The existing drainage system consists of a storm sewer line (18"-24" RCP, "Line 2") extending from the Amyx property north approximately 1,700 ft. and a storm sewer line (18" RCP, "Line 3") extending from the Amyx property north approximately 370 ft. The upstream end of Line 3 also has a 24" RCP line extending west, intersecting Line 2 and discharging to the west (see attached plan sheet). It should be noted that this storm sewer system was not sized to handle the anticipated ultimatestorm discharge. This was due primarily to the fact that drainage easements could not be obtained from adjacent property owners to carry the storm flow from Keaton Rd. directly to thecreek. An approximate 8'x3' box culvert would be required to handle the expected flows. The existing storm sewer system was constructed to enable the paving project to proceed. There are three (3) options to address the drainage concerns of Mr. Amyx: 1) Construct a drainage channel ditch to carry the flow to the creek. The ditch section would have erosion control measures such as rip -rap and/or concrete. The actual channel size will be determined on the slope and area available. The channel section would be approximately 3-4 ft deep and 840 ft wide at the bottom. This open channel option could be constructed for a cost range of $8,000 - $15,000 with an additional $ 25,000 for erosion control, if required. 2) Construct a box culvert with enough capacity for the ultimate 100 year storm flow. The actual culvert size will be determined by the slope and area available. It would be approximately 3 ft high and 8 ft wide. This option could be constructed for a cost range of $1305000 - $160,000. 3) Construct parallel reinforced concrete pipes (RCP) with a capacity for the existing storm flow with provisions for additional flow to pass over the ground. The actual pipe size for this concept will be determined by the slope and area available. It would be approximately 24" diameter. OTHER SERVICES Other services that may be provided by the city such as planning, code enforcement, animal control, library, park and recreation, court, and general administration will be made available within (60) days after the effective date of the annexation on the same basis and at the same level as provided throughout the city. CAPITAL IMPROVEMENTS Construction of water, sewer, street, and drainage facilities will begin within two (2) years after submissions of written request by landowners and payment of any development fees and construction costs required by the city in accordance with subdivision regulations and water and sewer extension policies. Construction will be completed within four and one half (44/2) years after request unless the construction process is interrupted by circumstances beyond the control of the city. No impact fees will be charged to any developer or landowner within the annexed area except in conformity with V.T.C.A., Local Government Code, ch. 395. Construction of other capital improvements shall be considered by the city in the future as the needs dictate on the same basis as such capital improvements are considered throughout the city. UNIFORM LEVEL OF SERVICES MAY NOT BE REOUIltED Nothing in this plan shall require the city to provide a uniform level of full municipal services to each area of the city, included the annexed area, if different characteristics of topography, land use, and population density are considered a sufficient basis for providing different level of service. To serve on the ARB, you must have lived in the appraisal district for at least two years before taking office. You don't need any special qualifications, but you may not serve on the board if you are. In county of more than loU,000, a person is ineiigibie if the person (i) has served aii ur paii of three previous terms, (2) is a former member of the board of directors, officer, or employee of the appraisal district, (3) if the person served as a member of the governing body or officer of a taxing unit for which the appraisal district appraises property, until the 4 h anniversary of the date the person ceased to be a member or officer or (4) has ever appeared before the ARB for compensation. You also may not serve as an ARB member if you are closely related to a person who operates for compensation as a tax agent or is in the business of appraising property for property tax purposes in the appraisal district. Relatives barred are those within the second degree of consanguinity or affinity. If you knowingly violate this provision, you commit a class B misdemeanor. This provision took effect September 1, 1989, and applies only to ARB members serving terms that began after that date. The law also bars from ARB service members who contract with the appraisal district or with a taxing unit in the appraisal district. The bar applies if the member or a business entity in which the member has a substantial interest contracts with the appraisal district or a taxing unit that participates in the appraisal district. The Texas Constitution does not allow a person to hold