Mayor Armstrong called the meeting to order, gave the invocation which was followed by the pledge to the flag. Z. CONSENT AGENDA: a). Approve Minutes b}. Disbursements c}. Payment #4 - All -Tex Paving, Inc. Bolivar/Tenth/Seventh - $94,719.75 Motion was made by Councilman Jenkins and seconded by Councilman Madden that all items on the Consent Agenda be approved, consider- ing item #c, that staff be given the discretion to hold payment until they feel all items have been taken care of. Motion carried. 3. Citizen's Input: None 4. Consider and Possible Action Regarding Awarding Bid For Solid Waste Services The following Solid Waste Proposals were received Monday. The contractors rate is $6.82 for twice weekly pick-up. `Recycling Options - $1.37 per household per month for curbside service. - $275 per pull for convenience center at Transfer Station City Council Minutes 11/ 15/93, page 3 *White Goads -Once per month, No charge for cemetery service *Clean Up Days - 2 30 yd. - 1 X Al additional charge free pick-up, Additional $235 per X After much discussion, motion was made by Councilman Richardson and seconded by Councilman Madden that the City Council accept the bid from Texas Waste Management which was the low bid and leave the recycling option curbside open, not to accept at this time, until the City gets some citizen input. Motion carried. 5. Consider and Possible Action Regarding Keeton/Keaton Road -Proper Spelling It was mentioned that 9-1-1 needs the correct spelling for Keeton/ Keaton Road. Motion was made by Councilman Kincaid and seconded by Councilman Madden for the City to notify the Texas Department of Public Safety that the proper spelling for Keaton/Keeton Road is KEATON ROAD. Motion carried. 6. Consider and Possible Action Regarding Nomination to DCAD Appraisal Review Board Motion was made by Councilman Richardson and seconded by Councilman Jenkins that the nominees listed below be contacted and see if one can serve and for Mayor Armstrong to appoint one as the nominee John Springer, Don Gillum, Richard Muir, Sharon Copeland, or Prentice Preston to the DCAD Appraisal Review Board. Motion carried. 7. Consider and Possible Action Regarding Grant Proposal -Marguerite Doe Foundation -Animal Control Motion was made by Councilman Jenkins and seconded by Councilman Richardson that we pursue a grant from the Marguerite Doe Foundation in regard to our animal control services. Motion carried. 8. Consider and Possible Action Regarding Appointment of City Health Officer City Council Minutes 11/ 15/93, page 4 Mayor Armstrong stated this agenda item is in reference to a memo in the packet informing Council that Dr. Bittle has closed his local practice, who is our current Health Officer. It was also mentioned that no letter has been received from him regarding his intentions; however, since he's not going to have an office open in Sanger, then it appears appropriate that the City Council needs to appoint a new Health Officer and Dr. Perry has agreed to serve if appointed. Motion was made by Councilman Kincaid and seconded by Councilman Richardson that the City Council appoint Dr. Richard Perry as the new City Health Officer. Motion carried. 9. City Administration Report City Administrator John Hamilton reported on the following items: a). The stencil kits far the Boy Scout Project from "Don't Polute" the City's Storm Water Drains have been received and the paint and supply of other safety materials are being coordinated with Mr. Doug McCowan, Assistant Scoutmaster. b}. City Offices will be closed Thursday and Friday, November 25th and 26th, in observance of the Thanksgiving Holiday. c). The engineering report and recommendations for the Roberts Subdivision will be presented to Council on December 6th by Hunter Associates. 10. Any Other Such Matters a}. Mayor Armstrong mentioned a copy of a letter she received from Frank Sturzl, Executive Director with T.M.L. was given to Council which relates to recent TML Legal Briefings referring to municipal solid waste landfills. b}. Mayor Armstrong stated she had received a letter from Galaxy which states that their business will be making changes on their charges; some citizens will notice lower rates while others will see a small increase under their restructuring plan. c). Mayor Armstrong inquired if Larry had taken care of a line that was down on lath Street which belongs to Galaxy. City Council Minutes 11/ 15/93, page 5 Electric Superintendent Larry Yoast stated that he had spoken with Galaxy and also a doorknocker was placed on the citizen's door that had complained about this problem informing them that the line would be taken care of by Galaxy. d}. Councilman Madden mentioned that he had noticed that on loth Street whenever the street was redone that it was lowered possibly about three feet. He inquired was the same going to happen on the other end of 19th Street. Mayor Armstrong stated this was done to maintain the drainage. Public Works Superintendent Chuck Tucker mentioned water was shifted from Bolivar to Wood in order to maintain proper drainage. Other streets affected