You state that this will be a short- term loan with all principal and interest to be paid shortly after the beginning of the next fiscal year. As I understand the transaction, this would, in essence, be an unsecured promissory note to the bank, with the proceeds to be used for municipal streets or facilities. In my opinion, the City is authorized to borrow such funds under the authority of Section 51.035 and Section 101.005 of the Local Government Code. These statutes provide that the governing body of a city such as Sanger may borrow money based upon its own credit. In the event a longer term payout is required, you may want to consider other financing methods. At this time, however, the City Council will only need to pass a borrowing resolution stating the amount and purpose for which the proceeds will be used. WHEREAS, the City of Sanger needs to provide for the immediate renovation of Acker Street, Elm Street and Pecan Street to improve traffic safety and accessibility to Sanger High School, and WHEREAS, upon advice of the Consulting City Attorney, Section 51.035 and Cprt;nr, 101 OO.q of the T.nrnl Government Code provide that the governing body of a city such as Sanger may borrow money based upon its own credit, and WHEREAS, GNB-Sanger, the City's depository, has agreed to finance up to $175,000 of this street improvement project based on GNB prime A nterest rate plus one (currently 6.5% + 1 = 7.5%) due on March 1, 1993, as a portion of the $218,000 project cast, NOW, THEREFORE, BE IT RESOLVED By the City Council of the City of Sanger, Denton County, Texas. 1). As it appears in the draft copy of the code of ordinances, it differs only in that it has been reprinted such that the format is the same as that of the entire code of ordinances. Probably the best course of action would be to have the code adopted with the zoning ordinance as it is now. In the future, the changes as indicated in the enclosed ordinance can be made. GSA will then include the amended zoning ordinance in the first supplement to the code at no charge. Again, this suggestion is made in the interest of getting the code adopted as soon as possible. (14) Section 37.3 regarding the powers and duties of the Zoning Board of Adjustment at Subsection 3a(ii) is revised to read as follows: "(a) The Board shall have the power to authorize upon appeal in specific cases such variance from the terms of this ordinance as will not be contrary to the public interest where, owing to special conditions, a literal enforcement of the provisions of this ordinance will result in unnecessary hardship and so that the spirit of this ordinance shall be observed and substantial justice done. In executing its power to grant such variances, the Board may: (ii) permit a variance where a strict application of the terms of this zoning ordinance relating to the construction or alterations of buildings or structures will impose upon him or her unusual and practical difficulties or particular hardship, provided the Board is satisfied that a granting of such variation will not merely serve as a convenience to the applicant, but will alleviate some demonstrable and unusual hardship or difficulty so great as to warrant a variance from the standards or regulations established by this ordinance and at the same time, the surrounding property will be properly protected. Financial hardship alone shall not be considered grounds for the issuance of a variance." (15) Section 27.3 regarding the powers and duties of the Zoning Board of Adjustment is revised to include Subsection 5 reading as follows: "5. Termination of nonconforming uses and structures.: Upon requests by city council or upon its own initiative, the Board of Adjustment may establish a termination date for a nonconforming use. Such termination date shall provide that the owner's actual investment in the structure made legally prior to the use became nonconforming can be amortized within a definite time period. In connection with establishing a reasonable time period, the ' . Board may consider the amount of investment realized to date, the amount remaining, if any, to be recovered during the amortization period, the life expectancy of the investment, the existence or nonexistence of lease obligations, removal costs directly attributable to the establishment of a termination date, and other costs and expenses directly attributable to the establishment of a termination date. Nonconformity as to parking shall not be subject to termination under this section. The procedure for termination of a nonconforming use shall be as established by the rules and regulations of the Board and shall include procedures for the giving of notice, the holding of a public hearing, and the rendition and transmittal of a decision to the property owner." (16) Section 37.3 regarding the powers and duties of the Zoning Board of Adjustment is revised to include Subsection 6 reading as follows: "6. En1�rQement or modification of nonconforming uses: The Board shall have the authority to permit the enlargement or modification of a nonconforming use or structure as provided in Section 35, and the procedure for such request shall be as established by the rules and regulations of the Board." (17) Sectionregarding the powers and duties of the Zoning Board of Adjustment is revised to include Subsection 7 reading as follows: "7. Reconstruction of nonconforming structures and reconstruction of structures housing_ nonconforming uses: The Board shall have the authority to permit the reconstruction of partially destroyed nonconforming structures or to permit the reconstruction of partially destroyed structures housing a nonconforming use as provided in Section 35, and such procedure for such request shall be as established by the rules and regulations of the Board." The City of Sanger would like to contract with the City of Denton to receive emergency medical ser- vices for its citizens. Pursuant to Chapter 774 of the Health and 5afet�r Code (Vernon Supp. 1991) and the Interlocal Cooperation Act [TEX. REV. CIV. STAT. ANN. Art. 4413 (32c)], a city may contract to provide emergency medical services to the county or another city. Agreement This Agreement is made on the day of , 199_, between the City of Denton, Texas (Denton), and The City of Sanger (Sanger) . The parties agree as follows: 1. Definitions. Emergency Medical Services or E.M.S. means personnel and ground transportation vehicles used to respond to an individual's perceived need for immediate medical care and to pre- vent death or aggravation of physiological or psychological illness or injury. 