ABSENT: Councilwoman Margie Braxton OTHERS PRESENT: City Secretary Rosalie Chavez, Electric Superintendent Larry Yoast, Jerry Jenkins, John Coker, City Auditor Bill Spore, Lisa Hardy 1. Call Meeting to Order. 2. Discuss Fiscal Year 94-95 Audit -Bill Spore, Auditor A quorum was not present during this item. Mr. Spore did present Council with copies of our Fiscal Year Audit for 94/95 and gave a report on expenses and revenues. 3. Discuss Applicants for City Administrator's Position. After adjournment from regular scheduled Council meeting, Council continued with the workshop. Mayor gave report concerning the references she had contacted in regards to the applicants. Discussion followed. Consensus of Council to schedule interviews for the following applicants: Jody Butler Kyle McCain Harold Boldt Jean Spencer Alan Guard Larry Keesler Discussed was the scheduling of interviews. Mayor indicated a couple of interviews would be set up for this Thursday night. Tentatively schedule for Thursday night were Alan Guard and Kyle McCain. She also indicated that on Saturday they could meet at 10:00 to interview the rest of the applicants. 4. Any Other Such Matters. None. S. Adjournment. Mayor Armstrong Called the Meeting to Order, led the Invocation which was followed by the Pledge of Allegiance. 2. CONSENT AGENDA a) Approve Minutes b) Disbursements Motion was made by Councilman Kincaid to approve Consent Agenda. Seconded by Councilman Ervin. Motion Carried unanimously. 3. Citizens Input. None. 4. Consider and Passible Action Regarding FY Audit 94/9S -Bill Spore. Motion was made by Councilman Bell to accept audit for 94/95 as presented. Seconded by Councilman Kincaid. Motion Carried unanimously. 5. Consider and Possible Action Regarding Appointment for FY 95/96 Audit. Motion was made by Councilman Richardson to retain Bill Spore to conduct annual audit for the year 95/96. Seconded by Councilman Ervin. Motion Carried unanimously. (*Fee based at $4500 for the regular audit plus $500 for single item audit Home Grant) 6. Consider and Possible Action to Adopt Resolution No. R02-96 Directing Publication of Notice of Intent to Issue Utility System Revenue Bonds and all matters thereof. CC MINUTES - Page 2 February 5, 1996 Dan Alman addressed Council concerning the approval of $1,060,000 loan for improvement for the wastewater treatment plant from the Water Development Board. The loan for wastewater treatment is eligible for the State Revolving Fund. The loan is at a low interest rate. Mr. Alman did state that the next step is for Council to proceed with the adoption of ordinance directing to give Notice of Intent to Issue Utility System Revenue Bonds. Mr. Ahnan indicated the City can earn interest equal to or greater than what interest the city pays on the bonds, however, if the project exceeds 3 years then the Federal Government restricts the yield the City is earning on the money that has not been expended. He also stated that since the loan is under $5 million he believes the. _ loan is not subject to arbitrary rebate where the positive interest the city makes has to be rebated to the government. The SRF program is set up as the Pre -Funded option which allows the City to sell the bonds and escrow the proceeds then they can draw the proceeds out and pay the engineers. This is a good cash flow tool for the City. Motion was made by Councilman Kincaid to Adopt Resolution R02-96 Directing Publication of Notice of Intent to Issue Utility System Revenue Bonds. Seconded by Councilman Ervin. RESOLUTION NO. R02-96 DIRECTING PUBLICATION OF NOTICE OF INTENTION TO ISSUE CITY OF SANGER, TEXAS UTILITY SYSTEM REVENUE BONDS, SERIES 1996, IN THE PRINCIPAL AMOUNT OF $1,06%000 Motion Carried unanimously. 7. Consider and Possible Action concerning Lease Purchase Copier - Police Department. Tony Tipton gave a brief presentation regarding the lease purchase of a Mita Copier for the Police Department. Discussed. Motion was made by Councilman from Office Equipment Center in Seconded by Councilman Kincaid. Motion Carried unanimously. Richardson to lease purchase the Mita Copier Denton for 36 months for $128.95 per month. CC MINUTES - Page 3 February 5, 1996 8. Consider and Possible Action regarding Resolution No. R01-96 supporting the Denton County Sesquicentennial and Courthouse Sesquicentennial Celebration. Motion was made by Councilman Bell to Adopt Resolution No. ROl-96 supporting the Denton County Sesquicentennial and Courthouse Sesquicentennial celebration. Seconded by Councilman Richardson. Motion Carried unanimously. 9. Consider and Possible Action regarding Proclamation No. P 1-96 proclaiming the week of February 19 - February 23, 1996 as "Seat Belt Safety Week". Motion was made by Councilman Richardson to Approve Proclamation P__1-96 __ _ _ .. _ . proclaiming February 19 - February 23,1996 as "Seat Belt Safety Week". Seconded by Councilman Kincaid. Motion Carried unanimously. 10. Any Other Such Matter. 1) Mayor Armstrong reminded Council of TML Region 8 Quarterly Meeting scheduled for February 16, 1996. The Public Utility Commission of Texas has confirmed this election and certified that the Cooperative is deregulated for ratemaking purposes. A copy of the Commission's certification accompanies this letter. In the future, the Cooperative will implement rate changes that may be approved by its board of directors. FOR § CERTIFICATION OF RATE § OF TEXAS DEREGULATION FOR RATEMAKING § PURPOSES § CERTIFICATION OF DEREGULATION On January 12, 1996, Denton County Electric Cooperative, Inc. (Cooperative) filed a request for administrative certification of deregulation for ratemaking purposes under the Public Utility Regulatory Act of 1995 (PURA), Tex. Rev. Civ. Stat. Ann. art. 1446c-0, § 2.2011 (Vernon Supp. 1996). In support of its request, the Cooperative submitted ballots and verified that a majority of the ballots demonstrate that members of the Cooperative support deregulation. The Cooperative affirms that the election was conducted in accordance with all provisions of § 2.2011 of PURR. Based on the representations made by the Cooperative in its application, the Public Utility Commission of Texas (Commission) finds that the Cooperative conducted its election in accordance with the requirements of PURA §2.2011, and that the majority of the ballots received were votes supporting deregulation. Accordingly, the Commission CERTIFIES that Denton County Electric Cooperative, Inc. is deregulated for ratemaking purposes as provided in PURR § 2.2011.
