The jury trial on the zoning case at Animart has been rescheduled for Monday, March 26th, 7 p.m. The business was cited by the police department for bagging sawdust on Tuesday, February 27th. 2). As you recall, $8,000.00 was authorized from U. F. Equipment Replacement for the purchase of a Brush/Dump Truck. The purchase has been completed for a total of $5,600, For this total we secured a truck, air compressor and Jack hammer, and a 48" back -hoe bucket for work in drainage ditches. 3}. Our new health inspector, Joe Tims, has completed his first quarter inspections. A question has arisen as to inspecting Day - Care Centers. They have not been inspected in the past; however, our ordinance does provide for inspections. Does Council have any input on this and if we do inspect, is twice annually sufficient? A copy of Ordinance 06-88 is enclosed for your review. 4). A copy of both City Code Chapter 3, Section 11 and an article concerning unsafe buildings is enclosed far your review. As you know, I received a complaint on the Trail house at 2nd & Church; and if you weren't aware, the fire damaged house on 10th Street from last October's fatal fire, has not been removed. HEALTH AUTHORITY AND SCOPE OF RESPONSIBILITY There is hereby established a City of Sanger Health Authority which shall have the responsibilty to permit and inspect all commercial operations within the corporate limits of the City of Sanger engaged in the business of preparing, manufacturing, storing or dispensing food of all types for human consumption to include but not limited to all restaurants, convenience stores, day care centers, convalescent or rest homes, public and private schools, and individual vendor operations to include mobile and stationary locations. Be EXCEPTIONS The above scope and responsibility is not intended to include nonprofit operations such as church bazaars, community or philanthropic activities, fund raising activities, and other such events not intended for individual gain or profit. C. PERMITS All food operations as defined be required to obtain an annual permit from the City of Sanger a one time application fee per schedule: 1. Application per 100 sq. EXEMPTION All facilities covered under this ordinance at the time of adoption shall be exempt from the application fee and further all facilities covered under this ordinance at time of adoption and having a bona - fide permit issued by the Denton County Health Depart- ment or the State of Texas shall have those permits honored by the Sanger Authority until their respective expiration date. E. RULES ADOPTED The rules and regulations on Food Service Sanitation by the Division of Food and Drugs of the Texas.Depart- ment of Health, as adopted by said Boardoon Novembej.�30, 1977, are hereby adopted as the minimum standards for food service operations within the corporate limits of the City of Sanger, Texas, provided, however, that in said rules the words "municipality of :5/1 M are" shall be understood to refer to the City of Sa Texas, and the words "regulatory authority" shall be understood to refer to the City.of Sanger Health Authority. A copy of the Rules on Food Service Sanitation hereby adopted shall be on file in the office of the city secretary. F. INSPECTIONS Those individuals employed by contract and whom may be employed by contract from time to time by the City of Sanger Health Authority for the purpose of inspecting food service establishments to determine compliance with its rules and regulations regarding food service establishment sanitation are hereby authorized and allowed to conduct inspections of those food service establishments within the City of Sanger, Texas to determine compliance with the rules and regulations of the Texas Department of Health Rules and Food Service Sanitation and are hereby authorized and granted the same powers of enforcement as are stipulated under the rules and regulations of the Texas Department of Health. G. AUTHORITY TO CLOSE FOR INSANITARY CONDITIONS (1) Posting of Notice Whenever the regulatory authority finds any building City of Sanger ordinance If 06-88 Page 3 or place used for the storage, manufacture or sale of food or drink for human consumption, or the methods or practices used therein, to be so filthy or unsanitary as to endanger the public health, it shall be his duty to post a notice of such conditions at the entrance of such buildings or place and to maintain the same until such conditions of practices have been removed or abated. (2) Closing The regulatory authority shall close any building or place described in this section and prevent its use for the storage, manufacture or sale of food or drink for human consumption until such place or building is put in such condition and so used as to eliminate the danger to the public health only after notifying the building official in said city. g. REVIEW OF PLAN5 . The following shall apply when food establishments are remodeled or constructed: (1) Whenever a food establishment is constructed or extensively remodeled and whenever an existing structure is converted to use as a food establish- ment, properly prepared plans and specifications for such construction, remodeling, or conversion shall be submitted to the City of Sanger for review and approval by the regulatory authority before construction, remodeling