During the past week, Ms. O'Rear has discussed this alley with bath the Fire Marshall and me. I assured Ms. O'Rear that the alley easement would remain open. Fire Marshall Landers told me that the building is in the central fire district and is required by fire code to have an alley. As near as the can tell the alley easement is ten (10) feet. I would remind you that an alley is a public right of way, mucY% like a street, and cannot be closed except by action of the City Council. Ms. O'Rear has discussed the I-35 signs denoting the Sanger exit with me and I referred her to Mr. Dwight. Bird, resident engineerDenton, Texas Highway Department. She also indicted that the City should construct a sign at the 1-35 access road and Bolivar, indicating "Downtown Sanger." I told Ms, O'Rear, that in my opinion, that would be a project to be undertaken by private groups or individuals and was not a City function. Regarding the skateboards, bicycles on the sidewalks, I assume that could be done by ordinance that would include blocking sidewalk access and advertising on sidewalks. The map or maps incorporated into this Chapter as a part hereof by reference thereto. 3-7-2: PERMITS REQUIRED: It shall be unlawful for any person to erect, construct, enlarge, alter, repair, replace, remove or demolish any fence regulated by this Chapter, except as specified in subsection (A) of this Section, or cause the same to be done without first obtaining a separate permit for each fence from the Department of Inspections. (A) Exempted Work: A fence permit shall not be required if it be determined by the Department of Inspections that only minor repair or painting is necessary. 3-7-3 3-7-7 3-7-3: APPLICATION FOR PERMIT: To obtain a permit, the applicant shall first file an application therefor in writing on a form furnished by the Department of Inspections for that purpose. 3-7-4: PLANS AND SPECIFICATIONS: Plans and other data as deemed necessary by the Department of Inspections shall be submitted with each application for permit (3 sets of plans required). 3-7-5: INFORMATION ON PLANS: Plans shall be drawn to scale and shall include the following: (A) Building locations and area to be fenced. (B) Legal description of land to be fenced. (C) Height of fence and type of materials to be used. (D) Intersections of streets, roads, highways, alleys and driveways. (E) Zoning. (F) Corner visibility range when required, shall be shown. 3-7-6: PERMITS ISSUANCE: The application, plans and other data, filed by an applicant for permit, shall be reviewed by the Department of Inspections and the Engineering Department. If the work described in an application for a permit and the plans and other data filed therewith conform to the requirements of this Chapter and other pertinent laws and ordinances, and that the fees specified in the City ordinance providing for permit, inspection and license fees have been paid, the permit shall be issued to the applicant. The plans shall be endorsed in writing or stamped approved and shall not be changed, modified or .altered without authorization from the Building Official, and all work shall be done in accordance with the approved plans. One set of approved plans shall be retained by the Department of Inspections for a period of not less than ninety (90) days from the date of completion of the work covered, one set of the approved plans shall be retained by the Engineering Department and one set of the approved plans shall be returned to the applicant. 3-7-7: VALIDITY OF PERMIT: The issuance or granting of a permit or approval of plans shall not be construed to be a permit for, or an approval of, any violation of any of the provisions of this Chapter or any other code or ordinance of the City. The issuance of a permit based upon plans and other data shall not prevent the Department of Inspections from thereafter requiring the correction of errors in said plans and other data, or from preventing building operations being carried on thereunder when in violation of this Chapter or any other code or ordinance of the City. a l.�r ..I [•�7 3-7-8 3-7-13 3-7-8: EXPIRATION: Every permit issued by the Department of Inspections under the provisions of this Chapter shall expire by limitation and become null and void if the authorized work is not commenced within sixty (60) days from the date of permitting, or if the authorized work is not completed, or is abandoned for a period of sixty (60) days. Before the work can be recommenced, a new permit shall be first obtained and the fee shall be one-half ('/2) the amount required for a new permit for such work, provided the elapsed time does not exceed one hundred eighty (180) days in which case the permittee shall pay a new full permit fee in order to renew action. 