Minutes: City Council —Workshop August 16, 1999 Present: Mayor Tommy Kincaid, Councilman Jerry Jenkins, Councilman Glenn Ervin, Councilman Carroll McNeill, Councilman Andy Garza, Councilman Joe Higgs Others Present: City Administrator Jack Smith, City Secretary Rose Chavez, Administrative Assistant Samantha Renz 1. Mayor Called Meeting to Order. 2. Discuss Proposed Budget. City Administrator indicated he did add one police off icer to start immediately. They also added another car, fully equipped. Discussed Revenues in the General Fund, and changes in the proposed budget. There were increases in the Hotel/Motel Tax, Sales Tax, and Property Taxes. City Administrator indicated they are requesting a two cent increase on the Property Tax Rate. Councilman Jenkins asked about the Mixed Drink Tax, and how he came up with the amount. City Administrator indicated he did not have a number to start with, so he came up with a figure that he thought would for sure be collected. There will be a recommendation from staff to increase building permit fees, community center fees, and fees for Plats, and Zoning Requests. Discussion regarding Franchise Fees. City Administrator continued to explain the revenue increases in the General Fund. Discussed Revenues in the Enterprise Fund. Electric Income and Electric Purchases stayed the same. Water and Sewer Tap Fees will increase when the new Ordinance is passed to increase the fees. Discussion regarding Water and Sewer Tap Fees and what will be done with the revenues. Discussion regarding expected Growth. City Secretary explained the Interest Income, and how it is earned from CD's and Savings. Miscellaneous Income, and Transfers were discussed. City Administrator continued to explain the revenue increases in the Enterprise Fund. City Secretary explained the Debt Service. Recessed at 6:45 P.M. Reconvened at 9:15 P.M. Discussion regarding salaries. Librarian's salary and qualifications were discussed. Mechanic's salary was discussed. Discussed salary increase for Street Supervisor. Discussion regarding salary increases and how they were decided. City Administrator indicated they were trying to get salaries up where they were at a competitive level. Discussion continued regarding salaries. Council agreed to go with staff s recommendations on all salaries. Discussion regarding Fees, City Administrator indicated all fees will be done by Ordinance. Discussed raising Tax Rate. City Secretary explained Rollback. Council agreed to have workshop on September 7, before Council meeting at 6:00 p.m. to discuss increases on various fees. 3. Approve Minutes: August 2, 1999 August 3, 1999 - Workshop August 10, 1999 - Workshop Disbursements Councilman Garza indicated Councilman Higgs was absent from the August 10�' meeting, and Bob Hagemann was present. Councilman Jenkins moved to approve the Consent Agenda as presented. Councilman Ervin seconded. Motion Carried unanimously. 3. Citizen's Input. None. 4. Consider and Possible Action Regarding a Preliminary Plat for Southwest Estates, being a 9.20 Acre Tract in the Henry Tierwester Survey, Abstract 1241. Councilman McNeill abstained from discussion on this Item, because the developer is his son. City Administrator addressed the letter from the City Engineer. He indicated all comments had been addressed, and new copies show a drainage easement. Jeff McNeill, 805 Keaton Rd., indicated he would be glad to answer any question the Council had. City Administrator indicated the Planning and Zoning Commission did recommend approval. Discussion while Council members looked over Plat. Discussion Regarding trees on the property. Councilman Higgs moved to accept the Plat. Councilman Jenkins seconded. Motion Carried unanimously. Councilman McNeill abstained. 5. Consider and Possible Action Regarding a Preliminary and Final Plat for Fleetwood Homes Centers of Texas, being a 4.00 Acre Commercial Tract, a Part of the Rueben Bebee Survey, Abstract 29. Property is located on the North Bound Side of I - 35, North of Spur 138. City Administrator indicated the Planning and Zoning Commission did recommend approval, andthatall items ontheEngineer's recommendation leuerhadbeen addressed. He indicated there was a Replat for the Sanger Industrial Park that would come before Council at the next meeting. Councilman Jenkins asked why the Preliminary Replat on Sanger Industrial Park did not come to Council before this Plat. Staff indicated the Fleetwood Plat was brought in to the office, and the Sanger Industrial Plat was sent directly to the City Engineer. Discussion regarding the Preliminary Replat. Councilman Jenkins indicated Council could not act on this Plat until the Preliminary Replat was approved. Council agreed to table this item, and reschedule it for September 7, 1999. Tom Daniel, Fleetwood Retail, asked if there was any way they could conditionally approve the Plat, pending the September 7" meeting. Councilman Jenkins indicated it was not a complete Plat, that meets the standard of the ordinances. Discussion. Mr. Daniel asked if there was anything the Council was concerned about, that he could address prior to the September 7`" meeting. Nothing was indicated by City Council. Discussion regarding the phases on the Preliminary Replat. Item tabled until September 7, 1999. 