or conversion is begun. The plans and specifications shall indicate the proposed layout, arrangement, mechnaical plans, and construction materials of work areas, and the type and model of proposed fixed equipment and facilities. The regulatory authority shall approve the plans and specifications if they meet the require- ments of the Rules of Food. Service Sanitation. No food establishment shall be constructed, extensively remodeled, or converted except in accordance with plans and specifications approved by the regulatory authority. (2) Whenever plans and specifications are required to be submitted to the City of Sanger and regulatory authority, the regulatory authority shall inspect the food establishment prior to its beginning operation to determine compliance with the approved plans and specifications and with the requirement of these rules. SECTION III It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses, and phrases of this Ordinance are severable and, if any phrase, clause, sentence, paragraph, or section of this Ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs, and sections of this Ordinance, since the same would have been enacted by the City Council without the incorporation in this Ordinance of any such unconstitutional phrase, clause, sentence, paragraph, or section. SECTION IV Whenever in this Ordinance or the adopted rules and regulations herein, an act is prohibited or is made or declared to be unlawful or an offense or a misdemeanor, or whatever in such Ordinance, the doing of an act is required or the failure to do any act is declared to be unlawful, the violation of any such provision shall be punishable by a fine of not exceeding Two Hundred ($200.00) Dollars; provided, however, that no penalty shall be greater or less than the penalty provided for the same or similar. offense under the laws of the State. Mr. Sweeney, a citizen, spoke informing the City Council as a retailer he was present because of this agenda item. He stated that he had a convenience store and -mentioned/ that whenever the County Health Inspector had inspected"his business previously; they had wrote his business up because of a cracked tile by the front door. Mr. Sweeney stated that he is more concerned for inspections to pertain to anything that could be a health hazard. Some examples that he gave was if the the store is kept clean, the food preparation area is clean or whatever that could be a health hazard. Mayor Armstrong made a suggestion that once they hire the gentleman they have him come in and schedule a meeting with all the local retailers to discuss inspections, etc. Discussion continued regarding fees. UNSAFE BUILDINGS AND PREMISES DEFINED Buildings, structures, or premises as hereinafter described shall be deemed to be dilapidated, hazardous, or unfit for human habitation. The term premises shall include all areas surrounding buildings and structures as well as vacant lots, and the term menace to health and safety shall include weeds, underbrush, trash, debris, and personal property of no reasonable value. (1) All buildings or structures that have become deteriorated through natural causes or by damage through exposure to the elements, especially wind, hail, or rain; or damage through fire to the extent that the roof, windows, and doors, or portions of the house, building, or structure which protect from the weather, will no longer reasonably protect from the weather. (2) All buildings or structures which constitute or in which are maintained as fire hazards, such as by containing accumulations of flammable materials, and represent a fire hazard to surrounding property. (3) All buildings or structures which are so struc- turally deteriorated that they are in danger of collapse, or which cannot be expected to with- stand the reasonably anticipated storms. (4) All buildings, structures, or premises permitted to exist to constitute a menace to health or safety, including all conditions conducive to the harbor- ing of rats or mice or other disease carrying animals or insects reasonably calculated to spread disease. Be ABATEMENT OF BUILDINGS OR PREMISES DEFINED AS UNSAFE Buildings or structures described in subsection A here- inbefore shall constitute dilapidated, hazardous, and unfit for human habitation structures and buildings, and are declared to be a hazard to health, safety, and 03 71 welfare of the citizens and are public nuisances and shall be ordered to be vacated, repaired, demolished, or cleaned up. C. BUILDING STANDARDS COMMISSION There is hereby created a building standards commission to be composed of five (5) members, each of whom shall be a resident of the city. They shall be appointed and hold office at the pleasure of a majority of the city council. As near as practical, they shall be aualified in one (1) or more fields of fire prevention, building construction, sanitation, health, and public safety. Such commission may appoint ex officio, nonvoting members to such commission to advise it as it deems necessary. It shall be the duty of the ex officio members of such commission, if any, to inspect all buildings or structures reported to be or believed to be substandard and to present a report of such inspection to the building standards commission, which commission shall, except in cases of emergency, notify the proper party of