3-7—g: SUSPENSION OR REVOCATION: The Department of Inspections may, in writing, suspend or revoke a permit issued under the provisions of this Chapter whenever the permit is issued in error or on the basis of incorrect information supplied, or in violation of any code or ordinance or any of the provisions of this Chapter. 3-7-10: PERMIT FEES: The fee for each permit shall be as set forth in the City ordinance providing for permit, inspection and license fees. No permit fees shall be refunded. (Ord. 1325, 1117-86) Fence permit fees shall be based upon the total valuation of construction and shall be the same as those set forth in Section 3-1-3 of this Title. (Ord. 1316, 7-7-86, eff. 9-1-86) 3-7-11: INSPECTIONS: Upon completion of the authorized work, it shall be the duty of the person doing the work to notify the Department of Inspections that such work is ready for inspection. Required inspections shall include: (A) Alignment Inspection: To be made after all post or support structures are in place. (B) Final Inspection: To be made after the fence has been completed. 3-7-12: MAINTENANCE: All fences, both existing and new, and all parts thereof, shall be maintained in a safe and aesthetically pleasing condition. Graffiti shall be removed immediately upon notification. All devices or safeguards which are required by this Chapter shall be maintained operable. The owner or his designated agent shall be responsible for the maintenance of the 3-7-13 3-7 A 3 (A) Fences constructed on any lot, and specifically corner lots, will be subject to, and shall conform to the visibility range requirements contained in Section 3-7-15 of this Chapter. Additional clear zone may be required by the City Engineer. (B) No fence, guy wire, braces or post of such fence shall be constructed upon or extend over property that the City has control over, owns or has an easement over or under, except upon utility easements which are permitted to be fenced if written permission is granted by all users. (C) No fence shall exceed ten feet (10') in height measured from the finished grade of the lot or property upon which the fence is being erected except as otherwise provided for in this Chapter. (D) No fence erected within the City limits shall be electrically charged in any manner. (E) No fence shall be constructed of barbed wire except on property zoned Agriculture - Open Space and is five (5) acres or greater in size. (F) All fences shall have a minimum of one gate for emergency ingress and egress. The minimum width shall be three feet (3'). (G) In LC, GB, WH, LI, HI, PK, PU and FP Zoning Districts fences eight feet (8') or greater in height may be constructed with angle arms at the top and such angle arms may be armed with barbed wire. Such arms shall not extend over public property, City, County or State rights of way, easements or private property. Any property that requires a screening device shall conform to the Zoning Ordinance. (H) Construction material may be wood, chain link or masonry, except in the case where a screening device is required, in all such cases the Zoning Ordinance shall prevail. (1) All private (single-family) swimming pools and spas shall be fenced or enclosed. The fence or enclosure shall extend around the entire .pool and have a minimum height of six feet (6). The fence or enclosure shall be equipped with self -closing and self -latching gates or doors. (J) All public (hotels, motels, apartments, etc.) swimming pools and spas shall be fenced or enclosed. The fence or enclosure shall extend around the entire pool and have a minimum height of four feet (4'). The fence or enclosure shall be equipped with a self -closing and self -latching gate or door. (K) No fence shall be constructed in the required front yard building setback area of R, DU, TH, PH, OD or MD Zoning Districts, except that a decorative fence may be constructed to a height no greater than three feet (3') above the finished lot grade and the solid area of such fence shall not exceed fifty percent (50%) of the total. 3-7-14 3-7-15 3-7-14: PENALTY: Any person who shall violate the provisions of this Chapter shall for each violation be deemed guilty of a misdemeanor and shall be fined not more than one thousand dollars ($1,000.00), and each violation shall be construed to constitute a separate offense. SECTION 2: Tliat a new Chapter 3 of the Canyon Municipal Code entitled "Animal Control" is hereby enacted to read and require as follows: ARTICLE I. GENERAL PROVISIONS SECTION 3-1. Definitions. As used in Chapter- 3, the following terms shall be construed to have the following meanings: (a) Animal. "Animal" is any live, vertebrate creature, domestic or wild. (b) At Large_ "At Large" is any anima]. not restrained, (c) Domestic Animal. "Domestic Animal" are those which are naturally tame and gentle or which, by long association with man, have become thoroughly domesticated and are now reduced to such a state of subjection to his will that they no longer possess the disposition or inclina- tion to escape. `Phis definition specifically includes