All members present. to order by the The oath of office was administered to Mike Vinson by Herb Arledge. Stanley Day presented a report on the cost of repairing equipment now owned by the city and the cost of purchasing new equipment. Also discussed contracting with Denton to use their trucks. Nel Armstrong and Carroll McNeil gave input to the discussion. The motion was made by Jack Burkholder to recommend that the Council investigate the interest rate of $11,700 which is the cost of remodeling the digger, derrick and. truck now owned by the city. If the interest accrued on this amount over the next two years would pay the interest on a. new truck then the purchase of a new truck would be more feasible. The board will support the council's decision. The motion was seconded by Chuck Trice and the motion carried unanimously. The motion was made by Jack Burkholder that the city council will meet with the Denton County Co-op and. try to work out a compromise. on street lights in the Bourland addition, and that an ordinance be adopted to protect Sanger in future developments. The ordinance should state that if Sanger does not provide the electricity for an addition the city will not provide free electricity for the street lights. Any sub -division that comes in under Denton County Co-op will have to form a home owners association to pay for street lights. The motion was seconded by Herb Arledge and passed unanimously by the board. Herb Arledge made the motion that the city proceed in making an agreement with the State Highway Department regarding lights on Interstate Highway 35. CITY OF SANGER, TEXAS ORDINANCE NO. #019-87 AN ORDINANCE AMENDING CHAPTER 10, SECTION 14 OF THE CITY OF SANGER CODE OF ORDINANCES ENTITLED UTILITY BILLING PROCEDURES; MORE SPECIFICALLY SUBSECTION C, ENTITLED SERVICE TO BE DISCONTINUED WHEN DELINQUENT; ESTABLISHING A NEW FEE; PROVIDING FOR A REPEAL OF ORDINANCES I CONFLICT; PROVIDING FOR A SEVERABILITY CLAUSE; PROVIDING FOR AN EFFECTIVE DATE AND PROVIDING A PENALTY CLAUSE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SANGER, TEXAS THAT: Subsection C of Section 61 Chapter 10 is hereby amended to read as follows: SECTION I C. SERVICE TO BE DISCONTINUED WHEN DELINQUENT Service may be discontinued, upon due written notice, to customers having past due bills on the twenty-seventh day of the month. In addition, a twenty ($20.00) reconnect fee will be assessed to all customers whose service has been discontinued. SECTION II All Ordinances or parts of Ordinances in conflict herewith are, to the extent of such conflict, hereby repealed. SECTION III It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses, and phrases of this Ordinance are severable and, if any phrase, clause, sentence, paragraph, or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competnent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs, and sections of this Ordinance, since the same would have been enacted by the City Council without the incorporation in this Ordinance of any such unconstitutional phrase, clause, sentence, paragraph, or section. SECTION IV Whenever in this Ordinance an act is prohibited or is made or declared to be unlawful or an offense or a misdemeanor, or wherever in such Ordinance, the doing of an act is required or the failure to do any act is declared to be unlawful, the violation of any such provision shall be punished by a fine of not exceeding One Thousand Dollars ($1,000.00); provided, however, that.no penalty shall be greater or less than the penalty provided for the same or vl�l - o ' I similar offense under the laws of the State. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SANGER, TEXAS THAT: Section 61 of Chapter 10, is h ere by amended to read as follows: SECTION I SECTION 6: ELECTRIC SERVICE CONNECTIONS Electrical service connection fees shall be as follows: CONNECT FEE ---------------------------------------- $30.00 For all new customers and any customer moving within the system. WATER SERVICE CONNECTIONS (1) The City of Sanger shall install, or cause to be installed, and maintain all water service connections in the street, alleys, and easements. All interruptions of water service to any and all customers shall be made under the direct supervision of the city water department before such interruption is made. Any person, firm, or corporation found interrupting water service without city supervision shall be in violation of this section and shall be subject to fines and penalties as prescribed in Chapter 1, Section 5 of the Sanger City Code. The city shall charge for the installation and maintenance of all such connections a sum sufficient to cover the average cost thereof. Such sum is to be determined and collected by the utility department and shall be at the following rates: Tap charge for all sizes up to 2" in approved subdivisions where the infrastructure for connection has been provided by the developer......................................