Staff recommends approval of the ordinance. JH:es oar CITY OF SANDER, TEXAS ORDINANCE N0.09-91 AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF SANGER, TEXAS TO ADD SECTION 6 TO CHAPTER 7, ENTITLED BEAUTIFICATION COMMITTEE, PROVIDING FOR A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SANGER. TEXAS SECTION I THAT CHAPTER 7 OF THE CODE OF ORDINANCES OF THE CITY OF SANGER, TEXAS IS HEREBY AMENDED BY ADDING SECTION 6 ENTITLED BEAUTIFICATION COMMITTEE, APPOINTMENT OF BOARD, WHICH SHALL READ AS FOLLOWS. :_•••_�•ft' f NOT :•: • There is hereby created a Beautification Committee to be composed of seven (7) members, appointed by the Mayor and confirmed by the City Council. Members shall serve from July 1 of the year of appointment for staggered terms of two (2) years and may be appointed to three (3) successive terms of office. The members of the beautification committee shall be identified by place numbers one (1) through (7). The even -numbered places shall expire in even -numbered years and the odd -numbered places shall expire in the odd -numbered years. Newly appointed members shall be installed at the first regular committee meeting after their appointment. Vacancies shall be filled for an unexpired term in the manner in which original appointments are required to be made. Continued absence of any member from regular meetings of the commission shall, at the discretion of the City Council, render any such member liable to immediate removal from office. B. E� OFFICIO MEMBERS The city manager or his designee shall be ex officia members of the board. Members of the Beautification Committee shall be served by the Sanger Post Office for the delivery of regular mail. D. ORGANIZATION AND SELECTION OF OFFICERS The committee shall hold an organization meeting in July of each year and shall elect a chair; vice chair; and a secretary from among its own membership. Any four (4) of the regularly appointed members shall constitute a quorum. The board shall determine its own rules and order of business and meet as needed. All meetings shall be open to the public and shall be conducted under the Texas Open Meetings Act, Article 6252-17 and a permanent record of proceedings maintained. { 1) The committee shall serve as a consulting, advisory and supervisory body to study and recommend policies relating to the operation and promotion, of beautification efforts as outlined in the Keep Texas Beautiful Program. (2) The committee shall submit annually to the city manager, not less than one hundred twenty (120) days prior to the beginning of the budget year, a list of recommended capital improvements, which in the opinion of the committee ought to be constructed during the forthcoming five (5) year period. Such list shall be arranged in order of preference, with recommendations as to which projects should be constructed in which year. SECTION II All Ordinances or parts of Ordinances in conflict herewith are, to the extent of such conflict, hereby repealed. SECTION III It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses, and phrases of this Ordinance are severable and, if any phrase, clause, sentence, paragraph, or section of this Ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs, and sections of ORD. #09-91 PAGE 3 this Ordinance, since the same would have been enacted by the City Council without the incorporation in this Ordinance of any such unconstitutional phrase, clause, sentence, paragraph, or section. Pending your comments, if accepted, the draft rules will be submitted to legal counsel for review and comment and an enacting ordinance will be presented to Council on August 5, 1991. Regarding the vacation liability, if Council concurs with the buy-back provision, each employee with more than 40 hours of vacation time on the books as of July 15th, would be given the option of taking their total time off for the year prior to December 31, 1991, or receiving compensation or a combination of both. Our current total liability is 2797 hours for a total of 29 052 . These funds would be absorbed into the various department salary accounts. For discussion purposes: As you know, the vacation policy as drafted calls for vacation time to accumulate and run from January 1st to December 31st of each year. This could be modified to run concurrently with our budget year and would work the same as specified in the draft proposal. Staff recommends approval of the proposed personnel policy and the provision to reduce our vacation liability to a yearly basis rather than the current uncapped system. Note: Staff is currently working on a step, pay plan and written evaluation policy for your consideration. I do not anticipate these being in place prior to the adoption of the FY 91/92 budget, but should be ready for your consideration in the early fall. This is also a step toward building a professional and experienced staff to better serve our community. In Docket No. 8868, the Commission set an FCF of $.0071049 per KWh. This factor became effective for the February 1990 billing period and has been applied since that time, with a fuel refund being authorized in Project No. 10040. The present fuel cost overrecovery results, principally, from the application of the current FCF to the Cooperative's energy purchases from other utilities for resale and from the effect of economy energy sales. The cost of the additional energy purchases was recovered through the Cooperative's' Power Cost Recovery Factor (PCRF), while the Coopera- tive's fuel costs decreased due to a reduction in its own generation. Thus, the FCF produced fuel revenues on replacement energy purchased for resale in addition to the fuel revenues produced on that .energy which was generated at the Cooperative's power plants. With regard to economy energy sales, the fuel revenues from the Cooperative's economy sales exceeded that which would have been produced by application of the FCF. V. Brazos Electric's cumulative fuel overrecovery