were Bolivar, Willow, Wood, Oak and Austin during the street improvements. Mayor Armstrong advised that any drainage problems that develop as a result of these street improvements, the City will do its best to correct any problems. e}. City Administrator John Hamilton stated Dan Almon will be present at the December 20th meeting to discuss financing options/bonds. f). Councilman Richardson inquired about the police radios. Mayor Armstrong instructed staff to get a complete report on the police radios from Chief Erwin. g}. MEARS, P.E. i iA9L taI 4, 1 NOV 1 5 1993 ! awn Re: Proposed drainage Improvements Tributary west of IH-35 between Duck Creek and Keaton Road Sanger, Texas Dear Mr. Hamilton: During periods of heavy rainfall in recent months, the City has noted significant runoff collection and drainage problems in the above referenced tributary. The drainage area in question consists of about 200 acres, some of which is from the east side of Interstate Highway 35, No special flood hazard areas (inundated by 100-year flood) are shown on FEMA Community Panel Number 480786001B revised February 2, 1990. When considering existing drainage conditions and any proposed improvements, the following is offered as general information: To properly plan the drainage system, consideration must be given to evaluate the future development patterns which may occur upstream from the project location. A change in land use can result in a change of storm runoff, increasing volumes and times of concentration up to 200 percent in some cases. The quantity of storm water that will fall upon and run off of any given area is unknown and must be estimated. Estimates are based upon past historical experience which is recorded in the form of rainfall and stream flow records. The "Rational Method" is one of the most accepted and widely used procedures to determine storm water runoff for small to moderately sized drainage areas. Over very small areas, storms of major proportion may cause very little damage. Minor inconvenience can be expected from ponding on lawns and in the streets. The accumulated runoff from many small areas contributing to a major stream can result in a major flood creating severe damage. For this reason, channels and structures located on larger streams must be designed to pass the greatest anticipated storm flow to be expected with a tolerable amount of damage. It is physically possible to provide drainage ways to accommodate, without overflowing, any size storm that could reasonably be expected to occur; however, it is not usually economically feasible to do so. November 9, 1993 Page 2 City of Sanger The risk of flood loss must be weighed against the cost of providing flood protection. Proper zoning and restriction of building within flood plains can substantially reduce expected flood loss along major streams. When considering smaller drainage areas, the cost of providing facilities for storms of extreme proportion becomes relatively large, while the possibility of intolerable loss becomes relatively smaller. For this reason it is usual and logical that drainage structures for smaller areas are designed with lower standards of protection than those applied in the design for larger areas. In most cases, the area under consideration is somewhere in between. ���� pei=�ou cal Lime in which a storm of known proportion will probably reoccur is referred to as a storm frequency. Storms of major proportion such as 11100 year", 1150 year" or some other time period does not mean that a storm of that proportion would not reoccur within 100 years, 50 years or whatever the time period may be. Two 11100 year" storms could occur a week or a year apart or several could occur in a relatively short period, though the probability of their reoccurrence is remote. The meaning of the frequency designation for storms or floods would be better understood if expressed in terms of probability. That is, the chances are one in 100 that a storm of 100 years intensity (or greater) will occur in any given year. Similarly, the chances are one in 50 that a storm of 50 year or greater intensity will occur, or one in 25 that a storm of 25 year or greater intensity will occur. The probability is one percent (1% = 1 in 100) that a 100 year frequency storm will occur in any given year. On the other hand, the probability is 37 percent that there could be no 100 year storm in the 100 year period; or, the probability is 63 percent that there will be at least one. The procedures by which such figures as these are deduced from the study of past rainfall or stream flow records are those of statistical analysis. These procedures establish, from a study of random events which have happened in the past, the probability that similar events can be expected to happen in the future. For the design of a particular storm drainage facility, actual velocities should be estimated from known slopes of the pipe conduit, gutter, or channel. Runoff from rainfall occurs after all cracks and surface depressions of impervious areas are filled and the upper layers of exposed soil