Consider and Possible Action Regarding Adoption of Resolution No. 19-95 - Prohibit Concealed Handguns on City -Owned Premises. Discussed. Motion was made by Councilman Richardson that the city deny Resolution R 19-95. Seconded by Councilman Be1L Motion Carried unanimously 4-0. 4. Consider and Passible Action to Approve Resolution No. 20-95 Requesting Financial Assistance from the Texas Water Development Board. Discussed. Consider and Possible Action Regarding Appointment of Fair Housing/Equal Opportunity Standards Officer. Motion was made by Councilman Richardson to appoint Rose Chavez as Fair Housing/Equal Opportunity Standards Officer. Seconded by Councilman Ervin. Motion Carried unanimously 4-Q. $. Consider and Possible Action for Reimbursement of Expenses and Excessive Time and Commitment in the absence of a City Administrator. Councilman Richardson addressed this issue concerning reimbursement to the Mayor for excessive time and commitment in the absence of the City Administrator. Discussed. Mayor Armstrong expressed her appreciation, however, she did not want a salary or compensation since it would make her feel she needed to be in the office 8 hours a day every day. She indicated that CC MINUTES - PAOE 3 December 18, 1995 the department heads are doing a great job and if they need her for any reason they call her. She thanked Council for their consideration. 9. Any Other Such Matters. {a) Mayor Armstrong briefed Council concerning a telephone call she received Sunday from Kim Shaw concerning her water situation at her property. Mrs. Shaw was very upset and wanted the Mayor to go and look at her property. The Mayor indicated she could not go since she was having her Christmas with her family. Mrs. Shaw did manage to call other Council members concerning her problem. The Mayor stated that she called Mrs. Shaw back on Monday after she talked with John Mears concerning this issue. Mayor Armstrong advised Mrs. Shaw that the water running across their property was coming from McNeil and Springer. The Mayor also advised her that everyone she has talked to had told her that the their problem could be corrected if they put a horn through their driveway. Mrs. Shaw was still not satisfied. The Mayor did indicate that the city legally could not take all the water off them and direct it to the Amyx's property. Councilman Bell and Councilman Kincaid indicated they went out to check the culverts that day she called to make sure they were draining properly. They indicated Amyx's property is getting 65% to 75% of the water and the Shaw's property is getting 30% to 35% of the water. {b) Mayor Armstrong indicated that the Library is leaking again. She stated that Chuck will contact Denton Roofing so they can come back and correct the problem. (c) Councilman Kincaid asked if staff had found out if the underground storage tanks were on State right -of --way. Larry Yoast indicated that one of the tanks is on State right -of --way 23' 6� into the center of 5th Street. Mayor Armstrong stated we need to contact the Highway Department to advise and see if we can get reimbursed for some of this expense. (d) Mayor Armstrong addressed John Mears' letter concerning Willowood Addition. {e) Mayor Armstrong also advised concerning the purchase of the Railroad property. She indicated she would write Matthew Hickey a letter and CC MI tNLTTES - PAGE 4 December 18, 1995 offer a price of $10,000 for the barn and storage area and $20,000 for the other property. She has talked to Mr. Hickey and he does understand that this is a negotiating price. Mr. Hickey did advise Mayor Armstrong it will be after the first of the year before he contacts her. Larry Yoast advised Jim Conley bought the property right across the street from. the City's for $3500 an acre. Discussion. This is in response to a phone call received this date from Ms. Rose Chavez, City Secretary, concerning the above referenced Subdivision Plans and all related construction. I have reviewed our involvement and preliminary plans submitted on the project. These plans were signed, dated and sealed by W.S. Nash on March 13, 1995. The File Plat is labeled "Preliminary For Review Only". The plat review was identified as a Preliminary Plat. The typed name Gary W. Hammett Registered Public Land Surveyor #1849 appeared on the plat. No signature or seal was provided. .Reference is made to comments made in n the recent council meeting concerning existing sanitary sewer utility lines. The preliminary construction plans presented. by the Developer and his Engineer indicate "existing 6" sewer line" on Sheet 5 of 6. The connection to this line is a part of the Engineering plans presented to the City. Standard practice is for the Developer and his Engineer to determine the location of the existing lines and where they will need to extend lines for connection and service. Cities do not prepare the development plans. The Subdivision Ordinance stipulates the Developer shall retain an Engineer and Surveyor to prepare plats and plans for improvements to be constructed. The responsibility is placed upon the Engineer (Surveyor of the Developer to investigate and prepare plans which conform with industry standards. The sewer plans on Sheet 5 of 6 indicate that a 6" sanitary sewer l0ne was to be constructed adjacent to the edge of the proposed Mayor Armstrong September 8, 1995 Page 2 concrete drainage flume (concrete drive section). Four foot %9* diameter manholes were to be constructed at two angle points in and along lots 10 and 11. Our preliminary review letter indicated that if the project were constructed as shown the manholes might be on private property. Our review letter makes no reference to placing the sewer line under the flume