a water supply of the county, municipality, water district or
the district or the waters of the state,• or
(2) prevent waste or unauthorized use of water,
samtary sewage or storm water under the jurisdiction of a count
municipality, water district or the district
(e) Rules adopted under Subsection (d) of this section:
(1) may not exceed the authority of the county,
municipality, or water district• and
(2) must conform to the terms of the contract
(f) The district shall publish once a week for two
consecutive weeks in one or more newspapers with eneral
circulation in the district a notice of the substance of the rules
adopted under Subsection (d) of this section and of any penalties

2-3 (3) the necessity and feasibility of those
24 improvements; and
2-5 (4) the proposed method for funding those
2-6 improvements.
2-7 SECTION 3. Section 21(c), Chapter 1053, Acts of the 71st
24 Legislature, Regular Session, 1989, is amended to read as follows:
2-9 (c) The district may not exercise the power of eminent

3-23 for a violation of the rules.
3-24 (g) A penalty for a violation of the rules may not take
44 effect before the fifth day after the date of the second
4-2 publication of the notice.
4-3 (h) A violation of a rule adopted under this section is a
44 Class C misdemeanor.
4-5 SECTION 5. All resolutions, orders, contracts and other acts or
4-6 attempted acts of the board of directors of the Upper Trinity
4-7 Regional Water District relating to any election, contract, or
44 issuance of bonds or other obligations anri the PYP1PnAit„rP of ii,nAa
4-9 in payment of the bonds and all other governmental and proprietary
440 actions by the board of directors its officers, agents, employees and contractors
441 of that district are validated in all respects. All the resolutions, orders, and other
4-12 acts or attempted acts of the board of directors of the Upper Trinity
4-13 Regional Water District, its officers, agents, employees and contractors
4-14 and all elections, contracts, issuances of
4-15 bonds or other obligations, and payments of the district are valid
446 as though they originally had been legally authorized or
447 accomplished.
448 SECTION 6. Section 5 of this Act does not apply to or affect
449 litigation pending on the effective date of this Act in any court
4-20 of competent jurisdiction in this state to which the district is a
4-21 party.
4-22 SECTION 7. (a) The proper and legal notice of the intention
4-23 to introduce this Act, setting forth the general substance of this
4-24 Act, has been published as provided by law, and the notice and a
54 copy of this Act have been furnished to all persons, agencies,
5-2 officials, or entities to which they are required to be furnished
5-3 by the constitution and other laws of this state, including the
54 governor, who has submitted the notice and Act to the Texas Natural
5-5 Resource Conservation Commission.
5-6 (b) The Texas Natural Resource Conservation Commission has
5-7 filed its recommendations relating to this Act With the governor,
54 lieutenant governor, and speaker of the house of representatives
5-9 within the required time.
540 (c) All requirements of the constitution and laws of this
541 state and the rules and procedures of the legislature With respect

5-12 to the notice, introduction, and passage of this Act are fulfilled
5-13 and accomplished.
5-14 SECTION 8. The importance of this legislation and the
545 crowded condition of the calendars in both houses create an
546 emergency and an imperative public necessity that the
547 constitutional rule requiring bills to be read on three several
5-18 days in each house be suspended, and this rule is hereby suspended,
5-19 and that this Act take effect and be in force from and after its
5-20 passage, and it is so enacted.
