MINUTES: CITY COUNUM OCTOBER 16, 2000 PRESENT: Mayor Tommy Kincaid, Councilman Carroll McNeill, Councilman Joe Higgs, Councilman Andy Garza ABSENT: Councilman Craig Waggoner, Councilman Glenn Ervin OTHERS PRESENT: City Manager Jack Smith, City Secretary/Assistant City Manager Rose Chavez, Administrative Assistant Samantha Renz, Electric Foreman Mike Prater, Police Chief Curtis Amyx, Water/Wastewater Superintendent Eddie Branham, Woodrow Barton, Trish Linville, Steve Hollingsworth, Travis Underwood, Fred Yeatts, Ralph Cain, Doug Stachowick, Kerry Schertz, David Miller, Ralph Amyx, Jack Biggerstaff, Shelley Ruland, Grace Garza 1. Mayor Called Meeting to Order, Councilman Garza led the Invocation, followed by the Pledge of Allegiance. CONSENT AGENDA 20 a) Approve Minutes: October 2, 2000 b) Disbursements Councilman Higgs moved to accept the Consent Agenda. Councilman McNeill seconded. Motion carried unanimously. 3. Citizen's Input. Woodrow Barton, 807 N. 7"', addressed the Council and indicated the County is going to have a public hearing on the CDD and he plans to attend. He indicated in 1970 he wondered who would want to live in this area, in 1980 he started raising cattle in the area. He indicated certain types of development do not clutter up the land and do not impact the current citizens. There are other types of developments such as the proposed retirement community, that will more than double or triple the number of homes in Sanger. He expressed concerns regarding the water supply. He indicated it would be irresponsible of the authorities to authorize and facilitate such a development without doing a study to determine the impact such a development would have on Sanger's water supply. 4. Consider and Possible Action Regarding Ralph Amyx's Drainage Problem on Keaton Road. City Manager addressed the item, he indicated the first option would cost $8,000 to $15,000 for the pipe, the City could put it in. Discussion. Ralph Amyx, Keaton Rd., indicated he just wanted the excess water taken care of. City Manager indicated they could lay two 24" pipes, buried smooth up to Keaton. The pipe would cost $15,000 to $20,000, the city could put it in. Discussed when this could be done. Lengthy Discussion regarding the drainage problem and easements. Councilman McNeill asked the City Manager if he thought the two 24" pipes were the best option. City Manager indicated he did, and asked Mr. Amyx if he could wait until September 30, 2001. Mr. Amyx indicated that would be fine. Discussion. Councilman Higgs moved to attempt to correct a construction problem created years ago with Keaton Road drainage by offering to put in two 24" underground culverts 350 foot west from Keaton Road by September 30, 2001. Councilman Garza seconded. Motion carried unanimously. 5. Consider and Possible Action on Water and Sewer Utilities to New High School. City Manager indicated in the packet, there was a letter from Mr. Sable to the school. Number ten of the letter addressed what the school would do, or cause to be done. It was pointed out to him that there was already a water and sewer line on the property. The City will not have to do anything for Mr. Sable. He indicated he had visited with the school's engineer, and they are designing the water line and sewer line and the City will furnish the water line from the overhead tank and see that an easement is procured from Mr. Sable going across his property to tie into the 15" sewer line. They were probably talking about $30,000 to put in the size lines that the school needs; however, the City will oversize the lines. Discussion regarding the size of the lines, tap fees, and the engineer's drawings. A representative for the school indicated they need to know where they were going to tie into the water and sewer before the engineering could be done. Discussion. Councilman McNeill indicated if this was a subdivision the Ordinance says the developer will bring utilities to their property. Discussion regarding lines and easements. Councilman McNeill suggested setting up a meeting with the City Engineer, the School's Engineer, Jack Smith and Jack Biggerstaff to discuss exactly what needs to be done. Item tabled until it can be worked out with the Engineers. 6. Councilman Garza seconded. Motion carried unanimously. 7. Consider and Possible Action on Resolution #10-23-00 -Authorizing GNB Loan for the Water Well Project. City Manager indicated we already have a loan with GNB, there are two more payments on the loan. He has spoken with GNB and they will extend the loan. Councilman Higgs moved to pass Resolution #10-23-00, authorizing GNB loan for the water well project. Councilman McNeill seconded. Motion carried unanimously. 8. Consider and Possible Action regarding Resolution #10-24-00 - Setting Date and Time and Place for Public Hearings on Proposed Annexations, Councilman McNeill moved to adopt Resolution #10-24-00. Councilman Higgs seconded. Motion carried unanimously. 9. Consider and Possible Action Regarding a Tax Abatement Agreement Between the City of Sanger and Walmart Stores East Inc. City Manager indicated the agreement complies with the Criteria set by the City for tax abatements. Councilman McNeill asked if the City Attorney had okayed this. City Manager indicated he had. Councilman Higgs moved to pass this tax abatement agreement between the City of Sanger and Walmart Stores East, Inc. Councilman Garza seconded. Motion carried unanimously. 