10/21/1991-CC-Minutes-RegularMINUTES: City Council Meeting October 21, 1991 MEMBERS PRESENT: Mayor Nel Armstrong, Councilwoman Margie Braxton, Councilman Jerry Jenkins, Councilman John Berndt, and Councilman Tommy Kincaid MEMBERS ABSENT: Councilman Wendell Thomas PRESENT: City Manager John Hamilton, City Secretary Rosalie Garcia, Public Works Superintendent Chuck Tucker, Electric Superintendent Larry Yoast, Chief of Police Benny Erwin, Frontier Waste Management - Benny Johnson, Sam Jones, Taisey Jones, Helen Johnson, Mae Jones, Garland Thornton, and Betty Johnson - Sanger Courier 1. Mayor Armstrong called the meeting to order. City Manager gave the invocation which was followed by the pledge to the flag. 2. Consent Agenda: (a). Approve Minutes 14f 7f 91} {b}. Disbursements (c). Proclamation #P8-91 - Texas Pharmacy Week Councilman Jahn Berndt made the motion to approve the Consent Agenda. Seconded by Councilman Tommy Kincaid. Motion carried. 3. Citizen's Input: None 4. Conduct Public Hearing Regarding Zoning Change Request from I-1 to SF-4 for Property located along Railroad Avenue Mayor Armstrong declared the Public Hearing open to the public. Mayor Armstrong did state the Planning &Zoning had given their recommendation for approval. 0r�sjP Mrs. Sam Jones spoke in favor of the zoning change and was representing those others that were present also. Mayor Armstrong declared the Public Hearing closed. 5. Consider and Possible Action Regarding Zoning Change Request - Railroad Avenue Motion was made by Councilman Kincaid to approve the zoning an Railroad Avenue as per recommendation from Planning and Zoning from I-1 to SF-4. Seconded by Councilman Berndt. Motion carried. 6. Consider and Possible Action Regarding Proposals for Material - Asphalt, Sand, Gravel Base, & Flex -Base Mayor Armstrong stated one bid was received and it was from Jeff McNeill. Motion was made by Councilman Berndt to accept bid from Jeff McNeill regarding material for asphalt, sand, gravel base, and flex -base. Seconded by Councilman Jenkins. Motion carried. 7. Consider and Possible Action Regarding Fence Proposals Fence Proposals Submitted: Melton Construction $6,150.00 Sanger Fence Co. $6,440.00 Hurricane Fence Co. $5,272.41 Klein Fence Co. $5,993.00 Discussion. Motion was made by Councilman Jenkins to accept Hurricane Fence Company's bid for $5,272.41. Seconded by Councilman Berndt. Motion carried with one no vote. 8. Consider and Possible Action Regarding Heavy Equipment Proposals Mayor Armstrong stated that only one bid was received. Motion was made by Councilman Jenkins to accept Bohmann Construction Company's Heavy Equipment 4peratians Bid. Seconded by Councilman Kincaid. Motion carried. 9. Consider and Possible Action Regarding Solid. Waste Rates from Frontier �U'aste Management Discussion. This item was tabled for the next City Council Meeting to allow Mr. Johnson time to prepare the information that was requested from City CounciL 10. Consider and Possible Action Regarding Proposed Land Donation Mayor Armstrong stated that she had received a letter from the Diocese of Ft. XVarth, Bishop Joseph P. Delaney, who awns a piece of property in Sanger that is located on the Southeast earner of Flum and 4th and is 100 X 87.5 ft. He would like to donate this property to the City. Motion was made by Councilman Jenkins to accept this generous donation. Seconded by Councilman Kincaid. Motion carried. DoL Motion was made by Councilman Berndt for the City to pay any closing cost that might be incurred in this gift situation. Seconded by Councilman Jenkins. Motion carried. 11. Consider and Possible Action Regarding Resolution #R10-91, Utility System Revenue Bonds, Series 1991 Discussion. Motion was made by Councilman Jenkins to adopt Resolution R101 91. RESOLUTION DIRECTING PUBLICATION OF NOTICE flF INTENTION Tfl ISSUE UTILITY SYSTEM REVENUE BONDS, SERIES 1991 Seconded by Councilwoman Braxton. Motion carried. Consider and Possible Action of I-35 Water Line Improvements Motion was made by Councilman Berndt to award the in, bid of $29,336.45 to Gary Dill of Gainesville and that we enter into the Pro- Rata Agreement with ARA Living Centers and with ARA paying their part of $7,965.11. Seconded by Councilwoman Braxton. Motion carried. Motion was made by Councilman Berndt to approve Library Interlocal • !' carried. 14. (16}. City Administration Report: a}. City Manager advised that on 1D-1C3-91 he had spoke by telephone with the Fort Worth Office of the Corps of Engineers. They advised that all required legal documents for the Pond Creek Access Marina Site had been finalized by their department and the paperwork is sitting on the attorneys desk at Texas Parks and Wildlife in Austin. Denton and Dallas have also signed off on it. b}. The proposed swimming pool grant is tentatively on their agenda for Thursday, November 7th. 17.} Any Other Such Matters: a}. Councilman Jenkins discussed Frontier Waste Management's letter concerning the Thanksgiving Holiday. Frontier Waste is asking for the holiday and to resume trash pickup on Monday. Discussion. Consensus of Council for him to take Thanksgiving holiday off. b}. Councilman Jenkins was concerned with the flags at the downtown park. All seem to be the same height. City Manager replied that the U.S. Flag is set up front which is Boy Scott Etiquette. c}. Councilman Berndt also commended on the recent street patch work. 16. (14}. Executive Session According to Article 5251-17, Vernon's Civil Statutes, (f), Negotiations for Acquisition of Real Property Mayor Armstrong convened City Council into Executive Session at 8:18 P.M. Mayor Armstrong reconvened the City Council from Executive Session at 8:20 p.m. 17. (15}. Consider and Possible Action Regarding Executive Session Item was tabled. No action taken. 18. Meeting adjourned.