existing at May 31, 1991 was $2,335,189.49. The Cooperative proposes that interest be calculated on the fuel cost overrecovery at the composite cost of capital established by the Commission in Docket No. 8868. The composite cost of capital established in that docket was 7.51 %. So calculated, interest totals $105,966.53, providing a total refund amount of $2,441,156.02. VI. Brazos Electric proposes that the refund be made to all its customers, through aone-time bill credit based on actual historical usage during the period in which the overrecovery occurred. Application of Brazos Electric Power Cooperative, Inc. for Authority to Refund an Over -Recovery of Fuel Cost Revenues VII. Due to its unique circumstances as a generation and transmission rural electric cooperative also purchasing significant amounts of electric energy from other utilities for resale to its customers, Brazos Electric projects recurring overrecoveries of its fuel costs using its FCF currently in effect; therefore, Brazos Electric proposes a change in its FCF in this proceeding, to take into account Brazos Electric's generation mix, as described in the testimony of David Reinke, Brazos Electric Manager -Accounting Department, attached hereto as Exhibit A and made a part hereof. Mr. Reinke's testimony fully supports the application for the relief herein requested. A different method of calculation for unique circumstances, as proposed by Brazos Electric, is specifically contemplated by Substantive Rule 23.33(b)(C}. In order to facilitate prompt refunds requested herein, Brazos Electric requests an exception to the requirements of Rule of Practice and Procedure 21.22(b)(4), which requires both newspaper publication of notice of this Application and individual notice to each affected customer, as required for general rate cases. In this connection, Brazos Electric requests authority to accomplish notification by an individual notice mailed or delivered to each affected customer, as listed in paragraph III above. In Docket 8868, Brazos Electric's last general rate proceeding, the cost of newspaper publication in 78 newspapers totalled $22,665. The necessity of such expense and delay is subject to serious question in Brazos Electric's case wherein there are only 27 customers, all of one class and under one rate. All of Brazos Electric's 27 customers will have actual notice of this project. The public interest inherent in a quick and economical resolution of this Project, so that Brazos Electric's customers may receive the refunds as promptly as possible, constitutes good cause for the granting of this requested exception. The notification proposed herein is adequate to fully inform all affected customers and is such that it will not cause delay in making the refunds due to Brazos Electric's customers. Such notice as Brazos Electric proposes has been found by the Commission to be in full compliance with the requirements of P.U.C. Proc. R. 21.25(a). Brazos Electric further requests, in accordance with Substantive Rule 23.23(b)(2), that Brazos Electric's fuel cost revenues and fuel costs during the period in question be subject to final reconciliation in an appropriate Brazos Electric general rate case or fuel reconciliation proceeding. Furthermore, Brazos Electric requests that the correctness of the refund amount and the allocation among its customers as proposed herein also be subject to final reconciliation at such time. In an effort to ensure uniformity for the census, the Census Bureau established specific criteria for determining when a housing unit should be classified as vacant. A local government's definition of vacant units may differ from the Census Bureau's definition. Local officials often consider only those housing units on the market for sale or rent as vacant. The Census Bureau considers vacant any unoccupied housing units that could be inhabited whether or not they are currently on the market. For example, many communities do not count a new structure as a housing unit until an occupancy certificate is issued. The Census Bureau counts these unoccupied units as vacant housing units if they are under roof and closed from the elements. If a housing unit was occupied, but the residents were away at the time of the census, our enumerators were instructed to classify the unit as occupied and obtain at least minimum information (number of persons, basic demographic data) from a knowledgeable source such as a neighbor or building manager. In some cases, it is possible the enumerator classified the housing unit as vacant, but we double-checked (using separate enumerators) the occupancy status for all units initially classified as vacant. Thus, even if usual Sanger residents did not complete a questionnaire elsewhere or were outside the United States during the census, they should have been accounted for in the census. I am certain that there are sewer collection system improvements that need to be made. Also, the Electric Department system improvements are not specified and are based on a average expenditure year bringing our system up to the mast reliable and efficient possible. All the street projects are negotiable. It should also be noted that there are certain loan programs available through the Texas Water Development Board which would allow the City to maximize available funds to upgrade our water/wastewater systems. As an example, at 8% interest on a twenty (20) year note the per $1,000 factor for debt service is 101.86; in other words a $100,000 loan would cost $10,186 in annual debt service. There is also the possibility of a bond program for both streets and water/wastewater. At this time staff does not anticipate a need for electric bonds once the current issues expire. The following Debt Summary is presented to show you our -fixed obligations for the balance of the decade and to enable you to project the necessary utility rate increases, especially in wastewater in order to make our debt payments.
