The City of Sanger's City Council will hold a public hearing on Monday, July 6, 1998
to consider a zoning change request from property owners Nim Ashley and Dwayne
Waters for property legally described as Abstract 71A Burleson, Tract 1, Acres 0.300
and Abstract 940A McKinney & Williams, Tract 2B, Acres 4.573. This property is
located on Cowling Road. They have requested this zoning change in order to construct
a storage building facility.

Dear Mayor Coker:
Based on conversations with Kim Lacey, grant consultant for the city of Sanger, and a letter
dated June 4, 1998, from Mr. Woodrow Barton, it appears there is significant opposition to this
project and a Landfill and Waste Disposal Agreement between the city and IESI has been
rescinded.
I would like to begin my review of the above referenced project if the community is still
committed to moving forward with this project; however, I am requesting the city formally
withdraw its application if it does not plan to move forward with this project. A formal
withdrawal of this application does not jeopardize the city's eligibility to apply for future projects
under the Texas Capital Fund Program. In addition, the city may re -submit this project at
another time if it so chooses.
I am requesting the city submit a formal response to this letter identifying the status of this
project and the city's decision regarding withdrawal. The response letter should be submitted to
my attention no later than Wednesday, July 8, 1998, in order to remain eligible for consideration
or the application will be returned.

Dear Mayor Cocker:
The Executive Director of the Texas Natural Resource Conservation Commission ("Commission"
or "TNRCC") is pursuing an enforcement action against the City of Sanger ("Sanger") for violations
of the Texas Water Code and Commission Rules. These violations were discovered during a record
review by the Arlington Regional Office and documented in a letter dated March 11, 1998 from the
Enforcement Division.
Please find enclosed a proposed agreed order which we have prepared in an attempt to expedite this
enforcement action. The order assesses an administrative penalty of Twelve Thousand Five Hundred
Dollars ($12,500), identifies the violations that we are addressing, and identifies specific technical
requirements necessary to resolve them.
If you have any questions regarding this matter, we are available to discuss them in a conference in
Austin or over the telephone. If we reach agreement in a timely manner, the TNRCC will then
proceed with the remaining procedural steps to settle this matter. These steps include publishing
notice of the proposed order in the Texas Register, and scheduling the matter for the Commission's
agenda. We believe that handling this matter expeditiously could save Sanger and the TNRCC a
significant amount of time, as well as the expense associated with litigation.

Should you believe you are unable to pay the proposed administrative penalty, you may claim
financial inability to pay part or all of the penalty amount. If this is the case, please contact us
immediately to obtain a list of financial disclosure documents we will need from you. These
documents, once properly completed and submitted, will be thoroughly reviewed to determine if we
agree with the claim of financial inability. Please be aware that if financial inability is proven to the
satisfaction of staff, discussions pertaining to the penalty amount adjustment will focus only on
deferral and not on waiver of the penalty amount. The Commission will make the final decision on
the staff recommendation.
You maybe able to perform or pay for a Supplemental Environmental Project ("SEP"), which is a
project that benefits the environment, to offset a portion of your penalty. Please contact us for
additional information regarding SEPs.
Please note that any agreements we reach are subject to final approval by the Commission.
If we cannot reach a settlement of this enforcement action or you do not wish to participate in
this expedited process, we will proceed with enforcement under the Commission's Enforcement
Rules, 30 Texas Administrative Code (TEX. ADMIN. CODE) ch. 70. Specifically, if the signed
order and penalty are not mailed and postmarked within 60 days from the date of this letter,
your case will be forwarded to the Litigation Support Division and this settlement offer will
no longer he available. If you would like to obtain a copy of 30 TEx, ADmiN. CODE ch. 70 or any
other TNRCC rules, you may contact any of the sources listed in the enclosed brochure entitled
Obtaining TNRCC Rules. The enforcement process described in 30 TEx, ADMIN. CODE ch. 70
requires the staff to prepare and issue an Executive Director's Preliminary Report and Petition to the
Commission.