the intention of the commission to hold its hearing and follow the procedure provided in this section. D. CONDITIONS FOR VACATING, REPAIRING, OR CLEANING UP UNSAFE BUILDINGS OR PREMISES Unsafe buildings, structures, or premises may be ordered to be, and shall be vacated, repaired, demolished, or cleaned up under the following conditions, regulations, and procedures. (1) When it shall come to the notice of the building standards commission that a building or premise in the city is unsafe under the terms of this section, the commission may cite the owner of such building, structure, or premise,or his authorized agent or representative, to appear and show cause why such building should not be declared to be unsafe and why he should not be ordered to vacate, repair, demolish, or clean up such building, structure, or premise. The date of such hearing shall be not less than ten (10) days after citation shall have been made. 72 (2) Such citation may be served by delivery of a copy thereof to the owner or the person in possession or depositing such citation to the address of the owner as shown on the County Appraisal District tax rolls in the U.S. Mail by certifed or regis- tered letter, or if such premises be unoccupied and the ownership unknown, by attaching a copy of such citation in a place of prominance on such building or structure and advertising same by publication thereof in a newspaper of general circulation in the county. (3) Prior to such hearing, a photograph shall be taken and an inspection and appraisal made of such building, structure, or premise which is to be presented as evidence into the record. (4) On the day set in such citation for hearing, hearing shall be had and on the basis of such hearing, the building standards commission shall determine whether or not such building, structure, or premise is unsafe. Upon making a determination that such building, structure, or premise is unsafe, the building standards commission shall issue a request to the city council who may instruct the city attorney to institute a suit within thirty (30) days after determination and failure by the appellant to comply with such decision, in the appropriate court of the state, to show that such structure is a hazard and thereby enforce the action taken by the building standards commission. Upon final judgment by the court that such structure is a hazard, and on a failure of such owner to take steps to remedy same, within thirty (30) days after rendering such final judgment, then the city is authorized to proceed with the necessary repair, vacating, demolishing, or cleaning up of such building, structure, or premise, and the costs of such repair, vacation, demolition, or clean-up shall be a lien charged against the land on which said structure existed, in favor of the city. (5) The owner of any substandard building, structure, or premise, or his authorized representative, may appeal from the decision of the building standards commission by giving notice thereof within ten (10) days from date of the hearing and file with the city secretary a fee of ten dollars ($10.00). Such appeal shall be to the city council, and upon the perfection of appeal, the city council shall set a date for a hearing before it and such appeal shall be by trial de novo. 73 (6) Pending appeal, such orders of the building standards commission as shall require vacation of the alleged unsafe building, structure, or premise or such emergency measures as may have been ordered shall remain in effect, but all other orders of the commission shall be suspended in their operation. E. STANDARDS WHICH MAY BE FOLLOWED IN REPAIRING, VACATING, OR DEMOLISHING The following standards may be followed in substance by the building standards commission in ordering repair, vacation, or demolition. (1) If the unsafe building or structure can reasonably be repaired so that it will no longer be in a condition which is in violation of the terms of this section, it shall be ordered repaired. (2) If the unsafe building or structure isin such condition as to make it dangerous to the health, morals, safety, or general welfare of its occupants, or of the public it shall be ordered to be vacated. (3) If the unsafe building or structure is in such condition that it cannot be reasonably repaired or conformed to the applicable codes, then it shall be demolished. (4) In any case, where an unsafe building or structure is fifty percent (500) damaged or decayed, it shall be demolished, and in all cases where a building cannot be repaired so that its existence will no longer be in violation of the terms of this section, it shall be demolished. F. OWNER'S VOLUNTARY REQUEST FOR DEMOLITION OR CLEAN UP The owner of an unsafe building, structure, or premise as defined herein, may voluntarily execute an agree- ment requesting the demolition of such building or the clean up of such premises. If the building standards commission authorizes said demolition or clean up, then the procedures set forth herein for notice and hearing shall not be required. The building standards commission may authorize the expenditure of public funds for such G. H. demolition and/or clean up if, in its judgment, the same is justified and necessary. DUTY OF CITY ATTORNEY TO ENFORCE ORDERS It shall be the duty of the city of Sanger to enforce the orders