become saturated. The characteristics of the various surfaces and the degree of their imperviousness determines the ratio of runoff to rainfall which is quantified as the "Runoff Coefficient". The runoff coefficient, represented by "C" in the Rational Method formula, varies from almost total imperviousness on building roofs, parking lots and paved streets to 80 percent absorption on flat, sandy, turfed lawns. Normally, the type of land use determines the grouping for the runoff coefficient. Different soils exhibit different porosities. The absorption rate of a dense clay soil is several times less than a deep sandy soil. Dense vegetation retards runoff r November 9, 1993 City of Sanger Page 3 until it can be absorbed into the ground. Steep sloping land drains readily while flat land holds water in place. The runoff coefficient "C", is expressed as the percentage of rainfall which appears as runoff, and is defined as for the appropriate land use as follows: Commercial 0.80 Industrial 0.70 Single Family Residential 0.50 Multi -Family Residential 0.70 Park Areas 0.30 Undeveloped n,2n Except where intolerable flooding conditions are anticipated, it would be desirable, from an aesthetic standpoint to allow the streams to use their natural channels. Improvement would be limited to clearing out underbrush and sediment, minor corrective work where channel restrictions or irregularities occur, and drainage structures required at channel crossings. The scenic beauty of a properly cleared and maintained natural watercourse is I civic asset. . Unfortunately, many areas have natural channels that have become inadequate to carry the runoff from a highly developed area. These areas require storm sewer pipe, or channel modification to be built to carry the anticipated flow, depending upon the funds and Right -of -Way available. The size of these improvements is determined by the slope of the proposed improvement, the quantity of anticipated storm flow and the maximum velocity limits. The improvement or modification of the existing watercourses for the purpose of containing their flood flows within defined channel limits will permit the closer approach of urban development to the stream. This saving of land area may be accomplished as a part of the development cost where economically justified. It is suggested that all building floor levels be restricted to two feet (21) above the 100 year flood frequency. Where additional flow area in the channel must be provided to hold flood waters within acceptable limits, the natural appearance is most nearly maintained by using an unlined earthen channel, preferably sodded with flat side slopes. It is also usually more economical to use an unlined channel. The limitation on use of unlined channels is the maintenance of flow velocities in the channel low enough to prevent erosion. Low velocities require greater flow cross -sectional area, with resultant wider drainage easement of Right -of -Way to accommodate the larger channel. Velocities above about eight feet (81) per second should not be permitted in unlined sections. Where the natural channel gradients are steep enough to produce greater velocities, an unlined channel November 9, 1993 Page 4 City of Sanger may be constructed with flatter slopes in successive "stair step" reaches, if some means of dissipating energy differential between the upper and lower reach is provided. Varying channel widths and configurations or holding ponds can also be utilized. It is recommended for unlined channel improvements that a flat bottom with 3:1 side slopes be considered. This slope is sufficiently flat to permit the use of mowing equipment for maintenance. The unlined channels with a bottom width greater than 30 feet should have a lined low flow section to control the flow that continues during low runoff periods. Design controls have to be provided to control erosion along and near the low flow sections. Concrete lining of the channel section provides better hydraulic efficiency because of the smooth surfaces and the protection afforded permits side slopes to be steeper, further increasing hydraulic efficiency of the section. Lining, therefore, both permits and produces higher flow velocities than occur in an unlined channel on the same slope. Velocities can be still further increased with a lined channel by taking full advantage of the available channel gradient, eliminating drop structures. The effect of increased velocities is to reduce the required flow area, Right -of -Way requirement, and excavation, with consequent reduction of quantities. These savings will generally be more than offset by the cost of lining. Lined channels are recommended in many of the developed areas where sufficient Right -of -Way cannot be obtained for unlined channels. These channels are recommended to have 2:1 side slopes. Drainage Right -of -Way widths for all channels must be adequate to allow maintenance equipment to enter and travel along the easement. One or more of several different factors can contribute to drainage problems in the area herein under consideration: 