The IWD requires these opportunities for Council to receive comment. The hearing was published in the Sanger Courier. JH:es CITY OF SANGER P. O. BOX 578 SANGER, TEXAS 76266 MEMORANDUM #544 TO: Honorable Mayor & Members of the City Council FROM: John Hamilton, City Manager DATE: June 15, 1990 SUBJECT: Consider Resolution #R1-90 -Grant Application As part of the Grant process with the Texas Forks and Wildlife Department, following two public hearings, Council must consider a Resolution in support of the grant application. If approved, staff will proceed with the application and submit it directly to TPWD in Austin prior to .July 31, 1990. If the Resolution is not approved by Council, no application will be submitted and staff will await instructions. As of May 31, 1990, the City has $305,000 in unencumbered reserves. Additionally, we have about $90,000 surplus in funds set aside for payments on Bonded Indebtedness. The current estimate for the pool is $190,000.00. This would mean tree City's share of the project would be $95,000.00. As we all know, the bid process has a way of contradicting estimates either positively or negatively. If Council approves the Resolution and we are approved far funding, one option would be to establish a workable cash/note ratio such as $50,000 from reserve funds and a short-term note, 6 to 18 months for the remaining $45,000. This option would also give us time to generate revenue from the pool as well as accumulate surplus funds from our revenue sources. The question before Council concerning Resolution #R1-90 is whether or not you want to proceed with the grant. process. There are no guarantees that we will be funded and we might have to apply more than once to be funded. As the program now exists, the funding cycles are July 31st and January 31st. They recommended approval with Member Ken Howard voting no. it was my understanding that Ken was not opposed to the plat only approval of the entire project when the developer stated he would develop the addition in stages. A copy of the minutes of that meeting are included for your review. Also enclosed is section 4.04 of the Subdivision Ordinance regarding Final Plat. procedures. You will notice that the first paragraph on page "15" of the Subdivision Ordinance addresses Mr. Howard's concern in voting no on the plat. The plat has been reviewed and approved by Hunter Associates, consulting engineers, for the City. The developer has paid the required filing fees. One question has arisen among Mr. Sable representing the developer of Willowood and Mr. Howard Ashcraft regarding drainage onto Mr. Ashcraft's property caused by Willowood's development. The Santa Fe Railroad has also become involved in the drainage issue. A letter stating the Railroad's position is also enclosed. Exceptions Where the subdivider may request exceptions or a waiver of these regulations, or is in disagreement with the intent or interpretation of the requirements set forth herein, the city planning and zoning commission may sub- mit such requests of the subdivider to the city council with recommendations for either an approval or disappro- val. 4.04 - Final Plat After approval of the preliminary plat, a final plat, pre- pared by a registered public surveyor and bearing his seal, shall be submitted to the city for consideration. Six (6) direct prints and one (1> film positive of the final plat along with an application for plat approval, the required filing fee, and two (2) copies of all required engi- neering drawings and other data shall be filed with the city not less than twenty (20) days prior to the meeting at which an action of review and recommendation is requested from the planning and zoning Commission. Twenty-five (25) copies of the final plat shall also be fur- nished at a reduced scale on sheets measuring eight and one- half inches (8�") by eleven inches (11"). No plat will be considered by tl�e city until all of the prescribed filing fees have been paid. The final plat may constitute all or only a portion of the approved preliminary plat, but any portion thereof shall conform to all of the requirements of these regulations unless exception has been granted by city council. 14 If final plats are submitted f:or approval for portions or sections of the proposed subdivision, each portion or'section shall carry the name of the entire subdivision but shall bear a distinguishing letter, number or subtitle. With an understanding of Mrs. Millar's particular circumstances, realizing that during the 1987 zoning code revision, due notice and public hearings were given and citizens had opportunities to speak to the P & Z Commission and the City Council regarding this property, staff recommends denial of the request as it would be spot zoning and challenge the integrity of the Zoning Ordinance. A variety of commercial uses are permitted although all permitted activities are conducted within a building or structure. 20.1 Use Regulations: A building or premise shall be used only for the following purposes: 1. Uses permitted in the B-1 district. 2. Single family residential attached and multi -family. 3. Other uses as listed in Section 26 of this ordinance. 20.2 Height Regulations: No building shall exceed thirty-five (35) feet in height, except cooling towers, vent stacks or mechanical equipment rooms may project not more than twelve {12) feet beyond maximum building height. 