MARCH 6, 2000

1. Mayor Called Meeting to Order, Councilman Garza led the Invocation, followed by
the Pledge of Allegiance.

Councilman McNeill moved to approve the Consent Agenda as presented.
Joe Higgs seconded.
Motion Carried unanimously.
3. Citizen's Input.
None.
4. Consider and Possible Action Regarding Ordinance #03-OS-00 -Amending Water and
Sewer Connect Fees for Apartments and Motels.
Mayor indicated the City Manager had spoke with him and advised that there had been
several individuals come in to City Hall and inquired about these fees, but decided not
to build apartments once they heard the cost.
Prentice Preston, 809 N. 5', expressed his concerns in regards to the existing ordinance
regarding water and sewer connect fees. Mr. Preston indicated if the developer has to
pay the current connect fees, it will cost more than the land. He thought Council should
consider having the growth pay for it in a Revenue Bond, and reconsider if this
Ordinance is the best way to pay for a treatment plant.
Councilman McNeill indicated he had asked for this to be on the Agenda. He indicated
when the Ordinance was passed, he felt the cost should be less, but not too low. He
indicated that when changing the Ordinance they should also be thinking about motels
and nursing homes, and how they should be charged.
Council agreed not to decide on this item, only to discuss it.
Discussed difference in Apartments "Ald Duplexes.
Discussion regarding fees.
Council instructed staff to research fees for other cities regarding nursing homes and
motels, and place on the next agenda.
Schedule workshop for 6:00 P.M. on March 20, 2000, before Council meeting.
5. Consider and Possible Action on Resolution #03-03-00 -Authorizing Mayor to Sign
Note with GNB for Purchase of Vehicle for Water/Wastewater Department,
Councilman Higgs moved to authorize the Mayor to sign the note at GNB.
Seconded by Councilman Garza.
Motion Carried unanimously.
6. Consider and Possible Action on Appointment of Election Judge and Alternate Judge
for May 6, 2000 Election and Presiding Judges for the Early voting Ballot Board.
Councilman Higgs moved to appoint Sarah Wilkerson as Election Judge and Marjorie
Braxton as Alternate Judge for May 6 Election, and the Early Voting Ballot Board,
Councilman McNeill seconded.
Motion Carried Unanimously.
7. Any Other Such Matters.
Eddie Branham indicated the new water line on Elm Street was in operation.

Re: Water and Sewer Connect Fees
In researching these fees with other cities, I was unable to obtain any information relating strictly
to Nursing Homes. A copy of the proposed Ordinance is attached for your review and any necessary
changes.
CITY OF SANGER, TEXAS
ORDINANCE NO. # 03-05-00
AN ORDINANCE AMENDING CHAPTER 10 (UTII,ITIES) OF THE CODE OF
ORDINANCES OF THE CITY OF SANGER, DENTON COUNTY,TEXAS,
MORE SPECIFICALLY SECTION 2 ENTITLED WATER AND SEWER
SERVICE CONNECTIONS ESTABLISHING NEW FEES; PROVIDING FOR
THE REPEAL OF ORDINANCES IN CONFLICT; PROVIDING A
SEVERABILITY CLAUSE, PROVIDING A PENALTY CLAUSE, AND
PROVIDING FOR AN EFFECTIVE DATE,
BE IT ORDAINED AND ORDERED by the City Council of the City of Sanger,
Texas that.
Section 2, subsections A &Bare hereby amended to read as follows:
SECTION II A. RESIDEN2ZAL WATER AND SEWER SERVICE CONfNECTIONS
A. WATER SERVICE CONNECTIONS
The City of Sanger sha11 install, or cause to be installed, and maintain all water service
connections in the streets, alleys, and easements. All interruptions of water service
to any and all customers shall be made under the direct supervision of the city water
department before such interruption is made. Any person, firm, or corporation found
interrupting water service without city supervision shall be in violation of this section
and shall be subject to fines and penalties as prescribed in Chapter 1, Section 5 of the
Sanger City Code.
The City shall charge for the installation and maintenance of all such connections a
sUM sufficient to cover the average cost thereof. Such sum is to be determined and
collected by the utility department and shall be at the following rates:
Tap charges for sizes up to 1"----------------------------•�------------------- $1500.00
Additional meter for Sprinkler system ---------------------------------------- $ 350.00
Charge for meter, box, and connections----------------------------------- Actual Cost
Charge for Water Connect Fees (User Fee}----------------------------------- $ 20.00
Charge for service interruption supervision------------------------------------ $ 35.00
All water services for construction purposes shall be metered and subject to the same
regulations and billings as permanent water accounts.

All meters and meter boxes shall be supplied by the City. In the event that a meter and meter
box is installed by the developer, the meter and box charge will be reduced ten dollars
($10.00).
B. SANTTARY SEWER SERVICE CONNECTIONS
The City of Sanger shall install all sanitary sewer service connections in the streets, alleys,
and easements both inside and outside the City limits. Said service connections shall be
installed from the main to the property line when the sewer main is located in an alley or a
street right -of --way, if the sewer main is in an easement, the service connection shall be
installed from the sewer main to the easement boundary line. The City of Sanger shall
charge twelve hundred fifty dollars ($1500.00) for each connection.