commission or the city council, appropriate court of this state, city council. SECTION 12: CURB, GUTTER, DRIVEWAY, AND CULVERT INSTALLATIONS under any in It shall be unlawful for any person to construct, re- construct, or repair any driveway, curb, gutter, or drainage facility in the streets and alleys of the city without first obtaining a permit. To obtain such permit an application must be filed with the city describing the abutting property to which the proposed work on the public property is to be done either by lot, block, or tract and house number, location on the street or similar description which will readily identify and definitely locate the site of proposed work; a description of the proposed work to be performed; and any other pertinent information as shall be required by the city. The fee for such permit shall be two dollars ($2.00) and shall expire if the work authorized therein is not commenced within three (3) .months of the date of the permit. Plans for such work shall be approved by the director of public works prior to issuance of any permit. (Provision for inclusion of section 11 and 12 provided for in ordinance adopting Code) d� Supp. No. 4 Animal Shelters House Bill 2379 passed during the 71st Legislative Session amending article 4477-6b eliminated the exemption of cities with populations of 7$,000 from the requirements of the Animal Shelter Act. The Animal Shelter Act among other things requires cities to: (1) employ a veterinarian at least once a year to inspect the shelter to determine whether it complies with the Act; (2) folio«� specific methods of euthanasia; (3) establish an advisory committee to be established to ensure compliance with the Act. Substandard Buildings House Bill 126$ passed during the 71 st Legislative Session which amended Chapter 214 of the Local Government Code specifically removed the distinction between Type A general law and home rule cities regarding authority to regulate substandard buildings where ordinances setting out minimum standards for buildings have been adopted. Type A cities now have been granted the authority to demolish dangerous buildings in addition to their previous authority to remove those buildings. Cities also now have the authority to require by ordinance the vacation, relocation of occupants, and the securing of substandard buildings in addition to their previous authority to require repair and demolition of substandard buildings. Cities can now authorize the repair of substandard buildings and assess the costs against the property or to assess a civil penalty against the owner for failure to repair, remove, or to demolish the structure. Cities now have to notify any mortgagee and lienholder of record on any property of any actions ordered by a city if the property owner does not comply. Senate Bill 621 also passed during the 71st Legislative Session adding a new section 214.003 to the Local Government Code allows home -rule cities to bring an action in district court against an owner of residential property that is not in compliance with ordinances governing fire protection, structural integrity, zoning, or disposal of refuse (unless the property is a homestead). Senate Bill 498 amending Article 18.0$ of the Code of Criminal Procedure added code enforcement officers as persons to wham search warrants can be issued to for the purpose of allowing the inspection of unsafe building conditions. 1\Tew Municipal Incinerator Rules New federal rules which have been proposed for municipal incinerators could further strain the nation's glutted recycling markets. In December 1989, the Environmental Protection Agency (EPA) issued regulations that would require that 2$% of all municipal waste scheduled for burning be separated and disposed of in an alternative way. But experience at the local and state levels have shown that the growing supply of materials cannot be absorbed by recycling markets without a corresponding increase in demand. The EPA regulations seem to address only half of the two part issue of supply and demand. The federal government alone consumes 2% of all the paper used in the U.S. If the federal government would seriously commit itself to buying a significant amount of recycled paper, it would have a very positive impact on the market. This impact could be more if both local and state governments did the same. Despite growing environmental awareness, recycling has increased only 4% in the last 30 years. City crews will tear off four layers of shingles and replace the old roof on the building at an estimated cost of $1,300. About $600 will be paid to scrape the old paint off the building to ready it for repainting. Also, an old conference table will be replaced with fuur new chairs, addi- tional landscaping will be done and another window air conditioning unit will be added. Insulation already has been added to the library and tht; building's lighting has been upgraded, officials said. The money for the improvements will be taken from a $5,000 reserve fund that has IxZen set aside fur the library, said City Administrator John Hamilton. The city is seeking a grant for the possible construction of a new library, but that may be at least several years away, so the repairs are being; com- pleted to keep the present library functional and to prevent deterioration, Hamilton said.