6. Consider and Possible Action on Awarding Fuel Bids. There were no bids received. City Secretary indicated she would re advertise if Council would allow, and will contact the stations individually to see if they want to bid. Councilman Jenkins moved to authorize staffto resubmit fuel bids for the 1999 — 2000 budget year. Councilman Higgs seconded. Motion Carried unanimously. 7. Consider and Possible Action Regarding Ordinance 08-13-99 —Increasing Water and Sewer Tap Fees. Discussion concerning information from Pilot Point. Discussion concerning how they should charge, per unit, per lot, per house, or actual connections. Councilman McNeill asked Eddie Branham about the difference in hooking up at a new subdivision, and the existing lots in town. Mr. Branham indicated the cost was about the same. Councilman Jenkins indicated they could charge the existing lots the same as they are charging now, and increase the fees for new lots. Councilman Garza indicated all of the lots will impact the system the same, and he felt they should all be charged the same. Discussion regarding tap fees and what the cost would be. Lisa Hardy, Sanger Courier, asked Council if they were going to establish separate residential and commercial fees. Mayor indicated they possibly would. Jeff McNeill asked who would pay the fees, the developer or the builder. Councilman Jenkins indicated it would be one or the other, but was still to be decided. Discussion Regarding the Ordinance, and what the cost should be. Mayor indicated he thought $1,800.00 was fair, but to cover the cost for improvements and a new system they will need to charge $2,000.00. Discussion regarding new and existing subdivisions. Council agreed new rate would go into effect October 1,1999, and if the building permit was purchased prior to October 1, they would be charged the current rate for water and sewer taps. If the building permit is purchased after October 1, they will be charged the new rate. Council agreed to change the Ordinance on page 3, second paragraph to read "This Ordinance will take effect October 1,1999, and immediately after the publication," and in the second paragraph on page 2, section b), remove "such costs will be determined by the city," and in the fourth paragraph to mark out "building" and change "house" to "each residential unit." Councilman Ervin moved to approve Ordinance 8-13-99 with changes as discussed and a price of $2,000.00 per tap. Councilman Garza seconded. Motion Carried 4 to 1. Councilman McNeill voted No. 8. Discussion Regarding Meeting With Texas Water Development Board. City Administrator indicated they had a meeting with Dan Almon and Mark Hill. He indicated they discussed a four million dollar sewer plant and the best way to handle it. He thought the best way was to schedule a meeting with the Texas Water Development Board in Austin to see what it would take to get that type of money. He wanted to get Council's permission to go to Austin to meet with the Board. Councilman Jenkins indicated the City Administrator, City Secretary, Dan Almon, and Mark Hill should go to the meeting in Austin. Council agreed they should go to Austin. 9. Consider and Possible Action on Metering Electric Use for Sanger Sellabration. Councilman Higgs asked how it is metered currently. Electric Superintendent indicated it is not metered. Mayor asked for an estimated cost. Electric Superintendent indicated approximately $500.00. Discussion. Councilman McNeill moved to donate the electricity to the Chamber for the Sanger Sellabration. Councilman Jenkins seconded. Motion Carried unanimously. 10. Any Other Such Matters. a) There will be a Sanger Historical Society Meeting on Monday, August 23, at 7:00 P.M. b) Councilman Jenkins indicated he would like to see the Metal Building Ordinance put back on the agenda for reconsideration. c) Councilman Higgs asked how far the City limits go out on McReynold Rd. Your per capita charge is based on the estimated population as of January 1, 1999 provided by the North Central Texas Council of Governments (see attached). As a reminder, the fee charged only funds a portion of the cost to the City of Denton to provide emergency ambulance services to your city. Please submit the contract to your Council for approval and signatures and return to us by September 1, 1999. Box 578 Sanger, Texas 76266 Dear Mayor Armstrong: In July of 1998, as part of our annual budget process, the City of Denton reviewed its annual agreement for the provision of emergency medical services with your City. Based on our current costs to provide those services to you, the City of Denton City Council voted on July 21, 1998, to increase your per capita charge from the current $5.75 to $6.50 starting on October 1, 1998. The population will be based on your estimated January 1, 1998, Council of Government figure. (42. The City of Denton's estimated cost to provide emergency ambulance services is $13.45 per capita (based on 25,050 total population) for the small cities in Denton County. This was established by a July, 1998 City of Denton Emergency Medical Services (EMS) Cost Analysis. Obviously, the cost to you to receive those services is substantially less than the cost to provide them. Therefore, the