20.3 Area Regulations: 1. Size of Yard: a. Front Yard: None required. b. Side Yard: None required, except district abuts a residential district a minimum side yard of ten (10) feet vided. Development in the I-1 District is limited primarily to certain wholesale and jobbing commercial uses and certain industrial uses, such as the fabrication of materials, and specialized manufacturing and research institu- tions, all of a non -nuisance type. No use or types of uses spe- cifically limited to the I-2 District may,be permitted in the I-1 District. 21.1 _Use Regulations: Uses permitted in the I-1 District are subject to the following conditions: (a) All business, servicing, or processing, except for off- street parking, off-street loading, display of merchan- dise for sale to the public, and establishments of the "drive-in" type, shall be conducted within completely enclosed areas. (b) All storage within one hundred feet (100') of a resi- dence district, except for motor vehicles in operable condition, shall be within completely enclosed buildings or effectively screened with screening not less than six feet (61) nor more than eight feet (81) in height, pro- vided no storage located within fifty feet (501) of such screening shall exceed the maximum height of such screening. 32 g (c) Permitted uses in the I-1 District shall not disseminate dust, fumes, gas, noxious odor, smoke, glare, or other atmospheric influence. (d) Permitted uses in the I-1 District shall produce no noise exceeding in intensity, at the boundary of the property, the average intensity of noise of street traf- fic. (e) Permitted uses in the I-1 District shall not create fire hazards on surrounding property. Permitted uses in the I-1 District include the following: 1. Advertising products, such as signs and billboards (manufacturing of) . 2. Ambulance, bus, train, and taxi stations, truck yards. 3. Awnings, venetian blinds, and windowshades, (manufacturing of). 4. Bakery, candy, dairy and other food products, but not including fish and meat products, sauerkraut, vinegar, yeast, alcohol or alcoholic beverages. 5. Building materials yard, contractor's yard, lumberyard. 6. Cameras and other photographic equipment (manufacturing of). 7. Ceramic products, such as pottery, figurines, and small glazed tiles. 8. Ice plants, cold storage plants. 9. Jewelry. 10. Machine shops (fabrication of metal not more than ten (10) gauge in thickness). 11. Metal stamping and extrusion of small products, such as costume jewelry, pins and needles, razor blades, bottle caps, buttons, and kitchen utensils. ' 12. Milk and ice cream processing. 13. Mobile home sales. 14. Musical instruments. 15. Orthopedic and medical appliances, such_as artificial limbs, braces, supports, and stretchers. 33 16. Repair of farm, household, office machinery or equipment. 17. Scientific and precision instruments (manufacturing of). 18. Sheet metal shops. 19. Public utility and public service uses as follows: (a) Bus stations, bus terminals, bus turnaround (off-street), bus garages, and bus lots; (b) Electric substations; (c) Radio and television towers; (d)' Railroad passenger stations; (e) Telephone exchanges, microwave relay towers, telephone transmission equipment buildings and ser- vice yards, (f) Privately owned water pumping stations and water reservoirs; 20. Radar installations and towers. 21. Radio and television studios and stations. 22. Schools, trade. 23. Storage and warehousing establishments. 24. Storage yards, but not including junkyards. 25. Swimming pool (manufacturing of). 26. Trailer sales and rental, for use with private passenger motor vehicles. 27. Weighing stations. 28. Wholesaling establishments. 29. Accessory uses, including bUt not limited to temporary buildings for construction purpose for a period no to exceed the duration of such construction. 30. Other wholesale, light manufacturing, construction or service uses which are similar in character to those enu- merated in this subsection, and which will not be dangerous or otherwise detrimental to persons residing or working in the vicinity thereof, or to the public welfare, and will not impair the use, enjoyment, or value of any property. 34 31. Factory outlet retail or wholesale store for the sales and servicing of goods or materials on the same premises as the manufacturing company to which they are related, including sales and service in a separate building or buildings. 32. Other uses as listed in Section 26 of this ordinance. The following specc uses shall be permitted in the I-1 District when granted in accordance with Section 27: 1. Railroad freight terminals, railroad switching and classification yards, repair shops, and roundhouses. 2. Stadiums, auditoriums, and arenas. 3. Other uses as listed in Section 26 of this ordinance. 21.2 Height Regulations: Maximum height one hundred (10'0) feet. 21.3 Area Regulations: 1. Size of Yards: a. c. Front Yard: Minimum required, twenty (20) feet. Side Yard: Minimum side yard of ten (10) feet except a corner lot adjacent to a street shall be twenty (20) feet. When the industrial district is adjacent to any residential district, a minimum side yard of twenty (20) feet shall be observed and a six (6) foot solid masonry or wood wall shall be constructed adjacent to the residential district's property line. Rear Yards: There shall twenty (20) feet, unless district, in which case a back shall be observed. 