household pets, such as dogs and cats. (d) Estray. "Estray" means any stray horse, stallion, mare, gelding, filly, colt, mule, hinny, jack, jennet, hog, sheep, goat, or head of any species of cattle, (e) Guard Dog. "Guard Dog" shall mean any dog trained or used to protect persons, premises, or property by attacking or threatening to attack any person found within the area patrolled by the dog, (f) Kennel, "Kennel" is any place where five (5) or more dogs, cats or any combination thereof, over the age of four (4) months, are raised, trained, boarded, harbored or kept, (g) Livestock. "Livestock" shall include any horse, donkey, stallion, mare, gelding, filly, colt, mule, hinny, jack, jennet, hog, sheep, goat or head of any species of cattle, (h) Local Ilealth Authority. Any person designated by the Chief of Police. (i) Other Animal, "Other Animal" is a goose, chicken, duck, rabbit, guinea, pigeon, bird, fowl, or any other animal of domestic barnyard variety not listed as a wild animal, domestic animal or estray. 1 (j) Owner. "Owner" is any person who owns, keeps, harbors, controls (physically or orally), feeds, shelters, or aids any animal, or any person who is the owner's agent left in charge of an animal. (k) Quarantine. Isolation and close observation of animals to prevent transmission of certain diseases. (1) Restrain. Any animal shall be deemed to be restrained when it is: (1) Confined on the premises of the owner within a fenced enclosure, capable of confining the animal; or (2) Fastened or picketed by a lead, rope, or chain so as to keep the animal on the premises; or (3) Under the control of a person by a leash; or (4) Within a vehicle being driven or parked, or (5) At heel and obedient to oral command. (m) Wild Animals. "Wild Animals" are those living in a state of nature and not ordinarily tame or domesti- cated. SECTION 3-2. Nuisance Animals. (a) It shall be unlawful for any person to own or maintain an animal in such a manner as to constitute a public nuisance. The following acts shall constitute a public nuisance: (1) Failure to restrain an animal. (2) Property damage caused by an animal. (3) Maintain an animal in an unsanitary environment. (4) Permit an animal to bark, whine, howl., crow, cackle, or make any other noise which causes annoyance or interference with another's reason- able use and enjoyment of his premises. (5) Herding of animals along or upon any public right- of-way, except by officers, agents, or employees of: the Federal, State, or Local Government or agency thereof, if such herding is done in the performance of official duties. (6) The maintenance of a kennel in violation of the Zoning Ordinances. (7) Keeping of more than three (3) dogs or cats (exclusive of puppy or kitten litter under the age of six months) within a Residential Zoned area. (b) It shall be unlawful for any person to keep swine within the limits of the City, except for the keeping of swine under direct supervision by and upon the premises of public and private schools, fairs, or livestock shows. Provided, however, in no event shall swine be kept within the limits of the City for a period of time in excess of seven (7) days. (c) All "Other Animals" authorized to be kept shall be confined to the premises of the owner or custodian of �a such "Other Animals", and it shall be unlawful fok any person to allow such "Other Animals" to run or fly at large, or go upon the premises of another person. No "other Animals" shall be kept within a front yard in a Residential Zoned area. (d) It shall be unlawful for the owner or custodian of any dead animal which is not intended as food for human consumption, to permit or suffer such dead animal to remain upon any premises. (e) It shall be unlawful to keep any livestock within the city limits unless such livestock is kept in private or commer- cial premises as authorized in Article II ofthis Chapter. SECTION 3-3. Interference with Animal Control Officer. It sha].1 be unlawful to interfere with or hinder the Animal Control Officer, or his designee thereof, in the performance of his official duty. SECTION 3-4. Records. It shall be the duty of the Chief of Police or his designee to keep or cause to be kept, accurate and detailed records of: (a) Impounding and disposition. Impoundment and disposi- tion of all animals coming into his custody. Such records shall be kept for a period of at least three (3) years and shall give the description of all animals impounded, date of impounding, date of sale or other disposition, the amount of money received from the sale of the name and address of the purchaser. (b) Bite Cases. All known animal bite cases shall be recorded by the Canyon Police Department. (c) Monies received. Records regarding monies received under the provisions of this chapter shall be open to inspection at reasonable times by persons responsible for similar records of the City, and shall be audited by the City