$300.00 Tap charges for all other up to 2" ................. 500.00 Tap charges for each additional inch over 2" ....... 100.00 Charge for meter, box, and connections ............. SANITARY SEWER SERVICE CONNECTIONS (1j The City of Sanger shall install all sanitary sewer service connections in the streets, alleys, and easements both inside and outside the city limits. Said service connections shall be installed from the main to the property line when the sewer main 4.1• wi iLW . is located in an alley or a street right-of-way; if the sewer main is in an easement, the service connection shall be installed from the sewer main to the easement boundary line. The City of Sanger shall charge three hundred fifty dollars ($350.00) for each sewer lateral connect. SECTION II All Ordinances or parts of Ordinances in conflict herewith are, to the extent of such conflict, hereby repealed. APPROVED: .ATTEST: City Secretary SECTION 5: WATER AND SEWER DEPOSIT Each person, firm or corporation making application for a connection with the waterworks and sanitary sewer system shall make a deposit in the amount as follows: Renter's deposit ------------------------ $ 40.00 Homeowner's deposit ---------------------- 25.00 Commercial deposit (except restaurants) -- 25.00 Restaurant deposit ----------------------- 50.00 EDITOR'S NOTE: The water and sewer deposits, as set forth above, were approved by the City Council on December 16, 1968 (restaurant deposits), May 3, 1971 (commercial depo- sits), and April 7, 1980 (renter's and homeowner's deposits) 175.1 Supp. No. 8 Where PPD = Estimated demand costs included in whole-& sale power supplier's base rates for the current month. D = Estimated total metered demand for the current month. CF = Correction factor adjustment to be applied in the current billing month to account for the difference between PCAD revenue received and actual cost incurred in preceding periods. (3) Applicable to Wholesale Power Adjustment Granted by Public Utilities Commission The clause above covers only the wholesale power adjustment granted by the public utilities commission prior to January 1, 1982, and shall remain in effect only until the wholesale power cost is again adjusted by the public utilities commission. Should an adjustment produce more revenue than the actual whole- sale power increase in any month, the overcharge will be credited to the customer's next month billing. EDITOR'S NOTE: Approved by city council on January 22, 1982. SECTION 8: ELECTRIC DEPOSITS Electric deposits shall be as follows: A. RESIDENTIAL DEPOSIT (1) Homeowner - all electric - $75.00 (2) Homeowner - conventional - $50.00 (3) Renter - all electric house - $125.00 (4) Renter - conventional house - $75.00 (5) Renter - all electric apartment - $125.00 (6) Renter - conventional apartment - $110.00 (7) Renter - mobile house' or trailer - $110.00 180 B. COMMERCIAL DEPOSITS (1) Small business (100 amp or less) - $100.00 EDITOR'S NOTE Approved by'city.council on November 2, 1981. (2) Large Business and industrial (100 amp or more) charge per connected amp - $0.50 EDITOR'S NOTE: Approved by city council on January 4, 1982. C. ELECTRIC DEPOSIT REFUNDS When homeowner or commercial customer have paid bills for service for twelve (12) consecutive billings without having service disconnected for nonpayment of bill and without having more than two (2) occasions in4which a bill was delinquent, and.when customer is not delinquent in payment of current bill, Sanger Electric System will refund the deposit. EDITOR'S NOTE: Approved by city counoil on November 2, 1981 and January 4, 1982: SECTION 9: ELECTRIC LINE EXTENSIONS When a new extension is required to serve one (1), customer the customer will be expected to sign a service agreement which will insure revenue equal to expenditures over a thirty-six (36) month period. The way the minimum bill will be figured is as follows: Figure the cost of the entire extension; reduce the total by the amount of a normal drop service; divide the remainder by thirty-six (36); and the resulting figure will be the amount of the minimum bill to be paid by the customer. This minimum bill will relate to only the base charge for electricity and the fuel adjustment charge will be added for only kwh used. EDITOR'S NOTE: Approved by city council on February '19, 1979.