Denton City Council also voted to increase your per capita fees over the next three years as follows: Year 1 (FY19984999) $6.50 Year 2 (FY1999-2000) W00 Year 3 (FY20W2001) $10000 I have attached the back up materials that the Denton City Council used to make their decision, including the EMS Cost Analysis. The amity of Sanger would like to contract with the City of Denton to receive emergency medical services for its citizens. Pursuant to Chapter 774 of the Tex. Health and Safety Code (Vernon 1992) and the Interlocal Cooperation Act, Tex. Gov't Code Ann. §791.001, et seq., (Vernon 1994), a city may contract to provide emergency medical services to the county or another city. Wl-IEREAS, both the City of Denton and the City of Sanger have the authority to perform the services set forth in this Agreement individually and in accordance with Tex. Gov't Code Ann. §791.011(c)(2); and WHEREAS, the City of Sanger will make all payments for services out of available current revenues and the City of Denton agrees that the payments made by the City of Sanger hereunder will fairly compensate it for the services performed; NOW, THEREFORE, WITNESSETH This Agreement is made on the _day of , 1999, between the City of Denton, Texas ("Denton"), and the City of Sanger ("Sanger"). The parties agree as follows: 1. Definitions. Emergency Medical Services or E.M.S. means personnel and ground transportation vehicles used to respond to an individual' perceived need for immediate medical care and to prevent death or aggravation of physiological or psychological illness or injury. 2. Denton to Provide EMS to Sanger. Denton shall provide emergency medical services to Sanger in response to requests for emergency medical services in accordance with this Agreement. All requests for emergency medical services for persons residing in the corporate limits of Sanger shall be communicated to Denton in the manner specified by Denton. 3. Discretion in Providing E.M.S. Sanger understands that Denton must also respond to requests for emergency medical services for persons in Denton and that Denton has other contracts to provide emergency medical services to other entities. Denton shall have the sole right and discretion, without being in breach of this Agreement and without liability to Sanger, to determine: (a) Whether or not to respond to a request for medical emergency service; PAGE 1 (b) Whether and when personnel or equipment are available to respond to a request for emergency medical service; (c) The order is which to respond to a request for emergency medical service; and (d) The time in which to respond to a request for emergency medical service. 4. Service Fee. In consideration for providing emergency medical services to Sanger, Sanger agrees to pay to Denton the sum of $41,600 for fiscal year 1999-2000 based on a population of 5,200 multiplied by $8.00. The population figure used is contained in the latest edition of the North Central Texas Council of Governments estimate for January 1, 1999. The annual payment shall be paid to Denton in equal quarterly payments on or before October 1, January 1, April 1, and July 1, of each annual term. Denton may, after giving prior notice, suspend service to Sanger during any period of time Sanger is delinquent in the payment of any undisputed service fee. 5. Patient Charges. In addition to the service fee paid by Sanger, Denton may charge and collect from persons provided emergency medical services, the patient fees established by or& nance of Denton. 6. Governmental Immunity Not Waived. Neither Denton nor Sanger waives, nor shall be deemed hereby to waive, any immunity or defense that would otherwise be available to it against claims made or arising from any act or omission resulting from this Agreement. 7. Term. The term of this Agreement shall be in one-year increments, beginning on October 1, 1999 and continuing to September 30 of the following year and thereafter from year to year until terminated in accordance with this Agreement. 8. Termination; Default. Either party may terminate this Agreement at any time without cause by giving 90 days advance notice in writing to the other, specifying the date of termination. If either party breaches a provision of this Agreement, the other party shall give the defaulting party written notice of the default. Should the defaulting party fail to correct the default within thirty days of the date notice of default is sent, the other party may declare the Agreement terminated. Sanger shall be liable to Denton pro rata for the payment of emergency medical services provided up to the date of termination. 