2. Size of Lot: a. Minimum Lot Area: None. b. Minimum Lot Width: Norte. c. Minimum Lot Depth: None, be a rear yard of depth of adjacent to a,residential fifty (50) foot rear set- 3. From time to time, the City receives bills for goods or services that have a due date prior to a scheduled Council meeting. These are usually routine and less than $250, 00, Would it suit. Council for staff to pre -authorize these bills to avoid late -charges and protect the City's Credit worthiness? 2). I-35 Northbound lanes are now open. If the construction remains on schedule, the service roads should be completed by late July. This brings up the question of the ordinance making Hughes Street "one-way." Does Council want to return the draft ordinance to the next agenda for consideration? 3). Also concerning the I-35 work completion, Staff fs preparing a report on the feasibility of constructing access to Loop 138 for Gateway Addition residents. This draft should be completed for your review the week of June 22nd. 4). The question of making substantial improvements to 10th Street, south of Bolivar to the Intermediate School was raised by Council recently. Hunter Associates has informally stated that to improve the street to curb and gutter with underground storm drainage would be approximately $110 per linear ft., $65 for 27 ft. street curb and gutter and $45 per linear foot for underground storm drains, 36" diameter reinforced concrete pipe. It is approximately 850 ft. from Bolivar south to Willow and 2000 fto south from Bolivar to Austin Street, Based on these distances, less 6% to 8% engineering fees, the 850 ft. section would be approximately $93,500 and to Austin from Bolivar would be $220,000, 00. This does riot take into account any oversizfng of the street to a 30 ft, or 32 ft, width. Selection of Officers At its organizational meeting, and annually thereafter when new members are appointed to the Library Board by the City Council, the Board shall elect from its own membership a vice -chairperson and a secretary. Any four (4) of the regu- larly appointed members shall constitute a quorum. The Board shall determine its own rules and order of business. ` ._ _ _ The Board shall meet at least once a quarter and at other times as called by the Chairperson or four (4) members of the Board; all meetings shall be open to the public; and shall be posted as according to the Texas State Open Meetings Act; and a permanent record of proceedings shall be maintained. D. Powers and Duties of the Library Board 1. The Board shall serve the City of Sanger as a consulting, advisory, supervisory body to study and recommend policies relating to the operation, promotion, enlargement, future planning, and such other matters involving the city -owned Library as may be referred to it by the City Council. 2. The annual budget for the Library shall be prepared by the Board and submitted to the City Administrator for review and submittal to the City Council for final adoption.. Proposed expenditures during the dear that are not included in the budget adopted by the City Council shall be referred to the City Administrator for review and submittal to the City Council for budget admendment. 3. Reports to or items requiring action by the City Council shall be submitted to the City Administrator for review and submittal to the City Council. E. Library rules and regulations The general rules and regulations for the operation and use of the library shall be promulgated by the Library Board and approved by the City Council. The books, newspapers,: magazines, pamphlets, manuscripts, or other property of the city public library shall be the property of :`the city; any person injuring or defacing any such property shall be liable to account therefor to the librarian. The Library Board .shall have authority to establish fines for any person retaining any such book, newspaper, magazine, pamphlet, manuscript or other property beyond the expiration of the time which by the rules of the library such property may be kept. Travis Roberts met with Ms. Jan Sills to discuss the steps the City has taken to bring flows into compliance with 31 TAC Chapter 305, Section 305.126. It is our understanding that because the flow meter could not be repaired and calibrated properly, a new ultrasonic flow meter was installed on February 18, 1990 to obtain more accurate flow recordings. Some manhole and gravity line repairs have also been completed in an effort to eliminate I/I. The City's recent request for funding of�sewer system improvements was, however, denied by the Texas Department of Commerce, so needed repairs are made as City funds are available. Daily average reported flows still exceeded 75% of the design capacity for the months of March and April 1990. Because of the heavy rainfall that occurred during this period, Ms. Sills agreed that the City could continue to monitor the flows through August 1990. A report summarizing the flows and their compliance with the rule should then be submitted for our review no later than September 14, 1990.