Service lines that require the cutting or boring of paved streets or alleys will be subject to
an additional charge based on the actual cost for such bores or cuts necessary for
installation.
The property owner shall install a service line, with clean -out fitting, at his or her expense
to the City's lateral, in accordance with City regulations and subject to the inspection of the
City, and shall hereafter be responsible for normal maintenance of said service lime from the
structure to the property line.
All water funds collected in excess of established costs shall be deposited in a separate account for
new storage facilities, new pump stations, purchase of easements or main trunk limes and disbursed
only after specific approval by the City Council.
All sewer funds collected in excess of established costs shall be deposited in a separate account for
new sewer plant, additions to sewer plant, purchase of easements or main trunk limes to plant and
disbursed only after specific approval by the City Council,
SECTION IV
All Ordinances or parts of Ordinances in conflict herewith are, to the extent of such conflict, hereby
repealed.
SECTION V
It is hereby declared to be the intention of the City Council that the sections, paragraphs,
sentences, clauses, and phrases of this Ordinance are severable and, if any phrase, clause,
sentence, paragraph, or section of this ordnance shall be declared unconstitutional by the
valid judgment decree of any court of competent jurisdiction, such unconstitutionality shall
not affect any of the remaining phrases, clauses, sentences, paragraphs, and sections of this
Ordnance, since the same would have been enacted by the City Council without the
incorporation in this Ordinance of any such unconstitutional phrase, clause, sentence,
paragraph, or section.
SECTION VI
Whenever in this Ordnance an act is prohibited or is made or declared to be unlawful or an
offense or a misdemeanor, or whenever in such Ordinance, the doing of an act is required
or the failure to do any act is declared to be unlawful, the violation of any such provision
shall be punished by a fine ofnot exceeding One Thousand Dollars ($1,000.00); provided,
however, that no penalty shall be greater or less than the penalty provided for the same or
similar offense under the laws of the State. Each day constitutes a separate offense.
This Ordinance will take affect immediately after the publication of the caption as the law
in such cases provides.

D. Since the Library is frequented by young children, there will be a policy to help prevent
registered child molesters from having access to the Library.
Procedures shall be as follows:
Every thirty days the Librarian will check the state's web site for registered sex offenders.
The web site is located at.

www.texaas.com (scroll to state seal) click on seal, go to public safety department
records of conviction -sex offenders free (enter) city and zip (scroll) to individuals.
The Cities of Sanger, Slidell, Krum and Valley View shall be checked regularly. Denton and
Pilot Point will be checked every six (6) months.
The list of offenders will be compared with the alphabetical list of Library Patrons. If there
is a "HIT" then the Librarian and/or her assistant will make a vigilant inquiry into when and
how this person uses the facilities. If there is a pattern of being on premises coincident with
heavy child traffic after school, or if there is another pattern of activity to make the actions
suspect, then the Librarian should do the following:
Seek advice of the Denton County District Attorneys office or the Department of
Public Safety.
Find out the Probation Officer and report to him.
Adopt an upscale observation of the suspect until the authorities can act to prevent
the attendance of this person.
Notify the Library Board President.
Activities that should make you suspicious include:
A person talking to an unrelated child for a lengthy period.
A person seeking the confidence of workers or children for no apparent reason.
Being there only when children are present.
The types of materials checked out by the person, or Internet usage.
Loitering in the foyer or outside when children are present.

SPECIFICATION AND QUESTIONNAIRE FOR:

AND 14 FOOT BACKHOE
The following specifications describe the minimum requirements for a tractor, loader backhoe. The
equipment bid shall be new, manufactured the same year or succeeding year of bid, of current design and
production model and available to the commercial market. Any additions, deletions or variations from the
following specifications must be noted or the bid will be rejected. Standard items appearing in the
manufacturers published specifications furnished by the bidder shall be included in the bid unless
otherwise noted. One copy of the manufacturers published specification shall be included with the bid.
The following information will help design a governmental or public utility bid requirement fora 1.0 cubic
,yard loader backhoe.
1GEN_ERAi.:
The loader backhoe shall be regular production model for which published specifications are available.
Machine modifications to meet the operational requirements of this specification shall be limited to the
manufacturers published standard and optional equipment.
All operating specifications are based on current SAE standards and shall be the basis for determining
compliance with specified requirements.
The loader backhoe shall be a 90 net horsepower, turbo -charged diesel tractor with front loader and 1.0
cubic yard capacity heaped bucket and backhoe with 14 foot dig depth.
The loader backhoe shall have a minimum operating weight of 13,500 pounds.
The loader backhoe shall meet all OSHA and EPA requirements in effect on the date of bid opening and
shall be furnished with lead free paint.