9. Notices. All notices sent under this Agreement shall be mailed, postage prepaid, to the respective addresses, as follows: To Denton: City Manager City of Denton 215 E. Venue of any suit or cause of action under this Agreement shall lie exclusively in Denton County, Texas. This Agreement shall be construed in accordance with the laws of the State of Texas. WATER AND SEWER SERVICE CONNECTIONS 1. WATER SERVICE CONNECTIONS The City of Sanger shall install, or cause to be installed, and maintain all water service connections in the streets, alleys, and easements. All interruptions of water service to any and all customers shall be made under the direct supervision of the city water department before such interruption is made. Any person, firm, or corporation found interrupting water service without city supervision shall be in violation of this section and shall be subject to fines and penalties as prescribed in Chapter 1, Section 5 of the Sanger City Code. The City shall charge for the installation and maintenance of all such connections a sum sufficient to cover the average cost thereof. Such sum is to be determined and collected by the utility department and shall be at the following rates: Tap charges for all sizes up to 211 ------------------------------------------- $2000.00 Charge for meter, box, and connections----------------------------------- Actual Cost Charge for Water Connect Fees (User Fee)---------------------------------- $ 10.00 Charge for service interruption supervision------------------------------------ $ 25.00 All water services for construction purposes shall be metered and subject to the same regulations and billings as permanent water accounts. All meters and meter boxes shall be supplied by the City. In the event that a meter and meter box is installed by the developer, the meter and box charge will be reduced ten dollars ($10.00). B. SANITARY SEWER SERVICE CONNECTIONS The City of Sanger shall install all sanitary sewer service connections in the streets, alleys, and easements both inside and outside the City limits. Said service connections shall be installed from the main to the property line when the sewer main is located in an alley or a street right -of --way, if the sewer main is in an easement, the service connection shall be installed from the sewer main to the easement boundary line. The City of Sanger shall charge two thousand dollars ($2000.00) for each sewer lateral connect. Service lines that require the cutting or boring of paved streets or alleys will be subject to an additional charge based on the actual cost for such bores or cuts necessary for installation. Such costs will be determined by the City. The property owner shall install a service line, with clean -out fitting, at his or her expense to the City's lateral, in accordance with City regulations and subject to the inspection of the City, and shall hereafter be responsible for normal maintenance of said service line from the house to property line. Each house or building within the City of Sanger shall be served by a separate and independent water and sanitary sewer line. SECTION II All Ordinances or parts of Ordinances in conflict herewith are, to the extent of such conflict, hereby repealed. SECTION III It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses, and phrases of this Ordinance are severable and, if any phrase, clause, sentence, paragraph, or section of this ordinance shall be declared unconstitutional by the valid judgment decree of any court of competent jurisdiction, suchunconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs, and sections of this Ordinance, since the same would have been enacted by the City Council without the incorporation in this Ordinance of any such unconstitutional phrase, clause, sentence, paragraph, or section. SECTION IV Whenever in this Ordinance an act is prohibited or is made or declared to be unlawful or an offense or a misdemeanor, or whenever in such Ordinance, the doing of an act is required or the failure to do any act is declared to be unlawful, the violation of any such provision shall be punished by a fine of not exceeding One Thousand Dollars ($1,000.00); provided, however, that no penalty shall be greater or less than the penalty provided for the same or similar offense under the laws of the State. The City Council must adopt an annual budget and conduct the financial affairs of the City in strict conformance with the budget. 2. The budget must be adopted prior to the first day of the ensuing fiscal year. 3. The City's budget officer must prepare a proposed budget for the consideration of the City Council. 4. The budget must include a list of all expenditures proposed to be made during the next fiscal year, and show comparisons with expenditures for the same purposes of the current fiscal year. 5. The budget must show a complete financial statement for the City, including all debts and other outstanding financial obligations; the estimated amount of cash or other balances that will be left in each fund at the end of the current fiscal year; the City's total actual revenues for the previous fiscal year; estimated revenues for the current fiscal year; and projected revenues for the next fiscal year. 6. Each prof ect or activity proposed for funding during the next fiscal year must be shown in the budget as definitely as possible, with the estimated cost for each item. 7. Copies of the proposed budget must be filed with the City Clerk/Secretary and made available for public inspection no later than 30 days prior to the date upon which the property tax rate for the next fiscal year is set by the Council. 8. The City Council must hold a public hearing on the budget not less than 15 days after the budget is filed with City Clerk or Secretary. Public notice of the time and place of hearing must be given in a newspaper of general circulation not more than 30 days nor less than 15 days prior to the hearing. 