1) size of existing channel, 2) condition of existing channel including slope, silt, blockages and vegetation "roughness", 3) existing drainage structure at Keaton Road; 4) lot grading and finished floor elevations on nearby property. In the past, the drainage channel and structure have functioned reasonably even for large rainfall amounts. However, during periods of high intensity/short duration rainfall, the runoff has been slowed or detained by the low channel velocities. Cleaning and grading the channel north of Keaton Road would provide the most economic relief of runoff problems in the area. The City could provide labor in cooperation with county crews and/or equipment (drag line, etc.). In particular, the channel area near November 9, 1993 City of Sanger Page 5 Brook Glen Drive and Fairfield Circle has little or no hydraulic definition or capacity. Moving downstream, the channel becomes Larger, but is filled with silt and large vegetation which inhibits flow. If contracted, appropriate clearing and grading for the channel would cost around $15-$30 per linear foot with the total cost depending upon the distance improved. The existing drainage structures at Keaton Road (three 48" RCP) are inadequate for periods of high runoff flows. The replacement of these structures were recently bid for a 3 x (5' x 51) concrete box culvert (alt. four 60" RCP). The construction amounts in either alternative would be around $30,000. The open lot south of Brook Glen Drive slopes such that creek overflow will drain directly toward several homes at the east end of the block. Regrading and fill at critical locations in this area could alleviate local flooding when channel flow tops existing or proposed banks. A check of the tributary should be made at the entrance to Clear Creek for beaver dams and other blockages which are very common and can cause significant problems in undersized channels. Any modifications to existing water courses should be approved by the appropriate agencies including the Federal Emergency Management Agency. Some alignment improvements could be made to the channel; however, the cost and liability of such alterations would probably not be justified by enough benefits. In summary, the following courses of action can be taken to improve drainage in the subject area: 1. Check tributary for blockages at Clear Creek and any upstream locations (Cost: minimal). 2. Grade open lot south of Brook Glen Drive (Cost: minimal). 3. Clear and grade channel north of Keaton Road to Fairfield Circle (Cost: minimal to significant). 4. Replace drainage structure at Keaton Road (Cost: significant). Note: Though cost significant, this improvement is recommended. 5. Concrete line critical portions of the channel to increase capacity (Cost: prohibitive). November 9, 1993 City of Sanger 6. Approve all plats/lot grading plans with relation to local drainage patterns and prohibit development which increases downstream flow rates from high runoff coefficients (Cost: minimal). I would expect someone from TWM to be present, especially if they have any concerns with the documents. One passible change that TWM may request is an Annual Consumer Price Index adjustment on the basic rates. This seems to be the industry norm. Our contract, on page 1, 2 (c) requires TWM to specifically request rate adjustments on July 15 prior to Council's Annual review in December. This would allow consideration of rates during budget review and allow Council to consider new rate scales effective in January of each year for the five (5) year term of the contract. JH:es Enclosures 000022 CONTRACT FOR SERVICES THIS AGREEMENT made this day of by and between Texas Waste Management, a division of Waste Management of Texas, Inc., a Texas Corporation ("Contractor") and THE CITY OF SANGER, TEXAS ("City"). T4ITNESSETH WHEREAS, the Contractor is engaged in the business of providing commercial and residential solid waste removal, and WHEREAS, the City desires to have the Contractor perform such solid waste removal services to the residents and businesses within its legal boundaries; NOW THEREFORE, in consideration of the mutual covenants, agreements and considerations herein contained, the City and the Contractor hereby agree as follows: 1. Exclusive Right. The City hereby grants to the Contractor the exclusive right and obligation to provide solid waste collection services within the City's legal boundaries as they exist as of the date hereof and as may be extended during the term of this agreement. 2. Term. A. The term of this Agreement shall be for a period of five (5) years commencing on January 2, 1994, and terminating on December 31, 1998, subject to prior termination as described in Paragraphs 2 (B) below and subject to annual review as provided in Paragraph 2 (C) below. B. Notwithstanding the provisions in Paragraph 2 (A) above, either party may terminate this Agreement, during the term hereof, after giving ninety (90) days written notice to the other party; provided, such early termination shall not relieve either party of its obligations hereunder that have accrued prior to the effective date of such termination. C. The provisions of Paragraph 5 below shall be reviewed annually by the City in December and may be changed upon the mutual agreement of both parties. Any requested increases by Contractor shall be presented to the Sanger City Council by the July 15 prior to December review. 