City Council Meeting December 20, 1993 Mayor Nel Armstrong, Councilwoman Margie Braxton, Councilman Russell Madden, Councilman Jack Richardson, Councilman Jerry Jenkins, and Councilman Tommy Kincaid City Administrator John Hamilton, Administrative Assistant Etta Stogsdill, Dan Almon -Southwest Securities, Dwain Pomykal-Texas Waste Management, Fire Chief Bill Murrell, Public Works Superintendent Chuck Tucker, Electric Superintendent Larry Yoast, Police Chief Benny Erwin, and Delania Trigg -Sanger Courier 1. Mayor Armstrong called the meeting to order. Councilman Madden gave the invocation which was followed by the pledge to the flag. 2. CONSENT AGENDA a}. Approve Minutes b}. Disbursements After brief discussion regarding disbursements, {Gail's Inc., telephone Award- Fire Dept. and Jeswood Oil Company -fuel purchase), motion was made by Councilman Jenkins and seconded by Councilman Richardson that the items on the Consent Agenda be approved. Motion carried. 3. Citizen's Input -None 4. (5). Consider and Possible Action Regarding Financing Options For Future Projects -Library, Street, Water/Wastewater Mr. Dan Almon, City of Sanger's Financial Advisor, explained several financing options the City Council might want to consider relating to future projects. Consensus of City Council to schedule a workshop for the second meeting in January, 1994. 5. {6}. Consider and Possible Action Regarding the Contract For Solid Waste Disposal Services Between Texas Waste Management and the City of Sanger (1/2/94 - 12/31/98) CC Minutes, 12/20/93, page 2 Motion was made by Councilman Richardson and seconded by Councilman Kincaid to adopt the contract with Texas Waste Management for Solid Waste Disposal Services for the City of Sanger. Motion carried. 6. {7). Consider and Possible Action Regarding Adopting Ordinance #017-93, Amending Solid Waste Collection CITY OF BANGER, TEXAS ORDINANCE NO. #017-93 AN ORDINANCE OF THE CITY OF BANGER, DENTON COUNTY, TEXAS, AMENDING SOLID WASTE COLLECTION, SECTION 6.314, OF THE SANGER CODE OF ORDINANCES; PROVIDING FOR REPEAL OF ORDINANCES IN CONFLICT; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A PENALTY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. Motion was made by Councilman Kincaid and seconded by Councilman Jenkins for the City Council to adopt Ordinance #017-93. Motion carried. 7. (S}. Consider and Possible Action Regarding Authorization To Advertise For A 1994 Utility Personnel Vehicle -Fire Department Motion was made by Councilman Richardson and seconded by Councilwoman Braxton to authorize advertising for bids for anew utility personnel vehicle for the Fire Department. Motion carried. 8. {4). Consider and Possible Action Regarding Bolivar Street Median Motion was made by Councilman Kincaid and seconded by Councilman Richardson to proceed finishing the construction on Bolivar Street Median at I-35. Motion carried. 9. (1 1.) City Administration Report City Administrator John Hamilton reported on the following items: (a). As a reminder, City Hall will be closed December 23rd, 24th and 31st for the Christmas Eve/Day and New Year's holiday. (b). Bill Spore, the City Auditor, has been working and will present the audit to Council as soon as completed, possibly the first meeting in February. CC Minutes, 12/20/93, page 3 10. { 12). Any Other Such Matters - None 11. {9). Executive Session Pursuant to Article 62524 i v Vernon's Civil Statutes, 2 (g), Personnel - Fire Marshall Mayor Armstrong convened the City Council into executive session at 7o50 p.m. Mayor Armstrong reconvened the City Council from executive session at 8:05 p.m. 12. { 10). Consider and Possible Aetion Regarding Executive Session Pursuant to V.A.T.S., Article 6252-17, 2 (g), Personnel - Fire Marshall Motion was made by Councilman Jenkins and seconded by Councilwoman Braxton to accept the committee's recommendation to the City Council and appoint Bob Hagemann as City Fire Marshall. G. McNeill contacted staff and Mayor Pro-Tem Jenkins inquiring as to the necessity of Sections 3.607 and 3.608 (permits) of the City Code. Also, historically, Mr. McNeill questioned the validity of requiring an annual bond on the mobile home parks. The bond has evidently been required since 1982. The enclosed letter from Kirk Franklin, attorney for Governmental Services addresses both questions. In response to Mr. Franklin's opinion, a bond will no longer be required for mobile home park operators. Box 578 Sanger, Texas 76266-0578 Dear John: J A N 6 1994 •3 As you requested, I have looked into your questions regarding the requirements to operate a mobile home park versus a recreational vehicle park in the City of Sanger. I hope this letter will answer any questions you may have. Article and section references herein are to the Code of Ordinances of the City of Sanger unless otherwise indicated. With regard to the operation of a mobile home park, the person wishing to do so must first obtain a permit from the city. (See Chapter 3, Section 3.605.) One of the prerequisites to issuance of such a permit is the payment of a permit fee. (See Chapter 3, Section 3.608.) The fee for such a permit is twenty-five dollars ($25.00), plus