Minutes were approved with noted corrections: #Item 9: Motion was made by Councilman Thomas and seconded by Councilwoman Braxton. #Item 13: Any Such Matters. Item e. If the City did not get the patches fixed correctly that our streets would not last even until the G.O. Bond were paid in full. 3. Disbursements: Motion was made lay Council�-nan Thomas and seconded by Councilman McNeill to approve disbursements for Payment. Motion carried. 4. Citizen's Input -none Considered and Possible on Reapplying for Municipal Swimming F'ooI C;rant.« CC Minutes 2®7-91 Discussion - Motion was made by Councilman Jenkins and seconded by Councilman McDaniel to resubmit the Municipal Swimming Pool Grant to the Parks and Recreation Department. Motion carried. 6. City Administration Report: Caster,office and Scott police office. b. Mr. Hamilton stated he had met with Benny Johnson of Frontier Waste to discuss the cost of a 30 cubic yard roll - off dumpster which would be 1.50 per cubic yard per month rent, $40.00 per month, $200.00 charge per load disposed. He also advised Hunter and Associates antipieate having the draft of the landfill closure plan available for the meeting of February 10. c. Hunter and Associates is also anticipating a n�id-week preconstruction conference with Calvert Construction on the Freese Drive Extension project. d. GENERAL The City of Sanger has. operated the current site as a landfill since it was initially opened in 1981. The .site, identified by Permit No. 1424, contains a total of 25.35 acres; however, since 1981, only 13.18 acres have been utilized to disposed of solid waste. The City of Sanger intends to close only that portion of the 25.35 acre tract that contains solid waste. The City's landfilling operations are proposed to cease in April 1991. The City of Sanger is currently negotiating with a private contractor for the disposal of Sanger's solid waste. The City is also exploring alternate disposal sites and modes of transferring the City's solid waste in the future. The City of Sanger is very much ,aware of the need to prepare its Closure Plan for this site and implement the approved Closure Plan to the Health Department's satisfaction. The City selected HUNTER ASSOCIATES, INC. to prepare a Closure Plan for approval by the Texas Department of Health and implementation by the City and outside contractor forces. A topographic map of the site prepared from recent survey information has been used to prepare the enclosed Closure Plan. II. ITEMS OF WORK A. Clean-up Surface Debris The first item of work proposed by the closure plan is the policing of the entire landfill site to remove all surface debris. Debris such as metal cans, concrete, bottlesI asphalt, and any other materials which have blown or otherwise been allowed to remain on the surface shall be disposed of by City forces. B. Leveling and Smoothing All uneven areas, which have been excavated or stockpiled, shall be smoothed out by machine to restore smooth contour to the site. This item of work does not include the importing or exporting of any soil. This item of work shall include an effort to maintain all existing vegetation possible and will be accomplished by City forces. C. Earth Moving and Erosion Control This is a major item of work that will be accomplished by City forces in conjunction with an outside contractor. This item will include the elimination of near vertical slopes, borrow pits, and providing adequate slopes for drainage and erosion control. This item involves "pushing" soil downhill in order to create flatter slopes throughout the site. This item will also include the transportation of material to achieve more desirable slopes over the .existing filled areas. The majority of the work associated with this item will provide smooth contours to areas that never received solid waste, so as to control erosion and otherwise provide more desirable topography to the site. D. Distribute Topsoil The City will salvage topsoil from the proposed excavation areas and use it in areas that will be disturbed during the closure process. Native vegetation has re-established itself over a large portion of the filled area. The City will seed rye grass during the first growing season in the areas that are disturbed by the closure process and then allow the native vegetation to re-establish. E. Building and Roads All equipment, tools, and other items owned by the City shall be removed from the site. The roads shall be maintained in order to be able to cover the site with fire fighting and earth moving equipment in the event of a fire or the need for addition of soil for erosion maintenance in the future. III. SCHEDULE The City will be able to accomplish all of the obligations of the Plan within this year. Budgeting to totally finance this Plan are in place at this time. Governor's Energy Management Center Request for Proposals Recycling Program Notice of invitation The Governor's Energy Management Center (GENIC) invites proposals from qualified local governments, regional councils of governments, and nonprofit organizations to implement recycling programs in the following categories: 1. Local projects: grants will be awarded to local governments and local nonprofit organizations to start or expand recycling programs, including drop-off centers, curb -side programs, yard waste diversion programs and education programs. Maximum: $20,000. 2. Regional projects: grants will be awarded to regional councils of governments and nonprofit organizations to coordinate recycling efforts in multi -county areas. Maximum: $200,000. (Regional recycling projects must be consistent with regional waste management plans developed by regional councils with funds from the Texas Department of Health.) 