3. Covenants of Contractor. agrees to the following: CONTRACT FOR SERVICES -- Page 1 The Contractor covenants and A. Residential Collection. Residential collection shall be twice weekly on Monday and Thursday of each week except for Christmas Day and other holidays as authorized by the Sanger City Council. Hours of collection shall commence not earlier than 8:00 a.m., and conclude not later than 4:00 p.m. on each collection day. Contractor shall be required to pick-up only solid waste that is in plastic bags (not to exceed 30 gallons), acceptable containers or bundles (not to exceed 40 pounds and 3 feet in length each), or such other containers as may be approved by the Sanger City Council. B. Commercial Collection. Commercial collection including multiple dwellings of four (4) or more units and all businesses (commercial and/or industrial establishments) are to be serviced on an "As -Needed" basis. Hand pick-up customers shall use a 30 gallon container. The hours of collection for commercial services shall commence not prior to 6:00 a.m. and conclude not later than 9:00 p.m. on each Monday and Thursday, except for Christmas Day and other holidays as authorized by the Sanger City Council. Apartments and/or multi -family residences will be collected between 8:00 a.m. and 9:00 p.m. on each collection day. The Contractor will place in the City, at no cost to the City for placement or collection pull, 10 gallon receptacles for trash collection at all parks within the City and in the downtown area. In addition, the Contractor will provide temporary placement of trash containers for special events sponsored by the City and located within the City upon the request of the Sanger City Council. Further, Contractor will provide two 30 yard roll -off containers in both Spring & Fall, to be pulled one time each at no charge to the City for Annual clean up. Additional collection pulls will cost $235.00 each. Also, Contractor will provide one 3 yard container for the Sanger Cemetery at no cost to the City. C. Compliance with Laws. All solid waste collected by the Contractor will be disposed of in a landfill other than that owned or operated by the City. The Contractor will comply with all applicable State and Federal laws regarding collection and transportation of solid waste material. D. Due Care. The Contractor shall exercise due care and caution to protect and preserve public and private property including City streets and parking areas while performing its obligations hereunder. Vehicles used by the Contractor in performing its residential services hereunder shall not zigzag from one side of the street to the other. E. Franchise Fee. The Contractor will pay monthly to the City a Franchise Fee of Six Percent (60) of its monthly gross CONTRACT FOR SERVICES -- Page 2 receipts for its residential and commercial collections. This Franchise Fee represents a charge for use of the City's streets. F. Liability Insurance. The Contractor shall maintain general liability insurance in the amount of $3,000,000.00 in the aggregate; provided, however, that the amount may be raised if the City is required to raise its liability coverage above amounts presently required by Federal or State laws. The City shall be named as an additional insured on such policy and such policy will contain a provision that the insurer will not cancel the policy without giving the City thirty (30) days' written notice. G. Recyclincx. Contractor will provide a container and hauling services for a recycle drop off center for aluminum and newspaper at a site to be determined by City. Such site shall be secured and staffed to prevent contamination as determined solely by City. Back charges for contamination will be paid by City. H. Indemnification. The Contractor shall indemnify and hold harmless the City and its agents against any and all claims, including attorney fees, relating to injury to persons, property, employees or anyone else under the control of the Contractor whose performance or failure to perform causes a claim to be made against the City. I. General Conditions. a. The Contractor shall not deny employment to any person for reasons of race, creed, national origin or religion, or any other reason in violation of State or Federal Law. Each employee of the Contractor shall at all times carry a valid Texas Operator's Driver's License applicable to the type of vehicle that such employee is operating. b. Wages of all employees of the Contractor will equal or exceed the minimum wage requirements as established by local, state and federal agencies. In addition, the Contractor shall comply with the provisions of the Fair Labor Standards Acts. c. The Contractor shall not litter any residential or commercial dwelling in the process