06-17-02-Ordinance-Regulating Portable Office Buildings-06/17/2002ORDINANCE # 06-17-02 AN ORDINANCE OF THE CITY OF SANGER AMENDING CHAPTER 3, BY ADDING AN ARTICLE TO BE NUMBERED AND TITLED ARTICLE 3.19 PORTABLE OFFICE BUILDINGS, TO THE CODE OF ORDINANCES OF THE CITY OF SANGER, TEXAS, AND PROVIDING FOR THE REPEAL OF ORDINANCES IN CONFLICT; PROVIDING A SEVERABIL,ITY CLAUSE; AND, PROVIDING FOR AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SANGER, TEXAS: SECTION I THAT CHAPTER 3, ARTICLE 3.1900 OF THE CITY OF SANGER CODE OF ORDINANCES IS HEREBY ADDED AND TO READ AS FOLLOWS: ARTICLE 3.19 PORTABLE OFFICE BUILDINGS Sec. 3.1901 Use of Portable Office Buildings Restricted This article establishes the use of portable office buildings in all zoning districts Definition: Portable Office Building shall mean a portable building either transported by skids on a flatbed trailer or equipped with axles and wheels. The building may have multiple rooms and a restroom but may not have a kitchen area. No Portable office building shall be used in any "SF", 'IMF", or IIMH" zones. Only under extreme circumstances may a portable office building be used in any `B" zone. Extreme circumstances shall include the following: (a) Disaster - Fire, tornado, flood, etc. — A portable office building may be utilized as temporary space until repairs and/or reconstruction is completed. Once repairs and/or reconstruction is completed, the owner has 30 calendar days to remove the building from the premises. (b) Major Remodeling of Permanent Structure - When a business located in the "B" zones can continue business, while remodeling, by using a portable office building, a temporary "Certificate of Occupancy" may be issued for a period of time not to exceed 6 months. If a six month time limit is not long enough to complete the project, additional time may be requested and granted if, to the satisfaction of the Code Enforcement Officer, additional time is needed. Appearance - The outside of the building shall have a pleasant appearance. The paint shall be complete, trim and moldings shall be finished and in good repair and the roof shall have an attractive appearance. If the design of the building requires that blocks are used for a foundation, skirting shall completely enclose the underneath of the building and shall extend to the ground. Sec. 3.1902 Penalty for Violations Any person, firm or corporation who shall violate any of the provisions of this article shall be guilty of a misdemeanor and upon conviction shall be fined in accordance with the general penalty provision found in Section 1.109 of this code. SECTION II All Ordinances or parts of Ordinances in conflict herewith are, to the extent of such conflict, hereby repealed. SECTION III It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses, and phrases of this Ordinance are severable and, if any phrase, clause, sentence, paragraph, or section of this Ordinance shall be declared unconstitutional by the valid judgement or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs, and sections of this Ordinance, since the same would have been enacted by the City Council without the incorporation in this Ordinance of any such unconstitutional phrase, clause, sentence, paragraph, or section. SECTION IV This Ordinance will take effect immediately after it's passage and publication.