three dollars ($3.00) for each mobile home lot. (See the fee schedule found in the appendix of the code, Article 7.000.) Note that there are also renewal and transfer fees, but these are not relevant to a discussion of the initial permit issuance. No financial guarantees (i.e., bonds, insurance proof, etc.) are required for the issuance of mobile home park permit. With regard to the operation of a recreational vehicle park, the person wishing to do so must first obtain a license from the city. (See Chapter 3, Section 3.702.) There is no substantive difference in a "license" and a "permit" for these purposes. One of the prerequisites to issuance of such a license is the payment of It license fee. (See Chapter 3, Section 3.702.) The fee for such a license is ten dollars ($10.00) for the first three (3) units, or fraction thereof, and fifteen dollars ($15.00) for the next seven (7) units, or fraction thereof, and the sum of one dollar ($1.00) for each additional unit. (See the fee schedule found in the appendix of the code, Article 8.000.) Issuance of a license to operate a recreational vehicle park has an additional prerequisite. In addition to payment of the license fee, the applicant must provide a fidelity bond in the amount of one thousand dollars ($1,000.00) to indemnify the city against the loss of amounts collected by the licensee. (See Chapter 3, Section 3.703.) No such bond is required in the case of mobile home parks. The bond required of recreational vehicle park ioperators is of course not the only difference between these two types of parks and the requrements to operate them, but as I understand it, it is the only difference about which there has been discussion. A structure constructed on or after June 151 1976, according to the rules of the United States Department of Housing and Urban Development, transportable in one or more sections, which, in the traveling mode, is eight (8) body feet or more in width or forty (40) body feet or more in length, or, when erected on site, is three hundred twenty (320) or more square feet, and which is built on a permanent chassis and designed to be used as a swelling with or without a permanent foundation when connected to the required utilities, and includes the plumbing, heating, air conditioning and electrical systems. References to "mobile homes" shall be taken to be references to HUD code manufactured homes. (Ordinance adopting Code) Mobile home nark. An area consisting of accommodations for a minimum of ten (101 mobile home spaces designated, arranged, and used for the leasing of lots for the purpose of parking or storing of mobile homes which are occupied or intended for occupancy as living quarters for individuals or families. Travel trailer. A vehicular, portable structure built on a chassis designed to be used as a temporary living facility for travel and recreational purposes, having a body which does not require a special permit to be towed on Texas highways. Permit. A written permit of certification issued by the City Council permitting operation, the construction, alteration, or extension of a mobile home park under the provisions of this section and the City Zoning Ordinance. (Chapter 3, Section 7B, Code of 1982) § 3.603 Parking of Mobile Homes and Travel Trailers It shall be unlawful for any person to park, place, or locate a mobile home within the City of Sanger for a longer period of time than forty-eight (48) hours except in an approved mobile home park as provided for in this article and the City Zoning Ordinance. Mobile homes and/or travel trailers shall not be parked on City streets. (Chapter 1, Section 7C, Code of 1982) § 3.604 Exceptions The provisions of the above Section 3.603 shall not apply to: (a) A mobile home or travel trailer parked upon a lot where mobile homes and travel trailers are sold and where no person occupies such mobile home or travel trailer as a dwelling or sleeping place. (b) A mobile home or travel trailer temporarily parked (less than 48 hours) upon a lot as an office or display unit and where no person occupies such mobile home or travel trailer as a dwelling or sleeping place. (c) A travel trailer parked upon a lot or tract of land and where no person occupies such travel trailer as a dwelling. (d) A mobile home or travel trailer temporarily parked upon a lot or tract of land and used to provide temporary shelter or temporary l4ving quarters for a guard, watchman, or supervisor of a public or private construction project. The maximum length of time permissible for such usage without approval shall be one hundred -eighty (180) days. (e) Travel trailers parked in recreational areas which have been designated as such by the City Council. (Chapter 3, Section 7D, Code of 1982) § 3.605 Permit Required It shall be unlawful for any person to operate, maintain, construct, alter, or extend any mobile home park within the City of Sanger unless he/she has a valid permit issued by the City Council for the operation and/or specific construction, alteration, or extension proposed. (Chapter 3, Section 7E, Code of 1982) § 3.606 Moving Mobile Homes It shall be unlawful for any mobile home owner, mobile home park operator