of performing its services hereunder; provided, however, that the Contractor shall not be required to collect any solid waste material that has not been placed in plastic trash bags, approved containers, or is bundled (as described above). In the event of spillage by the Contractor, the Contractor shall properly clean up any and all litter. d. Hazardous waste, body waste, dead animals, abandoned vehicles, vehicles parked, large equipment and parts thereto will not be required to be collected by the Contractor, unless the Contractor agrees to collect such items. The Contractor shall have on hand at all times in good working order, such equipment that shall permit the Contractor to adequately and efficiently perform its duties hereunder. Solid waste collection equipment shall be of the enclosed load packer type and all equipment shall be kept in good repair and appearance and in a sanitary, clean and run ready condition at all times. The Contractor shall have available to it at all times reserve equipment which can be put into service and operation in case of any breakdown of its equipment. f. The Contractor shall have vested title to all solid waste materials generated within the Municipal Area of the City. 4. Covenants of the City. The City covenants and agrees as follows: A. To remit all amounts due to the Contractor by the tenth (loth) day of each month commencing in the month of February, 1994. B. Provide the Contractor with confirmation of the residential and commercial customers on a monthly basis. C. To collect all state and local taxes due on the services provided by the Contractor hereunder and to remit all such amounts due to the appropriate authorities. D. To grant to the Contractor the right to pursue any cause of action the Contractor may have against any third party for interfering with the Contractor's exclusive right and obligation to provide solid waste collection services hereunder. In granting such rights, the Contractor shall be entitled to pursue its remedies without notice to the City. 5. Payment for Services Rendered. Please remember that in 1992 recommendations were given to city officials by Mr. Jim Dillard, TPWD Wildlife Biologist in regards to this same situation. Very little was done to satisfy these recommendations, and consequently the birds have returned to the same site again this year. My recommendations will follow closely those previously presented by Mr. Dillard. This particular nuisance heronry is located in a small block of upland woods of approximately 25 acres in size. The vegetation of this woodland heronry consists of an overstory of' primarily sugar hackberry, along with cedar elm and honey locust trees. The understory is made up of several shrub species indigenous to the Eastern Cross Timbers physiographic region. The estimated size of this heronry is approximately 750-1250 birds. Bird species composition of this particular heronry is primarily cattle egrets, however little blue herons, snowy egrets and black -crowned night -herons have been observed in association with this heronry. 'There are approximately 12 houses located in this area which are currently effected by this heronry. It must be noted that the above -mentioned specks of birds are protected under both state and federal laws. Federal regulations pertaining to management of nuisance heronries are specified in 'Title 50 of the Code of Federal Regulations. These birds also are protected by Chapter 64, Texas Parks and Wildlife Code from being killed, possessed, commercialized or disturbed at breeding sites. Mr. John Hamilton Page 2 July 19, 1993 At the present time, there are only two methods of preventing herons and egrets from establishing or reusing an established heronry that I am able to recommend to you. The first involves using scaring methods to try and deter the birds from using a particular site. This type of method includes the use of disturbing noises, colored streamers in trees or on tall poles, bright lights at night, smoke, water sprays, tethered balloons and display of hawk silhouettes. These types of scaring devices can be extremely effective if used when the birds first arrive at the heronry site during the spring months. At that time, they are very nervous and easily disturbed. My second recommendation in dealing with this problem involves trimming, thinning or clearing nest -site vegetation during the winter months before the birds return to breed. Since this particular site is densely vegetated, I feel that you can make this site unattractive to the birds by thinning the vegetation to provide spaces between trees and by the removal of understory vegetation. You have expressed your concerns in that you do not want to remove all the trees from this location. I do not recommend that you remove all of the trees. Dramatic changes are usually not necessary and I feel that with proper thinning and limited clearing of the trees you will be able to accomplish your objectives. Such changes to this particular element of the habitat in a heronry will usually produce longer lasting prevention than