Parks and Wildlife Department is nearing finalization. approval.Corps agreed to the twenty year lease term and has forwarded the agreement and to Texas Parks and Wildlife Department for c). On January 26, 1992, all municipality governments become subject to the new accommodation of the disabled American Disability Act. Our crews are working to demonstrate our good faith effort to accommodate all our citizens with free access to all our public facilities. #JJa0A I + $ Cfty Manager also stated that ramps will be made for the two doors at City Hall and also at the main entrance at Police Station and remodel all restroom facilities at all public buildings and sidewalk work across the way and access ramp at Community Center. d). Beautification Board has set Spring Cleanup for Aprii 4, 1992. Mayor Armstrong wanted to know if the company that has the City contract picking up the recyclables, if they are picking up as they are supposed to be regarding the recyclable items. City Manager advised that they are picking up as noted in contract. e). City Manager stated that the City ended the year with a 26.5% increase in sales tax. 9. Clther Such Matters: a). A copy of the audit has been enclosed for your review. Also, Mr. Spore has proposed preparing our 1991/ 1992 FY Audit for a total of $40750. This would include the audit that will be required on our swimming pool grant. We will audit the general purpose financial statements of the City of Sanger as of and for the year ended September 30, 1992. Our audit will be made in accordance with generally accepted auditing standards and will include such tests of the accounting records and other procedures we consider necessary to enable us to express an unqualified opinion that your financial statements are fairly presented, in all material respects, in accordance with generally accepted accounting principles applied consistently. If our opinion is other that unqualified, we will fully discuss the reasons with you. Our procedures will include tests of documentary evidence supporting the transactions recorded in the accounts and direct confirmation with selected customers, creditors and banks. At the conclusion of our examination, we will request certain written representations from you about the financial statements and related matters. An audit is based primarily on the selective testing of accounting records and related data; therefore, our audit will involve judgement about the number of transactions to be examined and the areas to be tested, Also, we will plan and perform the audit to obtain reasonable assurance about whether the financial statements are free of material misstatement. WHEREAS, COUNTY is a duly organized political subdivision of of Texas engaged in the administration of County Gov - the State ernment and related services for the benefit of the citizens of Denton County; and WHEREAS, AGENCY is a municipal corporation or incorporated volunteer fire department, duly organized and operating under the laws of the State of Texas and is engaged in the provision of fire protection service and related services for the benefit of the citizens of Denton County; and WHEREAS, AGENCY is the owner and operator of certain fire protection vehicles and other equipment designed for the extin- guishing of fire and prevention of damage to property and injury to persons from fire and has in its employ trained personnel whose duties are related to the use of such vehicles and equipment; and WHEREAS, COUNTY and AGENCY mutually desire to be subject to INTERLOCAL NTRE AGREEMENT SANGER01 .,, % the provisions of TEX. REV. CIV. STAT. Art 4413 (32c), the Interlocal Cooperation Act and Sections 352,001 and 352.004 Local Government Code and contract pursuant thereto; NOW, THEREFORE, COUNTY AND AGENCY, for the mutual consideration hereinafter stated, agree as follows: I. The effective date of this agreement shall be the 1st day of October, 1991. II. Services to be referred hereunder by AGENCY are fire protec- tion services normally rendered within the AGENCY Fire Department, as hereinafter defined, to citizens of COUNTY, to wit: A. Availability and provision of emergency fire prevention, extinguishment, safety and rescue services within the agreed or specified territory or jurisdiction of the AGENCY Fire Department; said services to be rendered as described herein by said Department in all unincorporated areas within the above referenced operating territory or jurisdiction of such Department, the referenced services as set out herein are rendered by said Department in consideration of the basic funding referenced elsewhere herein and the per -call fee set out elsewhere herein, for the common good and benefit and to serve the public,convenience and necessity of the citizens of Denton County who are not otherwise protected with respect to fire prevention, extinguishment, safety, and rescue services. INTERI.00AL FIRE AGRF.F.MENT BANGER B. The AGENCY Fire Department shall respond to requests for fire protection services made within the rural areas of COUNTY as set out in Exhibit "A" for the enumerated fire protection services. C. The COUNTY agrees that in the event a fire in the desig- Hated area of the AGENCY is considered to be of incendiary nature by the AGENCY and upon request by the AGENCY, the County Sheriff• will dispatch investigation personnel to the fire scene within a response time sufficient to legally maintain and protect all evidence of said fire and will conduct all appropriate investiga- tion and prosecution of arsonists. D. It is further agreed that the AGENCY shall not be re- sponsible for investigations of suspected incendiary fires in rural area, but shall be expected to cooperate with the County Sheriff in - immediately relating all pertinent information possible to the investigatorns). E. It is recognized that the officers and employees of AGENCY'S Fire Department have duties and responsibilities which include the rendition of fire protection services, and it shall be the responsibility and within the sole discretion of the officers and employees of said Fire Department to determine priorities in the dispatching and use of such equipment and personnel, and