or owner, or any other person to move a mobile home on streets and roadways of the City of Sanger wiuiout arst obtaining police escort by the City of Sanger Police Department. (Chapter 3, Section 7F, Code of 1982) Mobite Home Park Permit Application An application for a mobile home park permit shall contain the following: (a) Name and address of applicant. (b) Location and legal description of the mobile home park. (c) Name and address of the owner of the property. (d) A site plan of scale twenty feet (20') to one inch (1") in six (6) copies showing the following prepared by a licensed engineer, (1) Date, scale, north point, name of owner and name of person preparing the plan. (2) Location of existing boundaries and dimensions of the tract. (3) Location and width of private driveways used for ingress and egress. (4) Location and width of private drives and streets within the park. (5) Locations, dimensions and yard setbacks of all unit plots. (6) Location of permanent structures and accessory structures. (7) Designation of parking, recreational and landscaped areas. (8) All required front, side and rear yard building setback lines in compliance with this article and the City Zoning Ordinance. (9) Names of contiguous subdivisions and the owners of contiguous parcels of unsubdivided land and an indication of whether or not contiguous properties are platted. (Chapter 3, Section 7G, Code of 1982) 340 § 3.608 Mobile Home Park Permit and Renewal Fees (a) The initial permit fee for each mobile home park shall be as set forth in Article 7.000 of the fee schedule found in the Appendix of this Code. The permit fee must accompany each application for a mobile home park permit. (b) A mobile home park permit shall be effective from January 1 st of one year, or when granted, until December 31 st of said year. The fee for yearly renewal applications on each mobile home park shall be as set forth in Article 7.000 of the fee schedule. (Chapter 3, Section 7H, Code of 1982) § 3.609 Transfer of Permit Each person holding a mobile home park permit shall give notice in writing to the City Building Official within seventy-two (72) hours after having sold, transferred, given or otherwise disposed of interest in or control of a mobile home park. The transferee of the permit shall make application for transfer of said permit within seven (7) days after such notification to the City Building Official. Upon receipt of such application, the City Building Official determines that the mobile home park is in compliance with all applicable provisions of this article and the City Zoning Ordinance before transferring said permit. (Chapter 3, Section 7I, Code of 1982) Permit Transfer Fee An application for a permit transfer shall be accompanied by a fee as set forth in Article 7.000 of the fee schedule found in the Appendix of this Code. (Chapter 3, Section W, Code of 1982) § 3.611 Issuance of Permit The City Council shall issue a permit for the proposed mobile home park when the proposed plan meets the requirements of this article and other applicable ordinances. (Chapter 3, Section 7K, Code of 1982) § 3.612 Mobile Home Park Space Requirements* (a) Each mobile home park shall consist of accommodations for a minimum of ten (10) mobile home spaces with utility facilities installed ready for use prior to first occupancy of any space. (b) Off-street parking for at least two (2) vehicles per stand shall be concrete and all other parking areas shall be constructed of all-weather materials and located to eliminate interference with access to parking areas provided for other mobile homes, travel trailers and for public parking within the mobile home park. (c) Each mobile home shall be placed on a concrete foundation pad to provide adequate support. 'Cross reference —For additional park and lot requirements, see Chapter 12, Zoning, § 17. (d) No mobile home shall be parked in a mobile home park with less than minimum blocking and anchoring. Minimum blocking and anchoring shall be according to Texas State Law. (e) Entrance driveways and roadways from a public street into a mobile home park shall be a minimum of thirty-five feet (35') in width measured at the property line, unless otherwise required by state highway officials. (f) An internal street or common access route shall be provided to each stand. Local streets shall be a minimum of thirty-four feet (34') in width from back of curb to back of curb. The collector streets shall be a minimum of forty feet (40') in width from back of curb to back of curb. The internal streets shall be continuous and connect with either outer streets in the park, public streets or, in the alternative, shall be provided with a cul-de-sac having a minimum radius of sixty (60') feet. All other streets shall have a minimum radius at intersections of thirty (30') feet. No internal street ending in a cul-de-sac shall exceed one thousand feet (i,000&) in length. (g) All internal streets shall be curbed and guttered and paved in compliance with the City of Sanger. (1) Curb and gutter shall be constructed as a unit with battered curbs not less than six inches (6") in depth and reinforced with three (3) No. 3 bars