9. Following the public hearing, the proposed budget can be changed by the City Council "as in their judgment the law warrants and the best interests of the taxpayers demands". 10. Upon adoption of the final budget by majority vote of the Council copies must be filed with the County Clerk and City Clerk/Secretary and made available for public inspection. 11. After the new fiscal year has begun and the budget has been put into effect, no expenditure "shall thereafter be made except in strict compliance with such adopted budget". The City Council may amend the budget for reasons of "grave public necessity" requiring "emergency expenditures to meet unusual and unforeseen conditions, which could not, by reasonable diligent thought and attention, have been included in the original budget". Docket Management Systems *Staff recommends approval* j ORDINANCE NO, 09-15-99 An ordinance of the City of Sanger , Texas , establishing a Municipal Court Technology Fund; providing for the assessment and collection of a municipal court technology fee; providing for severability; providing for publication and effective date; providing for expiration date. Whereas, 40172 of the Code of Criminal Procedure provides for the establishment of a Municipal Court Technology Fund. Be it Ordained by the City Council of the City of Sanger , Texas: Section 1: Establishment of Municipal Court Technology Fund A. There is hereby created and established a Municipal Court Technology Fund, here -in -now known as the Fund, pursuant to Article 102.0172 of the Code of Criminal Procedure, B. The Fund may be maintained in an interest bearing account and may be maintained in the ,.general revenue account. Section 2. Establishment of Amount of the fee and Assessment and Collection A. The fee shall be in the amount of (up to four dollars. B. The fee shall be assessed and collected from the defendant upon conviction for a misdemeanor offense in the Municipal Court as a cost of court. A defendant is considered convicted if: (1) a sentence is imposed on the person; (2) the person is placed on community supervision, including deferred adjudication community supervision; or (3) the court defers final disposition of the person's case. C. The fee shall be collected on conviction for an offense committed on or after September 1, 1999 (or for convictions on offenses committed on or after ordinance is adopted)." D. The clerk of the court shall collect the fee and pay the fee to the municipal treasurer or other official who discharges or performs the duties of the treasurer) of the City of Sanger , who shall deposit the fee into the Municipal Court Technology Fund. Section 3. Designated Use of the Fund and Administration A. The Fund shall be used only to finance the purchase of technological enhancements for the Municipal court of the City of Sanger ,Texas, including: (1) computer systems; (2) computer networks; (3) computer hardware; (4) computer software; (5) imaging systems; (6) electronic kiosks; (7) electronic ticket writers; or (8) docket management systems. "Fee may only be assessed and collected on offenses occurring on or after September 1, 1999. The fee may not be assessed or collected retroactively if Fund is established at a later date than September 1, 1999. o B. The Fund shall be administered by or under the direction of the City Council of the City of S�ngar Section 4. Severability If any provision, section, subsection, sentence, clause or phrase of this ordinance, or the application of same to any person or set of circumstances for any reason is held to be unconstitutional, void or invalid or for any reason unenforceable, the validity of the remaining portions of this ordinance or the application thereby shall remain in effect, it being the intent of the City Council of the City of Saner ,Texas in adopting this ordinance, that no portion thereof or provision contained herein shall become inoperative or fail by any reason of unconstitutionality or invalidity of any portion or Nrovision. Section 5. Repealing Conflict All ordinances and parts of ordinances in conflict with this ordinance are hereby repealed to the extent of conflict with this ordinance. Section 6. Publishing and Effective Date This ordinance shall be published in accordance with the requirement of publishing all ordinances and becomes effect in accordance with state law upon passage, but no earlier than September 1, 1999. Section 7. Expiration and Administration of Fund In accordance with Article 102.0172 of the Code of Criminal Procedure, this ordinance and the assessment and collection of the Municipal Court Technology fee expires September 1, 2005. The purpose of the use of any funds remaining ih the Fund shalt continue to be used and administered as required by this ordinance and for that purpose this ordinance remains in effect. If a municipality creates the fund, defendants 'convicted of a misdemeanor offense in a municipal court or municipal court of record must pay a technology fee of up to $4. The municipal court clerk must collect the costs and pay the funds to the municipal treasurer, or to any other official who performs those duties. The fund shall be administered by the municipality's governing body.