section. The manholes designed were not in the flume section and had standard manhole ring and cover tops. If these manholes are constructed within the concrete drainage flumes, then the City may and probably should require the cover to be bolted and sealed to cut down on inflow. The plans further indicate the 6" sewer line to be on 0.3� slope. State design criteria for a 6" line is 0.5% mimimum slope. With PVC pipe the velocity of a theoretical volume will allow a slope down to 0.35%. In order to use a 0.3� slope, the Developer and his Engineer. could have used an 8" pipe. We had previously marked these, same comments on the construction plans for Phase II of the Sargent Addition, The Developer and Surveyor/Engineer on that project are the same as this Phase III. The Engineer is aware of the State Design Criteria, The Preliminary Plat identifies both water and sanitary sewer lines on the plat. Final Plats should not include utility lines. They should be in the various attached construction plans. The Final Plat needs to be prepared to the proper size which can be recorded in the Denton County Records. We will be most happy to further explain to the City Council the various needs and responsibilities for Engineers and Surveyors to prepare plans. The City does not, should not, and will not pay outside Engineers or consultants to prepare plans for which a Developer is responsible. Hammett & Nash, Inc. are very capable of this Design Engineering and Surveying. Any further reference that the City Engineer should have performed this service for the Developer is out of place. We assist the City when requested and do not provide day to day inspection on line location I nvestigations. Mayor, if you need us to visit with any Developer and their Engineer and Surveyor, we will be glad to. We are furnishing both the Developer and the Surveyor/Engineer a copy of this letter. Prior to the consideration of the plat by the planning and zoning commission, the city manager and his duly authorized representatives shall check the plat and make recommendations. B . When a preliminary plat is filed with the city for review and approval, it shall be immediately forwarded to the city engineer, who will make a preliminary study of the plat. If it appears substantially complete, an bn-site review of the tract to eb - subdivided will be made to determine any apparent problems with development of the subject land. Any preliminary plat which is found to be incomplete or requires significant changes shall be returned to the subdivider for additions or changes before resubmission. C. It shall be unlawful for any owner, or agent of any owner, to lay out, subdivide or plat any land into lots, blocks and streets within the city, or to sell property therein, which has not been laid out, subdivided and platted according to these regulations. D. No officer or employee of the city shall perform, or cause to be performed, any work upon any streets or in any addition or subdivision of the city, unless all requirements of these regulations have been complied with by the owner of the addition or subdivision. • E. The city hereby defines its policy to be that the city will withhold improvements of any nature whatsoever, including the maintenance of streets, issuance of building permits or furnishing of sewage facilities and water service, until the subdivision plat has been approved by the city council. No improvements shall be initiated nor any contracts executed until this approval has been obtained. F. Any owner or developer of any lot, tract or parcel of land located within the corporate limits of the city or within its jurisdiction who may wish to effect a subdivision of such land shall conform to the general procedure described as follows: (1) The subdder shall prepare and submit a "Preliminary Plat" to the city for review, study and approval by the planning and zoning commission at least twenty (20) days prior to the commission's next regularly scheduled meeting. The planning and zoning commission shall act on the preliminary plat within thirty (30) days from the date such plat was filed; (2) In the case of a proposed phased development, the subdivider shall file a preliminary plat showing the entire proposed subdivision, the various phases by which the subdivision will be developed, and lots that will be sold within the phase to be developed upon approval of the final plat by the city council. If the subdivision is to be developed in phases or units, an overall master development plan for street, drainage, water and sewer improvements shall be submitted to the city engineer by the subdivider's engineer at the time the first phase of construction is submitted for approval. This overall plan shall show the layout of streets and easements, lot configurations, water and sewer main locations and sizes, fire hydrant locations, manhole locations and drainage improvements; (3) After approval of the preliminary plat by the planning and zoning commission, the subdivider may then prepare a "Final Plat" of all or a u portion of the land included in the preliminary plat for submission to and consideration by the planning and zoning commission for final recommendations. The final plat and accompanying data must be submitted at least twenty (20) days prior to the date of the meeting that such action will be taken by the planning and zoning commission; (4) Upon final action on any such final plat by the city planning and zoning commission, the same shall be referred to the city council, and the city council shall consider such final plat for acceptance of the dedication of all public property therein set forth, provided that the plat shall in all things fully comply with the terms and provisions