of reinforcing steel running longitudinally, two (2) in curb section and the third in the gutter section. Concrete shall consist of not less than five (5) sacks of Portland cement per cubic yard and the surface shall be troweled with a steel trowel and finished by brushing transversely with a wet brush. The curb and gutter shall be constructed on a two inch (2") minimum sand cushion. Expansion joints shall be constructed at a minimum distance of sixty feet (60') between expansion joints with tooled or saw -cut joints every twenty feet (20'). (2) All clearing and grubbing shall be to a depth of not less than one foot (P) below subgrade. (3) Subgrade shall be scarified to a minimum depth of four inches (4") and recompacted to a minimum density of ninety percent (90%) standard proctor. If natural subgrade has a P.I. of twenty-five (25) or greater, it shall be treated with lime. If sufficient depth of suitable subgrade material is not available, it shall be removed and replaced with suitable material. (4) A minimum of five inches (5") of flexible base material consisting of crushed stone shall be compacted to a minimum density of ninety percent (90%) standard proctor. All materials and construction shall be in accordance with the requirements of the City of Sanger. (5) After completion of the flexible base and prior to surfacing, there shall be applied to the surface of the base an asphaltic prime coat complying with the requirements of the City of Sanger at a rate of 0.20 to 0.30 gallons per square yard. (6) After the prime coat has been absorbed by the base it shall be surfaced with a minimum of two inches (2") of hot mix asphaltic concrete, type "D", complying with requirements of the City of Sanger, with coarse aggregate limited to crushed limestone. Asphalt street: two (2) coats of asphalt; Prime: AC 10 (summer) and RC5 (winter); Treated Rock: P134. �. (h) Internal streets shall be maintained free of cracks, holes, and other hazards at the expense of the licensee. Inspection of streets shall occur at least yearly in conjunction with other City of Sanger inspections of mobile home parks or tourist courts. The inspection shall be made by the City and shall cover the hazards listed above. (i) Protective lighting shall be provided on the site. (j) The ground surface in all parts of a mobile home park shall be graded and equipped to drain all surface water in a safe, efficient manner. The adequacy of drainage facilities shall be verified by a licensed professional engineer. There shall be an analysis and design of the 100 year flood improvements to meet FEMA requirements. (k) There shall be constructed and maintained a permanent privacy fence. of wood fencing material or masonry materials not less than six feet (6') in height on all sides of the park except where natural barriers exist to form all or part of such a screen, or where roadways exist to create a traffic hazard (1) All streets within each park shall be numbered or named in an approved manner. (m) Cooking shelters, barbeque pits, fu'eplaces and woodburning stoves shall be located, constructed, maintained and used as to minimize fire hazards and smoke nuisance both on the property on which used and on neighboring property. No open fire shall be permitted. No fuel shall be used and no material burned which emits dense smoke or objectionable odors. (n) Fire resistant skirting or an equal substitute approved by the Building Official shall be �^, required on all mobile homes and shall be installed within thirty (30) days after emplacement of the mobile home. (Chapter 3, Section 7L, Code of 1982) § 3.613 Mobile Home Park Utilities (a) Water supply for human consumption and fire protection must be obtained from the City of Sanger Water Supply System. Each mobile home park shall have a master water meter. The basic water fee will be charged for each mobile home. (b) Water mains will connect to the City of Sanger Water Supply System and will be installed at the expense of the mobile home park. (c) Sewage disposal must be through the City of Sanger collection, treatment, and disposal system. (d) Sewer mains required to connect to the City of Sanger Sewer System will be installed at the expense of the mobile home park. Each mobile home shall be charged a separate sewer fee. (e) Internal mobile home plumbing must comply with minimum standards set for mobile homes by the State of Texas. External plumbing must comply with the City of Sanger Plumbing Code and standard specifications. (f) Electrical systems must connect to the City of Sanger Electrical Distribution System and comply with the City of Sanger Electrical Code. Each mobile home shall have a separate electric meter. 