The loader backhoe shall have a 4-cylinder turbo -charged diesel engine with a minimum 90 net

Dear Fellow Texan:
I am writing to inquire about your taxing entity's decision to participate in the August 2000 sales tax
holiday. As you are aware, Senate Bill 441—the measure that authorized the tax holiday —allows local
entities to decide whether they want to continue participation in providing this tax break to Texas families
in the year 2000 and beyond.
Cutting taxes is one of the ten principles that I have laid out for Texas in the 21S` Century. I was pleased
that Texas taxpayers saved over $32 million during our state's first sales tax holiday in August 1999.
Texans saved over $25 million in state sales taxes and $7 million in local sales taxes while purchasing
more than $400 million in tax-exempt clothing and footwear during this much -deserved tax holiday. Even
with these savings, I was still able to return $3.5 billion to local taxing entities in 1999 (a 7.1 percent
increase from 1998), which set a new one-year record for sales tax revenue.
These numbers confirm the message that I delivered throughout 1999, and that I will deliver throughout
this year —the Texas economy is robust, consumer confidence is high, and economic growth is promoting
paychecks and jobs for Texans. Furthermore, cutting taxes truly generates a period of economic growth,
even when that tax cut is in effect for only a short amount of time.
This year, however, cities, counties and other local taxing entities have the opportunity to opt out of the tax
holiday and not offer the exemption to Texas taxpayers. While the state sales tax exemption will continue
during the first weekend in August, all other taxing entities must inform my office by certified or registered
mail no later than March 31, 2000, if their decision is not to participate in this year's sales tax holiday.
If your decision is to repeal the local tax exemption, you must provide my office with a copy of the order or
ordinance that your governing body adopts to effect the repeal. A majority of the governing body must vote
to approve the repeal, and must hold a public hearing before taking such a vote. This process is provided
in greater detail at Section. 326.003 of the Texas Tax Code.
I hope that you will join the state in providing much needed tax relief to Texas families. If you have any

FEBRUARY 2000 ACTIVITIES

HIGHLIGHTS:
The Library received an unexpected grant from the Tocker Foundation. It was for $200
worth of books from the University of Texas Press. The Foundation gave the grant to 20 small
libraries statewide, evidently chosen at random. We got books on history, gardening, cooking,
bugs, the law and edible wild plants.
ADMINISTRATION:
Downloaded the Annual Report Form from the Internet. It took 2 '/2 hours, plus one
hour to install. This is the first year that the Texas State Library has provided an electronic
version of the annual report. So far it has proven much more troublesome than the old print
version, but may be better once the process is refined.
Aided the Friends of the Library in filling out an IRS form that would give them
permanent non-profit status; their advance ruling period ended in December so the form must be
filed by March 30.
The Internet was having trouble for more than two weeks. Hackers were disrupting
popular sites on the system and our service provider was under attack. Things were mostly back
to normal by the last Thursday of the month.

PROGRAMS:
Renee SWiatekI the teenage volunteer who conducted after -school programs for
middleschoolers has become too busy to continue. This program will be suspended until another
volunteer can be found.
T he Storytime theme for February was "Food". At the program "Everybody Eats"
children made pinecone bird feeders. At the "Where Does Food Come From" program, kids
took home a container of watercress seeds to grow. They made trail mix out of dry cereal,
raisins, chocolate chips and peanuts for the "Cooking Food" program. They made faces out of
sliced vegetables for the program "Eating Food".

Jenny Brown and her
husband Todd are going
through a bad time. rive
miscarriages and Jenny's refusal
to consider adoption have put a
strain on their marriage. Then
when Jenny is fired from her job,
her husband doesn't even seem
to care. It seems that none of
Jenny's three simple wishes will
come true. Her wishes are: to
have a happy marriage, to have a
job she loves and to find her birth
mother.
She wrote these wishes
down while taking Making
Magic and Miracles, an adult
education course at the Institute
of Affirmation. She never really
intended to get involved in these
quirky courses; she had just
come to the institute to get a
drink of water. But the institute's
motto, "The answer is yes, now
what's the question," seems to
offer hope, and Jenny searches
for a course that could perhaps
save her marriage. The only ones
that sound promising, though,
are in the automotive section
(Resurrect Your Wreck) and in
the home -improvement section
(Dump to Dreamhouse in Just
Days) .
She does happen upon a
class entitled Happiness Love
Ideas Money, but their
technique of visualizing success
doesn't seem to work for her.
Someone in the class find $20 on
the sidewalk. All Jenny gets is
dog poo on her shoe.

rirst Time. When the instructor
is absent, the institute's director,
Michael, railroads Jenny into
directing. Jenny finds an
unexpected talent. A review of
her first real play raves, "Seeing

unlikely place." However her
husband Todd is unimpressed;
he thinks she is wasting her time
rather than searching for
another job.

Michael is always around. When
Jenny has a flat on the freeway,
Michael is just 10 cars behind
her. When she falls off a ladder at
rehearsal, Michael gets her to
the hospital. Could it be that she
wilI find love with someone else?
Maybe the answer is not always
yes.

crafted an optimistic book with a
wise and foolish heroine who
would make a good friend. With
a keen eye and wry wit, she
shows that sometimes wishes do
come true. According to the

for you.