of this ordinance. The city council shall act on the final plat within thirty (30) days from the date such plat was filed for approval, (5) Upon acceptance of such plat by the city council and completion of required public facilities or the filing of a performance bond by the developer which covers said facilities, the city secretary shall immediately cause such plat to be recorded in the plat records of the county. The subdivider shall, however, pay to the city, in advance, the required fees for filing of such plat by the county clerk. The recording of the final plat shall be the responsibility of the city secretary; (6) In subdivisions approved for phased development and as each consecutive block is completed, that is, the proper utilities are installed and approved by the city, and the streets and alleys are paved and approved by the city, building permits may be issued on a block -by -block basis, but no certificate of occupancy shall be issued by the building official until the phase is completed and accepted by the city; (7) The subdivider shall include in the conditions of sale for each lot within the subdivision a notice to the purchaser that no certificate of occupancy shall be issued for any structure or building constructed therein unless and until the city has approved and accepted that phase of the subdivision, (8) The subdivider shall understand that all proposed improvements are to be installed or constructed at his own cost and expense, unless otherwise noted herein; and (9) Where a plat of a lot of record of undivided property is proposed to be subdivided and meets the criteria for abbreviated procedures set forth under the "short form subdivision," and providing all of the requirements have been met, the subdivider may submit a final plat to the city for approval. Where circumstances in the opinion of the city manager warrant, such plat may receive administrative approval, which action shall authorize the building official to issue a building permit for improvements on said parcel. An application in writing, for the approval of the preliminary plat, together with six (6) prints, shall be filed with the city manager at least twenty (20) days before the meeting of the planning and zoning commission, if the plat is to be considered. CAny valve box which has so moved from its original position as to prevent the application of the valve key shall be satisfactorily reset by the developer at his own expense. A reinforced concrete pad of the dimensions, 3'4' x 314" x 6", shall be poured around all valve boxes that are outside the pavement section, unless otherwise directed by the city. (h) Fire hydrants shall be placed to conform with the requirements of the State Board of Insurance and the Fire Prevention and Engineering Bureau of Texas. Each hydrant shall be set upon a slab of stone or concrete not less than four inches (4") thick and not less than one (1) square foot of surface area. Where solid rock exists in the bottom of the trench and same is excavated to the proper depth to form a foundation for the hydrant, the slab of stone or concrete above specified may be omitted. The hydrant shall be set perpendicular, and to the proper depth, and shall be carefully and substantially blocked against firm trench walls using Class 2,000 concrete. (i) Fire hydrants shall be installed and operable prior to the erection of any building in which any combustible material is used as determined by the fire chief of the city. 6.06 - Sani Sewers C ^Sanitary sewer facilities shall be furnished and installed to adequately service the subdivision and shall conform to a city's sanitary sewe p an and meet the requirements, in all respects, of the Texas Department of Health and Texas Water Commission. The adequacy of the sewerage facilities provided by the subdivider shall be determined by the City* (a) Sanitary sewer mains may be vitr�ed clay sewer pipe (extra strength), cement -lined bituminous coated ductile iron pipe, polyethylene -lined ductile iron pipe or polyvinyl chloride (PVC) pipe. The subdivider shall comply with the applicable Standard Specifications of Division 2, that are related to the materials for the sewer mains accepted by the city. Connections shall be made with a fabricated fitting. Field -glued connections are not allowed. When PVC pipe passes through a manhole wall, asbestos cement sleeves with a rubber ring joint shall be used to provide a positive water -tight connection. (b) The minimum diameter of sewer mains shall be eight inches (8"). Six inch It diameter sewer mains may be acceptable only Co short distances (not to exceed 400 feet) and only in locations where the main will not be extended, as approved by the city. 000 33 CITY OF BANGER P.O. The members of the board shall be identified by place numbers one (1) through seven (7). The even numbered places shall expire in the even numbered years, the odd numbered places shall expire in the odd numbered years. Said determination of respective places shall be deter-. mined by lottery at the initial meeting of:board following adoption of this ordinance and appointment of the members. Newly appointed members shall be installed at the first J regular board meeting after their appointment. Vacancies shall be filled for any unexpired term in the same manner as provided for regular appointments. Each member of the Board shall be entitled to one vote. The City Librarian shall serve as an ex-officio member of the Board. DFW RDF has been providing reliable and environmentally safe landfill services to the City of Sanger since 1993. The operation of DFW RDF has proven to be a significant benefit to the City of Sanger and its citizens by providing local, economical solid waste disposal and