3-13 (g) Approaches to all travel trailers and mobile homes shall be kept clear for fire fighting. (h) Water supply facilities for fire department operations shall be connected to the City of Sanger water supply. Water mains for fire protection purposes are to be sized six (6) ID or larger with standard City of Sanger hydrants located within three hundred feet (300') of all mobile home sites, measured along driveways or streets, and such water supply systems shall meet the minimum standards for fire fighting purposes as required by the State Board of Insurance. Fire hydrants will be subject to periodic inspections by the Sanger Fire Department. It shall be the responsibility of the park licensee to insure that the fire hydrants in need of immediate repair shall be required in a satisfactory manner within twenty-four (24) hours. Non -emergency repairs shall be made within fourteen (14) days upon receipt of notification. Nonemergency, for purposes of this paragraph, shall mean of a nature not impairing the actual use intended. (i) The park licensee or his/her agent shall provide an adequate system of collection "Al safe disposal of rubbish, approved by the City's Fire Marshal and sanitation department. J) The park licensee or his/her agent shall be responsible for maintaining the entire area of the park free of dry brush, leaves, limbs and weeds. (Chapter 3, Section 7M, Code of 1982) § 3.614 Responsibilities of Mobile Home Park Operator or Owner (a) The operator or owner of a mobile home park shall operate the park in compliance with this article and other applicable ordinances, and shall provide adequate supervision to maintain the park, its facilities, and equipment in a safe and sanitary condition. (b) The operator or owner of the park shall be responsible for the proper placement of each mobile home on its lot, including the security of its installation and the installation of its utility connections. (c) The operator or owner of the park shall notify all park occupants of applicable provisions of this article and inform them of their duties and responsibilities under this article. (d) The City of Sanger Building Inspector shall inspect and approve utility connections prior to authorizing City of Sanger utility services. (Chapter 3, Section 7N, Code of 1982) § 3.615 Responsibilities of Mobile Home Park Occupants (a) Each mobile home occupant shall comply with the provisions of this article and shall maintain his/her mobile home lot, facilities, and equipment in a clean and sanitary condition. (b) Porches, awnings, and other additions, when installed shall meet City of Sanger Building Code requirements. The space underneath a mobile home unit shall be skirted and shall be permitted for storage only under the following conditions: (1) Stored items shall not interfere with the underneath inspection of the mobile home. (2) The storage area shall comply with the City fire and sanitary regulations. 3-14 (c) Storage facilities with a minimum capacity of two hundred (200) cubic feet per stand may be provided on the stand, or in compounds located with one hundred feet (100') of each stand. Storage facilities shall be designed in a manner that will enhance the appearance of the park and shall be faced with masonry, porcelained steel, baked enameled street or other material equal in fire resistance, durability and appearance, or of an equal material approved by the Building Official. (Chapter 3, Section 70, Code of 1982) § 3.616 Commerce and Business Activity (a) No mobile home parked in a mobile home park shall be used to house, store, or display merchandise or equipment for sale or resale. (b) Commercial and business activity, such as coinoperated laundry and dry cleaning establishments and other like commercial operations which provide service to park occupants, may be conducted when such operations: (1) Occupy not more than a total of ten percent (10%) of the park area. (2) Are subordinate to the residential use and character of the park. (3) Are located, designed, and intended to serve the needs of persons residing in the park. (4) Present no visible evidence of their commercial character outside the mobile home unit other than a single unlighted sign not to exceed one (1) foot square attached flat against the mobile home unit. (5) Provide adequate parking to prevent blocking of streets and driveways. (Chapter 3, Section 7P, Code of 1982) § 3.617 Inspections Required (a) The Building Official, the City -County Health Director, the Fire Chief, the Fire Marshal, the Police Chief, the City Engineer, the Director of Utilities, and the Tax Assessor -Collector or their representative are hereby authorized and directed to make such inspections as are necessary to determine compliance with this article. (b) The Building Official, the City -County Health Director, the Fire Chief, the Fire Marshal, the Police Chief, the City Engineer, the Director of Utilities, and the Tax Assessor -Collector, or other City official shall have the power to enter at reasonable times upon any private or public property for the purpose of inspecting and investigating conditions relating to the enforcement of this section and for the maintenance of the utilities. (c) The Building Official, the City -County Health Director, the Fire Chief, the Fire Marshal, the Police Chief and the Tax Assessor -Collector shall have the power and authority in discharging their official duties to inspect the register containing a record of all residents of the mobile home or travel trailer park. (d) It shall be the duty of every occupant of a mobile home or travel trailer within a licensed park to give the licensee, his