05-14-03-Ordinance-Correcting the Legal Description of Annexed Property in teh H Tierwester survey-05/05/2003CITY OF SANGER, TEXAS ORDINANCE NO. 05-14-03 AN ORDINANCE OF THE CITY OF SANGER, TEXAS, CORRECTING THE LEGAL DESCRIPTION OF TERRITORY HERETOFORE ANNEXED INTO THE CITY BY ORDINANCE NO. 05-06-02; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Ordinance No. 05-06-02 annexed several tracts of land into the city limits of the City of Sanger; and WHEREAS, one of the legal descriptions contained in such ordinance was for a tract referred to as "A1241 TR 305(City)"; and WHEREAS, through inadvertent clerical error, the legal description contained for such tract in Ordinance No. 05-06-02 was incorrect and should be replaced; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SANGER, TEXAS: SECTION 1. That the metes and bounds description attached hereto as Exhibit "A" and made part hereof for all purposes, be, and the same is hereby, substituted for the legal description styled "A1241TR305(City)" as contained in Ordinance No. 05-06-02. SECTION 2. That the premises hereof are found to be true and correct. SECTION 3. That this ordinance shall take effect immediately from and after its passage, as the law in such cases provides. SECTION 4. That except for the correction of the legal description referred to herein, no amendments are made to Ordinance No. 05-06-02 and it shall continue in full force and effect as written, with the substitution of the correct legal description contained herein. Tierwester survey, being part of the 2 acre "butcher pen" lot out of a 570 acre tract out of said Tierwester survey, and also being part of a certain deed from E. Horst and wife, Verdie Lee Horst, to E. E. Horst and J. L. Horst, dated January 15, 1945, recorded in Volume 312, page 362, of the Deed Records of Denton County, Texas; BEGINNING at the Northwest corner of said Horst lot, in the East boundary line of a 40 foot street, said begimning point also being the Southwest corner of a 1 acre tact of land sold by Mary H. Shirley to Louis Galloway; THENCE East with the North boundary line of said Horst tract, and Galloway's South boundary line, 187 feet, more or less, to the POB TRACT 1; THENCE South, 36 feet to the southwest corner thereof; THENCE South 63 degrees 45 minutes 31 seconds East, 70.24 feet, to the southeast corner thereof; THENCE North, 67.06 feet, to the northeast corner thereof, THENCE West, 63 feet, to the POB TRACT 1; for total of 0.075 acres. Tract 2 Referencing a lot lying and being situated in Denton County, Texas out of the H. Tierwester survey, being part of the 2 acre "butcher pen" lot out of a 570 acre tract out of said Tierwester survey, and also being part of a certain deed from E. Horst and wife, Verdie Lee Horst, to E. E. Horst and J. L. Shirley to Louis Galloway; THENCE East with the North boundary line of said Horst tract, 400 feet, more or less, to a stake for corner; THENCE South, 75 feet, to the POB TRACT 2; THENCE South, 66 feet, to the southeast corner thereof, THENCE North 63 degrees 45 minutes 31 seconds West, 149.27 feet, to the northwest corner thereof; THENCE East, 133.89 feet, to the POB TRACT 2; for a total of 0.0101 acres.