other methods. Please remember that once the birds establish themselves in a heronry and begin breeding activities you will have to cease both scaring and vegetation -control methods. Also keep in mind that even if you are successful in detering these birds from their current location, they might well establish themselves in another undesirable location and you will still be faced with the same problems. I hope that these recommendations will be of help to you in dealing with this particular nuisance heronry. Now, subject to the exceptions discussed below, the rate freeze expires on February 15, 1994, instead of November 15, 1993. The FCC noted in its order that it was extending the freeze in order to give more franchising authorities the opportunity to become certified to regulate the basic service tier rates. However, if you have already filed your Form 328 with the FCC and you have adopted your regulatory ordinance, then the freeze extension does not apply to your cable operator. The operator must file its Form 393 with the city within 30 days after being notified by the city that it has regulatory authority over the basic service rates. If the basic service tier of your cable operator has become subject to your jurisdiction, the freeze extension also does not apply to the rates charged for the cable programming service tier. I have spoken with Debra Drayovitch, City Attorney for the City of Denton, regarding the pending lawsuit against the City of Denton involving pepper mace. She states that two other suits are pending in Texas that she is aware of. Each deal with claims resulting from the lasting effects of the O.C., one resulted in death. Based upon your information to me that each officer will be trained in th.e use of the projector and the situations justifying the projector's use and a policy outlining both, I believe the City has in place all measures available at this time to safeguard it against liability. However, reactions to the spray cannot be anticipated, if disability or death results from O.C.'s use, even though unforeseen or anticipated, the City may be held responsible. As usual, because pepper mace is relatively new to the legal world, it is not possible to safeguard the City against being named as a potential Defendant in any action involving any use of the formula. In safeguarding the City against suits, Dallas' information provides a good standard to use for when O.C.'s use is appropriate. Verbal threats of violence by a suspect do not alone justify the use of chemical agents. Any threat must be a credible one, which would cause officers to reasonably believe that it would be unsafe to approach and control the suspect. On August 7, 1993, friends and family of plaintiff Paulette Griffin hosted a party for her at the home of plaintiffs Avery and Lisa Williams, to celebrate Ms. Griffin's departure for her first year of college. All plaintiffs attended the party. 10. DuflnQ the party. defendant Officer Juan Cabrales walked unannounced into the Williams home and issued Avery Williams a warning citation, purportedly for noise generated by the party. Mr. Williams then directed the party disc jockey to turn down the volume of the music. 11. Approximately two hours later, Officer Cabrales returned with Officer Gary Moors. The two men informed Avery Williams they would issue him a citation as a result of the noise. Ms. Williams told the officers the music had been turned down, and she had checked with all the neighbors to insure the party was not disturbing them. Officer Cabrales indicated the citation would issue anyway. Officer Moors accompanied Avery Williams into the house to issue the citation. 12. Officer Cabrales then approached the disc jockey and told him to turn off the music, because the police were closing the party. Cabrales then pointed his flashlight at one of the partygoers, Charles Brown, and asked the young man what was in his cup. Cabrales asked to see the Brown's identification. At that point, several other officers appeared on the scene. 13. Brown asked another person to hold his cup while he showed the officers some identification. Cabrales yanked the cup out of Brown's hand, spilling liquid all over Ms. Williams in the process. As Brown reached into his pocket, the officers sprayed the crowd with mace or some similar substance. They then threw Brown to the ground, handcuffed him, and arrested him. COMPLAINT -- PAGE 3 14. Neither Brown nor any aother partygoer ever gave the officers any cause to fear for their safety or any legitimate reason to use the mace. 15. All plaintiffs inhaled the mace and were harmed by it. Some of thVI were forced to seek emergency medical care as a result of inhaling the mace. 16. As certain of the partygoers left the Williams home, some of them choking on the mace, Officer Moors stood across the street, pointing at them and laughing. Claims 17. Defendants Juan Cabrales, Gary Moors, and other Denton police officers, having caused the violation of plaintiffs' rights, are jointly and severally liable to plaintiffs under 42 U.S.C. § 1983 and the United States Constitution. These known and unknown police officers were acting throughout this episode as agents of the Denton Police Department and the City of Denton under color of state law. 18. As a direct and proximate result of these illegal and malicious acts by Cabrales, Moors, and unknown officers, plaintiffs suffered deprivation of their rights under law, including the Fifth, Eighth, and Fourteenth Amendments to the United States Constitution, and 42 U.S.C. § 1983. 