the I udgment of any such officer or, employee as to any such matter shall be the final determination. INTERIACAL 17RE AGREEMIsNT SANGT1t The COUNTY shall designate the County Judge to act on behalf of COUNTY, and to serve as "Liaison Officer" between COUNTY and AGENCY. The County Judge or his designated substitute shall insure the performance of all duties and obligations of COUNTY herein stated, and, shall devote sufficient time and attention to the, execution of said duties on behalf of COUNTY in full compliance with the terms and conditions of this agreement; and, shall provide immediate and direct supervision of COUNTY'S employees, agents, contractors, sub -contractors, and/or laborers, if any; in the furtherance of the purposes, terms, and conditions of this Agreement for the mutual benefit of COUNTY and AGENCY. IV. AGENCY shall insure the performance of all duties and obli- gations of AGENCY as herein stated; and, shall devote sufficient time and attention to the execution of said duties on behalf of AGENCY in full compliance with the terms and conditions of this agreement; and, shall provide immediate and direct supervision of the AGENCY employees, agents, contractors, sub -contractors, and/or laborers, if any, in the furtherance of the purposes, terms, and conditions of this Agreement for the mutual benefit of AGENCY and COUNTY. For the services hereinabove stated, COUNTY agrees to pay to AGENCY for the full performance of this agreement, the sum of INTF.RLOCAL FIRE AGREEPKE.NT SANGER 4 FIVE THOUSAND ($51000.00) DOLLARS upon execution of this agreement and the sum of EIGHTY-FIVE DOLLARS ($85.00) per fire call in the designated unincorporated areas of Denton County, Texas. AGENCY understands and agrees that payment by COUNTY to the AGENCY shall be made in accordance with the normal and customary processes and business procedures of COUNTY, and in conformance with applicable, state law. County agrees to provide to Agency an STX 800 MhZ radio for the use of Agency in carrying out the terms of this contract. This radio will remain the property of the County and will be returned on termination of this agreement. County will bear the risk of loss or destruction and make necessary repairs so long as Agency uses the property in a reasonable manner for the purposes of this contract. County reserves the right to reclaim the property at any time for any reason. This is the same radio provided in previous contracts, not an additional radio. VI. COUNTY agrees to and accepts full responsibility for the acts, negligence, and/or omissions of all COUNTY'S officers, employees, and agents while within its County limits. VII. COUNTY and AGENCY understand and agree that liability under A this contract is governed by Article 4413 (32c) Sec. 4g and Section 352.004 Local Government Code. This agreement is made in contemplation of the applicability of these laws to the agreement. INTFAT40CAL FIRE AGREEMENT SANGER �" 5 Insofar as legally possible COUNTY and AGENCY agree to be bound by the above mentioned statutes as they exist as of the date of this agreement. VIII. In the event of any default in any of the covenants herein containedI this agreement may be forfeited and terminated at either party's discretion if such default continues for a period of ten (10) days after notice to the other party in writing of such default and intention to declare this agreement terminated. Unless the default is cured aforesaid, this agreement shall terminate and come to an end as if that were the day originally fixed herein for the expiration of the agreement. IX. This agreement: may be terminated at any time, by either party giving sixty (60) days advance written notice to the other party. In the event of such termination by either party, AGENCY shall be compensateA pro rata for all services performed to termination date, together with reimbursable expenses then due and as authorized by this agreement. In the event of such termination, should AGENCY be overcompensated on a pro rata basis for all services performed to termination date, and/or be overcompensated reimbursable expenses as authorized by this Agreement, then COUNTY r shall be reimbursed pro rata for all such overcompensation. Acceptance of such reimbursement shall not constitute a waiver of any claim that may otherwise arise out of this agreement. INTERLOCAL FIRE AGREEMENT BANGER X. The fact that COUNTY and AGENCY accept certain responsibili- ties relating to the rendition of fire protection services under this agreement as a part of their responsibility for providing protection for the public health makes it imperative that the performance of these vital services be recognized as a governmental function and that the doctrine of governmental immunity shall be, and it is hereby invoked to the extent possible under the law. Neither AGENCY nor COUNTY waives or shall be deemed hereby to waive, any immunity or defense that would otherwise be available to it against claims arising from the exercise of governmental powers and functions. XI. This agreement represents the entire and integrated agreement between AGENCY and COUNTY and supersedes all prior negotiations, representations and/or agreements, either written or oral. This agreement may be amended only by written instrument signed by both AGENCY and COUNTY. XII. This agreement and any of its terms and provisions, as well as the rights and duties of the parties hereto, shall be governed by the laws of the State of Texas. , XIII. Any party Emergency Medical Services requested to render mutual aid to the area or areas covered normally by any other party Emergency Medical Services, shall make available to such area or areas all available resources, consistent with rendering mutual aid in Emergency Medical Care in the protection of life and personal property in such areas from disaster caused by or contributed to by enemy attack, civil disaster, natural disaster, or any other causes being sufficient reason to call for such mutual aid, provided however, that it'is agreed, if deemed necessary by the requested department, the requested department may reasonably withhold resources and aid which is reasonable and necessary to