I would like to begin my review of the above referenced project if the community is still committed to moving forward with this project; however, I am requesting the city formally withdraw its application if it does not plan to move forward with this project. A formal withdrawal of this application does not jeopardize the city's eligibility to apply for future projects under the Texas Capital Fund Program. In addition, the city may re -submit this project at another time if it so chooses. These violations were discovered during a record review by the Arlington Regional Office and documented in a letter dated March 11, 1998 from the Enforcement Division. Please find enclosed a proposed agreed order which we have prepared in an attempt to expedite this enforcement action. The order assesses an administrative penalty of Twelve Thousand Five Hundred Dollars ($12,500), identifies the violations that we are addressing, and identifies specific technical requirements necessary to resolve them. If you have any questions regarding this matter, we are available to discuss them in a conference in Austin or over the telephone. If we reach agreement in a timely manner, the TNRCC will then proceed with the remaining procedural steps to settle this matter.