10. Consider and Possible Action on Ordinance #10-21-00 -Increasing the Cap on the Sewer Charges from $25.00 to $30.00 on the Residential Rate. Councilman McNeill indicated he and Mr. Yeatts had done a study on the water and sewer, and this will only effect about 7% of the people. Councilman Garza indicated when the cap was taken off of the Commercial, he thought it was discussed that this would not be necessary. Councilman McNeill indicated this did not have to be done, but he had pressed for it in order to try to get a few more funds in. Councilman Garza indicated he did not feel the people should be charged for the water not going back to the sewer plant. Discussion. Councilman McNeill moved to adopt Ordinance #10-21-00 on increasing the sewer charge from $25.00 to a $30.00 cap. Councilman Higgs seconded. Motion carried unanimously. 11. Consider and Possible Action on a Nomination to the Denton Central Appraisal Review Board. Councilman Higgs nominated Ralph Amyx. Councilman McNeill seconded. Motion carried unanimously. 12. Consider and Possible Action on Ordinance #10-22-00 -Amending the Truck Route to Include lst Street from Plum to F.M. 455, and Plum Street from 6"' Street to ls` Street. Discussion regarding the proposed changes to the truck route. Councilman Higgs moved to accept Ordinance #10-22-00. Councilman McNeill seconded. Motion carried unanimously. 13. Consider and Possible Action on the Interlocal Cooperation Agreement for Fire Protection Services with Denton County. Mayor indicated this is standard procedure. Councilman Garza moved to accept the agreement. Councilman McNeill seconded. Motion carried unanimously. 14. Consider and Possible Action to Council member to Attend TML Conference in Austin. City Manager indicated he would like to attend, along with Councilman Ervin. Councilman McNeill moved to allow both the City Manager and Councilman Ervin to go to the TML Conference meeting in Austin. Councilman Higgs seconded. Motion carried unanimously. 15. Consider and Possible Action to Award Bid for Electric Line to Wal-Mart Distribution Center. Councilman McNeill indicated there was a big difference in the bids. City Secretary indicated she had asked the same question, and the low bid apparently would cover it, everything that needs to be done was in the bid packet. Discussion. Mike Prater indicated the bid did not include the exit out of the sub station. Councilman Higgs moved to accept the low bid, which is Texas Electric. Councilman Garza seconded. Motion carried unanimously. 16. Consider an Possible Action on Resolution #10-25-00 on Adoption of the Internal Revenue Code -Section 457 Plan for Employees. City Secretary indicated some of the employees would like something like a 401K plan; however, the City cannot have a 401K, but can have this 457 Plan. It is an investment program for employees to participate in. It will be at no cost to the City. Councilman Higgs moved to accept Resolution #1045-00 on adoption of Internal Revenue Code Section 457 Plan for the employees. Councilman McNeill seconded. Motion carried unanimously. 17. Any Other Such Matters. a) Councilman Higgs questioned why the City could not annex Hoffman's R.V. Park. City Secretary explained that after researching the law, the proposed property to be annexed must be contiguous to the City on two sides or be contiguous to a tract of land in the City limits that is over a thousand feet wide at it's narrowest point. The only other way is for them to do it voluntarily. b) City Manager indicated staff had advertised for an Electric Superintendent and Linemen in several publications, and as soon as its narrowed down he will let the Council know. 18. MAINTENANCE OF CITY PARK AND RECREATION FACILITIES If any city park and recreation facilities are located within the annexed area, they will be maintained within sixty (60) days after the effective date of the annexation on the same basis and at the same level as similar facilities are maintained throughout the city. OTHER SERVICES Other services that may be provided by the city such as planning, code enforcement, animal control, library, park and recreation, court, and general administration will be made available within (60) days after the effective date of the annexation on the same basis and at the same level as provided throughout the city. CAPITAL IMPROVEMENTS Construction of water, sewer, street, and drainage facilities will begin within two (2) years after submissions of written request by landowners and payment of any development fees and construction costs required by the city in accordance with subdivision regulations and water and sewer extension policies. Construction will be completed within four and one half (4 /2) years after request unless the construction process is interrupted by circumstances beyond the control of the city. No impact fees will be charged to any developer or landowner within the annexed area except in conformity with V.T.C.A., Local Government Code, ch. 395. Construction of other capital improvements shall be considered by the city in the future as the needs dictate on the same basis as such capital improvements are considered