provide adequate protection to the area such Emergency Medical Service normally protects. III. The requesting department must request aid through the Central Dispatch Center (C.D.C.). Any request for mutual aid assistance shall include a statement of the quanity.and type equipment desired. In addition the request shall specify the number of additional personnel required and the location to which the personnel and equipment are to be dispatched. IV. A request for aid hereunder shall be made only by or under the direction of an official of the party Emergency Medical Service, or by the local or interjurisdictional disaster agency as set up by the Texas Disaster Act of 1975. �3) V. Each�.party Emergency Medical Service requesting aid shall extend to any other party Emergency Medicq]. Service, while operating within its area limits under the terms of this agreement, the same power, duties, rights, priviledges and immunities as if such other party Emergency Medical Service were performing its duties in the area where it normally renders service and is employed. Such powers, duties, rights, priviledges and immunities as mentioned above shall come in full force and effect at the time aid is requested by the requesting agency. VI. Each party Emergency Medical Service shall provide for the payment of compensation and death benefits to injured members of its own department and to representatives of deceased members of such forces where such members sustain injuries or are killed wh11e rendering aid pursuant to this agreement in the same manner and on the same terms as if injury or death were sustained within the city or area in which such party Emergency Medical Service normally operates. VII. A11 Emergency Medical Services forces of any party to this agreement shell continue under command and control of their regular officers but the organizational units of the assisting Emergency Medial Service shall come under the operational control and command of the requesting Emergency Medical Service. VIII. No liability shall attach to any political subvision, state or federal agency or their officers, agents. or employees, or Emergency Medical Service or their members, rendering aid pursuant to this agreement, as�a result of any act or emmission on the part of such forces while engaged in good faith in carrying out the purpose of this agreement, nor shall any liability attach to such parties or persons an account of the use or maintenance of any equipment or supplies in connection therewith. �,� No Political subdivision or party to this agreement shall be reimbursed by any other party for expenses incurred or liabilities ,. arising out of this agreement. However, the State of Texas or the United States Government may relieve the party receiving aid from any, liability and may reimburse the supplying party Emergency Medical Service for all its costs and losses incurred while rendering aid pursuant to this agreement, including transportation; subsistence maintenance expenses or its forces and fair and reasonable compensation for the use, damage, or utilization of its supplies, materials, equipment and facilities. It is provided, ,.however, that the immediate preceeding Paragraph 11 shall not prohibit any political subdivision from reimbursement from the United States Government through Revenue Sharing precedures. X. A responding department, its supplies and forces shall be released by the requesting department when the services of the responding department no longer required or when the responding department is needed within the area for which it normally provides Emergency Medical Services. XI. This agreement and supplies used by a party Emergency Medical Service in carrying out this agreement shall, at the time of any action herewith be considered owned by it; and. all personnel acting for a party Emergency Medical Service under this agreement shall be, at the time of such action, be considered an employee_or volunteer member of such party Emergency Medical Service. XII. This agreement shall be enforceable in equity by specific performance or mandamus. Post -vaccine serologies from the 400 employees involved revealed that less than half of the workers (48%, 48%, 40% and 24% respectively) adequately responded to the 1/10 ml dose. The Centers for Disease Control (CDC) recently reported these four instances of poor immune response among public safety workers immunized with ID hepatitis B vaccine. These workers required additional doses of vaccine at costs that exceeded the CDC approved three intra-muscular (IM) injection series. Hepatitis B vaccine is not licensed by the Food and Drug Administration for ID administration. In addition, the Immunization Practices Advisory Committee at CDC recommends that hepatitis B vaccine only be administered by IM injection into the deltoid muscle. County and city government agencies in Texas may now qualify for special reduced price hepatitis B vaccine on a cost reimbursement basis from the Texas Department of Health. We would like to offer some suggestions, based on current market conditions, that will serve to minimize your hauling requirements, it is our understanding that stored newspapers from your main- tenance facility are being placed in the bins. We are not able to move newspapers at this time, due to current market satura- tion. In addition, newspapers that have been stored for too long and yellowed with time cannot be moved at all. The paper must be of a white and fairly new quality, in order to be de -inked and restored to a useable state. We can, of course, take your glass and aluminum. Plastics, how- ever, are presently at an all-time low, as far as movability is concerned. Therefore, we are able to accept only the #1 and #2 plastics, and are limiting #2s to the frosty -white milk and water jugs. We are not accepting #2 colored plastics, which include Tide containers, Ivory bottles, etc. Market dictates should result,,in a reduction in the amount of materials collected for a while. Of course, items that we cannot currently accept may be stored at your facility until the markets open up again, and we will be happy to resume collection just as soon as conditions allow.