creating employment opportunities for azea residents; and generating significant tax revenue for Denton County. The company has grown from approximately 15 employees in 1979 to 200 today. As you know, the landfill is located in the City of Lewisville. In addition to being a vital component of the community's infrastructure, they act as a cata- . lyst for economic development by ensuring low cost waste disposal service for homes and ' businesses alike. DFW Recycling and Disposal Facility DFW RDF is located on 851 acres of land adja- cent to the Elm Fork of the Trinity River in Lewisville, Texas, immediately north of Hebron Parkway. Of the 851 acres, 409 are permitted by the Texas Natural Resource Conservation Commission (TNRCC) as a Type I municipal solid waste disposal facility. Of the 409 permit- ted acres, 318 are designated for landfilling. The remaining acres contain buffers, roads, drainage and environmental monitoring features, and a ;as recovery plant. Waste disposal operations have been conducted on the site since the early 1970s. The facility, which has about 10 years of site life remaining, currently serves portions of southern Denton and northern Dallas counties. Permi t Amendment M Many of the communities served by DFW RDF have experienced rapid development in recent years, and are expected to continue this growth into the next century. With economic growth comes increasing amounts of waste. At present; there is only enough landfill capacity in the area to handle solid waste that will be generated over the next 10 years. DFW RDF is in the process of seeking a permit.: amendment to help meet the area's solid waste disposal needs for years to come. The amend- ment calls for increasing the landfill's capacity by means of a vertical expansion. The expansion will raise the height of the landfill approximately 150 feet from its currently approved height of 90 feet above adjacent ground level. This would extend the estimated site life of DFW RDF to approximately 30 years. Because of DFW RDF's location, much of the expansion will be obscured from public view. Where the increase is visible, steps will be taken to nninimize its aesthetic impact. The expansion will consist of long slopes with gentle grades, for example, and include vegetative screening imme- diately adjacent to public areas. Expansion to Benefit Surrounding Communities The cities of Lewisville, Carrollton, Flower Mound and surrounding communities have much to gain from DFW RDF's proposed expansion. It will provide these growing areas with a local, economical and environmentally responsible means of solid. waste disposal for the foreseeable future. DFW RDF customers currently enjoy among the lowest disposal rates in the country. The most costly component of solid waste disposal is preparing the site for landfilling, and more than 70 percent of DFW RDF's landfill acreage has already been prepared. A vertical expansion will help maximize these fixed costs, resulting in continued, economical low rates for our customers. Another factor contributing to disposal rates is the distance waste must be transported. The further the distance, the higher the cost. DFW RDF's expansion will help insure that waste can be disposed of locally, again helping to maintain economical rates. Disposal rates aside, the expansion will benefit local areas because DFW RDF and its. associated hauling company are viable members of the business community. The facilities employ approximately 200 people. Their combined annual operations have an initial impact of approximately $6 million on the local economy. That, in turn, generates about $12 million worth of overall economic activity as those dollars turn over in the communities. But the benefits don't end there. DFW RDF is also a good corporate citizen, and will continue to be so for decades to come. The facility helps support local civic and charitable organizations through annual contributions. In 1992, DFW RDF donated 36.6 acres of land valued at $300,000 so that Hebron Parkway could be completed. Completion of this roadway has contributed to the tremendous development the area is currently experiencing. Environmental Safety Features All Waste Management, Inc. sanitary landfills, includI ng DFW RDF, are overseen by the company's Environmental Management staff of more than 350 civil and environmental engi- neers, hydrologists and soil engineers, surveyors and monitoring technicians. Waste Management is the nation's largest private employer of engineers, scientists and other environmental specialists devoted exclusively to environmen- tally safe waste management services. DFW RDF currently meets or exceeds all appli- cable environmental regulations for landfill operation. In fact, many of today's new environ- mental regulations were patterned after Waste Management's corporate requirements for environmental safety. As in the past, DFW RDF will continue to receive only non -hazardous, municipally generated solid waste, such as household and commercial refuse. Additional environmental safeguards include, among others: • Liners. DFW RDF is a geologically ideal site for a sanitary landfill. The faality sits atop the Eagle Ford shale formation, an acceptable alternative to synthetic liners under the new federal environ- mental regulations. In addition to this natural liner, a composite liner system will cover portions of the landfill site constructed since 1993. It consists of three feet of recompacted clay overlain by a 60-mil thick, high -density polyethylene plastic and a synthetic drainage layer. Once a section of the landfill is completed, a final cover of recompacted Jay, topped with vegetation, is put in place, to seal off the landfill and prevent erosion. In