more than one paid public office. S. B. 1017 requires the Comptroller to approve curricula, provide materials and supervise a course for training ARB members. The Comptroller shall issue certificates indicating course completion. All ARB members must complete the course or may not participate in ARB hearings. ARB Terms and Size Members serve two-year staggered terms, approximately half the member's terms expire each year. Terms begin January 1. The appraisal district directors appoint ARB members by a majority vote and record their decision in a resolution. ARB Compensation The ARB receives a $50.00 minimum for a half day and $12.50 an hour for any hours worked after the $50.00 minimum. The maximum pay is capped at $100.00 per day. Services to be rendered hereunder by CITY are fire protection services normally rendered within the CITY Fire Department as hereinafter defined, to citizens of COUNTY, to wit: A. Availability and provision of emergency fire prevention, extinguishment, safety and rescue services within the agreed or specified territory or jurisdiction of the CITY Fire Department; said services to be rendered as described herein by said Department in all unincorporated areas within the above referenced operating territory or jurisdiction of such Department, the referenced services as set out herein are rendered by said Department in consideration of the basic funding referenced elsewhere herein and the per -call fee set out elsewhere herein, for the common good and benefit and to serve the public convenience and necessity of the citizens of Denton County who are not otherwise protected with respect to fire prevention, extinguishment, safety, and rescue services. B. The CITY Fire Department shall respond to requests for fire protection services made within COUNTY as set out in Exhibit "A" attached hereto and incorporated by reference. C. The COUNTY agrees that in the event a fire in the CITY's unincorporated designated area which the CITY considers to be of incendiary nature and upon request by the CITY, the County Fire Marshal will dispatch investigation personnel to the fire scene within a response time sufficient to legally maintain and protect all evidence of said fire and will conduct all appropriate investigation and prosecution of arsonists. D. It is further agreed that the CITY shall not be responsible for investigations of suspected incendiary fires in rural area, but shall cooperate with the County Fire Marshal in immediately relating all pertinent information possible to the investigator(s). E. It is further agreed that the County Fire Marshal may assist in the conduct of appropriate investigations of a fire which the CITY considers to be of incendiary nature in the CITY's unincorporated designated area upon request by the CITY. F. It is further agreed that the CITY shall submit monthly statements on the Texas Fire Incident Reporting Systems standardized forms to the Denton County Fire Marshal, 110 West INTERLOCAL FIRE AGREEMENT 00-01 Z DENTON COUN'PY - BANGER Hickory, Denton, Texas 76201. This form will serve as the billing statement to the COUNTY for reimbursement of calls made in the unincorporated designated area. G. It is further agreed that Denton County Fire Marshal shall provide the forms upon request from the CITY. H. It is recognized that the officers and employees of CITY's Fire Department have duties and responsibilities which include the rendition of fire protection services, and it shall be the responsibility and within the sole discretion of the officers and employees of said Fire Department to determine priorities in the dispatching and use of such equipment and personnel, and the judgment of any such officer or employee as to any such matter shall be the final determination. 11 The COUNTY shall designate the County Judge to act on behalf of COUNTY and to serve as "Liaison Officer" between COUNTY and CITY. The County Judge or his designated substitute shall insure the performance of all duties and obligations of COUNTY herein stated, devote sufficient time and attention to the execution of said duties on behalf of COUNTY in full compliance with the terms and conditions of this agreement and provide supervision of COUNTY's employees, agents, contractors, sub -contractors and/or laborers, if any, in the furtherance of the purposes, terms and conditions of this agreement for the mutual benefit of COUNTY and CITY. IV. CITY shall ensure the performance of all duties and obligations of CITY as hereinafter stated, devote sufficient time and attention to the execution of said duties on behalf of CITY in full compliance with the terms and conditions of this agreement and shall provide immediate and direct supervision of the CITY employees, agents, contractors, sub -contractors and/or laborers, if any, in the furtherance of the purposes, terms and conditions of this agreement for the mutual benefit of CITY and COUNTY. V. INTERLOCAL FIRE AGREEMENT 00-01 $ For the services hereinabove stated, COUNTY agrees to pay to CITY for the full performance of this agreement the sum