19. The acts and conduct of Cabrales, Moors, and other unknown officers constitute assault and battery, intentional infliction of emotional distress, and gross negligence under Texas law, and this Court has pendent jurisdiction over those claims. 20. Defendant Michael Jez is the policymaker responsible for developing, promulgating, and enforcing orders, rules, instructions, regulations, and policies governing the conduct of Denton police officers and officials. Defendant Jez is also responsible for supervising the training, instruction, discipline, control, and conduct of defendants Cabrales and Moors. COMPLAINT -- PAGE 4 21. Defendant Michael Jez failed to develop, promulgate, and enforce policies governing the use of force and mace consistent with the constitution and laws of the United States and Texas sufficient to protect the safety of Denton citizens. This failure amounts to gross negligence and a deliberate indifference to the safety of Denton czens, and was a proximate cause of the violation of plaintiffs' rights, and of plaintiffs' damages. 22. Defendant Michael Jez failed to train and supervise adequately Cabrales and Moors. This failure amounts to gross negligence and a deliberate indifference to the safety of Denton citizens, and was a proximate cause of the violation of plaintiffs' rights, and of plaintiffs' damages. 23. The Denton Police Department and the City of Denton failed to provide proper training and supervision to Denton police officers regarding the use of force and mace. This failure amounts to gross negligence and a deliberate indifference to the safety of Denton citizens, and way a proximate cause of the violation of plaintiffs' rights and plaintiffs' damages. 24. As the direct and proximate result of defendants' actions, plaintiffs each suffered humiliation, physical pain, and mental anguish. 25. As the direct and proximate result of defendants' action, certain plaintiffs -- including Lisa Williams, Troy Rogers, and 011ie Mae McCullough -- incurred reasonable and necessary medical expenses. 26. Officers Cabrales and Moors, and other officers as yet unknown to plaintiffs, knew or should have known that their actions violated clearly established federal and state constitutional rights. 27. T�XA TO: Members of the TML Board of Direct�o'rs ;}—�'"�� FROM; Frank J: Stttrzl; Executive Director �/�,u.G�_�ij!'�%�"� SUBJECT: Recent Action of the Texas Natural Resource Conservation Commission (TNRCC) At its November 3 meeting, the TML Board discussed a legal brief recently filed by TML with the TNRCC relating to an application for a landfill in Denton County. The Board unanimously voted to continue the League's opposition to landfill siting restrictions, even during permit hearings in which cities protest the permit. The Board also voted unammously not to withdraw and refute the TML brief in the Denton County case, and essentially over -rode the objections of Mayor Yvonne Jenkins of the City of Argyle, one of the protesting cities in the Denton County case. (The last attachment to this memo is a copy of my November 10 memo summarizing the issues and the case.) On November 18, the TNRCC Commissioners rejected the hearing examiner's recommendation that the permit be denied because of the landfills presumed, negative effect on the value of surrounding properties. In essence, the Commission accepted TML's argument that the "land value" criterion is inappropriate and not authorized by statute or regulation. The Commission remanded the case back to the hearing examiner for a further analysis of potential groundwater pollutiozi, air traffic safety, and land use compatibility. These are criteria which are authorized by statute or regulation. The Commission will next consider the application in March 1994. In summary, TML was successful in its efforts to convince the Commission that landfill siting should not be restricted for reasons not clearly authorized by law or regulation. For the League, then, this particular application is probably no longer an issue. Ultimately, the permit may be denied or granted, but whatever the outcome, it will be based on legitimate reasons. The best estimate available at this time is: $1,272 per month Estimate $882 per month The current revenue is based on a 7% of gross receipts franchise fee plus a $.28 per month premium on all residential customers. The estimated revenue is based on a 6% of gross receipts franchise fee. Both figures make no allowance for growth. If this assumption is correct, the City will realize an estimated loss of revenue of ",510 for the remaining nine (9) months of the fiscal year.