auditor annually in the same manner as other City records are audited. SECTION 3-5. Animal Care - General. (a) Any person who, as the operator of a motor vehicle, strikes a domestic animal shall immediately report such injury or death to the animal's owner. In the event the owner is unavailable or unknown, then such report shall be made to the Animal Control Officer or the Canyon Police Department or to the local Humane Society. (b) No person shall expose an open trap or metal jaw trap likely to injure any domestic animal or person. (c) No person shall dye, color, or artificially color any rabbit, baby chick, duckling, or "Other Animai", or offer for sale any such dyed, colored or artificially colored "Other Animal". SECTION 3-6. Vaccination. No person shall own, keep or harbor a dog or cat over the age of four (4) months within the city limits unless the dog or cat shall have been vaccinated with an anti -rabies vaccine by a licensed veterinarian. All such animals shall be vaccinated at one (1) year intervals from the initial date on which such animal 3 was vaccinated or required to be vaccinated. SECTION 3-7. Vaccination Tag. Upon compliance with t-he provisions of Section 3-6, there shall be issued to the owner a numbered metallic vaccination tag stamped with the number and the month and year issued, which shall be securely fastened on such vaccinated dog or cat. SECTION 3-8. Guard Dogs. Guard dogs shall be securely enclosed within the area patrolled at all times or under the continuous control of a trained handler. It shall be unlawful for any person to place or maintain guard dogs in any area for the protection of person or property unless the following provisions are met: (a) The dogs shall be confined to an enclosed area adequate to ensure they will not escape, or , (b) The dogs shall be under the absolute controloof a handler at all times when not securely enclosed, and (c) The owner or other persons in control of premises upon which a guard dog is kept, shall post a warning sign at each entrance to such premises with lettering clearly visible from a distance of fifty (50) feet. In the case of the nonresidential or multifamily premises, the sign shall contain a telephone number where some person responsible for controlling such guard dog can be reached twenty-four (24) hours a day; and (d) Prior to the placing of a guard dog on any non residen- tial or multifamily premises, the persons responsible for. the placing shall inform the Chief of Police in writing of their intention to place said dog or dogs, the number of dogs to be placed, the location where said dog or dogs will be placed, and the approximate length of time said dog or dogs will be guarding the area, (e) For the purpose of this section, the term "nonresiden- tial or multifamily premises shall mean the placing of guard dogs on any nonresidential or multifamily property, irrespective of ownership of the property or dog. E II. WILD ANIMALS, ESTRAYS SECTION 3-9. Applicability of Article. This article shall be applicable only to Wild Animals, livestock, other animals, or Estrays as defined in this Chapter. SECTION 3-10. Keeping or Harboring. It shall be unlawful to ity limits the following: keep, harbor or maintain within the c (a) Bats, skunks, poisonous reptiles, foxes. (b) Any Wild Animal whose normal mature weight exceeds forty (40) pounds. (c) Livestock, except as hereinafter provided, (d) This section shall not apply to or prohibit theIr following: 4 (1) A publicly or privately owned zoo maintained or operated by a nonprofit organization or govern- mental, entity. _.e (2) A publicly or privately maintained circus, travel- ing show, or rodeo which does not remain in Canyon longer than fifteen (15) consecutive days. (3) Any person desiring to keep livestock within the city limits shall make application to the City Commission for a permit, which shall expire on December 31st following issuance, but may be renewed annually in the same manner as provided in this Article. The application shall be in writing, forwarded to Code Enforcement, containing the following information:• SECTION 3-11. Applicant's name, address, and phone number; and A legal description and general location of the premises for which permit is desired; and The minimum and maximum number of livestock desired to be kept at said location; and An itemized listing of residences, businesses or other buildings within 500 feet of any part of the premise for which permit is desired. The application shall be directed to the Director of Code Enforcement• for investigation of the premises concerned and he shall report his findings to the City Commission, The City Commission shall consider the application, retaining the right to approve or reject the applicant's request for livestock permit. In addition, the City Commission shall retain the right to revoke any livestock permit if it finds that premises are being maintained