some areas of the landfill, synthetics will also be used in addition to the recompacted clay. • Groundwater Monitoring. Groundwater protection for area residents is one of DFW RDF's top priorities. The facility has a certified groundwater monitoring system. Twice a year, groundwater samples are collected by an independent consultant. The samples are sent to Waste Management's Environmental Manage- ment Laboratory, where 62 distinct parameters on each well are analyzed in the parts -per - billion range. A detailed statistical analysis is, also performed to compare current readings with past results. If significant differences are found, even more stringent testing is performed. All results are submitted to the TNRCC, along with an evaluation. At present, DFW RDF has seven groundwater monitoring wells. Five more will be added in 1995. Should the expansion be permitted, additional wells will be installed to monitor the expansion. An extensive hydrogeologic report was recently wm- pleted to ascertain the best location for these wells. • Surface Water Protection. DFW RDF is equally committed to protecting the surface water. In compliance with federally mandated environmental regulations, an independent contractor collects stormwater run-off at the site twice a year. Specific criteria must be met before the samples can be collected. The storm must be of a certain magnitude, for example, and no rain must have fallen for at least three days prior. Once collected, the samples are tested, with 53 parameters analyzed into the parts -per -billion range. The results are then sent to the Environ mental Protection Agency for review. • Methane Gas Recovery. As refuse slowly decomposes, methane gas is formed as a natural byproduct. DFW RDF monitors for landfill 'gas on a quarterly basis at permanent -probes around the perimeter of the landfill. This helps ensure that the landfill continues to operate in an envi- ronmentally sound manner. More than just monitoring for gas, DFW RDF is ku the only facility in the state that converts landfill gas into useful product by capturing and burning it to generate electricity. The facility's gas recov- ery plant was constructed in 1988. It draws two million cubic feet of gas from the landfill daily, and burns it to generate 75 megawatts of electric power — or enough to serve 4,500 homes. Con- . ruction is currently underway to increase both the well field and plant capacity by 100 percent.. Cross -Section of a Completed Landfill Like the One Proposed at DFW RDF The protective liners and final cover surpass state requirements. The wastewater collection system recovers any liquids from the land fill for proper off -site disposal. Methane monitoring probes around the perimeter of the. landfill verifij there is no methane gas migration. Groundwater testing wells make sisre the lining system always functions properly. • • � Q: Why is DFW RDF seeking a vertical rather than a horizontal expansion? A: A vertical expansion will help ensure that DFW RDF customers continue to enjoy among the lowest disposal costs in the nation. The most costly component of solid waste disposal lies in preparing the site for landfilling. Once the site has been prepared, as more than 70 percent of DFW RDF's landfill acreage has, it is more economical to maximize these fixed costs by expanding upward rather than outward. Because the acreage has already been set aside for landfill use, a vertical expansion will also maxi- mize the potential of the existing site. This will conserve for other purposes additional. land that might otherwise have. been needed for landfilling. Q: Won't the vertical expansion be an eyesore, creating a mountain of trash as high as a 24story building? A: No: The solid waste is covered quickly after it is placed, leaving only a portion of the waste ex= posed at any time. Also, due to DFW RDF's location, much of the expansion will be hidden by natural tree lines and buildings: Where visible, the expansion will appear as a gentle slope topped with vegetation. It will rise only one foot in height for every four feet of horizontal expanse. By the time the landfill reaches its maximum height, it will be one -quarter to one-half mile in from DFW RDF's property line. Moreover, only a small area at the center of the landfill will reach the maxi- mum height of 240 feet, and this will occur to- wards the end of the 30-year expansion. A: DFW RDF is situated in a sparsely populated section of the community. Trucks traveling to and from the landfill pass only a small number of residences. Even without the landfill expansion, it is not likely the traffic would go away., Waste Management would still operate a hauling com- pany at the site and, in the event the landfill closed, the facility could serve as a transfer station. Q: What will happen if DFW RDF does not receive an expansion permit? A: Without an expansion permit, DFW RDF will be forced to close in approximately 10 years. This. would cause significantly higher solid waste disposal rates for residential and business custom- ers; in part because the waste would have`to be - hauled longer distances for disposal, and tipping fees would likely be higher as a result. . The closure of DFW RDF would also remove an important competitive element from north central Texas' waste disposal marketplace: With diminished competition, other landfills would likely increase their tipping fees. This, in turn, would mean greater operating expenses for local businesses and higher property taxes or fees for property owners in . southern Denton and northern Dallas counties. In addition, if DFW RDF dosed the City of Lewisville would not receive economic benefits such as jobs, tax revenues and procurements.