throughout the city. October 12, 2000 Number 6 resident Clinton has signed into law the Religious Land Use and Institutionalized Persons Act (RLUIPA), an act that cities had aggressively opposed because it represents a significant preemption of local authority. Local officials across the nation have made clear their concerns surrounding RLUIPA and have protested the special protections for religious groups carved out by this law. After the bill was signed into law, National League of Cities (NLC) Executive Director Don Borut said, "We are extremely disappointed that the federal government has again preempted a fundamental home rule power of local governments. We also question the constitutionality of the legislation." TM law is a scaled -down version of the religious liberty bill that ran into opposition last year. According to NLC, gay rights leaders and civil rights activists were concerned that the bill would have allowed landlords and employers to refuse to deal with gays and lesbians by citing religious objections. Two months ago, House and Senate sponsors agreed to narrow the bill so that it would address only land use disputes and religious conflicts involving people under the control of others, such as prisoners and nursing home patients. For cities, of course, the most significant aspect of RLUIPA is its effect on land use regulation. The general rule established by the Act is that: "[n]o government shall impose or implement a land use regulation in a manner that imposes a substantial burden on the religious exercise of a person...unless the government demonstrates that imposition of the burden.. . (A) is in the furtherance of a compelling governmental interest; and (B) is the least restrictive means of furthering that... interest." Unfortunately, RLUIPA substantially erodes the municipal protections that were included in a state law passed in 1999. When the Texas Legislature was deliberating the Texas Religious Freedom Restoration Act (TRFRA) last year, TML was successful in ensuring that the following protections were written into the law before it was passed and signed by the Governor, Note. The governmental protections enumerated in RLUIPA are practically nonexistent and are very limited in scope. plaintiff produces prima facie evidence of a violation of RLUIPA, the burden of persuasion on most elements of the claim shifts to the government, but the plaintiff does retain the burden of persuasion on whether the government practice substantially burdens the plaintiff's exercise of religion. 2. If the Commerce Clause is the only jurisdictional basis for bringing a claim under a provision of RLUIPA, the provision shall not apply if the government demonstrates that all substantial burdens on similar religious exercise throughout the nation would not, in the aggregate, have a substantial effect on commerce. 3. A government may avoid the preemptive force of RLUIPA by changing the policy that results in a substantial burden, by retaining the policy and exempting the substantially burdened religious exercise, or by any other means that eliminate the substantial burden. 4. AKINGS" Municipal efforts to block passage of takings legislation in the 1061h Congress have been extremely effective. The Senate Judiciary Committee recently opted not to move takings legislation out of committee this year. Just before the Senate recessed in late July, Senator Orrin Hatch (R-Utah) placed S.B. 1028, the "Citizens Access to Justice Act" (a substitute for the House -passed version, H.R. 2372, "The Private Property Rights Implementation Act,") on the Senate Judiciary Committee's Calendar for markup. City ally Senator Patrick Leahy (I)-Vt.) used procedural rules to stall markup of the bill, so no action was taken at that time. The measure was expected to be acted on in mid -September but in a surprise move, Senator Hatch pulled the measure from the agenda. Senator Hatch said that he would not bring up the bill again this session, but did express his commitment to acting on the legislation early next year, before Memorial Day. Senator Leahy asked that hearings be held when the bill is reconsidered, and Senator Hatch said he would take this into consideration. With the passage of either the House or Senate version of the proposed takings bill, every zoning dispute would have become a federal case. Either bill would permit landowners and developers to bypass state courts, local planning commissions, and city councils and take their land use grievances directly into federal court. Big developers could use premature, costly federal litigation as a hammer to coerce cities into approving projects that could harm localdhomeowners and the environment. This would constitute a massive preemption of state and local government authority. That committee, which will meet in Austin on November 15 in conjunction with the Annual Conference, will consider all resolutions submitted by the TML legislative policy committees or by the membership at large. This year, members of the Resolutions Committee will face the task of considering a total of 93 resolutions. That number of resolutions is easily an all-time record, smashing the previous record (71 resolutions in 1998) by more than 30 percent. TML member cities may use the material leerein for any purpose.