so as to constitute a public nuisance or noncompliance with state health regulations. Impoundment, Sale or Disposition of Estrays. (a) The Sheriff or his designee may take up and impound at the animal shelter any estray found within the city limits in violation of the State Agriculture Code, Chapter 142., "Estrays". (b) The Sheriff or his designee may sell any estray impounded under the provisions of this article at a public auction after having advertised twice (2) in the local newspaper during the 15 days after the date of impoundment. In addition, a notice of impoundment with a general description of the estray shall be posted in the County Courthouse. (c) Final disposition of the estray shall be in compliance with the State Agriculture Code, Chapter 142, "Es - trays". SECTION 3-12. Impoundment of Wild or other Animals. Any peace officer or the Animal Control Officer may take up and impound at the animal shelter any animal found within the city limits in violation oL• Penal Code 42.11 or Section 3-10 of 5 this Chapter. SECTION 3-13. Sale of Impounded Wild and Other Animals; Notice of Sale; Disposition of Proceeds. The Animal. Control Officer may sell any animal impounded under the provisions of. this Article at public auction after having held such animal for at least five (5) days and after Having published notice of such sale together with a general description of the animal or animals to be sold. Such notice shall appear one (1) time at least five (5) days prior to the date of the sale and shall state that such animal or animals will be sold to defray cost if not reclaimed prior to such date. The proceeds of any such sale shall be used to defray sale expenses and expenses of taking up and keeping of such animals. The balance, if any, shall be paid to the owner of the animal, if known, and if such owner is unknown, such: balance shall be paid into the city treasury. Within six (6) months after such sale, an owner may, upon proof of such ownership satisfactory to the Chief of Police, be entitled to receive the amount paid into the city treasury on account of such sale. SECTION 3-14. Disposition of (Unclaimed) Impounded Wild and Other. animals. Any impounded animal which is not reclaimed, or found to be infected with rabies, seriously injured or determined by the Animal Control Officer to be unsalable, shall forthwith be destroyed. SECTION 3-15. Redemption of Impounded Wild and Other Animals Sold. The owner of any animal impounded and sold under the provisions of this article may redeem it by paying to the purchaser the amount paid by the purchaser for such animal plus reasonable expenses for keeping it; provided that the owner redeems the animal within thirty (30) days after the date of sale; otherwise, the animal becomes the absolute property of the purchaser. SECTION 3-16. Confinement of Animal by Owner of Private Pre- mises; Notice to Animal Control Officer. If any animal is found upon the premises of any person, the owner or occupant of. the premises shall have the right to confine such animal temporarily pending its release to the Animal Control Officer or to the true owner of such animal. ARTICLE III. DOMESTIC ANIMALS - SECTION 3-1'7. Impounding. The Animal Control Officer is authorized to take up all animals found not to be restrained and impound such animals in the animal shelter. All such animals shall be confined in a humane manner. SECTION 3-1II. Notice of Violation. Where the ownership of an animal, found not to be restrain- . ed, is known, a notice of such violation may be issued by the Animal Control Officer or his designee to such owner. upon issuance of any such notice, the Animal Control. Officer or his designee shall file a complaint with Municipal Court and request that the violator be summoned to appear in Municipal Court and answer such charges. SECTION 3-19. Notice to Owner of Tagged Animals. '� Upon impounding animals found with current vaccination or other identifying tags, the Animal Control Officer shall make a reasonable .effort to notify the owners of such animals so impounded, and of the conditions whereby they may regain posses- sion of such animals. SECTION 3-20. Redemption Requirements. (a) Payment of impounded fees. Any animal impounded under tiie provisions of this article may be reclaimed by the owner. upon the payment of all impoundment fees. b) Unvaccinated Animals. Any animal over the age of four (A) monti�s which does not have a current rabies vaccination may not be redeemedr transferred or adopted until it has been vaccinated as required in this Chapter. SECTION 3-?.1. Disposition of Unclaimed or Unredeemed Animals. (a) After the requirements of notice as set forth in Sections 3-18 and 3-19 and the expiration of three (3) days, any impounded animal that is unclaimed or unredeemed shall become the property of the City of Canyon which shall have the following powers: (1) Authority to ownership. The