agent, or authorized employee access to any part of such park at reasonable times for the purpose of making such repairs or alterations as are necessary to effect compliance with this article. (e) Whenever it is determined that there are grounds to believe that there has been a violation of any provision of this article, the City Building Official shall give notice of such alleged violation to the licensee or agent, as hereinafter provided. Such notice shall: (1) Be in writing; (2) Include a statement of the reasons for its issuance; (3) Allow a reasonable time for the performance of the act it requires; (4) Be served upon the licensee or his/her agent; provided, that such notice or order shall be deemed to have been properly served upon such licensee or his/her agent when a copy thereof has been sent by mail to his last known address, or when he/she has been served with such notice by any method authorized or required by the laws of this state; and ��� �u[iutili a�� ouuinc of remedial action which, if taken will effect compliance with the provisions of this article. (f) Any person affected by the refusal of the Building Official to issue a permit under the provisions hereof, may request and shall be granted a hearing on the matter before the Board of Adjustment; provided that such person shall file within ten (10) days after the day the permit was refused, in the office of the Building Official, a written petition requesting such hearing and setting forth a brief statement of the grounds therefore. Upon receipt of such petition the Building Official shall forward it to the City Secretary who shall set a time and place for such hearing and give the petitioner written notice thereof. At such hearing the petitioner shall be given an opportunity to be heard and to show why such permit should be issued. (g) Any person affected by any notice which has been issued in connection with the enforcement of any provision of this section, by the Building Official may request and shall be granted a hearing on the matter before the Board of Adjustment, provided that such person shall file within ten (10) days after the day the notice was served, in the office of the City Secretary, a written petirion requesting such hearing and setting forth a brief statement of the grounds therefore. The filing of the request for a hearing shall operate as a stay of the notice and of the suspension. Upon receipt of such petition, the City Secretary shall set a time and place for such hearing and shall give the petitioner written notice thereof. At such hearing, the petitioner shall be given an opportunity to be heard and to show why such notice should be modified or withdrawn. (Chapter 3, Section 7Q, Code of 1982) § 3.618 Existing Mobile Home Parks (a) Mobile home parks existing on the effective date of this article in compliance with existing ordinances and the City Code are hereby declared to be legal. All applications for mobile home park permits, or plans for expansions of existing mobile home parks, submitted after the effective date of this article must comply with its provisions. (b) All mobile home parks, whether existing before or after the effective date of this article, must comply with the provisions of Section 3.608 (Renewal Fees); Section 3.609 (Transfer of Permit); Section 3.610 (Permit Transfer Fee); Section 3.714 (Responsibilities of Mobile Home Park Operator or Owner); and Section 3.615 (Responsibilities of Mobile Home Park Occupants). 3-16 �3a�4,���-� i i �-� �� �i (c) Expansion of a nonconforming mobile home park, expansion of a nonconforming use in a mobile home park, or expansion of a nonconforming use outside a mobile home park existing on the effective date of this article is prohibited. (d) Building permits will be required from the City of Sanger on all additional structures. (Chapter 3, Section 7R, Code of 1982) § 3.619 Revocation of Permit The City Council may revoke any permit to maintain and operate a mobile home park when the park owner and/or operator fails to comply with the rules and regulations of this article. (Chapter 3, Section 7S, Code of 1982) § 3.701 Definitions Recreational Vehicle.. The following shall be considered recreational vehicles: (a) Travel trailer. A vehicular, portable structure built on a chassis, designed to be used as a temporary dwelling, or to be towed behind a motor vehicle, without special permit being needed, and having an overall length of not more than thirty-five feet (35') and a width not exceeding eight (8') feet. (b) Pick up coach. A structure designed to be mounted on a truck. chassis for use as a temporary dwelling for travel, recreation, and vacation. (c) Motor home. A portable, temporary dwelling to be used for travel, recreation and vacation constructed as an integral part of a self-propelled vehicle. (d) Camnin,g trailer. A canvas, folding structure mounted on wheels and designed for travel, recreation and vacation use. Recreational Vehicle Park. A unified development under private ownership designed primarily for transient service not to exceed thirty (30) days, on which travel trailer, pickup coaches, and self-propelled motorized vehicles are parked or