3. Demonstration �roiects: Certain materials have proven difficult to recycle. Projects will be selected to demonstrate the collection, processing and marketing of these materials. These materials, and the maximum available for innovative approaches to recycling them, include plastics ($50,000), auto tires ($100,000), appliances ($50,000), motor oil ($50,000) and construction materials ($100,000). Local governments, regional councils of governments and nonprofit organizations are eligible for these grants. (Proposals to demonstrate the recycling of other materials will be considered. However, you are strongly urged to contact the GEMC before preparing such proposals.) Restrictions on the Use of Funds This program is funded with oil overcharge funds appropriated to the Governor's Energy Management Center by the 71 st Texas Legislature. A minimum 20% matching funds is required. Oil Overcharge funds are monetary settlements retumed to the states as a result of litigation by the U.S. Department of Energy (DOE) against certain oil companies for violations of price controls in effect between 1973 and 1981. The courts returned these funds to the states for use in certain energy programs deemed to provide restitution to citizens aggrieved by the overcharges. Funds are subject to program guidelines of the DOE State Energy Conservation Plan (SECP) and the U.S. v. Exxon court decision, and may not be used to pay indirect ar administrative costs. The funds may be used to supplement existing programs, but may not supplant funds already allocated to the programs. Projects selected will be funded on a cost reimbursement basis. All expenses must be properly documented and permissible under the contract and under federal guidelines, and all are subject to approval by the Governors office. No advance payments are allowable. Mr. Cole stated that the location would be subject to health department inspections. I interrupt this to mean could we use the site for collection purposes as long as we take precautions to keep the area orderly and monitor the types of solid waste being collected. DATE: February 12, 1991 SUBJECT: Fire Annual Report Attached is a copy of the Annual Report from the Board of Trustees for the Fire Dept. Retirement Plan. Also a copy of the minutes from our last board meeting. The guideline for completing the Annual Report and the duties of the Local Board gives the Board the option of deciding which fires i.in its area are to be included on the Annual Report. The Board may excuse a firefighter from some of the fires and drills on the Annual Report due to illness, work or any excuse the Board may rule is legitimate. A firefighter cannot be excused from every fire and drill and still receive credit toward retirement. A firefighter must make 40� of unexcused drills and 25% of unexcused fires to receive credit toward retirement. As an example, a paid fireman on another department will miss nine (9) scheduled drills and approximately 30% of our fires due to their work schedule. We had 189 fires and 23 drills for 1990, had these firemen been excused due to work, their report would show 126 fires and 14 drills. They would have had to made 31 fires and 6 drills to receive credit toward retirement. Tf a firefighter does not malte the required amount of fires and drills, this does not automatically drop them from the department, this is a local decision, they just will not receive credit toward retirement for that year. Also some of our firemen are in fire related schools at different times thru the year and are forced to miss some of the drills and. fires. The firemen who work out of town will miss approximately 50% of our fires and the members we are fortunate enough to have who work in town cannot leave their work every time. Due to the fact this Pension System is designed to encourage participation, and if an excused absence was granted, you would have to account for every man at each drill and f ire to see who was available. This would take quite a lot of bookkeeping. Also we were reviewing last years reports and it would have been almost impossible to determine who could have been available. Whereas it was the Board's decision to deny any excused absences and count all fires and drills. a John Hamilton Page 2 2/12/91 We have eight (8) firemen, listed below and the fires and drills they did make who did not qualify: Curtis Amyx 11 Drills 31 Fires Eddie Hernandez 1 " 35 " Larry Klein 3 " 46 " Eddy Nixon 7 " 33 Frank Smith 9 " 10 " Danny Spindle 0 " 21 Mike Tucker 10 " 40 " Kenneth Swindle 16 " 28 In reviewing the above, I am reminded of the fact that we are all Volunteers and we must work for a living before we can afford to donate our time, I am recommending that all firemen listed above retain membership in the Fire Depte with the exception of Eddie Hernandez and Danny Spindle and in keeping with our guideline of not excusing ALL Fires or ALL Drills, I am recommending they be dropped from the roll for their Drill Record. Also it was learned from a telephone conversation with Elaime Rummel who is the Administrative Assistant for the Pension System, that our Fire Marshall must attend the same amount of drills and fires that the other firemen do to receive credit for retirement. Since J. C. Landers did not attend drills or fires he will not receive any credit for retirement in 1990. We did not know this was required until now. Chapter 166, Acts of the 63rd Legislature, Regular 7 Session, 1973 (Article 1435a, Vernon's Texas Civil Statutes), is 8 amended by adding Section 4c to read as follows: 9 Section 4c. Notwithstanding any term, condition, or provision 10 of Section 4a of this Act to the contrary, any public entity which 11 is an incorporated city, town or village, which is engaged in the 12 distribution and sale of electric energy to the public, and which 13 had a population according to the 1990 federal census of 125,000 or 14 less, may pass a concurrent ordinance as provided in and with the 15 effect specified in Section 4a of this Act Any municipal power 16 agency which is or was created by two or more Public entities 17 described in the preceding sentence may engage in the generation 18 and transmission of electric power and energy within or outside of 19 the State of Texas and may engage in the sale, purchase or exchange 20 of electric power and energy with entities within or outside the 21 State of Texas, and may make contributions to other public entities 22 as they may mutually agree, provided that nothing in this section 23 authorizes an agency to engage in the distribution and retail sale 24 of electric power and energvl provided further that an agency 25 connected to intrastate transmission lines shall not transmit -1- 26 purchase, sell, deliver or receive electric power and energy 27 generated outside the State of Texas except in the event the 28 E'ederal Energy Regulatory Commission grants an exemption from the 29 application of the Federal Power Act under the rules and regulation 30 of said Commission.