Animal Control Officer may transfer ownership of any impounded animal that is unclaimed or unredeemed. In the event of such transfer of ownership, the person or agency t-o whom ownership is transferred shall pay for such animal's food and care while in the animal shelter and shall comply with the appli- cable vaccination requirements. (2) R.iyht �o destS rOy• The Animal Control Officer may humanely destroy an impounded animal that is unclaimed or unredeemed. No person may put to death a dog, cat or other small domestic animal in the custody of the Animal Control Officer by shooting, except in emergency field conditions, by clubbing, by a decompression chamber, by carbon monoxide, or poison. All dogs, cats and small domestic animals shall be destroyed by administer- ing of. an approved drug. This Chapter applies to the destruction of domestic animals by the Animal Control Officer, in accordance with House Dill 309 (Art. 4477-6b, Vernon Texas Civil Statutes). (3) Transfer. of ownership to Humane Society. The Animal Control Officer may transfer ownership of any impounded animal that is unclaimed or un- redeemed to the Amarillo Panhandle Humane Society for the purposes of adoption. (b) Donated, sick, weaned or injured animals. (1) Tl�e Animal Control Officer may destroy any animal by a humane method if tl�e animal is unweaned, so sick or injured that its cure is considered by the Animal Control Officer to be impracticable, or, if death is imminent; and in any of such events, such destruction may be done immediately without notice of any waiting period. (2) In the case of donated animals, immediate destruc- tion of the animal is permitted. 7 SECTION 3-22, Report of Bite Cases by Physicians; General Public. (a) It shall be the duty of every physician or other practitioner to report to the local health authority the names and addresses of persons treated for bites inflicted by animals, together with such other informa- tion as will be helpful in rabies control. (b) It shall be the duty of every person owning or having possession of an animal which has bitten a person to report the same to the local health authority and to confine it in an enclosure, or to securely hold the animal in a closed, padlocked cage for observation and examination by the local health authority. No person having the custody or possession of such animal shall fail, refuse or neglect to =allow the local health authority to make an inspection or examination of such animal for the purpose of determining whether such animal has rabies. SECTION 3-23. Quarantine Regulations; Pathological Examination. (a) Animal which bites; observation period. Every animal which bites a person or which is suspected of having bitten a person shall be promptly reported to the local health authority, and shall thereupon be securely quarantined for a period of ten (10) days. (b) Quarantine places. Quarantining shall be at the following: (1) State approved rabies quarantine facility in which case the owner of the animal suspected of having rabies, shall pay the usual impoundment fees. (2) A licensed veterinary hospital, upon the owner's request and at his expense. (3) Home quarantine is subject to the approval of the Chief of Police and the following requirements: (a) The owner of the animal is a resident of Canyon and has proper confinement facilities at his residence in Canyon, and (b) The owner of the suspect animal agrees that he will have the animal inspected by a Licensed veterinarian immediately following the ten (10) day period and agrees to furnish the local health authority with a certificate of health showing the animal to be free of rabies, and (c) The animal was not in violation of any laws or ordinances at the time of the possible exposure, and (d) The animal is currently vaccinated, and (e) The animal can be observed daily by the local health authority. (4) An animal of unknown ownership will be quarantined at a state approved rabies quarantine facility. (c) Surrender by owner; expense. Upon demand made by the local health authority it shall be unlawful for the owner to fail to surrender any animal which has bitten a person or another animal, or which is suspected of 0319 having been exposed to rabies, for quarantine, the expense of which shall be borne by the owner. (d) Release to owner. The quarantined animal may be reclaimed by the owner if adjudged free of rabies, upon payment of impoundment fees and upon compliance with the vaccination requirement of this Chapter. (e) Pathological examination: health officer notified. When an animal under quarantine is diagnosed by a licensed veterinarian as being rabid or suspected of being rabid or dies while under observation, the local healthy authority shall immediately send the head of such animal to the State Health Department for pathological examination. The local health authority shall notify the proper public health official of reports