2. Denton to Provide EMS to Sanger. Denton shall provide emer- gency medical services to Sanger in response to requests for emer- gency medical services in accordance with this Agreement. All re- quests for emergency medical services for persons residing in the corporate limits of Sanger shall be communicated to Denton in the manner specified by Denton. 3. Discretion in Providing E.M.B: Sanger understands that Denton must also respond to requests for emergency medical services for persons in Denton and that Denton has other contracts to pro- vide emergency medical services to other entities. Denton shall have the sole right and discretion, without being in breach of this Agreement and without liability to Sanger, to determine: (a) Whether or not to respond to a request for medical emergency service; (b) Whether and when personnel or equipment are available to respond to a request for emergency medical service; (c) The order is which to respond to a request for emergen- cy medical service; and � < r� (d) The time in which to respond to a request for emergency ���� medical service. 4. service Fee. In consideration for providing emergency medi- cal services to Sanger, Sanger agrees to pay to Denton an annual sum during each year of this Agreement determined by multiplying the population in Sanger by Two Dollars and Seventy -Five Cents (population x $2.75). The population figure used shall be that contained in the latest edition of the North Central Texas Council of Government's Regional Directory. The annual payment shall be paid to Denton in equal quarterly payments on or before October 1, January 1, April 1, and July 1, of each annual term. Denton may, after giving prior notice, suspend service to Sanger during any period of time Sanger is delinquent in the payment of any undisput- ed service fee. 5. Patient Charges. In addition to the service. fee paid by Sanger, Denton may charge and col"lect from persons provided emer- gency medical services, the patient fees established by ordinance of Denton. 6. Governmental Immunity Not Waived. Neither Denton or Sanger waives, nor shall be deemed hereby to waive, any immunity or de- fense that would otherwise be available to it against claims made or arising from any act or omission resulting from this Agreement. 7. Term. The term of this Agreement shall be in one year increments, beginning on October 1, 1992 and continuing to September 30 of the following year and thereafter from year to year until terminated in accordance with this Agreement. 8. Termination; Default. Either party may terminate this Agreement at any time without cause by giving ninety (90) days ad- vance notice in writing to the other, specifying the date of termi- nation. If either party breaches a provision of this Agreement, the other party shall give the defaulting party written notice of the default. Should the defaulting party fail to correct the de- fault within thirty days of the date notice of default is sent, the other party may declare the Agreement terminated. As you can see, public water supply (PWS) systems are required to pay for extensive and very expensive testing unless they can receive sampling waivers from the State. Without waivers, the testing can cost between $7,500 and $10,000 for each sampling point in your system. In an attempt to grant as many sampling waivers as possible, we are compiling and analyzing information on all public water supply wells in Texas. We are therefore requesting that you provide us with information regarding your PWS wells. This information will be used to determine if your wells are vulnerable to contamination by the chemicals which will be monitored in Phase II. To improve the chance that your provide us with legible copies of your PWS wells: system will receive waivers, please of the following documents for each 1. A State Well Report/Well Schedule completed by the driller at the time of well construction. If this form cannot be located, please provide us with detailed information on well construction and material setting. In either case, indicate any changes in well construction which have taken place since the well was drilled. 2. A geological log of sediment or rock types encountered during the drilling of the well. If this log is on the State Well Report/Schedule, no further documents are required. Copies of any additional geological or geophysical well logs will help in the waiver evaluation. 3. Reminder of July 24 Project Submittal Deadline Enclosed is an invitation to a public meeting to be held on preparation of the Project Development Plan (PDP) and the Transportation Improvement Program (TIP). This meeting is being conducted jointly by the Texas Department of Transportation (TxDOT) and the NCTCOG Regional Transportation Council. As a result of the Intermodal Surface Transportation Efficiency Act of 1991, NCTCOG as the Metropolitan Planning Organization (MPO) for the Dallas -Fort Worth, Denton, and Lewisville areas, is responsible for developing the Transportation Improvement Program with the assistance of TxDOT and the transportation authorities. The Regional Transportation Council is the transportation policy committee for the MPO. TxDOT has responsibility for the Project Development Plan in cooperation with the Regional Transportation Council. The intent of this meeting is to allow public input into the PDP and TIP preparation process. The process for development of these documents will be explained, and public comments will be requested. It would be appreciated if you would also forward this invitation to groups (e.g., neighborhood associations, chambers of commerce) within your jurisdictions whom you feel may have an interest in attending.