situated and used for the purpose of supplying to the public a parking space for such vehicles meeting all the requirements of this article. Recreational Vehicle Stand. A parcel or area of land for the placement of a single recreational vehicle and the exclusive use of its occupants and which is located in a recreational vehicle park. Permanent Re.ridentc. Any recreational vehicle which stays longer than thirty (30) continuous days in the same recreational vehicle park. (Chapter 3, Section 8A, Code of 1982) § 3.702 Recreational Vehicle Park License (a) License Re uir .d. It shall be unlawful for any person to maintain or operate, within the limits of the City, any recreational vehicle park unless such person shall first obtain a license therefor. All recreational vehicle parks in existence upon the effective date of this 00 article shall, within ninety (90) days thereafter, obtain such license and all other respects comply fully with the requirements of this article. (b) License Fee. The permit for a recreational vehicle park shall be obtained from the City Secretary at a fee as set forth in Article 8.000 of the fee schedule found in the Appendix of this Code. Such permit shall expire on December 31st of the year in which it was issued. Application for renewal of permits shall be written thirty (30) days prior to expiration, and a renewal fee for a twelve-month period thereafter. (c) Application for License. Applications for a recreational vehicle park shall be filed with the City Secretary for submission to the Planning and Zoning Commission, at least ten (10) days in advance of the meeting of said Planning and Zoning Commission at which approval is requested. Applications shall be in writing and shall contain the following information: (11 The name and arir3rec� of the annlirant (2) The location and legal description of the recreational vehicle park. (3) A complete plan of the park. (4) Plans and specifications of all buildings and other improvements constructed, or to be constructed within the recreational vehicle park. (5) Such further information as may be requested by the City, to determine if the recreational vehicle park will comply with the legal requirements. After approval of the application by the Planning and Zoning Commission, and compliance with any conditional approval or disapproval of the application by the Planning and Zoning - Commission, the Planning and Zoning Commission shall transmit the application along with the recommendations of the Planning and Zoning Commission, to the City Council for action of approval or disapproval. The City Administrator, at the direction of the City Council, shall issue the license. (d) Revocation of License. The City may revoke any license to maintain and operate a recreational vehicle park when the licensee has been found guilty by a court of competent jurisdiction of violating any provisions of this article. After such conviction, the license may be reissued if the circumstances leading to convicHnn have been remedied and the park is being maintained and operated in full compliance the law and the provisions of this article. (Chapter 3, Section 8B, Code of 1982) § 3.703 Bonding Requirements At the licensee's expense, the City Administrator shall cause each licensee of a recreational vehicle park to be bonded with a fidelity bond in the penal sum of one thousand dollars ($1,000.00). Such bond shall be in a form approved by the City Attorney, with a corporate surety licensed to do business in the State of Texas, and shall indemnify the City against the loss of any and all amounts collected by such licensee under the provisions of this section. At the time of the inspection, the site was in violation of the Commission's "Municipal Solid Waste Regulations" (MSWR). This violation was the same violation observed on November 9, 1993, the corrective action is as follows: 30 TAC 330.254(1): "Post -Closure Maintenance Requirements. (1) For a minimum of the first five years after the completion of final closure, the owner or operator shall retain the right of entry to and maintain all rights -of -way of a closed MSWLF unit or MSW site in order to conduct periodic inspections of the closed unit or site. The owner or operator shall correct, as needed, erosion of cover material, lack of vegetative growth, leachate or methane migration, and subsidence or ponding of water on the unit or site. If any of these problems occur after the end of the five -years of post -closure care maintenance, the owner or operator shall be responsible for their correction until the executive director determines that all problems have been adequately resolved. Second, came to the office to express her concern that Sanger does not operate its own Ambulance Service. As I understood Ms. Burrows, her concern was two -fold: 1). the time required for Denton Ambulance to arrive at a Sanger address, and 2). she felt the Denton Paramedics were not caring and the ambulance, Itself, provided a very rough ride. Ms. Burrows offered $100.00 of her own funds toward the goal of operating an independent Ambulance Service. She also provided a copy of her bill which I have attached for your review.