of human contacts and the diagnosis made of the suspected animal from the pathological examination. (f) Animals bitten by rabid animals. Any unvaccinated animal bitten by another animal suspected of being or known to be rabid shall be immediately destroyed, or shall be surrendered to the animal shelter or home quarantine for a period of six (6) months quarantine, and shall be vaccinated immediately, plus re -vaccinated at the end of 5 months. Any vaccinated animal bitten by another animal suspected of being or known to be rabid shall be immediately vaccinated and surrendered to the animal shelter for a period of ninety (90) days quarantine. In the event the biting animal is found not to be rabid, the bitten animal shall be released. Said animal shall be quarantined at the owner's expense and said expense shall be paid at the end of each months quarantine or the animal shall become the property of the City of Canyon and shall be forthwith disposed of; provided, however, that the Chief of Police may permit the quarantine of the bitten animal for the required period in a licensed veterinary facility at the owner's option and expense. SECTION 3-24. City Wide Quarantine. (a) Conditions warranting; period. A city-wide quarantine may be invoked for a period of thirty (30) days by the City Commission upon the recommendation of the Chief of Police after the Commission has been notified by the State Health Department of a positive diagnosis of rabies of an animal or after an investigation it has determined there exists an immediate threat of rabies. (b) Extending time. In the event there are additional positive cases of rabies occurring during the thirty (30) day period of the city-wide quarantine, such period of quarantine may be extended for an additional reasonable period of time. (c) Animals in public. It shall be unlawful for any person to take or permit any animal to be at large or in any other public place during the period of quarantine. SECTION 3-25. Killing, Removing from City and Disposal of Carcass. It shall be unlawful for any person to kill, or cause to be killed, any rabid animal, any animal suspected of having been exposed to rabies or any animal which has bitten a person or is suspected to have bitten a person, except as herein provided, nor to remove same from the city limits without written permission from the Chief of Police. F] (a) Exposed to rabies. The carcass of any dead animal suspected of having been exposed to rabies shall, upon N%M- demand, be surrendered to the local health authority. (b) Determined rabid. The local health authority shall direct the disposition of any animal found to be infected with rabies. (c) Surrender after demand. It shall be unlawful for any person to fail or refuse to surrender any animal for quarantine, destruction or disposal as required herein when demand is made therefor by the local health authority. SECTION 3-26. Any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be punished by a fine of not more than TWO HUNDRED DOLLARS ($200.00). Each such violation shall be considered a separate offense. SECTION 3-27. This ordinance shall become effective and be in full force.and effect from and after the date of its passage and publication as required by law. The proposed revisions to the rule, which would affect pets only in unincorporated Denton County, likely will be presented at a public meeting at some point, commissioners have said. Currently, animals are re- quired only to be restrained by their owners if they stray from the owner 's property. The changes being proposed would require an animal's owner to contain the animal on their property, either with a leash or fenee, and also would require owners to use a leash no more than 6 feet in length to restrain the animal off of the owner's property. Although commissioners ini- tially were considering a leash law only, Commissioner Budd Cole pointed out that commiy s- sinners were adopting rules pursuant to the Rabies Control Act of 1981, Chapter 826, of the Health and Safety Code, which states than animals should be registered. Cole asked for clarification as to whether commissioners could adopt rules based on just some portions of the code, rather than the entire code. Some commissioners say animal registration is poten- tially a much more emotional issue than a leash law alone, costing the county more in staff. Among other items to be considered by commissioners Monday are, ■ A request for four addi- tional probation officers to staff the county pre-trial services department. The positions, each with salary and benefits of $36,015, would cost the county an additional0-9$144,000 for fiscal year 1991. The officers would supervise all adults released on misdemeanor and felony con- onal bonds from date of release through all court ap- pearances. ■ A request to create an assistant civil attorney position for the commissioners court attorney department.