of TEN THOUSAND DOLLARS G$10,000.00) upon execution of this agreement and the sum of TWO HUNDRED TEN DOLLARS G$210.00) per fire call in the designated unincorporated areas of Denton County, Texas. No payment will be made for service provided outside the service district whether by mutual aid agreement or otherwise. CITY understands and agrees that payment by COUNTY to the CITY shall be made in accordance with the normal and customary processes and business procedures of COUNTY, and in conformance with applicable state law. COUNTY agrees to provide to CITY an STX 800 Mhz radio for the use of CITY in carrying out the terms of this contract. This radio will remain the property of the COUNTY and will be returned on termination of this agreement. COUNTY will bear the risk of loss or destruction and make necessary repairs so long as CITY uses the property in a reasonable manner for the purposes of this contact. COUNTY reserves the right to reclaim the property at any time for any reason. It is agreed by COUNTY and CITY that the radio was provided for in previous contracts between COUNTY and CITY additional radio. VI. No agreement has been made for an COUNTY agrees to and accepts full responsibility for the acts, negligence, and/or omissions of all COUNTY's officers, employees, and agents while with in its COUNTY limits. VII. COUNTY and CITY understand and agree that liability under this contract is governed by V.T.C.A. Government Code Chapter 791 and V.T.C.A. Local Government Code Section 352.001 and 352.004. This agreement is made in contemplation of the applicability of these laws to the agreement. Insofar as legally possible COUNTY and CITY agree to be bound by the above mentioned statutes as they exist as of the date of this agreement. This agreement may be terminated I by either party giving sixty (60) days advance written notice to the other party. In the event of such termination by either party, CI T Y shall be compensated pro rata for all services performed to termination date, together with reimbursable expenses then due and as authorized by this agreement. In the event of such termination, should CITY be overcompensated on a pro rata basis for all services performed to termination date, and/or be overcompensated reimbursable expenses as authorized by this Agreement, then COUNTY shall be reimbursed pro rata for all such overcompensation. Acceptance of such reimbursement shall not constitute a waiver of any claim that may otherwise arise out of this agreement. The fact that COUNTY and CITY accept certain responsibilities relating to the rendition of fire protection services under this agreement as a part of their responsibility for providing protection for the public health makes it imperative that the performance of these vital services be recognized as a governmental function and that the doctrine of governmental immunity shall be and it is hereby invoked to the extent possible under the law. Neither CITY nor COUNTY waives nor shall be deemed hereby to waive, any immunity or defense that would otherwise be available to it against claims arising from the exercise of government powers and functions. MONTHLY REPORT SANGER PUBLIC LIBRARY SEPTEMBER 2000 ACTIVITIES Submitted by Victoria Elieson HIGHLIGHTS: Lynne Smiland began working as a library clerk on September 14. She has quickly grasped library procedures for routine tasks. Training is continuing. Elizabeth Caldwell quit so that she could spend more time with her husband. She will be missed. ADMINISTRATION: Updated the Interlibrary Loan procedures. Meetings attended: Denton County Library Advisory Board, 9/21, Carrollton North Texas Regional Library System Meeting, 9/28, Fort Worth, accompanied by Norma Matney, the System Representative for our library. COLLECTION: Finished the annual inventory. Took afresh collection of books to the Senior Center and brought back the previous batch. SPECIAL PROJECTS: The Friends of the Librarybooksale at the Sanger Sellabration netted $528.10. This was the most money realized from a Friends booksale. PROGRAMS: The Storytime theme this month was "In Your Own Backyard". Matt Jonas brought his iguana, skank, and monitor to show during the program on "Reptiles". Megan Raley brought her tarantulas to the program on "Bugs". At that program, the children made starched yarn cocoons with tissue paper butterflies inside. Other crafts included sponge painted trees for the "Plants" program and a clay nest and eggs for the "Birds" program. The day care center for which the library has, in the past, provided Storytime is not sending any children over so far this year. However, on the first week, Matt Jonas 5s reptiles did visit the Center. Planned Storytime themes from January through May 2001. Ordered Storytime kits and films for those programs. Jonas brought the iguana to storytime at Sanger Public Library Wednesday, Sept. 6. Four -year -old Margaret Hilliard shows great interest in Jason during Wednesdays special storytime presentation, and with urging from her mother, Dee, she reaches out to pet the large reptile.
