Development Services Director Ramie Hammonds gives and overview and goes over the staff
report. She also states that this is an approved plat that they are wanting to divide so they can start
construction on 6A. She also explains this item goes with #8 so we can do these together if the
board would like. She states they are not changing anything except dividing the property.
Sally Amendola asked what is going on with the amenity center that was supposed to be going in for
the homeowners.
John said the planning is already completed and they are working on the financing.
Phillip Surles made a motion to approve. Motion was seconded by Jason Miller. Motion passes
unanimously with a 60 vote.

1st REVIEW COMMENTS – Replat (Bolivar Heights Addition)
Request is for a Replat of Bolivar Heights Addition creating 2 lots, being approximately 5.718
acres, prepared by Cox Land Surveying, submitted on 05/19/2021. Below are the comments that
should be addressed prior to recommendation to City Council for approval. Resubmit the revised
plat along with a response letter addressing all comments.
Planning
1. Provide site plan with location of existing buildings to show all buildings are within lot
lines.
2. Provide information showing that Roger Hebard is authorized to sign for Bontera Inc.
3. Show centerline of existing streets. Dimensions from centerline to edges of existing and
proposed right-of-way on both sides of centerline.
4. Provide a signed and notarized copy of private restrictions (if any), that are filed for record
in the office of the County Clerk.
5. In title box add total number of lots, gross acreage, right-of-way acreage, if dedicated.
6. Add all City of Sanger standard notes (see checklist)
7. Provide name, address, and phone number of all utilities providing service to the
development and signature of each provider or a will serve letter signifying their ability to
provide service to the subdivision.
8. Add all Denton County Standard Plat Notes.
9. In signature block add space for City Secretary.
10. Lot 1-R1 and 1-R2 do not appear meet the lot shape requirement (2 ½ :1). A variance will
need to be requested.

Final Plat – 1st Sub -Engineering Review
The 1st submittal of Final Plat for Bolivar Heights Addition Lot 1, submitted 09/16/2021 has been reviewed by
the Engineering Department. The following are comments that need to be addressed prior to
recommendation to City Council for approval of the plat.
Staff may support a recommendation to City Council of approval of plat with the conditional that all City and
Staff comments have been addressed prior to construction or filing of plat.
This plat is in the City of Sanger ETJ. The City of Sanger has an interlocal agreement with Denton County
regarding platting, review of construction plans and construction inspection. All City of Sanger as well as
Denton County standards, codes, and requirements shall apply with the more restrictive standard governing.
See City Code and DCSRR Sect. IV 11.
The Final Plat and civil construction plans shall be reviewed under separate tracks. Following civil
construction plan review and approval by the City of Sanger, the civil plans will also need to be reviewed and
approved by Denton County prior to release for construction. Associated development agreements and
bonding may be required.
The Final Plat will need to be approved by City Council. If during civil plan review by both City of Sanger and
subsequently Denton County, any changes that will need to be reflected on the final plat may require final
plat to go back to Planning and Zoning and City Council for review.
Public improvements associated with this development will be required to be constructed prior to the plat

The applicant is proposing a temporary concrete batch plant use starting July 7, 2021 and ending January 7, 2022. The
batch plant will be operational 7AM to 7PM from Monday through Saturday. Temporary Concrete Batching Plant use
is only permitted through SUP in SF10 (Single Family Residential 10) zoning district, that is the zoning for Sanger
Circle Phase 6. The batch plant will have to meet all of TCEQ requirements. A TCEQ permit application has been
submitted by the applicant. The temporary concrete batching plant will be located at a distance of approximately 450
feet from the nearest residential dwelling unit.

Issues for Consideration
In recommending that a specific use permit for the premises under consideration be granted, the
City Council shall determine that such uses are harmonious and adaptable to building structures
and uses of adjacent property and other property in the vicinity of the premises under consideration,
and shall make recommendations as to requirements for the paving of streets, alleys and sidewalks,
means of access to public streets, provisions for drainage, adequate off-street parking, protective
screening and open space, heights of structures and compatibility of buildings.
Staff Recommendation
Staff recommends APPROVAL of the proposed SUP for Temporary Concrete Batching Plant use
with the following condition:
1. Temporary Batch Plant will only be used for the Sable Creek Phase 4 and 5
subdivision
Actions for Planning & Zoning Commission
The Planning & Zoning Commission shall make a recommendation on this proposed SUP to the
City Council.
Notification Response Form
Staff mailed nineteen (19) public hearing notices to the owners of properties within 200 feet of the
subject property. At the time of this report one response has been received in opposition.
Future Actions
The City Council will conduct a public hearing and act on this request on July 6, 2021.

DEVELOPMNET ON A TRACT OF LAND GENERALLY DESCRIBED AS A0029A R.
BEEBE, TR 149, 153, 17.5 ACRES; PROVIDING FOR THE REPEAL OF ALL
ORDINANCES IN CONFLICT; PROVIDING FOR A SEVERABILITY CLAUSE;
PROVIDING FOR A PENALTY OF FINE IN ACCORDANCE WITH SECTION 1.109 OF
THE CODE OF ORDINANCE FOR VIOLATIONS; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, all Requests for A Specific Use Permit (SUP) were duly filed with the City
of Sanger, Texas, concerning the hereinafter described properties;
WHEREAS, due notice of hearings were made in the time and manner prescribed by law
and the Planning and Zoning Commission of the City of Sanger, Texas, duly covered and
conducted public hearing for the purpose of assessing a request for a Specific Use Permit (SUP)
on the hereinafter described properties located in the City of Sanger, Texas;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
SANGER, TEXAS:
SECTION 1. That a Specific Use Permit (SUP) to allow a Temporary Concrete Batching
Plant use is hereby granted for a period of 180 days from July 7, 2021 to January 7, 2022 and may
only serve the Sable Creek Phase 4 & 5 subdivision. This is an approximately 1.4 -acre site, on
property described as A0029A R. Beebe, Tr 149, 153, 17.5 acres, and shown in Exhibit A,
generally located west of Creekside Dr.
SECTION 2. All ordinances or parts of ordinances in conflict herewith are, to the extent
of such conflict, hereby repealed.
SECTION 3. It is hereby declared to be the intention of the City Council that the sections,
paragraphs, sentences, clauses, phrases and words of this Ordinance are severable and, if any
word, phrase, clause, sentence, paragraph, or section of this Ordinance shall be declared
unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such
unconstitutionality shall not affect any of the remaining portions of this Ordinance, since the same
would have been enacted by the City Council without the incorporation in this Ordinance of any
such unconstitutional word, phrase, clause, sentence, paragraph, or section.
SECTION 4. Any person, firm or corporation who shall violate any of the provisions of
this article shall be guilty of a misdemeanor and upon conviction shall be fined in accordance
with the general penalty provision found in The Code of Ordinances, Section 1.109 General
Penalty for Violations of Code.

the publication of the caption, as the law and Charter in such cases provide.
